The study outlines comprehensive policy changes that include a broad and competitive pay structure, increased support to mental health workers, better community outreaches, and product modernization in recruitment and retention.

Immunity For Imaginary Policy In Tort Claims Against The Federal Government, Gregory C. Sisk Feb 2025

Immunity For Imaginary Policy In Tort Claims Against The Federal Government, Gregory C. Sisk

Notre Dame Law Review

Fictional policy justifications for official negligence are regularly accepted by the federal courts to shield the federal government from liability for ordinary tortious wrongdoing. The lower federal courts have adopted an extravagant interpretation of the discretionary function exception to the Federal Tort Claims Act that applies whenever a policy implication can be theorized. Under this “susceptible to policy analysis” approach, the United States government escapes accountability through after-the-fact speculation regarding policy factors that could have played a role (but actually did not) in the harmful government conduct.

By textual command, the exception shields only government decisions “based on,” that is, …

Trends In Terrorism Recruitment: Examining Recruitment Patterns Among 250 Armed Groups Using Terrorism, Evan Perkoski, Meredith Maloof Loken, Alec Worsnop

Reports, Projects, and Research

Violent non-state actors (VNSAs) that use terrorism recruit a wide range of people and draw upon distinct features to entice them. They recruit men and women, the highly educated and undereducated, military veterans, and police officers. They sometimes reach these people with religious, racial, or ideological rhetoric. What do we know about VNSA’s global recruitment patterns? How widespread are different recruitment choices (e.g. military veterans), and which recruitment characteristics are likely to co-occur? Based on the 2019 National Strategy for Counterterrorism priorities 1.1, 3.2, and 3.3 to understand and establish prevention architecture to thwart terrorist radicalization and recruitment, this report …

Constitutional Freedoms In The United States, Tom Rozinski

Open Touro Created

2025

Constitutional Freedoms is an undergraduate text for courses in civil rights and liberties. It covers most of the subject areas of other undergraduate texts, although it rearranges some in ways that are more conducive to student learning. The major difference is that freedoms of speech and press are treated together as aspects of communication, rather than separately because so distinguished in the US Constitution. The book includes sections on Supreme Court procedure, methods of interpretation, and tests for unconstitutionality, as well as information about experiential learning opportunities for students.

California’S Bug Problem: The Backup Generation Information Gap And Its Impact On Vulnerable Communities, Andrew H. Jacobs Feb 2025

California’S Bug Problem: The Backup Generation Information Gap And Its Impact On Vulnerable Communities, Andrew H. Jacobs

UC Law Journal

California’s electricity system has faced unprecedented challenges in recent years. Extreme heat, wildfires, and additional severe weather events stressed the system to a breaking point. The state’s electric grid operator repeatedly called for rolling blackouts on hot summer days to preserve the integrity of the electric grid. Electric utilities proactively shut off power during dry and windy conditions to prevent their equipment from sparking wildfires. Strings of powerful winter storms left hundreds of thousands across the state without power for multiple days.

In response to the poor reliability of the electrical grid, demand for backup generation has skyrocketed. Both residents …

Proving The Future In Criminal Cases, Christopher Slobogin Feb 2025

Proving The Future In Criminal Cases, Christopher Slobogin

Vanderbilt Law School Faculty Publications

Expert opinion about dangerousness—the risk of reoffending—is commonly introduced at sentencing, criminal commitment proceedings, and some types of pretrial detention hearings. This Essay argues that the rules governing the admissibility of scientific evidence should apply to this testimony and that, on that assumption, such evidence must be (1) “material” (logically relevant, empirically generalizable, and epistemologically germane), (2) “probative” (a measure of accuracy, which is more stringent when the evidence is from an expert), (3) helpful to the factfinder (through promoting “incremental validity”), and (4) presented in a non-prejudicial manner (i.e., in a way that minimizes the possibility it will be …

In 2018, after law enforcement announced it had used a technique called forensic investigative genetic genealogy (FIGG) to identify the Golden State Killer, we conducted a U.S. general population survey and found most respondents supported using FIGG to solve violent crimes. Since then, FIGG has helped close hundreds of criminal cases, but it also has weathered controversies. On FIGG's fifth anniversary, we conducted an expanded, follow-up survey with U.S.-based participants to determine if public opinion had changed and found continued support for FIGG across most applications. The same proportion (91 %) of respondents in the 2018 and 2023 surveys endorsed …

The Conceptual Limits Of Risk Governance In Terrorism Prevention: Towards A Theory Of Threat Thinking, Anya Degenshein Feb 2025

The Conceptual Limits Of Risk Governance In Terrorism Prevention: Towards A Theory Of Threat Thinking, Anya Degenshein

