The question of which scientists are qualified to provide expert guidance in legal controversies is a perennial debate among scholars, judges, and lawyers. Scientists who participate in legal disputes can achieve enormous power and influence, not only over the case at hand but over long-term developments in legal doctrine. While these issues arise in many areas of the law, environmental litigation has been a particularly active site of contestations over epistemic authority. Courts have frequently relied on scientists to understand whether the government is justified in regulating pollution and who may be liable for environmental and public health harms.

Assessing Government Transparency: An Analysis Of South Dakota's Open Records And Meeting Laws, Neil Fulton, Sarah Kammer, Patrick Garry
Assessing Government Transparency: An Analysis Of South Dakota's Open Records And Meeting Laws, Neil Fulton, Sarah Kammer, Patrick Garry
Faculty Publications
Government transparency is crucial for an effective and responsive democracy. The pursuit of such transparency underlies state open records and meetings laws. South Dakota’s open records law strives to open government records to the public. However, it also contains an array of exceptions that prevent the disclosure of certain records. When denied access to government records, the public possesses a statutory right of appeal. This article examines the workings of that appeal process. Open meetings laws also serve to give the public a role in government deliberations and to make those deliberations transparent. Those laws, including South Dakota’s law, provide …
Motherhood Or Work: Why Not Both? Representations Of Femininity In Australian Wartime Radio Serials, Emma Price
Motherhood Or Work: Why Not Both? Representations Of Femininity In Australian Wartime Radio Serials, Emma Price
Theses
War is a gendering activity. As media is one of the many sites where gender is constructed, this study aims to investigate through a discourse analysis of serials produced by women for radio in the 1940s, the ways these programs represented or challenged social and cultural expectations placed on women. The themes female dramatists explored through the genre of radio serials, and the statements these programs made about life as a woman during the Second World War, are under-researched areas in Australian scholarship. While it must be acknowledged that the war was not a turning point in the status of …

NAKHARA (Journal of Environmental Design and Planning)
Since UNESCO formalized the concept of cultural landscapes in 1992, heritage discourse has shifted from monument-centric approaches toward values-based perspectives that foreground the dynamic interplay among people, place, and ecology. Within this framework, cultural landscapes offer a critical lens for understanding rural settlements not only as spatial configurations but also as embodiments of intangible knowledge and ecological adaptation. This study investigates Kampung Batu Lonceng, a vernacular settlement situated along the active Lembang Fault in West Java, Indonesia. With historical traces dating back to the Neolithic period, the kampung exemplifies how spatial formation is shaped simultaneously by geomorphological vulnerabilities and long-standing …
Palm Oil Expansion: Carrying On The Legacy Of Colonial Exploitation In Indonesia, Melinda Burgin
Palm Oil Expansion: Carrying On The Legacy Of Colonial Exploitation In Indonesia, Melinda Burgin
Res Publica - Journal of Undergraduate Research
Today, plantation agriculture in Indonesia is dominated by palm oil expansion. While the palm oil industry has frequently been touted as an economic boon for Indonesia, the environmental and social consequences have been dire, particularly for Indigenous peoples. Oil palm cultivation has been a part of Indonesian agriculture since its introduction by Dutch traders in the mid 19th century, but palm oil production in Indonesia really exploded in the 1990s, as seen in Figure 1. Since then, palm oil production has been a leading cause of deforestation (Austin, 2019) and caused devastation to indigenous communities as they lose swathes of …
Contract Rights After Lochner: The Clause That Time Forgot, Leonard C. Brahin
Contract Rights After Lochner: The Clause That Time Forgot, Leonard C. Brahin
Western New England Law Review
The Contract Clause occupies a unique position in our constitutional jurisprudence. Its language sweeps broadly and the Marshall Court wielded it like a bludgeon, curtailing the power of overzealous state governments. But this sweeping power was curbed as the end of the Lochner era rendered the Contract Clause all but a dead letter.
Rendered inert for years by atextual interpretations, the rise of textualism and “history and tradition” offers new hope to impaired contractors. Building on this momentum, this Article conducts the first, complete fifty-state survey of state court constitutions and proposes that the Marshall Court’s original understanding of the …

