Of Labor, Antitrust, And Why The Proposed House Settlement Will Not Solve The Ncaa’S Problem, Marc Edelman, Michael A. Carrier Jan 2025

Of Labor, Antitrust, And Why The Proposed House Settlement Will Not Solve The Ncaa’S Problem, Marc Edelman, Michael A. Carrier

Fordham Law Review

The National Collegiate Athletic Association (NCAA) recently settled three antitrust lawsuits. With a significant payout, it hopes to put its antitrust worries behind it. In doing so, the NCAA seeks to follow in the footsteps of the National Football League (NFL), which has enjoyed thirty years of labor peace. But there is a big difference between these two situations. The NFL’s 1993 settlement in White v. National Football League was shielded from antitrust scrutiny by the nonstatutory labor exemption, which encourages collective bargaining activity. No such exemption protects the NCAA’s settlement. This Essay explains why the NCAA cannot establish a …

Re-Recording The Record: The Case For A Stronger Moral Right Of Integrity In The United States, Alexandria Touron Jan 2025

Re-Recording The Record: The Case For A Stronger Moral Right Of Integrity In The United States, Alexandria Touron

Fordham Law Review

In the United States, musical artists have limited legal recourse over transferring ownership of their music to third parties, even when such transfers may harm the artist’s reputation or the integrity of the work. Even the most prominent musicians, like Taylor Swift, must operate within an industry structure that normalizes the transfer of rights and, thus, control of their creative works. This occurs because U.S. law ties artists’ rights almost exclusively to economic ownership of their work unless they specifically bargain to keep their moral rights. However, most other countries have comprehensive moral rights frameworks where all artists can protect …

Law-Following Ai: Designing Ai Agents To Obey Human Laws, Cullen O'Keefe, Ketan Ramakrishnan, Janna Tay, Christoph Winter

Fordham Law Review

Artificial intelligence (AI) companies are working to develop a new type of actor: “AI agents,” which we define as AI systems that can perform computer-based tasks as competently as human experts. Expert-level AI agents will likely create enormous economic value but also pose significant risks. Humans use computers to commit crimes, torts, and other violations of the law. As AI agents progress, therefore, they will be increasingly capable of performing actions that would be illegal if performed by humans. Such lawless AI agents could pose a severe risk to human life, liberty, and the rule of law.

Digital-Only Banks – Retail Banks For Retail Customers Only?, Katarzyna Schmidt-Jessa, Maciej Stradomski Jan 2025

Digital-Only Banks – Retail Banks For Retail Customers Only?, Katarzyna Schmidt-Jessa, Maciej Stradomski

Journal of Banking and Financial Economics

This paper explores how traditional banks perceive digital-only banks and the potential impact of digital-only banks on the retail segment of the banking sector. To obtain the main goal, we conducted in-depth semi-structured interviews with managers and directors representing different traditional banks with profound insight into the bank digitalisation process. The results indicate that, for traditional banks, the development of digital-only banks does not pose a threat or challenge that can significantly undermine their business. A high level of user experience, innovativeness, and lack of obsolete processes and technologies are the main advantages of digital-only banks that attract retail customers. …

Biological Sciences Faculty Research and Publications

Individuals with diabetes mellitus frequently develop severe skin and soft tissue infections (SSTIs) that are recalcitrant to antibiotic treatment. We examined how diabetes affects the emergence of antibiotic resistance in a Staphylococcus aureus SSTI. We determined that S. aureus evolves antibiotic resistance rapidly in diabetic mice, while resistance did not occur in nondiabetic mice over the course of infection. Diabetes-associated immune cell dysfunction plays a minor role in the emergence of resistance, while hyperglycemia plays a dominant role facilitating the expansion and takeover of resistant mutants in diabetic infections. Furthermore, vancomycin intermediate resistant isolates display a pronounced fitness defect in …

The Rad6-Like Ubiquitin Conjugase Gene Osubc7 Has A Positive Role In The Early Cold Stress Tolerance Response Of Rice, Huy Phan, Michael Schläppi Jan 2025

The Rad6-Like Ubiquitin Conjugase Gene Osubc7 Has A Positive Role In The Early Cold Stress Tolerance Response Of Rice, Huy Phan, Michael Schläppi

Biological Sciences Faculty Research and Publications

Background/Objectives: Cold stress poses a significant threat to Asian rice cultivation, disrupting important physiological processes crucial for seedling establishment and overall plant growth. It is, thus, crucial to elucidate genetic pathways involved in cold stress tolerance response mechanisms. Methods: We mapped OsUBC7, a Radiation-sensitive 6 (RAD6)-type homolog of rice, to a low-temperature seedling survivability (LTSS) QTL and used genomics, molecular genetics, and physiological assays to assess its role in plant resilience against low-temperature stress. Results: OsUBC7 is cold responsive and has higher expression levels in cold-tolerant japonica than cold-sensitive indica. Overexpression of OsUBC7 enhances LTSS of indica and freezing tolerance …

Teaching Documentary Filmmaking As Social Advocacy: The Case Of The Yangon Film School, Violet Valdez, Mon Mon Myat Jan 2025

Teaching Documentary Filmmaking As Social Advocacy: The Case Of The Yangon Film School, Violet Valdez, Mon Mon Myat

Department of Communication Faculty Publications

This is a descriptive case study of Yangon Film School (Yangon, Myanmar) in a setting of protracted civil conflict that has persisted since 1968. It examined the school’s approach in the teaching of documentary filmmaking and analyzed key aspects of the school’s operations. Findings show that the documentary filmmaking taught in the school was informed by social advocacy. This was fostered through the students’ participation in films commissioned to the school by civil society organizations and the practice of participatory filmmaking. The school stood out in the Myanmar setting for its dual character as a training center and a production …

Diaspora Politics And A Rising China: Ambivalent Ties Amid Geopolitical Changes, Jiaqi M. Liu Jan 2025

Diaspora Politics And A Rising China: Ambivalent Ties Amid Geopolitical Changes, Jiaqi M. Liu

Research Collection School of Social Sciences

Over the past decade, the rise of China on the global stage has witnessed the emergence of members of the Chinese diaspora as new meso-level actors in mediating Sino-Western relations. As part of China’s burgeoning “public diplomacy” around the globe, Chinese migrants organize cultural events to establish grassroots and semi-official exchanges between China and the West. This chapter provides a state-of-the-art examination of so-called “diasporic public diplomacy” whereby the Chinese diaspora plays an increasingly important role in promoting China’s soft power abroad. Based on long-term fieldwork in a prominent emigrant community, I analyse how Chinese national policies envision two specific …