Social and Cultural Sciences Faculty Research and Publications

Risk theories have dominated research on policing and punishment for the past 30 years, including a growing interest in crime prevention. Drawing on excerpts from court documents of 351 counterterrorism stings, an empirical exemplar in contemporary crime prevention, I demonstrate that these cases both defy the logics of actuarial risk governance and exceed the logics of precautionary risk governance in three ways: (1) who they target; (2) how they assess these targets; and (3) what they target as a sign of dangerousness. Engaging core biopolitical ideas, including the notion of the criminal “other”, I build a theory of threat thinking, …

The Potential For Fuel Reduction To Reduce Wildfire Intensity In A Warming California, Patrick T. Brown, Scott J. Strenfel, Richard B. Bagley, Craig B. Clements

Faculty Research, Scholarly, and Creative Activity

Increasing fuel aridity due to climate warming has and will continue to increase wildfire danger in California. In addition to reducing global greenhouse gas emissions, one of the primary proposals for counteracting this increase in wildfire danger is a widespread expansion of hazardous fuel reductions. Here, we quantify the potential for fuel reduction to reduce wildfire intensity using empirical relationships derived from historical observations with a novel combination of spatiotemporal resolution (0.375 km, instantaneous) and extent (48 million acres, 9 years). We use machine learning to quantify relationships between sixteen environmental conditions (including ten fuel characteristics and four temperature-affected aridity …

Natural hazards pose significant challenges to affected communities worldwide, yet there remains a lack of comprehensive studies comparing recovery efforts across different countries and cultures. This study addresses the gap by investigating the impact of three devastating tsunami events on four distinct locations: Banda Aceh (Sumatra, Indonesia) and Southern Thailand, both affected by the 2004 Indian Ocean Tsunami, the 20th anniversary of which provided the initial motivation for the study; the Tohoku region of Japan, affected by the 2011 Great East Japan Earthquake and Tsunami; and Palu Bay (Sulawesi, Indonesia) affected by the Palu-Central Sulawesi Earthquake and consequent triple disaster. …

Peacebuilding At The San Diego-Tijuana Border: A Ground Level View, Rebeca Cazares-Adame Md, Mph, Andrew Blum Phd

Kroc IPJ Research and Resources

This brief complements the work of researchers like Kleinfeld and Blattman by seeking to understand in a more inductive way the work of peacebuilders on the ground in Tijuana, a city experiencing systemic, chronic violence. Based on survey research and interviews conducted with those peacebuilders, the brief identifies insights that can help inform a peacebuilding field that includes and integrates work in conflict zones and non-conflict zones experiencing widespread violence. Developing this more integrated approach is particularly important at the moment as we move into President Trump’s second term and begin to see the impacts of his administration in the …

My Wings Are Not Broken: Black Males, Carcerality, And Education, Crystal M. Welch-Scott Feb 2025

My Wings Are Not Broken: Black Males, Carcerality, And Education, Crystal M. Welch-Scott

Dissertations, Theses, and Capstone Projects

Historically, educational spaces have been sites of racialized inequality for Black youth, creating disparate educational outcomes. The disproportionate divide between young Black and White men continues throughout the life of their academic journey, and this research seeks to examine its impact on dropping out of school. The experience of Black young men being “othered” – compared to their White counterparts – coupled with the myriad ways Black youth must navigate normalcy creates additional challenges they must carry. This dissertation employs critical race theory and ecological systems theory as theoretical frameworks. It utilizes hierarchical regression modeling of the High School Longitudinal …

Does Treatment Setting In Ati Matter? An Examination Of Completion Rates And The Role Of Violent Charges Among Individuals With Co-Occurring Disorders, George J. Anderson Feb 2025

Does Treatment Setting In Ati Matter? An Examination Of Completion Rates And The Role Of Violent Charges Among Individuals With Co-Occurring Disorders, George J. Anderson

Dissertations, Theses, and Capstone Projects

Despite the proliferation of alternatives to incarceration (ATI) for individuals with co-occurring disorders in recent decades, little is known about comparative styles of treatment used in this context. The following study uses data from a case management service in a large urban city (n=273) where several types of treatment are utilized in the ATI landscape. Specifically, this study compares ATI completion rates and time to completion or failure for several styles of treatment: clinic-based outpatient, residential, assertive community treatment (ACT) and personalized recovery-oriented services (PROS) programs. Results of a logistic regression indicate that individuals initially referred to residential treatment had …

University Student Organizations: Influence On Leadership Skills In The Workforce, James W. Ebert, Tomicka N. Williams, Aline K. Major, Kristi Pitts, Donna Yohman, Jodi Levit, Thomas Anderson

The Guardianship Journal

The modern-day workforce is ever-changing, and so are the required leadership skill sets for employees to be successful in the workplace. University student organizations (USOs) offer students opportunities to develop their leadership skills in preparation for the workforce. The purpose of this research is to conduct an empirical study that uses distributed leadership theory (DLT) as a lens to explore how USOs influence a student's leadership capacity in the workforce. Exploring the various components of DLT (autonomy, accountability, and leadership capacity) using an empirical research method approach is plausible in understanding the unique approach USOs offer students while simultaneously preparing …