From The Battlefield To The Asylum: The Social Construction Of Disability In Italy, 1900 - 1950, Brandie Crisp Robb
From The Battlefield To The Asylum: The Social Construction Of Disability In Italy, 1900 - 1950, Brandie Crisp Robb
Graduate Theses/Dissertations
The Italian social construction of disability reflects a complex interplay between social, religious, political, and religious influences present during the first half of the twentieth century. While Western European and American disability discourse remained similar, those influences unique to Italy resulted in the formation of two distinct disability discourses during the early twentieth century: that of the heroic physically disabled veteran who sacrificed everything for the good of Italy, and the eugenically unfit Italian associated with dependency and uselessness. By combining a theoretical framework that includes critical disability theory with historical methodology, the following thesis demonstrates how the emerging disability …
Medellín Manifesto On Transnational Value Chains And International Law, Diane Desierto
Medellín Manifesto On Transnational Value Chains And International Law, Diane Desierto
Journal Articles
Global Value Chains (GVCs) have been heralded as the ‘new world of trade’, yet they branch far beyond what has traditionally been considered ‘trade’—they interact with and are informed by multiple legal regimes often in ways unrelated to the theoretical and practical bases of those regimes. Building on the 2016 IGLP Manifesto, which sought to place law at the centre of GVC research, the Medellín Manifesto’s aspiration is to establish a research agenda that is specifically focused on international law: one that treats GVCs as amorphous and transnational legal creatures—they are transnational value chains (TVCs); one that recognises that the …

Algorithmic Selection Of Iconic Constitutions, Tejas Ramdas, Patrick Chung-Chia Huang, Nuno Garoupa, Martin T. Wells, Yun-Chien Chang, Tom Ginsburg
Coase-Sandor Institute for Law & Economics Research Paper Series
This chapter examines the influence of pre-20th century constitutions using a quantitative approach, comparing expert-selected “iconic” constitutions with those identified algorithmically. In prior work, human experts identified four influential constitutions: the U.S. 1791, France 1791, Spain 1812, and France 1848. Here, we employ a genetic algorithm and Document Term Matrix (DTM) analysis to assess which one or four of 180 pre-1899 constitutions had the greatest textual impact on 581 post-1900 constitutions. Two criteria guide the selection: coverage and originality. Through iterative optimization, the algorithm identifies the most textually influential constitutions, allowing for a direct comparison with expert selections. This chapter …
Navigating The Seas Of History In International Law, Valentina Vadi
Navigating The Seas Of History In International Law, Valentina Vadi
South Carolina Journal of International Law and Business
Inquiries into questions of time, history, and international law have recently come to the fore. So far, however, many studies have only examined developments in international law from a temporally and thematically fragmented, brief, and narrow perspective. Due to international law’s growing normative and institutional fragmentation and emphasis on specific crises, episodes, and events, many analyses focus on transient trends and particular facets of international law. This study suggests an alternative to these constrained viewpoints: a thorough, multilayered, and broad perspective to questions of international law, drawing on Fernand Braudel’s tripartite theory of time.
Braudel’s theory of time provides valuable …

Riverside Readings: Audio Drama Development And Implementation Plan, Trent P. Mylie
Theses and Dissertations
The current state of media includes broadcasting, podcasting, and a new yet familiar form of accessible media through streaming. Numerous examples illustrate the significance of broadcasting and counter the notion that it is a niche or outdated form of media. Younger generations, including mine, have grown up in an era rich in media, witnessing the dawn and resurgence of formats that once seemed lost. As we transition into a collegiate environment, we seek to channel our creativity through a medium; for us, that medium is radio and podcasting. Riverside Readings allows individuals to explore their creative passions and engage in …

Unstable Rivalry: Structure, Domestic Politics, And Taiwan In U.S.-China Relations, Brendan Edward Flynn
Unstable Rivalry: Structure, Domestic Politics, And Taiwan In U.S.-China Relations, Brendan Edward Flynn
Wayne State University Dissertations
International relations (IR) scholarship frequently utilizes structural and domestic political levels of analysis to explain interstate war and conflict. While U.S.-China relations have deteriorated significantly, there is considerable disagreement about what caused this change. In this dissertation I utilize Militarized Interstate Disputes (MIDs) to operationalize instability between the U.S. and China and test competing theories. Increasing levels of MIDs since 2009 broadly confirm structural theories that hold power parity is a primary driver of conflict between great powers. Case studies of the Third Taiwan Strait Crisis (1995 – 1996) and Fourth Taiwan Strait Crisis (2022), however, illustrate that domestic political …

