Factory Farms And Labor Law: Can Unionization Get The Job Done?, Miranda Herreid Jan 2025

Factory Farms And Labor Law: Can Unionization Get The Job Done?, Miranda Herreid

Animal Law Review

At different moments in U.S. history, workers have joined together to fight for a better future. Now more than ever, as industries become increas-ingly consolidated and powerful, workers’ ability to band together and ad-vocate for their rights is integral. Recent victories in labor rights have not yet made their way to the industrial animal agricultural sphere. This is unfortunate, as the conditions at slaughterhouses and concentrated animal feeding operations are extractive and abusive towards workers and animals alike. In the past, strong union presence in slaughterhouses aided workers in achieving wage increases and job stability. However, this resulted in extreme …

Metallic Nanoparticles And Cosmetics: The Role Of Mitochondria And Premature Aging, Veronica Montesinos-Cruz, Justin Olmanson Jan 2025

Metallic Nanoparticles And Cosmetics: The Role Of Mitochondria And Premature Aging, Veronica Montesinos-Cruz, Justin Olmanson

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The cosmetic industry has developed and commercialized numerous products using new technologies, making them increasingly appealing to the public. The use of metallic nanoparticles (MtNPs) as key ingredients in cosmetics has become more widespread due to their demonstrated benefits. However, the use of these products remains controversial, as some studies have shown that MtNPs can penetrate the deeper layers of the skin and disrupt homeostatic balance. It has also been demonstrated that the interaction between MtNPs and keratinocytes increases the generation of reactive oxygen species (ROS), which can lead to oxidative stress, a condition associated with premature aging. Mitochondria, as …

Don’T Trust The Process: The Viability Of Eighth Amendment Claims For Ultra-Processed Food Overconsumption In Prisons, Markus C. Johnson, Rita L. Rahoi-Gilchrest Jan 2025

Don’T Trust The Process: The Viability Of Eighth Amendment Claims For Ultra-Processed Food Overconsumption In Prisons, Markus C. Johnson, Rita L. Rahoi-Gilchrest

Marquette Law Review

With the largest prison population worldwide, American prisons serve more food than anywhere else. To cut costs, American prisons overwhelmingly (or even entirely) serve prisoners ultra-processed foods, which, if overconsumed, have detrimental and long-lasting health effects. Prisoners taking issue with the food being served to them rely on the courts to counteract any inappropriate prison dietary practices, wielding the Eighth Amendment as a constitutional guarantee to be free from cruel and unusual punishment. But courts are failing to protect this constitutional guarantee by relying on precedent that is at odds with modern Eighth Amendment principles. Indeed, when it comes to …

Boden Lecture: Taxation Of Autonomous Artificial Intelligence, Reuven Avi-Yonah, Lucas Brasil Salama, Herbert Snitz, W. Robert Thomas Jan 2025

Boden Lecture: Taxation Of Autonomous Artificial Intelligence, Reuven Avi-Yonah, Lucas Brasil Salama, Herbert Snitz, W. Robert Thomas

Marquette Law Review

This Article proposes that tax can be a useful supplement to other measures to regulate Autonomous Artificial Intelligence (AAI) and limit its potential harmful effects. This proposal differs from command-and-control regulation of AAI along the lines of European Union legislation that may unduly limit the development of AAI. It also differs from existing proposals to tax AAI to generate revenue to help workers displaced by AAI programs, or to tax the data used by AAI. The proposal is based on granting AAI programs like ChatGPT separate legal personhood, like corporate personhood, while incentivizing or requiring their corporate owner to place …

The Gift Of Exit Financing, Robert W. Miller Jan 2025

The Gift Of Exit Financing, Robert W. Miller

Marquette Law Review

Aggressive liability management exercises have spilled over into bankruptcy court and exit financing is often the prize in the center of the arena. Debtors no longer rely upon gifting, the traditional strategy for buying plan support. Instead, they can replicate gifting’s benefits in a more defensible package by funneling discounted subscription rights to chosen constituencies as part of exit financing.

