The Price Of Criminal Law, Russell M. Gold Jan 2024

The Price Of Criminal Law, Russell M. Gold

Articles

Should tax dollars pay for more criminal law, better public schools, or a new community center? Different counties will answer the question differently, but facing these tradeoffs is profoundly important to democratic governance. Nonetheless, because the criminal legal system diffuses power and hides and offioads costs, officials and voters do not have to honestly consider that question. These structural features place a hidden thumb on the scale that gives counties more criminal enforcement than they pay for. That is a problem. Too much enforcement is particularly pernicious in criminal law: Incarceration inflicts tremendous suffering, especially in poor communities of color. …

Repurposed Energy, Hannah Jacobs Wiseman, Alexandra Klass Jan 2024

Repurposed Energy, Hannah Jacobs Wiseman, Alexandra Klass

Faculty Scholarship

Wildfires, weather extremes, and other conditions induced partially by climate change add urgency to the project of accelerating the clean energy transition from fossil fuels to zero-carbon energy infrastructure. Yet the hurdles to accomplishing such a massive industrial-scale transition are daunting. Indeed, large renewable energy generation projects regularly face denials or project-killing delays across the United States. This Article proposes a national policy to channel the bulk of new clean energy projects to targeted categories of both rural lands and urban, post-industrial lands that we define collectively as “repurposed energy” sites. Such lands will consist of marginal farmland, abandoned coal …

Transgender Students And The First Amendment, Dara Purvis Jan 2024

Transgender Students And The First Amendment, Dara Purvis

Faculty Scholarship

Suppose a transgender child experiences teasing and harassment from their classmates, whose hostile reactions interrupt the school day. School administrators tell the transgender child that, in order to allow educational activities to continue, they must dress in more gender-neutral clothing, ideally cionsistent with the sex they were assigned at birth. The student's parents protest, arguing that their child's clothing is speech that expresses their gender identity. The school points to Tinker v. Des Moines, allowing suppression of student speech where it creates a material disruption, as well as recent legislation characterizing discussion of gender identity as lewd and obscene. …

Strengthening Pre-Dental Ethics Education, Rivers Singley B.S., Alex Ha B.S.

Journal of the American College of Dentists

The ethics and professionalism core, which forms the basis of all clinical learning and development, is a vital component of dental education. As a result, ethics and professionalism courses are included in the curricula of dental schools nationwide. But are dental ethics taught before dental school, especially in the context of predental communities, and if so, in what way? In addition to explaining why and how the introduction of The ADA Principles of Ethics and Code of Conduct (the ADA code) might be better rooted at an earlier stage of learning for those interested in pursuing a career in dentistry, …

Inequitable Organ Allocation, Benjamin Mcmichael Jan 2024

Inequitable Organ Allocation, Benjamin Mcmichael

Articles

Seventeen people die every day in the United States waiting for an organ transplant, and over 100,000 people are currently on waitlists to receive a donated organ. Given these stark numbers, the allocation policies governing who receives donated organs are both critically important and hotly debated. Congress passed the National Organ Transplant Act in 1984 with the goal of eliminating markets for organs and the promise of equitable access to transplants without regard to geography or socioeconomic status. Despite these laudable goals, recent developments in organ allocation policy have led to multiple lawsuits, congressional inquiries, and an expose in the …

Implementation And Assessment Of Highway Intrusion Technologies, Sogand Hasanzadeh, Behzad Esmaeili, Kyeongsuk Lee, Hrishikesh Pokharkar, Shiva Pooladvand, Woei-Chyi Chang

JTRP Technical Reports

Highway workers face dangers from distracted drivers and challenging work zones, which results in thousands of incidents annually in the U.S. Traditional safety measures, though beneficial, highlight a need for advanced intrusion alert technologies. While many state DOTs are exploring these technologies, research gaps persist regarding their effectiveness in alerting drivers and workers. This study aims to evaluate the efficiency and implications of four commercial intrusion technologies, with a focus on drivers’ and workers’ cognition and response. Results offer practical guidelines and a decision-making tool to assist INDOT in selecting the optimal technology. The ultimate goal is to significantly reduce …

