Neither Covered Nor Excluded: Impacts Of Speciesism On Aquatic Animal Experimentation Under The Animal Welfare Act, Sophia Pastorini Jan 2024

Neither Covered Nor Excluded: Impacts Of Speciesism On Aquatic Animal Experimentation Under The Animal Welfare Act, Sophia Pastorini

Animal Law Review

Despite significant scientific evidence affirming their capacity for pain and pleasure, aquatic animals in laboratory settings receive limited federal protection. The Animal Welfare Act leaves aquatic animals entirely adrift; they are neither included in the list of protected animals nor explicitly excluded. They inhabit a realm so marginalized that they are not even mentioned in the Act. The urgency of safeguarding aquatic animal welfare is a matter of moral imperative, scientific integrity, and justice. By employing a multifaceted approach that combines ethical considerations and legal frameworks, this Article seeks to catalyze change in the treatment of aquatic animals in research …

De-Myth-Ifying Laboratory Animal Law: The Truth Behind Four Commonly Misunderstood Facts In Laboratory Animal Welfare Law, Rebecca Critser Jan 2024

De-Myth-Ifying Laboratory Animal Law: The Truth Behind Four Commonly Misunderstood Facts In Laboratory Animal Welfare Law, Rebecca Critser

Animal Law Review

The subspeciality of laboratory animal law presents unique difficulties because it requires familiarity with two highly specialized fields: law and science. Consequently, it is not surprising that some aspects of laboratory animal law have been misunderstood. This Article highlights four such misunderstandings surrounding laboratory animal law and provides an explanation of the truth behind each myth. The myths discussed include: (1) the AWA is the only federal law applicable to laboratory animals; (2) states are preempted from regulating the laboratory animal space; (3) birds, rats, and mice are not covered under federal law; and (4) the 3Rs are explicitly required …

Pinky Swear? We'll Be Together Forever: Queering Girlhood, Sophie Kim Jan 2024

Pinky Swear? We'll Be Together Forever: Queering Girlhood, Sophie Kim

Scripps Senior Theses

Throughout popular culture, friendships between girls are often portrayed as emotionally intimate partnerships. The fact that these relationships are rarely questioned about the possibility for attraction, while encounters between boys and girls often are, demonstrates the hegemony of the heteropatriarchal social order. The prevalence of passionate, partnership-like friendships among girls within mainstream society will be analyzed through a queer lens, positing that common conceptions of girlhood are inherently queer regardless of the presence of attraction. By conducting open-ended, semi-structured interviews, this qualitative research study aims to ask: how do young adults interpret their experiences with closeness in relationships with other …

Cross-Border Data Regulatory Frameworks: Opportunities, Challenges, And A Future- Forward Agenda, Andrew D. Mitchell, Neha Mishra Jan 2024

Cross-Border Data Regulatory Frameworks: Opportunities, Challenges, And A Future- Forward Agenda, Andrew D. Mitchell, Neha Mishra

Fordham Intellectual Property, Media and Entertainment Law Journal

This Article evaluates the existing regulatory framework for cross-border data flows across Bahrain, Djibouti, Jordan, Kuwait, Morocco, Nigeria, Oman, Pakistan, Rwanda, and Saudi Arabia. A common factor among these countries is that they are members of the Digital Cooperation Organization (“DCO”). It considers how these countries have devised laws, regulations, and policies on cross-border data flows to enable digital trade, and how these instruments promote the growth of a robust digital economy, both domestically and internationally. The Article then offers policy recommendations for DCO members to consider in developing relevant laws and regulations on data flows.

These …

On The Legality Of Defrauding The Public, Wes Henricksen Jan 2024

On The Legality Of Defrauding The Public, Wes Henricksen

Marquette Law Review

Speech used to intentionally mislead others to gain a tangible benefit while causing harm to the one deceived or to others is generally labeled “fraud.” This term is used in both legal and nonlegal contexts. Where speech used to defraud satisfies the elements of a tort or a crime, it becomes “actionable fraud.” Categories of actionable fraud include common law deceit, securities fraud, and wire fraud. But taken together, these laws address harmful dishonesty in an inconsistent manner. While they broadly prohibit deceiving individual victims, they often allow deceiving the public at large. As a result, it is often lawful …

An Impossible Burden: A Comment Supporting Revision Of Wisconsin’S Parenthood As A Result Of Sexual Assault Statute, Gabriella Humblet Jan 2024

An Impossible Burden: A Comment Supporting Revision Of Wisconsin’S Parenthood As A Result Of Sexual Assault Statute, Gabriella Humblet

Marquette Law Review

The Wisconsin statute that regulates termination of parental rights (TPR) as a result of sexual assault is untenable and in need of revision. The current statute is far too stringent to be practically implemented, which is especially true in involuntary TPR proceedings.

