The Curiously Minor Role Of Minor V. Happersett (Foreword), Susan Frelich Appleton, Travis Crum, Hannah Keidan
The Curiously Minor Role Of Minor V. Happersett (Foreword), Susan Frelich Appleton, Travis Crum, Hannah Keidan
Scholarship@WashULaw
This Foreword introduces a symposium marking the 150th anniversary of Minor v. Happersett, a Supreme Court decision unanimously holding that the Fourteenth Amendment's Privileges or Immunities Clause did not enfranchise women. Notwithstanding its impact on the women's suffrage movement and the subsequent ratification of the Nineteenth Amendment, Minor presents a puzzle: it is a relatively obscure precedent that remains deeply relevant to contemporary legal debates. To elucidate this point, this Foreword juxtaposes Minor with two notorious Supreme Court decisions: Dred Scott and Dobbs.
Like Dred Scott, Minor pairs a morally repugnant result with legalistic reasoning. But whereas …
A Liberty-Balancing Approach To Crime, Sheldon Evans
A Liberty-Balancing Approach To Crime, Sheldon Evans
Scholarship@WashULaw
At its core, the criminal legal system is an ecosystem of institutions that seek to balance liberty interests. The insightful theories and complex practices of crime policy coalesce around questions on how crime impacts the liberties of individuals and communities to be safe, and how this correlates with the deprivation of liberty from offenders through our punishment system. But modern criminal policy, most often associated with the problems of overcriminalization and mass incarceration, has wholly abandoned any such delicate and nuanced balancing. Instead, the system thrives on sacrificing the liberties of offenders in a perverse and ineffective regime that leads …

In the past few years, large language models (LLMs) have achieved significant technical advances, such that legal-advocacy organizations are increasingly adopting them as complements to—or substitutes for—lawyers and other human experts. Several studies have examined LLMs' performance in taking law school exams, finding mixed results. Yet there have been no published studies systematically analyzing LLMs' competence at one of law professors' chief responsibilities: grading law school exams. This paper presents results of an analysis of how LLMs perform in evaluating student responses to legal analysis questions of the kind typically administered in law school exams. The underlying data come from …
When Hard Cases Make Bad Law: A Theory Of How Case Facts Affect Judge-Made Law, Sepehr Shahshahani
When Hard Cases Make Bad Law: A Theory Of How Case Facts Affect Judge-Made Law, Sepehr Shahshahani
Scholarship@WashULaw
“Hard cases make bad law” is one of the most famous aphorisms in Anglo-American law. Its insight is that when strict application of a generally sound law would impose a special hardship on someone, a court may be tempted to distort the law to avoid the hardship. Scholars have long debated the meaning and truth of the aphorism, but the debate has suffered from an imprecise conceptualization of what makes a case “hard.” This lack of precision limits our ability to disentangle and work through the important questions the aphorism raises about how the facts of a particular case affect …
An Anthology Of Interference In Law School Clinics, Peter A. Joy, Robert R. Kuehn
An Anthology Of Interference In Law School Clinics, Peter A. Joy, Robert R. Kuehn
Scholarship@WashULaw
An Anthology of Interference in Law School Clinics explores interference in law school clinics in the United States, addressing its long history and the legal ethics, academic freedom, and First Amendment responses to that interference. Law clinics have faced interference in their representation of clients from elected officials, business groups, alumni and, at times, even their own school administrators. This interference has targeted clinics for providing individuals and nongovernmental organizations with legal representation on important matters, including racial and gender discrimination, environmental issues, prisoner rights litigation, death penalty cases, and immigration and human rights matters. In each instance, the interference …

Ultrasound is a popular imaging technique mainly due to its non-invasive nature. And so, it is being used in a variety of applications. Due to plane wave imaging technique in ultrasound, frame rate of ultrasound imaging has the potential for being very high. Due to which, many channel data frames are being generated within a few seconds. As a result, tasks such as storing data frames and transferring them from front end ultrasonic system to processing computers are presenting significant challenges. Our current research work minimized these issues. We proposed and implemented: (a) Data encoding technique - We combined every …

