This Article examines the evidence of original intent behind the Second Amendment, which Justice Antonin Scalia ignored in District of Columbia v. Heller. It suggests that the adoption of the Second Amendment was motivated by states' concerns about federal control over state and local militias. Thus, it was intended as a state’s rights amendment before Justice Scalia disregarded the opening clause. The Article then examines the results of Justice Scalia’s opinion in terms of a widespread increasing homicide rate in a nation with more firearms in circulation than the total population. The global ecological crisis has posed unprecedented survival challenges to human being. Consequently, ecological issues have naturally become central concerns in philosophy. From the methodological perspective of constructive engagement in comparative philosophy, we have chosen to compare the ecological thoughts of two thinkers—Karl Marx and Lao Zi (老子)—who are separated by vast spans of time and cultural tradition. We argue that Karl Marx holds a mild anthropocentric ecological view, while Lao Zi holds a transcendental ecological view. In recent years, comparative scholars and commentators have attempted to find ways to best characterize the opposition between Confucianism and Legalism. For example, it has been argued that Confucianism exemplifies “idealism”, whereas Legalism is a version of “realism” and that their dispute can be construed as a clash between the broader philosophical frameworks of idealism and realism. The Russian parliament authorized the use of military force in Ukraine in March, 2014, ostensibly to protect “Russian interests,” and soon thereafter, Russia seized the entire Crimean region from Ukraine and annexed it into the Russian Federation. The United States and Europe have refused military intervention in the region, instead relying on legal measures, or “lawfare,” including economic sanctions against both Russian nationals and Russian businesses, including government entities. Economic sanctions, which have become the United States’ foreign policy tool of choice, often have unintended consequences. The Fourth Amendment to the United States Constitution provides the people the right to be “secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,” which means the people have the right to freedom from warrantless government intrusion, or trespass, into their persons, houses, papers, and effects. Most people are familiar with persons, houses and papers, but the term “effects” is unfamiliar to many. Federal climate policy in the United States is still in its infancy and is in large part characterized by efforts to reach a consensus on the very existence and causality of climate change. This has stemmed from a sociopolitical rift within the country, with the objectivity and usefulness of science attacked by detractors. Scientists who are most qualified to defend their methods and provide information to policymakers rarely have an institutional incentive to share this knowledge, but should be encouraged to communicate their findings to the public, especially those who receive public funding. This paper argues that the proliferation of geographical inquiry into popular culture as a prism for understanding geopolitical processes can benefit from more sustained engagement with psychoanalytic theory, particularly the work of Melanie Klein . Klein’s account of guilt and the urge to make reparation as both central to the development of conscience and profoundly unevenly distributed contributes to a critique of dominant, uneven geographies of guilt and encourages a nuanced approach to guilt’s potential ethical implications . Though recent research into civil wars has significantly increased the degree of study into non-conflict activities of rebel groups, particularly in rebel governance, rebel groups have not yet been seen as ontological security providers, capable of developing and reinstating some form of normalcy for civilian populations. The fast sermon is an important and overlooked genre in the literary history of colonial New England, one which complicates theories about American puritanism underwritten by the imprecise narrative construct of the jeremiad. This thesis will argue that preachers used fast sermons to shape their communities, respond to major events, and provide competing interpretations of Congregationalist doctrine throughout the seventeenth century. Using the Americans with Disabilities Act (ADA) as a unifying text, my dissertation explores the relationship between cultural production and the neoliberal crafting of humanity, the term I use to describe how social dimensions—including the construction of the textual and material body—become reorganized and governed through market relations. While many disability scholars and activists frame the ADA’s failures through social misunderstandings of disability, few have seriously attended to the limits of the ADA as a neoliberal fusing of economic governance and classical liberal individualism.

This dissertation is the first to trace the institutional development of the IRI’s passive defense strategy and its two Islamic Revolutionary Guards Corps (IRGC)-led executive bodies: the Permanent Committee for Passive Defense (PCPD) and the National Passive Defense Organization (NPDO). This dissertation explores the politics of gender, labor, national security, and social class in India through an examination of a coercive domestic labor regime in the Indian Army. Previous scholarship has focused on the neoliberal state-sponsored global care chains and immigrant women workers from formerly colonized nations, many in Asia, catering to wealthy ‘civilian’ households in the global North. However, little is known about the roles, relationalities, and infrastructures of servitude, inhabited primarily by racialized men, that endure within the domestic life of postcolonial state institutions long after the retreat of European colonial regimes. Abstract This dissertation is an interdisciplinary study of human adaptation to high altitude. High altitude environments are known for being very difficult places for humans to live, for several reasons, but especially because they are characterized by low ambient oxygen tension, i.e., hypoxia. In spite of these challenges, there are several human populations that have lived at high altitude for tens of thousands of years. The two best-characterized highland populations, Andeans and Tibetans, have both been shown to perform better at high altitude than their lowland counterparts. The purpose of the study was to examine the race and gender differences among retired enlisted service members in work self-determination regarding the decision to reenlist. Existing research indicated little to no information regarding these factors. The independent variables are race and gender, and the dependent variable is work self-determination in the decision-making to re-enlist. This research utilized an adapted version of the Work Extrinsic and Intrinsic Motivation Scale, an 18-item assessment of work motivation theoretically grounded in self-determination theory. Career progression of U.S. military officers into the senior officer corps remains a difficult objective. Current research focuses on the lack of diversity in the senior officer corps and systematic factors inhibiting officers from promotions. This study was grounded in McCrae and Costa’s five-factor model of personality, to examine U.S. military officers’ personality characteristics and their relation to promotion while moderating for race. This quantitative study used binary logistical regression of survey data to establish whether the personality characteristics of openness, conscientiousness, extraversion, agreeableness, and neuroticism predict promotion. Arctic-based ghost stories possess a particular environmental flavor and, focusing on specific traumas created by late-stage capitalism and extractive colonialism, reveal crimes that have been buried, with the ghost returning to demand retribution. Beyond the traditional revenant, ghostly behavior may also be attributed to living people or nonhuman objects that work to uncover hidden crimes and gain justice or revenge. Tsitsi Dangarembga’s second novel in her Nervous Conditions trilogy, The Book of Not (2006) emphasizes the disabling nature of colonial domination and terror through pain and violence inflicted on the body and the mind. Through the use of Frantz Fanon’s colonial and post-colonial theory and Homi Bhabha’s concept of colonial mimicry the critical nature of Tambudzai—the main protagonist—position in the novel becomes apparent. During the Southern Campaign of the American Revolution, the British military established a series of fortified posts to secure the South Carolina backcountry. This chain of posts was comprised of at least 25 fortified positions that extended in an east-west arc from Georgetown, South Carolina, at the mouth of the Pee Dee River to the village of Augusta, Georgia, on the Savannah River. This dissertation examines the British fortification strategy in the South Carolina backcountry during the Southern Campaign from the anthropological perspective of infrastructure theory.
