The Southern Business Administration Association was founded in 1964 with the objective of promoting and improving collegiate education for business. The Mary Ona Denny Mathews Papers consists of Winthrop materials collected by Mrs. Mathews. Mary Ona Denny Mathews (1897-1988) graduated from Winthrop College in 1919 and began working at Winthrop in the Business Office from 1919 until she retired in 1942. She married Brig. Gen. Lucius Don Mathews (1893-1972) on August 9, 1924. The collection contains three postcards: One dated July 29, 1919 from David Bancroft Johnson; the other two have not been used or dated. There is also one photograph of a young lady at Winthrop-not dated; a two page letter from D. B. Johnson in regards to her …

Many species of wildlife alter their daily activity patterns in response to co-occurring species as well as the surrounding environment. Often smaller or subordinate species alter their activity patterns to avoid being active at the same time as larger, dominant species to avoid agonistic interactions. Human development can complicate interspecies interactions, as not all wildlife respond to human activity in the same manner. While some species may change the timing of their activity to avoid being active when humans are, others may be unaffected or may benefit from being active at the same time as humans to reduce predation risk …

Anti-SLAPP statutes in Nevada follow a two-pronged analysis. The first prong asks whether the moving party has established, by a preponderance of the evidence, that the claims are based upon a good faith communication in furtherance of the right to free speech in direct connection with an issue of public concern. Similarly, the defendant must establish that the communication is truthful or was made without knowledge of its falsehood. The second prong asks whether the plaintiff has demonstrated with prima facie evidence a probability of prevailing on its claims. The Supreme Court of Nevada found that under certain circumstances, a nonsignatory to a contract with an arbitration clause can compel another nonsignatory to participate in arbitration. This compulsion is appropriate if the nonsignatory seeking to compel arbitration shows both the right to enforce the contract and that compelling arbitration aligns with standard principles of contract law or estoppel. The Court reversed the district court’s orders denying motions to compel arbitration and remanded for further proceedings.

Firstly, the Court in this case considered whether defendants to a medical malpractice action may present evidence concerning the plaintiff's informed consent or assumption of the risk when the plaintiff does not raise a claim based on lack of informed consent. In the case of McCord vs. State, the Nevada Supreme Court clarified the interpretation of NRS 482.275(4) regarding license plates.2 The court ruled that a license plate frame partially covering the plate does not constitute “foreign material” making the plate illegible. Furthermore, it established that such a circumstance does not provide probable cause for a traffic stop. The Court addressed several issues related to the appointment and compensation of a Guardian Ad Litem (GAL) for Kathleen June Jones (June). First, the Court held that June waived any claim regarding the district court’s failure to state the GAL’s hourly rate in the appointment order because she did not raise it below, and that any error was harmless. Additionally, the Court found an error in the district court’s conclusion that it was required to appoint an attorney as GAL, but found this to be harmless as well, due to the absence of any qualified nonattorney. The Nevada Supreme Court affirmed the district court’s decision in regard to a revocable inter vivos trust dispute following a divorce. First, they determined that a revocable inter vivos family trust isn’t a necessary party in a divorce action where the spouses are co-trustees, co- settlors, and beneficiaries. Second, the district court has jurisdiction to distribute community assets held in a revocable inter vivos trust.

Generative Adversarial Networks (GANs) have received immense attention in recent years due to their ability to capture complex, high-dimensional data distributions without the need for extensive labeling. Since their conception in 2014, a wide array of GAN variants have been proposed featuring alternative architectures, optimizers, and loss functions with the goal of improving performance and training stability. This manuscript focuses on quantifying the resilience of a GAN architecture to specific modes of image degradation. Teacher Use Of Rubrics To Assess Claim, Evidence And Reasonings In The High School Science Classroom, Brianna Finnegan

This qualitative study examines how high school science teachers in an eastern Iowa high school utilize rubrics to assess students’ claims, evidence, and reasoning (CER) in the science classroom. The research investigates the methodology teachers employ in assessing student proficiency using their own rubrics they have created. Data were collected through think-aloud interviews with participating teachers as they evaluated and scored CER examples. Analysis of interview data involved inductive coding to identify common themes and categories, shedding light on teacher’s scoring practices, rubric construction, and perceptions of student proficiency and rubric validity.

Over forty thousand people die in motor vehicle crashes in the United States each year, and over two million are injured. The careful deployment of driving automation systems could prevent many of these deaths and injuries, but only if it is accompanied by effective regulation. Conventional vehicle safety standards are inadequate because they can only test how technology performs in a controlled environment. To assess the safety of a driving automation system, regulators must observe how it performs in a range of unpredictable, real world edge cases. In Mortgage Corp. of the South v. Bozeman (2023), the Eleventh Circuit Court of Appeals ruled that a confirmed chapter 13 plan was unworthy of res judicata respect. In so ruling, it held itself not bound by the Supreme Court’s super-finality opinion in United Student Aid Funds v. Espinosa. The Eleventh Circuit thought that it was preventing the chapter 13 plan from “murdering” the home mortgage. In reality, the plan was lawful and upheld payment in full of the mortgage. Seasonal prey abundance can drive predatory fishes to aggregate in areas of high prey density. This project aimed to determine whether Walleye (Sander vitreus) exhibit an aggregative predation response to larval White Sturgeon (Acipenser transmontanus) drifts in the Lake Roosevelt system which is a reservoir of the Columbia River in Washington State. Populations of sturgeon are threatened worldwide, and are in need of conservation research. Walleye are a popular nonnative piscivorous game fish that were accidentally or illegally introduced to Lake Roosevelt in the 1950’s. Poor feeding system hygiene may contribute to uncontrolled spontaneous fermentation in liquid pig feed and its associated undesirable effects. This study aimed to determine the effects of an intensive sanitisation programme in a grow-finisher liquid feeding system by monitoring microbiological and physico-chemical parameters of liquid feed and microbial colonisation of the feeding system surfaces. The sanitisation programme involved a combination of physical and chemical cleaning between batches of grow-finisher pigs, combined with nightly rinsing of the system with an organic acid blend. Judicial balancing has been subjected to a standard list of objections for decades, without anyone's offering a comprehensive and persuasive response. This Article fills that gap. Balancing is not embedded in an invidious instrumentalism, such as utilitarianism, that saps law of its moral salience; it does not depend on the quantification or commensuration of manifestly qualitative legal interests; it is not arbitrary, result-oriented, or mere opinion; it does not invade the province of the legislature; and--most importantly--it does not risk balancing constitutional rights away by treating them as mere interests.

Under modern Supreme Court jurisprudence, the First Amendment ordinarily imposes no heightened standard of review upon neutral laws of general applicability that coincidentally burden the free exercise of religion. To relieve or minimize this burden, however, lawmakers are generally free to promulgate exemptions from or accommodations to such laws for the benefit of religious adherents. Such exemptions and accommodations are common.

Purpose: To evaluate and compare oral health and behavior scores at the first dental visit and dental treatment need using general anesthesia/sedation (GA/S) of children with systemic diseases (SD) and healthy children.

Methods: Data were obtained from healthy children (n = 87) and children with SD (n = 79), aged 4 to 6 years, presenting to a hospital dental clinic for a first dental examination. The total number of decayed, missing and filled teeth (dmft), dental behavior score using Frankl Scale, and dental treatment need using GA/S were recorded.
