Judging Bankruptcy Without Distress, Jack Zarin-Rosenfeld
Judging Bankruptcy Without Distress, Jack Zarin-Rosenfeld
Hofstra Law Faculty Scholarship
In Harrington v. Purdue Pharma, the United States Supreme Court rejected the bankruptcy plan of OxyContin producer Purdue Pharma, which purported to settle claims against both Purdue (the bankruptcy debtor) and Purdue’s individual owners and managers, all members of the Sackler family who had not themselves filed for bankruptcy (the Sackler Release). Concluding that the United States Bankruptcy Code does not authorize settlement of claims against non-debtors without claimant consent, the Harrington Court appeared set to stem the tide of “bankruptcy without distress,” a flourishing practice in which solvent non-debtors (like the Sacklers) would settle their liabilities within the …

Fixation On Viruses: Eye-Tracking, Image-Based Agency, And Fear-Appeal Desensitization, Braden Bagley, Lijie Zhou, Hayden Coombs, Matthew Barton
Iowa Journal of Communication
This study examined the effects of image-based assignment of agency (IAA) on COVID-19 and flu fear-appeals by employing eye-tracking technology. Volunteers participated in a 2x2x2 between-groups experiment. Fixation-count and fixation-duration were collected by a Tobii Pro X3-120 Screen-Based Eye-Tracker. After reviewing a fact sheet, participants answered a 29-item survey that included items aligning with the extended parallel process model. The flu/agentic-image/virus-agentic-language message produced significantly higher fixation-frequency to the image and a higher perception of severity than the COVID-19/real-image/human-agentic-language message. Fixation-frequency on the image produced significantly higher fear perceptions, but significantly lower message-quality and message-credibility perceptions. Flu messages led to significantly …

Future Giving Intention As Related To An Individual's Donor And Volunteer Status Within A Charitable Nonprofit Organization, Adrienne Darrah
Iowa Journal of Communication
Charitable nonprofit organizations have a responsibility not only to the communities they serve but also to the individuals who support them. When nonprofits fail to act as good stewards of raised monies, they may find themselves caught in a scandal that not only holds legal ramifications but financial and ethical implications as well. Drawing on resource dependence and stewardship theories, manipulated stimuli related the American Red Cross’ response to the 2010 Haitian earthquake was utilized to analyze the relationship between future giving intention and current monetary donor, blood donor, and volunteer status. This paper also considers crisis communication in examining …

Unheard Voices: The Hidden Influence Of Non-American Accents On Patient Outcomes And Provider Perception In Healthcare Situations In The United States, Gift Oluwatosin Olalusi
Iowa Journal of Communication
Stigma surrounding non-native American accents in the United States adversely influences the health-related decisions and behaviors of those who speak with such accents. Grounded in stigma management communication theory (SMCT), this study explored how individuals with non-native American accents communicatively manage accent stigma experiences in healthcare situations in the United States through ten semi-structured interviews. SMCT’s strategies of accepting, avoiding, ignoring, evading responsibility, and denying were identified by participants as the management strategies employed when they face stigmatization. The findings suggest that stereotype threat and patients’ stigma management strategies are important phenomena that can impact the healthcare outcome of patients …

Is It Real Enough? A Mixed-Methods Study Of Realism, Engagement And Counterargument In Transmedia Edutainment For Sustainable Behaviors, Aya Shata, Michelle Selig
Hank Greenspun School of Journalism and Media Studies Faculty Research
Advancements in technology have driven media convergence, paving the way for innovative storytelling formats like Transmedia Edutainment (TE-E), a new promising strategy for advocating prosocial behaviors. However, there is limited research on narrative processing and the persuasive outcomes of TE-E, particularly in environmental contexts. Therefore, this paper examines TE-E as a new communication strategy that leverages storytelling across multiple platforms to promote pro-environmental messaging. Drawing on entertainment-education literature and narrative persuasion theories, specifically the narrative engagement model and perceived realism as theoretical frameworks in this study, to help understand the role and influence of TE-E. Using a mixed-method design, five …