This Comment seeks to explain why Wisconsin’s current statute for TPR as a result of sexual assault is flawed. First, this Comment gives background by detailing rape statistics in the United States to explain why the possibility for TPR exists when a conception results from a sexual assault. Second, Wisconsin adopts a position that is at odds with …

A need exists to better understand the relationships between COVID-19, coping behaviors, physical activity and stress, and COVID-19’s impact on way of life. A cross-sectional study design was used to examine adult physical activity, hope, depression, anxiety, and coping status by gender during the COVID-19 pandemic, and to determine the impact of these variables on the coping process. The study also examined the effect of gender on the relation between physical activity and dependent variables. A global survey instrument was used in this study, including 1,400 Turkish adults. This study identified significant gender-based differences regarding physical activity, hope, depression, anxiety, …

Adaptive Multi-Label Classification On Drifting Data Streams, Martha Roseberry Jan 2024

Adaptive Multi-Label Classification On Drifting Data Streams, Martha Roseberry

Theses and Dissertations

Drifting data streams and multi-label data are both challenging problems. When multi-label data arrives as a stream, the challenges of both problems must be addressed along with additional challenges unique to the combined problem. Algorithms must be fast and flexible, able to match both the speed and evolving nature of the stream. We propose four methods for learning from multi-label drifting data streams. First, a multi-label k Nearest Neighbors with Self Adjusting Memory (ML-SAM-kNN) exploits short- and long-term memories to predict the current and evolving states of the data stream. Second, a punitive k nearest neighbors algorithm with a self-adjusting …

Aristotle’S Poetics: A Biologist’S Approach To Tragedy, James J. Clauss Jan 2024

Aristotle’S Poetics: A Biologist’S Approach To Tragedy, James J. Clauss

Honors in Practice Online Archive

The paper describes a class that introduces Aristotle’s Poetics from the perspective of his scientific, especially biological, treatises: a systematic analysis of what emotions a tragedy is supposed to elicit and how they are resolved by the audience (homoeopathy). Students read 11 ancient and modern plays and view one film, observing whether his theory of the Tragic explains our responses. The final project includes the writing of a tragic story (not a drama) evincing the students’ own understanding of the Tragic based on the readings.

Forming Civic Virtue Through An Honors Seminar Focused On Local Civil Rights History, Lynn Stallings, Aaron D. Cobb

Honors in Practice Online Archive

Citizenship and related values are common elements in the missions of honors programs. Our goal was to design a junior honors seminar with an intentional focus on developing citizenship, civic identity, and civic virtues through engagement with the challenging history of our city, Montgomery, Alabama. The course employed four evidence-based strategies for character formation in higher education: reflection on personal experience, engagement with virtuous exemplars, dialogue that increases virtue literacy, and awareness of situational variables. This paper describes our focus on learning about Civil Rights history to develop citizenship and civic virtues, the course’s impact on students, our reflections on …

Third-Year Medical College Rotations For Premedical Honors Program Undergraduates, Harvey G. Stenger Jr., William L. Ziegler

Honors in Practice Online Archive

Honors programs typically enroll many students interested in the healthcare field, and honors administrators and faculty do their best to ensure that those students’ dreams are fulfilled. With Medical Doctor (MD) program acceptance rates averaging just 6.1%, students need a standout application. Experience has shown that getting accepted into a medical school is more than earning a great GPA and excelling on the MCAT exam; it also requires convincing a committee of professionals that an applicant has the right personal qualities and work ethic to succeed in the field of medicine, and applicants need to highlight their clinical experience as …

A Meaningful Life: The Future Of Juvenile Justice In Washington After Anderson, Samuel Coren Jan 2024

A Meaningful Life: The Future Of Juvenile Justice In Washington After Anderson, Samuel Coren

Seattle University Law Review

Until 2022, Washington’s line of juvenile sentencing jurisprudence gave every indication of continuing along the course set by Miller v. Alabama, as Washington courts recognized that “children are different” and should not be subjected to the harshest punishments available in the criminal legal system. State v. Anderson marked a stark diversion from this course. In upholding the constitutionality of a de facto life sentence for a juvenile, the Washington Supreme Court all but rejected the well-established scientific consensus surrounding juvenile brain development and implicit racial bias. Whether this decision reflects a minor aberration or a broader trend in the court’s …

2024 Resident Scholar Reflection: Elizabeth Groppe, Elizabeth Groppe

Marian Fellowships and Other Sponsored Research in the Marian Library

One of my favorite places to spend a summer Ohio morning is in our family garden of lavender bee balm and ripening cherry tomatoes. But in the summer of 2024, I deepened my appreciation for gardening in the Marian Library as a Marian Resident Scholar. Each day spent in the reading room, I admired a display of some gorgeous Marian artwork including images of Marian flowers drawn by Brother A. Joseph Barrish, S.M.; a botanical rosary by Katrina Rose Harrington; and a painting of Mary encircled by echinacea and monarch butterflies (inset image) by Ann Marie Coolick and Megan Coonelly. …