Leveraging Lidar Intensity To Evaluate Roadway Pavement Marking Retroreflectivity, Gregory L. Brinster, Mona Hodaei, Aser M. Eissa, Zechariah Deloach, Joseph E. Bruno, Ayman Habib, Darcy M. Bullock Jan 2024

Leveraging Lidar Intensity To Evaluate Roadway Pavement Marking Retroreflectivity, Gregory L. Brinster, Mona Hodaei, Aser M. Eissa, Zechariah Deloach, Joseph E. Bruno, Ayman Habib, Darcy M. Bullock

JTRP Technical Reports

Clearly visible lane markings are important for all road users, particularly autonomous vehicles. In general, nighttime retroreflectivity is one of the most challenging marking visibility characteristics for agencies to monitor and maintain, particularly in cold weather climates when agency snowplows remove retroreflective material during winter operations. Traditional surface-applied paint and glass beads typically only last one season in climates with routine snowplow activity. Recently, transportation agencies in cold weather climates have begun deploying improved recessed, durable pavement markings that can last several years and have very high retroreflective properties. These recessed durable markings are typically either epoxy, thermoplastic or preformed …

The Nebulous Binaries Of C.S. Lewis' Till We Have Faces, Amantia Menalla Jan 2024

The Nebulous Binaries Of C.S. Lewis' Till We Have Faces, Amantia Menalla

Honors Undergraduate Theses

Much of C.S. Lewis’ novel Till We Have Faces can be examined through one of two binaries. The tension between rationality, or reason, and spirituality, or religion, is one of the core facets of both the text and its main character, Orual. Orual feels the pull of both ideas and thus spends most of the novel in a nebulous space between them. This tension is further complicated by the space between the feminine and the masculine which she also inhabits. By covering her face and body, Orual de-emphasizes her feminine identity and takes on a masculine role, dressing as a …

The Barriers To Adult Play In Graduate Students, Rosalind Nolde, Sabrina Solis, Catherine Salomon, T Monelli

Occupational Therapy | MSOT Capstone Projects

The purpose of this study is to expand the knowledge of barriers to play for graduate students. The research question asked, what are the barriers to play experienced by graduate students? Play is a complex term that is unique to the individual. Although subjective, existing literature gives suggestions as to what play can mean or feel like to the individual participating. Brown (2009), notes that the definition of play should be experienced rather than defined as it is distinctive to each individual. Van Vleet and Feeney (2015) describe play as being the purpose of amusement, fun or to have energetic, …

Bayesian Estimation Of Hierarchical Linear Models From Incomplete Data: Cluster-Level Non-Linear Effects And Small Sample Sizes, Dongho Shin Jan 2024

Bayesian Estimation Of Hierarchical Linear Models From Incomplete Data: Cluster-Level Non-Linear Effects And Small Sample Sizes, Dongho Shin

Theses and Dissertations

We consider Bayesian estimation of a hierarchical linear model (HLM) from small sample sizes. The continuous response Y and covariates C are partially observed and assumed missing at random. With C having linear effects, the HLM may be efficiently estimated by available methods. When C includes cluster-level covariates having interactive or other nonlinear effects given small sample sizes, however, maximum likelihood estimation is suboptimal, and existing Gibbs samplers are based on a Bayesian joint distribution compatible with the HLM, but impute missing values of C by a Metropolis algorithm via a proposal density having a constant variance while the target …

“Just Holding That Space”: Using Culturally Relevant Pedagogy To Create Counterspaces For Black College Students In Aanapisi/Hsi Classrooms, Nicholas B. Lacy, Yea-Wen Chen, Damariyé L. Smith Jan 2024

“Just Holding That Space”: Using Culturally Relevant Pedagogy To Create Counterspaces For Black College Students In Aanapisi/Hsi Classrooms, Nicholas B. Lacy, Yea-Wen Chen, Damariyé L. Smith