Recognizing exit financing’s distortive power, courts responded by evaluating the quality of negotiations and reviewing precedent transactions. Meanwhile, commentators suggest heightened monitoring and informal guardrails. All of these approaches ignore the shortcomings of judicial valuation. Market testing is the only …

Public Private Property, Xiaoqian Hu Jan 2025

Public Private Property, Xiaoqian Hu

Marquette Law Review

Many struggles are being fought in America today around regulation and redistribution of private property rights: between owners’ right to develop land and society’s need for environmental conservation; between landlords’ privilege to charge higher rents and society’s need for affordable housing, between property owners’ desire for protection from negative effects and unhoused persons’ need to live in the only space accessible to them, etc. These struggles, however, are doomed by a widely shared notion that public and private are inherent qualities in a zero-sum game. This Article refutes this notion. Building upon Legal Realist, post-Realist, and poststructuralist insights, it argues …

Locating Consumer Financial Regulation, Nikita Aggarwal Jan 2025

Locating Consumer Financial Regulation, Nikita Aggarwal

Articles

Recent advances in data-driven technology in consumer financial markets, commonly referred to as "fintech," have resurfaced the question of whether and to what extent data, particularly consumers' personal data, should be a locus for regulatory intervention in these markets. While innovation in fintech and the accompanying increase in the processing of personal data offer to improve the functioning of consumer financial markets, like all advances in technology, they also come with costs and risks. In 2024, in a move that favored the regulation of personal financial data per se and many of the traditional features of personal data protection regulation, …

Biological Sciences Faculty Publications

The insect molting process is critical to growth and development and is regulated in part by the neuropeptides corazonin, eclosion hormone, and α and β bursicon. We found messages in a synganglion transcriptome from adult, female American dog ticks, Dermacentor variabilis (that do not molt), with a high similarity to the larval insect neuropeptides that control molting. The phylogenetic analysis of the tick putative neuropeptides compared to other arthropods is discussed in detail. The relative gene expression of these peptides was determined by quantitative PCR during the following adult developmental stages: (i) virgin, unfed 0–24 h after entering the adult …

Graffiti, Neoliberalismo, At Tunggalian Para Sa Espasyo Sa Lungsod Quezon, Harvey James G. Castillo

From Fort To Prison: The Production Of Iloilo City, Ram Paulo A. Anayan Jan 2025

From Fort To Prison: The Production Of Iloilo City, Ram Paulo A. Anayan

Filipino Faculty Publications

The foundation of colonial cities in the Philippines rests on violence. The Spanish policies of the reducción forced the natives to settle in pueblos where colonial power is ensured. The resistance of some natives brought about the divide between tagabayan (town dweller) and tagabundok (mountain dweller)—respective connotations of civilization and savagery (Lumbera and Lumbera, 36). This paper examines how this centripetal-centrifugal force of simultaneous identity-production and displacement is echoed in the metonymy of the fort on which the origins of Iloilo City stand. I navigate how this movement manifests in the consciousness of the city across historical periods represented by …

Corporate Scenarios: Drawing Lessons From History, Madison Condon Jan 2025

Corporate Scenarios: Drawing Lessons From History, Madison Condon

Seattle University Law Review

As corporations are increasingly pressed to reveal information about their exposure to climate-related risks, they are often asked to undertake and disclose the outcome of “scenario analysis.” In this exercise, corporations, including financial institutions, examine how their business would fare under different pathways the future may take. One oft-used scenario, for example, is the International Energy Agency’s “Net-Zero by 2050: A Roadmap for the Energy Sector.” This Essay presents a history of the use of scenarios as a corporate planning tool, particularly in the oil industry, arguing that it is key for understanding our present moment and the role of …

Shareholder Expression In A Time Of Heightened Political Tension, Aaron A. Dhir Jan 2025