Objectives/Goals: Predictive performance alone may not determine a model’s clinical utility. Neurobiological changes in obesity alter brain structures, but traditional voxel-based morphometry is limited to group-level analysis. We propose a probabilistic model with uncertainty heatmaps to improve interpretability and personalized prediction. Methods/Study Population: The data for this study are sourced from the Human Connectome Project (HCP), with approval from the Washington University in St. Louis Institutional Review Board. We preprocessed raw T1-weighted structural MRI scans from 525 patients using an automated pipeline. The dataset is divided into training (357 cases), calibration (63 cases), and testing (105 cases). Our probabilistic model …

The Professional Backgrounds And Experiences Of Higher Education Trustees And Its Influence On Decision Making, Jade J. Irving
Graduate Theses, Dissertations, and Problem Reports (ETD)
There are many complex decisions that must be made among the board of governors within institutions of higher education. Recent headlines on the decisions of trustees regarding campus closures and consolidations, program cuts, and presidential appointments have put a spotlight on the individuals responsible for making such decisions. This study examined how trustees of public 4-year institutions in the state of West Virginia perceive the value of their professional backgrounds and experiences in fulfilling their governance responsibilities. Using an explanatory sequential design, this study investigated how trustees’ professional experiences shape their decision-making processes through the theoretical lenses of sensemaking theory …

BACKGROUND: According to clinical practice guidelines for polycystic ovary syndrome, first-line treatment includes performing 150 min of moderate-to-vigorous physical activity on most days of the week plus at least 2 days of resistance training. However, < 40% of women with polycystic ovary syndrome engage in regular physical activity, and about 60% are sedentary. Research evidence supports theory-informed physical activity interventions to improve motivation for physical activity. This study examined the fit of a behavioral change theory for women with polycystic ovary syndrome. OBJECTIVES: The purposes of this qualitative study were to analyze physical activity barriers through the lens of self-determination theory and identify motivational strategies that may promote initiation and maintenance of physical activity among women with polycystic ovary syndrome. DESIGN: The study involved a qualitative, descriptive design using theory-driven thematic analysis. METHODS: After emailing a demographic questionnaire and Personal Health Questionnaire-8 to screen for depressive symptoms, participants (n = 7) met three times via Zoom during the summer of 2021. Meetings were audio-recorded, transcribed, and analyzed. RESULTS: Participants were aged 33.9 (±8.1) years, premenopausal, mostly White (71%), educated (100% with at least some college), employed full-time (86%), and married (86%) with a mean depressive symptoms score of 6.4 (±3.4) indicating mild depression. Strategies such as a buddy system, physician support, technology, and behavioral change techniques are necessary to meet the psychological needs of autonomy, competence, and relatedness among women with polycystic ovary syndrome to help increase exercise motivation. CONCLUSION: Findings supported the use of self-determination theory by emphasizing that the social context of polycystic ovary syndrome can undermine physical activity behavior. Thus, physical activity interventions should consider the social context, peer support system, and mental health status of women with polycystic ovary syndrome, and include tailored programs and motivational strategies to help meet the psychological needs of autonomy, competence, and relatedness.

Immigrants to Canada face unique barriers to accessing health care including communication barriers, socioeconomic limitations, and a lack of health care system navigation knowledge. Arabs in particular face mainstream negative attitudes, propagated through political discourses as well as entertainment media. We sought to understand how older adult Arab immigrants and family caregivers accessed and experienced health care in Ontario. We conducted a critical constructivist grounded theory, using Charmaz’s approach to grounded theory. A critical constructivist grounded theory method asks not only “what” social processes are happening and “how” but also “why” and “who” benefits. Both older adult immigrant Arabs and …