Rebuilding The Spatial Visualization Test, Maerianna Artang, Maia Catterall, Yagmur Onder, Nrupaja Bhide, Dhinesh Balaji Radhakrishnan, Jennifer J. Deboer
Indiana STEM Education Conference
Literature demonstrates that spatial visualization skills are crucial for students entering engineering and are used as early indicators of success. Historically, studies stated that students of gender or cultural minorities in engineering scored lower than their White, male counterparts. However, recent studies critically question the research approaches used in such studies (Bartlet, 2023; Önder et. al, 2023). We investigate the possible reasons for this score discrepancy and explore the construction of an asset-based spatial visualization assessment. Our work expands the area of spatial visualization development as applied in engineering design, specifically for the scope of marginalized learner contexts. We incorporated …

Investigating The Psychometric Properties Of A Set Of Local Stem Literacy Instruments In Rasch Model, Lijun Shen
Theses and Dissertations--Educational Policy Studies and Evaluation
This study investigates the psychometric features of the See Blue STEM literacy inventories (SBSTEMs, including the elementary version SB-E and the middle school version SB-M) to determine their validity in measuring STEM literacy. Using data from elementary and middle school students participating in the See Blue STEM camp in 2019 and 2021-22, this research employed the Rasch Partial Credit Model (PCM) to analyze item-level performance and identify DIF items across various demographic subgroups (race, gender, free-lunch status, and potential first-generation status) and camp delivery modes (online versus in-person). Results indicated that both the elementary (SB-E) and middle school (SB-M) versions …
Historicity And Axiology: Temporal Implications For Axiology, Bennett Gilbert
Historicity And Axiology: Temporal Implications For Axiology, Bennett Gilbert
History Faculty Publications and Presentations
To develop the axiology of moral (or ethical) values, phenomenological analysis must look at temporality in a way that is unfamiliar to it. This way is through knowledge and experience of the actual historical past, from which it has been separated by the Heideggerian conception of historicity and its classical Husserlian analysis of time consciousness. The development of historical studies helps to make this possible. A simple sample model of the diachronesis of the awareness of ethical significance, value, and obligation is presented. It moves the analysis from a presentist focus to the field of experience in which subjects develop …
History’S Movement: The Historical Ontology In Social Ontology, Bennett B. Gilbert
History’S Movement: The Historical Ontology In Social Ontology, Bennett B. Gilbert
History Faculty Publications and Presentations
Social ontology and the philosophy of history both concern themselves with human collectives. Social ontology is supposed to be theoretical, although the social sciences are supposed to be empirical. Philosophy of history is supposed to be theoretical, although historiography is supposed to be empirical. In fact, the a priori and the a posteriori mix in both theoretical and empirical endeavors in similar ways. Since the two endeavors hold part of their objects of inquiry in common, they should be able to speak to another. In what follows I aim to expose some of the ways their dialogue stresses and can …