Shareholder Expression In A Time Of Heightened Political Tension, Aaron A. Dhir

Seattle University Law Review

In this article, I provide context for my forthcoming research project on shareholder proposals and racial equity audits. Since the murder of George Floyd in May of 2020, progressive shareholder actors have increasingly used the proposal mechanism to advance diversity, equity, inclusion, and justice-related goals. These proposals have frequently gone beyond requesting the usual corporate fare of diversity trainings, intersectionality workshops, affinity groups, etc. Instead, a more ambitious type of proposal asks corporate America to conduct racial equity audits, defined as “an independent, objective and holistic analysis of a company’s policies, practices, products, services and efforts to combat systemic racism …

Corporate Governance Speech, Sarah C. Haan Jan 2025

Corporate Governance Speech, Sarah C. Haan

Seattle University Law Review

The State has always regulated the intra-firm communications that make corporate governance possible, most commonly by mandating disclosures of information by a corporation to its shareholders. Some such laws are labeled “securities regulation,” but securities regulation is a broad category that extends to speech by actors who are outside the corporate enterprise as well. Also, the conventional securities regulation category does not capture all such laws; other examples, including informationforcing mandates, can be found in state corporate law. This Article uses the term “corporate governance speech” to describe the communications among shareholders, directors, and officers through which corporate governance is …

Dark Accounting Matter, Colleen Honigsberg Jan 2025

Dark Accounting Matter, Colleen Honigsberg

Seattle University Law Review

Physicists calculate that approximately 85% of the matter in the universe is composed of “dark matter” that “does not absorb, reflect, or emit electromagnetic radiation and is therefore difficult to detect.” The S&P 500 currently trades at a price-to-book value of 4.2, suggesting that book value accounts for less than 20% of the S&P 500’s market value. The remaining 80% appears nowhere in these firms’ balance sheets—it is invisible to contemporary accounting techniques and constitutes “dark accounting matter.”

Some “dark accounting matter” is composed of factors commonly described as components of “ESG.” Human capital, for example, is an intangible asset …

The Employees’ Dilemma: Balancing Internal Reporting, Whistleblowing, And Insider Trading Risks, Geeyoung Min Jan 2025

The Employees’ Dilemma: Balancing Internal Reporting, Whistleblowing, And Insider Trading Risks, Geeyoung Min

Seattle University Law Review

The Essay examines how recent developments in insider trading regulations and whistleblower reward programs can lead to unintended and counterproductive results of discouraging employees from using internal reporting channels within corporate compliance programs. While the presence of a robust and well-functioning corporate compliance program is a critical factor both in mitigating the level of public enforcement actions against companies and in protecting corporate managers from liability in private litigation, these programs often provide little incentive for employees to report potential misconduct internally.

Corporate compliance programs are designed to promote the upward information flow within the company, which is essential for …

How The Antidiscrimination Law Of Commercial Transactions Really Works, Helen Norton Jan 2025

How The Antidiscrimination Law Of Commercial Transactions Really Works, Helen Norton

Seattle University Law Review

A variety of businesses now cite 303 Creative when seeking First Amendment protection for their refusal to serve certain customers based on those customers’ protected class status. How this litigation will play out remains to be seen. But future courts need not, and should not, repeat the 303 Creative Court’s misunderstanding of how the antidiscrimination law of commercial transactions actually works.

Part I of this Essay explains the Court’s longstanding understanding of the antidiscrimination law of commercial transactions, and then describes the Court’s failure to engage with this precedent in 303 Creative. Part II then identifies the 303 Creative decision’s …

Toxicokinetics And Perfluorooctanesulfonic Acid-Induced Liver Protein Expression Are Markedly Altered In Mice Lacking Albumin, Emily M. Kaye, Jitka Becanova, Simon Vojta, Rainer Lohmann, Fabian Fischer, Angela Slitt Jan 2025

Toxicokinetics And Perfluorooctanesulfonic Acid-Induced Liver Protein Expression Are Markedly Altered In Mice Lacking Albumin, Emily M. Kaye, Jitka Becanova, Simon Vojta, Rainer Lohmann, Fabian Fischer, Angela Slitt