Applied Environmental Research
Thailand has been facing air pollution, e.g., PM2.5, and impacts from climate phenomena, e.g., the El Niño‒Southern Oscillation (ENSO). Both air pollution and climate interact with each other. Changes in the planetary boundary layer height (PBLH) can affect PM2.5, represented by the aerosol optical depth (AOD), and are influenced by ENSO related to changes in the PBLH. The relationships among the PBLH, ENSO, and AOD were investigated via an empirical orthogonal function (EOF), which decomposes the spatiotemporal data of the PBLH into spatial patterns and corresponding time series. Correlation analysis was used to determine the relationships between the PBL variability …

Spatial And Temporal Pattern Assessment Of Agricultural Drought Sensitivity And Its Potential Impact On Economic Crops In Nakhon Ratchasima, Thailand, Suwit Ongsomwang, Siripon Kamontum
Applied Environmental Research
Agricultural drought sensitivity (ADS) is highly diverse across regions, primarily due to differences in climate, soil types, and farming practices. Agricultural drought impacts depend on drought intensity, severity, duration and timing relative to crop growth stages. Therefore, spatial and temporal pattern assessments of ADS and its potential impact on economic crops in three scenarios via multicriteria decision-making methods were conducted. As a result, the spatial distributions of the ADS index and its classification at 3 m7, 3 m10 and 6 m10, covering the planting and growing periods, displayed different patterns. The percentages of moderate, high and very high severity levels …

Applied Environmental Research
This study identified Bacillus cereus, an efficient Cr(VI) bioreducer, isolated from marine sediment in Thailand. Batch experiments verified the complete removal of 25 mg L-1Cr(VI) from synthetic wastewater (pH 7.0) after 6 days at 37 °C, 50 rpm,and a biomass concentration of 25% (v/v) culture inoculum. The Freundlich isotherm model demonstrated the best correlation with the Cr(VI) adsorption equilibrium data in the 25–100 mg L-1concentration range (R2= 0.9831). Kinetic analyses indicated that the removal of Cr(VI) by living B. cereusfollowed a pseudo-second-order adsorption model (R2= 0.9875) and a pseudo-second-order reduction model (R2= 0.9807). The adsorption rate can be accuratelycharacterizedvia the …

Student Posters
Autism Spectrum Disorder (ASD) is a neurodevelopmental disorder characterized by difficulties in social communication and restricted, repetitive behaviors, interests, or activities. A study in 2020 estimated that ASD affects 2.8% of children in the United States (NIMH). The RPL10 gene, encodes the Ribosomal protein L10, has been implicated in ASD and plays a crucial role in protein synthesis and neuronal development, contributing to a protein essential for assembling the large ribosomal subunit. This study investigates how variations in PRL10 (Ribosomal Protein L10) can contribute to ASD.

Irritable Bowel Syndrome is a disease linked with the gastrointestinal system and seen to cause bloating, abdominal pain, and harmful alterations in the digestive system. Its cause is complex and is known to have both environmental and genetic factors. Recent studies have shown that IBS occurs due to genetic variations, which leads to the pathogenesis of IBS. One gene, the EED (Embryonic Ectoderm Development) gene has been involved in various biological processes, particularly gastrointestinal functions. The purpose of this study is to explore the potential relationship between the EED gene and IBS.

C1s enzyme plays a crucial role in the immune system so that the body can fight infection and repair damaged tissues. However, if it is not working properly, it will do more harm than good. This is shown in the case of periodontal Ehlers-Danlos syndrome (pEDS), a rare genetic disorder whereby C1s breaks down collagen I, a protein that gives structure and strength to connective tissues. Severe gum disease, loose teeth and premature teeth is a result of this. The purpose of this study is to identify and analyze the pathogenicity of C1s mutations and association in pEDS.