Journal of Communication Pedagogy

Black college students continue to face the specter of anti-Blackness which creates additional barriers to success and flourishing in higher education. This study investigates how instructors in higher education can provide racial equity to Black students in AANAPISI/HSI classrooms through counterspaces. We use culturally relevant pedagogy to investigate the experiences of 21 Black college students at an AANAPISI/HSI to understand better how higher education instructors can utilize counterspaces, places where Black college students can challenge dominant discourses and create a collegial learning environment. We identified three counterspace themes: (1) Mitigate Eurocentric Pedagogy, (2) Employ Black and Critical Scholarship, and (3) …

Intergenerational Connections: Us College Students’ Attitudes And Expectations Toward Older Adults And Aging In An Online Critical Community Engagement Project, Sandra L. Faulkner, Madison Pollino, Jaclyn Shetterly, Wendy K. Watson

Journal of Communication Pedagogy

We present a critically focused, semester-long community engagement project entitled Intergenerational Connections as a form of critical interpersonal and family communication pedagogy (CIFCP). The project utilized Zoom to connect small groups of undergraduate students in the US enrolled in a course on relational communication with older adults in a long-term care facility to dialogue about close relationships. We were interested in how dialogue across generations maintained or altered students’ attitudes and expectations about communicating with older adults and analyzed student reflections before, during, and after the dialogues using a turning point analysis. The study was framed using Social Identity Theory …

You Don’T Have To Be Their Best Friend: Complicating The Instructor-Student Relationship Through A Mixed-Method Typology, Jessalyn I. Vallade, Kyle Rudick Jan 2024

You Don’T Have To Be Their Best Friend: Complicating The Instructor-Student Relationship Through A Mixed-Method Typology, Jessalyn I. Vallade, Kyle Rudick

Journal of Communication Pedagogy

The purpose of this study was to explore the nuances of instructor-student relationships with a nationally representative sample of students. Participants were randomly assigned to describe relationships with their best, worst, and/or last instructor and rate their satisfaction with each relationship, and the level of closeness with the instructor. Coding of student descriptions revealed 13 themes, organized into six pairs of constructive/destructive relationship anchors and one neutral category (Professional Relationship). Importantly, professional relationships were not as close as constructive relationships but were equally satisfying, indicating the closeness in instructor-student relationships has diminishing returns. Results are discussed in the context of …

Post-Truth's Effect On The Brain And The Future Self: A Critical Communication Pedagogy Response, David H. Kahl Jr. Jan 2024

Post-Truth's Effect On The Brain And The Future Self: A Critical Communication Pedagogy Response, David H. Kahl Jr.

Journal of Communication Pedagogy

The university was created for the critical examination of ideas to seek truth. However, the proliferation of post-truth messages has made this goal more difficult to reach, creating an important communication pedagogy problem. Hegemonic forces create post-truth messages to mislead people and play to their existing beliefs in order to maintain and advance power. Post-truth messages are particularly effective because they cause cognitive overload and temporal discounting. Critical communication pedagogy (CCP) is a means by which instructors and students can evaluate post-truth messages. CCP allows for dialogue to reduce the cognitive issues that post-truth messages cause and allow for the …

#Politicalcommunicationsowhite: A Call For Considering Race In The Undergraduate Political Communication Course, Ant Woodall, Lindsey Meeks Jan 2024

#Politicalcommunicationsowhite: A Call For Considering Race In The Undergraduate Political Communication Course, Ant Woodall, Lindsey Meeks

Journal of Communication Pedagogy

The field of communication has been working to reconcile its historic omission of race from research and pedagogy. The subfield of political communication has begun this process in its research but has yet to consider the implications of race missing from pedagogy. This essay offers an argument for including race in the political communication course, in the form of more focus on race in course content and more work by scholars of color. We offer reasons for these inclusions, ways for instructors to begin this incorporation, and what considerations instructors must be mindful of throughout the process.