Graduate School of Oceanography Faculty Publications

Perfluorooctanesulfonic acid (PFOS) is a ubiquitous perfluoroalkyl substance (PFAS) linked to liver disease and obesity in humans. Binding studies suggest that albumin is a crucial blood protein influencing PFOS toxicokinetics and hepatotoxicity; however, its role has not been mechanistically tested in vivo. This study used an albumin-deficient mouse model to investigate the relevance of albumin in PFOS tissue distribution and liver disease end points. Adult male C57BL/6J wild-type (Alb+/+) and albumin-deficient (Alb–/–) mice were orally gavaged daily for 7 days with either vehicle or PFOS at 0.5 or 10 mg/kg body weight. The measured PFOS concentrations …

Allergic Bronchopulmonary Aspergillosis In Pediatric Asthma : A Diagnostic Challenge Mimicking Tuberculosis, Praveen Das, Santosh Kondekar, Surbhi Rathi Jan 2025

Allergic Bronchopulmonary Aspergillosis In Pediatric Asthma : A Diagnostic Challenge Mimicking Tuberculosis, Praveen Das, Santosh Kondekar, Surbhi Rathi

Digital Journal of Clinical Medicine

Allergic bronchopulmonary aspergillosis (ABPA) is a rare hypersensitivity reaction to Aspergillus fumigatus, more commonly observed in adults and patients with cystic fibrosis. It can, however, present in pediatric asthmatics with refractory symptoms, leading to diagnostic challenges due to overlapping features with other pulmonary diseases, including tuberculosis. ABPA should be considered in children with uncontrolled asthma and atypical radiologic features, especially when unresponsive to standard therapies. Early recognition and appropriate management are critical to prevent irreversible lung damage and improve quality of life.

Lack Of Consistent Diurnal Trends In Acoustic Metrics From Restored Coral Reefs, Jeremy Velázquez-Alvarado, Valentina Pérez-García, Javier S. Tellechea, Joni T. Backstrom, Alex Mercado-Molina

Gulf and Caribbean Research

Once vibrant ecosystems, coral reefs are degrading at unprecedented rates due to natural and human—induced disturbances, necessitating immediate restoration and conservation efforts. Evaluating the success of these projects often involves assessing changes in reef biodiversity. Bioacoustics has emerged as a promising, non—invasive method for such evaluations, though its efficacy remains debated. This study aimed to determine whether the diurnal soundscapes of restored coral reefs are consistent across different time frames (months) and spatial scales (reefs), which is crucial for developing reliable monitoring tools for reef health. To achieve this, 2 commonly used acoustic indices, the Acoustic Complexity Index (ACI) and …

Artists Engage And Persist With Big Ideas, Michelle Mathias Jan 2025

Artists Engage And Persist With Big Ideas, Michelle Mathias

Graduate Research Papers

In a choice-based, Teaching for Artistic Behavior (TAB) art studio classroom, students are encouraged to be independent, authentic, and self-directed learners. However, many students struggle with committing to and following through with their artistic ideas, often resulting in disengagement and work that lacks personal significance. This qualitative action research explored how implementing the Studio Habits of Mind, complemented by the Big Idea framework, influences student engagement and perseverance. By introducing a broad conceptual focus—specifically, the Big Idea of “Play and Art”—this study aimed to provide structure, foster personal connections, and support students in completing meaningful artwork. Research questions centered on …

What Amino Acid Residue Is Responsible For The Interaction Of Atg11 With Its Autophagy Partner Atg9?, Patricia Omoyemwen Woghiren Jan 2025

What Amino Acid Residue Is Responsible For The Interaction Of Atg11 With Its Autophagy Partner Atg9?, Patricia Omoyemwen Woghiren

Senior Honors Theses and Projects

Macroautophagy is a cellular function that involves the formation of a double membrane vesicle that isolates and transports cellular materials to the vacuole or lysosome for degradation and recycling. It is divided into selective and non-selective macroautophagy. Atg11 and Atg9 are two key proteins involved in selective macroautophagy, and their interaction is critical for selective macroautophagy. Specific residues on Atg9 critical for Atg11 binding have been identified, but similar residues on Atg11 have not been identified. The aim of my research was to identify a specific residue critical for Atg11’s interaction with Atg9. To this end, we carried out Yeast-twohybrid …