Piglet Nursing Location Along The Sow’S Udder Line Affects Piglet Weight Gain And Subsequent Weaning Weight, Shannon Dierking, Harold J. Monegue, Merlin Lindemann
Animal and Food Sciences Faculty Publications
Background: There is a linear correlation between piglet weaning weight and average daily gain during the post-nursery period. A key factor that influences piglet weight gain during lactation is milk intake. Thus, the variation in piglet weaning weight is hypothesized to be, to some extent, a result of differences in milk production among individual mammary glands. Objective: The objective of this study was to evaluate the impact of piglet nursing location throughout lactation on piglet weaning weight, with a secondary objective of determining the impact of piglet birth weight on nursing location selection. Methods: Teat pairs were labeled from anterior …

Transportation at weaning is an integral component of the American swine industry. However, the long-term effects on growth performance have not been well characterized. Previous research suggests transportation causes weight loss immediately following weaning, but few studies have followed this effect further than 7 d post-weaning, with transport causing decreased body weight in those that have. In experiment 1, average weight pigs at 20 ± 1.3 d of age were weaned and either 1) transported for 9 hour without feed and water (TR), 2) had their feed and water restricted for 9 hour (FR), or 3) were weaned and provided …

Automated Sponge Segmentation With Mask R-Cnn On Arms Plate Images For Reef Monitoring, Mrunali Abhijit Thokadiwala
Automated Sponge Segmentation With Mask R-Cnn On Arms Plate Images For Reef Monitoring, Mrunali Abhijit Thokadiwala
Master's Projects
Climate change-driven ocean warming and acidification are disrupting the ecological balance of coral reefs. Notably, these oceanic conditions are undermining coral health and accelerating their decline which is favoring some sponge species in outcompeting them for dominance. Although functional, these altered reefs destabilize the reef architecture, hinder nutrient cycling, and support fewer marine species. Thus, monitoring the growth and abundance of various sponges and understanding their roles at different stages of ecological succession in coral reefs is vital. Autonomous reef monitoring structures (ARMS) are often used for this purpose, but manual taxonomic analysis using their images is time-consuming, inconsistent and …
Application Of Root Cause Analysis For Fall Prevention: A Quality Improvement Initiative For Older Adults In A Skilled Nursing And Long-Term Care Facility, Terrence Ranjo
Doctoral Projects
Falls in older adults are common and often have severe outcomes. They are the leading cause of fatal and non-fatal injuries among people aged 65 and older and continue to increase. Half of residents in nursing facilities fall annually, and one in every ten falls will lead to a severe injury. Federal regulations like the Centers for Medicare and Medicaid Services require long-term care (LTC) facilities to incorporate quality assurance performance improvement initiatives to address identified quality concerns in LTC facilities. Root cause analysis (RCA) can help clinicians identify several root causes of falls and guide clinicians in developing personalized …

'Typical Cases': Representation, Racializing Medicine, And The Politics Of The Case Study In The Moulages Collections Of The Hôpital Saint-Louis, Kathleen Pierce
Art: Faculty Publications
Physicians at the hôpital Saint-Louis prized their collection of wax models (moulages) for their precise representation of color: a central project of dermatology. Close looking at the collection, however, reveals the repeated use of a consistent light skin tone across the vast majority of models. Given physicians’ investment in chromatic precision, how might we understand this generic attention to skin coloration? “Typical Cases” asks how, when, and why skin pigmentation mattered to fin-de-siècle dermatologists. I first argue that the overrepresentation of light skin tones comprises an aesthetic choice made by the model-makers and their physician-patrons. I subsequently ask how this …

40 Years Passing By In (A) “Heartbeat”, Christopher Janney
Monsoon: South Asian Studies Association Journal
This article outlines the forty-year history go Christopher Janney’s iconic performance work “HeartBeat.” Trained as an architect and jazz musician, Janney combines these two disciplines to create large interactive light/sound installations and performances. On the one hand, he attempts to make architecture more like music, more “alive” using real-time sensing devices as on his “Harmonic Convergence” installation on the Miami International Airport. On the other hand, he attempts to make music more like architecture, more physical more visual. In his “HeartBeat” performance, a dancer wears a heartbeat device that amplifies his/her heartbeat in “real time.” Over this pulse, live musicians …