Assessing Distribution And Density Changes Of The Ecosystem Engineers, Rockweed And Kelp, In Narragansett Bay, Ri, Rebecca Venezia
Open Access Dissertations
Climate change and anthropogenic stressors in marine costal habitats include increased sea surface temperatures (SST) and precipitation. The impacts of these stressors can affect ecosystem engineer species, which create three-dimensional habitat space in and provide various ecosystem services that modify and maintain ecosystem resources. In Narragansett Bay, RI, USA there is anecdotal evidence that the habitat forming species of kelp, Saccharina latissima, and rockweeds, Ascophyllum nodosum and Fucus spp, are changing but few long-term studies have been conducted to verify this. We compared the historical studies from the 1960s to 2010s on seaweeds in Narraganset Bay to modern SCUBA …
Technological Change And The Evolution Of Patent Rights, Paul Rogerson
Technological Change And The Evolution Of Patent Rights, Paul Rogerson
Chapman Law Review
The history of patent law is characterized by a striking pattern: dramatic, recurring cycles between eras of stronger and weaker patent rights. One theory is that patent law has been adapting to waves of technological change. In periods of rapid technological progress, following major breakthroughs (like the steam engine or the microprocessor), freely granting patents tends to create thickets of overlapping claims that block innovation, and courts have reacted by weakening rights (raising the standard to obtain and enforce a patent).
Existing histories, relying on qualitative methods, have argued that this theory explains certain nineteenth-century legal developments, but have questioned …
Defining ‘Un-Americanism’ In Culture And Art: The Dies Committee’S Investigation Of The Federal Theatre Project, Matthew G. Summers
Defining ‘Un-Americanism’ In Culture And Art: The Dies Committee’S Investigation Of The Federal Theatre Project, Matthew G. Summers
Dissertations and Theses
This thesis explores the House Un-American Activities Committee’s (HUAC) expansive definition of ‘Un-Americanism’ through the body’s 1938 investigation of the Federal Theatre Project (FTP). The committee, then known as the Dies Committee after its chairman Martin Dies (D-TX), publicly presented the hearings as an attempt to root out communism in a deeply compromised government program. And indeed the FTP, an ambitious New Deal Program to provide work for unemployed professionals in the theatre, had an undoubtedly leftist bent. However, the hearings were consistently focused on the project's progressive stances on issues of race and gender, and effectively exposed the underlying …
“History Is Within And Around Us:” High School Students Actively Engage The Past In New York City, Alina Lewis
“History Is Within And Around Us:” High School Students Actively Engage The Past In New York City, Alina Lewis
Electronic Theses & Dissertations (2024 - present)
Background/Context: Research on history education in the United States context has focused narrowly on history as a cognitive practice. This body of research assumes that it is difficult for students to “think like historians” (Wineburg, 1999) and is largely focused on advancing a discrete set of historical thinking skills through curricular interventions. Largely ignored in this discourse are the ways in which students engage with the past in out-of-school contexts.
Purpose/Objective: This study examines students’ engagements with history in out-of-school contexts. It is my hope that better understanding and describing how students experience history outside of school spaces will suggest …

Worldbuilding A Queer Before: D&D As A Neomedievalism For A Modern Age, Brianna M. Thompson
Electronic Theses & Dissertations (2024 - present)
Dungeons & Dragons (D&D) has had countless participants and audience members in the course of its over fifty-year existence. It has also been the subject of several studies that attempt to capture its unique form of performative play. Yet, there has been a scarcity of scholarship on how D&D acts as a neomedievalism and how that can offer a queer kind of opportunity to its players, allowing them to find a place in a past that is historically inaccessible and yet endlessly in the process of being (re)imagined. Using an interweaving of archival theory with queer and performance studies, particularly …
Embracing The Unmanageable: The Critique Of The Everyday And The Postwar Condition In Wallace Stevens’ And Robert Duncan’S Works Circa 1950, Kazuma Morita
Electronic Theses & Dissertations (2024 - present)
My thesis is designed as an investigation of the ethical and political implications of the everyday in postwar American poetry. While recent scholarship of everyday life studies has clarified the centrality of the everyday or the ordinary to modernism and postwar literature, it does not elaborate enough on the impact of the political condition on literary expressions of everyday life in post-1945 period. Given U.S. military’s infiltration into everyday life of people living inside and outside the country after World War II, it is an important task to spotlight the way American postwar poets tackled U.S. war culture through their …
The Benefit Of New Perspective: An Analysis Of Postcolonial Adaptation, Sara L. Tilbe
The Benefit Of New Perspective: An Analysis Of Postcolonial Adaptation, Sara L. Tilbe
Electronic Theses & Dissertations (2024 - present)
In our modern world, the concept of literary adaptation is not unheard of. Each release of a new, popular text comes with an underlying chance that it will likely be snatched up by Hollywood executives to be told through a cinematic setting. However, there is less fanfare when it comes to the topic of literary adaptation, particularly of famous texts that are deemed “classic” of the literary canon. Usually, any news of a literary adaptation of a classic book is meant with polarizing views from the general public. Some welcome the change, excited for what a new author can bring …

Diversity Within Species: Mechanisms, Evolution And Implications In Bacterial Disease, Kathryn R. Piper
Electronic Theses & Dissertations (2024 - present)
The Gram-positive bacterium Staphylococcus aureus and the Gram-negative bacterium Escherichia coli are ubiquitous commensal and opportunistic pathogens. In humans, S. aureus is commonly found on the skin and mucus membranes, and is known to cause infections in the skin, bloodstream and brain. E. coli is a normal part of the gut microbiota in humans and can cause intestinal and extraintestinal infections alike. S. aureus and E. coli pose global threats to public health, due to the high morbidity and mortality of invasive strains. The wide range of infections they cause in humans and other animals are exacerbated by the presence …
