Exacting Assessments: Sheetz And The Problem Of Stategraft, Christopher Serkin

In the spring of 2024, the United States Supreme Court decided Sheetz v. County of El Dorado. The case resolved a long-standing question: whether the constitutional rules applying to ad hoc development exactions also apply to legislated exactions. They do. It is an important case, and one that may reconfigure the financing of municipal infrastructure. This Essay examines the case through the lens of Professor Bernadette Atuahene's concept of "stategraft," or the government illegally using its regulatory power to raise money from the poor and politically powerless. The theme of this Symposium takes me back more than thirty years to work I did on corporations and human capital at the Brookings Institution in the 1990s. Although I have been on the faculty of law schools since 2000, I am not a lawyer, and in fact, never went to law school. Big data have become increasingly important for policymakers and scientists but have yet to be employed for the development of spatially specific groundwater contamination indices or protecting human and environmental health. The current study sought to develop a series of indices via analyses of three variables: Non-E. coli coliform (NEC) concentration, E. coli concentration, and the calculated NEC:E. coli concentration ratio. A large microbial water quality dataset comprising 1,104,094 samples collected from 292,638 Ontarian wells between 2010 and 2021 was used. In Ontario, monitoring, maintenance, and treatment of private drinking systems (e.g. wells) are the responsibility of the well owner. Fecal contamination of drinking water threatens public health, particularly in rural communities which are often fully reliant on unregulated private groundwater as a primary drinking water source. Private well users face a higher risk of acute gastrointestinal illness compared to those served by municipally operated systems (Murphy et al., 2016). Private well owners in Ontario are responsible for maintaining their wells and monitoring the quality of their well water supplies. Protective actions including well maintenance, treatment and regular water quality testing are crucial in preventing well water contamination and reducing exposure to waterborne pathogens, however participation rates are low. The current study sought to explore knowledge, perceptions, and behaviours among private well owners in two communities in southeastern Ontario (i.e., Town of Greater Napanee and Stone Mills Township) and contextualize relationships between motivators and barriers to undertaking protective actions. In Students for Fair Admissions, Inc. v. President & Fellows of Harvard College, the Supreme Court considered voluminous evidence that Harvard discriminated against Asian Americans to keep the racial composition of its student body similar year after year. The Court held that Harvard engaged in unlawful discrimination, providing clarity to an area of the law that was filled with ambiguities and self-contradictions. The Court’s decision made clear that discrimination in favor of some racial groups necessarily inflicts discriminatory, race-based harms on others.

The rise of social media in the twenty-first century has led to multi-million-dollar careers for influencers, adults, and children alike. Similarly, the rise of child influencers, often colloquially coined as “kidfluencers,” have raised legal issues because kidfluencers are currently unprotected by child labor laws. The Coogan Law, enacted in 1939 to protect child performers in California and similar laws across the United States do not currently apply to kidfluencers. This places kidfluencers at a severe risk of having their financial earnings squandered by their parents or guardians managing their funds.

The global population continues to increase, which drives up demand for broiler meat. Furthermore, the production cycle's duration and the decisions made regarding broiler marketing are important factors, along with productivity and profitability. In this study, the effects of different marketing ages (MA) on carcass characteristics, economic indicators, and broiler chicken production were investigated. A total of 200 male, one-day-old chick Cobb-500 broilers were used. The chicks were divided at random into four equal groups of five replicates. Intestinal healing normally proceeds through three stages: the inflammatory, proliferative, and maturation stages. Dehiscence, a disastrous outcome of intestinal anastomosis surgery, usually happens during the inflammatory stage of recovery, when the anastomotic technique (suture or staple line) has the greatest influence on the biomechanical strength of the anastomosis. Because of the severe systemic abnormalities and financial load brought on by septic peritonitis and the need for a second surgery, the ensuing septic peritonitis is linked to an astounding morbidity rate of up to 85%.

Objective: To study the molecular characterization of three virulence genes and phenotypic detection of extended spectrum beta-lactam-producing enzymes in Proteus mirabilis isolates from fish in the Federal Capital Territory (FCT).

Design: cross-sectional study.

Animal: A total of 400 fish were purchased from various markets and sites in the Federal Capital Territory. Thirteen (32.5%) P. mirabilis isolates were obtained. This study used amoxicillin with clavulanate and ceftazidime, a third-generation cephalosporin antibiotics, to treat all phenotypically typed isolates utilizing Extended Spectrum Beta-Lactam (ESBL). Background: investigated the anatomical features and histological structures of the brain of adult common carp. In addition, these features were compared with those of other types of fish.

Methods: Adult fish (8- 18 M) were collected, their gross anatomical features were inspected; and small specimens from different brain parts were fixed, sectioned, stained, and histologically examined.

Results: In the common carp, the olfactory bulb was round, somewhat tiny, and connected to the telencephalon by a very long, thin olfactory tract. The Roberts Court holds a well-earned reputation for overturning Supreme Court precedent regardless of the long-standing nature of the case. The Roberts Court knows how to overrule precedent. In Students for Fair Admissions v. Harvard (SFFA), the Court’s majority opinion never intimates that it overrules Grutter v. Bollinger, the Court’s leading opinion permitting race-based affirmative action in college admissions. Instead, the Roberts Court applied Grutter as authoritative to hold certain affirmative action programs entailing racial preferences violative of the Constitution.