Poor Little Woman And Sybil Of The Rhine: Code Switching In Hildegard Of Bingen’S Writing, Bridgett Meskis
Poor Little Woman And Sybil Of The Rhine: Code Switching In Hildegard Of Bingen’S Writing, Bridgett Meskis
Undergraduate Theses, Professional Papers, and Capstone Artifacts
Hildegard of Bingen (1098- 1179) was a twelfth century German Benedictine abbess, mystic, author, composer, and theologian. Despite the heavily patriarchal and restrictive culture of her day, Hildegard managed to gain autonomy and authority within her community. She benefited from a boom in popularity in the mid-1990s, which saw a broadening of research subjects, including focus on the gender dynamics at play in Hildegard’s life. This scholarship has died down significantly since. Given the breadth and depth of her work, Hildegard of Bingen’s work deserves to be revisited through more recent theoretical lenses that can provide significant insights into her …

The Impact Of Trauma-Informed Teaching In A Middle School Classroom, Kathleen M. Wittig
All Electronic Theses and Dissertations
Student trauma has become more prevalent in the classroom setting since the COVID-19 pandemic. More and more schools are adopting a trauma-informed/sensitive approach to teaching to serve the growing number of students with trauma in the classroom. Educators are finding themselves faced with more emotional and behavioral issues in the classroom, teacher burnout is increasing daily, and more students are being referred to special education. It is not that these students are bad kids; rather, it is that they lack certain skills to allow them to be successful. Instead of trying to change the child, educators need to look at …

Graduate Research Theses & Dissertations
College students have difficulty selecting effective learning strategies, often due to their perceptions of cost and value of these strategies. The goal of the present study was to examine ways to increase students’ perceptions of value to outweigh their perceptions of cost to help them select an effective learning strategy (generation). Students were randomly assigned to one of five conditions in an additive design: no treatment control, experience comparing generation to a less effective learning strategy, experience plus information about its application to one’s life, experience and application plus evidence of the effectiveness of generation, or experience, application, and evidence, …
Historicity And Axiology: Temporal Implications For Axiology, Bennett Gilbert
Historicity And Axiology: Temporal Implications For Axiology, Bennett Gilbert
History Faculty Publications and Presentations
To develop the axiology of moral (or ethical) values, phenomenological analysis must look at temporality in a way that is unfamiliar to it. This way is through knowledge and experience of the actual historical past, from which it has been separated by the Heideggerian conception of historicity and its classical Husserlian analysis of time consciousness. The development of historical studies helps to make this possible. A simple sample model of the diachronesis of the awareness of ethical significance, value, and obligation is presented. It moves the analysis from a presentist focus to the field of experience in which subjects develop …

The twin concepts in the title will be introduced in the contexts of the philosophy of history and of philosophical personalism, as distinct from (though related to) their uses as logical and metaphysical categories. Overviews of varieties of philosophy of history and of basic principles I employ are foundations of the argument. Concepts, or ideas, in general have, I argue, real existence through the way that personal agents use them in creating the histories of human relations. I introduce a Personalist account, which has a more thoroughly diachronic character. Further remarks on the power of ideas to create relations expands …

Muharram, Milad And The Memons: The Commemoration Of Muharram And Celebration Of Milad Within The Memon Community, Ashkan Fayyaz
SSLA Culminating Experience
This thesis is a documentation of the Oral History of the commemoration of Muharram and celebration of Eid Milad-un-Nabi (ﷺ) within the Memon community residing in Karachi. The thesis traces a shift in scale from Muharram commemorations to Eid Milad-un-Nabi (ﷺ) celebrations. Using seven oral-history interviews from Kharadar and Hussainabad, it reconstructs the rituals affiliated with Muharram and Rabi-ul-Awal and analyses their meanings through hermeneutic phenomenology. It then analyzes transformation via Van Manen’s four lifeworld existentials: spatiality, corporeality, temporality and relationality. To complement the findings of this thesis, a historical analysis of Memon community’s practices in colonial Natal and colonial …
