The California Bridge Model For Emergency Department-Initiated Medication-Assisted Treatment For Opioid Use Disorder: Adaptations For Perinatal Hospital Services, Devin C. Thomas Jan 2024

The California Bridge Model For Emergency Department-Initiated Medication-Assisted Treatment For Opioid Use Disorder: Adaptations For Perinatal Hospital Services, Devin C. Thomas

Yale School of Nursing Digital Theses

Background: Poor access to gender-specific, pregnancy-focused medication-assisted treatment for perinatal opioid use disorder greatly contributes to adverse outcomes for pregnant patients, infants, and society, at large. It is well established that Emergency Department-initiated pharmacotherapy for opioid use disorder is safe, effective, and can be rapidly adopted by hospital systems to improve access to care for people who misuse opioids. Like the Emergency Department, perinatal hospital services are well positioned to serve as critical access points in the treatment of perinatal opioid use disorder. However, concerns such as lack of training, workflow inefficiencies, and bias act as barriers to co-located, integrated …

Shifting Blame And Gendered Differences: A News Media Study Of The Characterization Of Police Sexual Violence, Brittany Nieman Jan 2024

Shifting Blame And Gendered Differences: A News Media Study Of The Characterization Of Police Sexual Violence, Brittany Nieman

Theses and Dissertations (Comprehensive)

This thesis offers a critical analysis of media representations of police sexual violence cases in Canada. This paper looks to fill the gap on media representations of police sexual violence cases and to contribute to long standing literature on gendered issues in policing. Symbolic interactionism, framing theory, and critical feminist ideologies make up the theoretical background for this work. Using Altheide and Schneiders (2012) Qualitative Document Analysis Process, a media analysis was conducted on 104 Canadian news articles revolving around police sexual violence cases occurring on Canadian policing services. This study primarily revealed a dichotomy in representations of the complainant …

Indigenous Wholistic Abolition: Visioning Indigenous Queer, Two-Spirit & Indigiqueer Futures, Giselle Dias Jan 2024

Indigenous Wholistic Abolition: Visioning Indigenous Queer, Two-Spirit & Indigiqueer Futures, Giselle Dias

Theses and Dissertations (Comprehensive)

As a queer Métis, activist and organizer in the field of prisoners’ rights, penal abolition, and transformative justice, I have been interested in learning about how Indigenous peoples’ relationship with Aki (Land) grounds abolition theory and guides the ways that I and other Indigenous abolitionists engage in abolition. As part of this process, I wanted to speak to other Indigenous queer, Two-Spirit, trans, non-binary, and/or Indigiqueer (Q2STNBI) people about their visions of abolition and abolitionist futures through a relational Land-based lens. Therefore, I used a methodology that centres Métis worldviews and community organizing and is grounded in the ethics of …

Care To Criminalization: How Adults With Lived Crossover Kid Experience Percieve Their Experiences In The Child Protection System And The Criminal Justice System, Clarissa Kurzawski Jan 2024

Care To Criminalization: How Adults With Lived Crossover Kid Experience Percieve Their Experiences In The Child Protection System And The Criminal Justice System, Clarissa Kurzawski

Theses and Dissertations (Comprehensive)

Crossover kids are youth who were/are in the child protection system and cross over into the juvenile/criminal justice system. Children who have been in the child protection system are 52% more likely to end up in the criminal justice system (Baidawi, 2020; Bateman, 2021; Turpel-Lafond, 2009). This creates a concerning trajectory for youth who are in the child protection system, through no fault of their own, because criminal justice involvement can follow them into adulthood. Children are entering a system of care that is criminalizing them and moving them into a system of custody. There has been scholarship using extant …

Virtual Justice?: An Analysis Of Access To Court For People Experiencing Homelessness, Kaitlin Humer Jan 2024

Virtual Justice?: An Analysis Of Access To Court For People Experiencing Homelessness, Kaitlin Humer

Theses and Dissertations (Comprehensive)

Homelessness in Canada remains a wicked social problem that often intersects with compounding forms of marginalization. The criminalization of homelessness and living life in the public sphere explain, in part, why this population is likely to interact with the criminal justice system. Following the onset of the pandemic, the courts were forced to modernize and embrace digital technologies to maintain operations. Now four years since these changes, there are no signs of turning back and the court system is continuing forward with a hybrid model. Despite this, there is minimal research on the impact of virtual court proceedings on people …

Impact Ipsa Loquitur: A Reverse Hand Rule For Consumer Finance, Susan Block-Lieb, Edward J. Janger

Faculty Scholarship

Algorithms in consumer finance can entrench, exacerbate, and conceal bias. This article considers the increased importance, in the age of algorithmic lending, of disparate impact analysis as a tool to combat predation and discrimination in consumer finance transactions. It explores the existing legal landscape and finds gaps in the relationship between discrimination and predatory lending doctrines. It then situates both disparate impact analysis and UDAAP doctrines within the broader context of balancing and burden-shifting rules in tort law and considers how this analysis might be tailored for the new algorithmic lending environment. We conclude that predatory discrimination permits consideration of …

Proportionalities, Youngjae Lee Jan 2024

Proportionalities, Youngjae Lee

Faculty Scholarship

"Proportionality" is ubiquitous. The idea that punishment should be proportional to crime is familiar in criminal law and has a lengthy history. But that is not the only place where one encounters the concept of proportionality in law and ethics. The idea of proportionality is important also in the self-defense context, where the right to defend oneself with force is limited by the principle of proportionality. Proportionality plays a role in the context of war, especially in the idea that the military advantage one side may draw from an attack must not be excessive in relation to the loss of …

Punishment And Resources, Mark D. White Jan 2024

Punishment And Resources, Mark D. White

Publications and Research

Philosophers of punishment have paid little attention to resource constraints, which have an undeniable impact on how various approaches to punishment work in the real world. It has fallen on economists, with their central focus on scarcity and opportunity cost, to analyze the resource demands of different philosophies of punishment. However, the utilitarian nature of mainstream economics limits the scope of economic theories of punishment to deterrence, which fits naturally into mathematical economic techniques, as opposed to retributivism, the principled nature of which resists quantification. This chapter explores the resource implications of punishment. It starts by identifying shortcomings of the …

Drug Addiction, Insanity, And Competency: How The Halimi Case Galvanizes A U.S.-Inspired Reform Of France's Criminal Responsibility System, Ruben Attia Jan 2024

Drug Addiction, Insanity, And Competency: How The Halimi Case Galvanizes A U.S.-Inspired Reform Of France's Criminal Responsibility System, Ruben Attia

Cardozo International & Comparative Law Review

The Halimi case, culminating in a verdict from the Court of Cassation in April 2021, has ignited intense and contentious debates on criminal responsibility, leading to a profound erosion of public trust in the French judicial system. This Note delves into the urgency of addressing the issues presented by Halimi and emphasizes the necessity for innovative approaches within the French legislative framework. Striking a delicate balance between permitting the trial of controversial cases and upholding the age-old moral duty of excluding the mentally insane from guilty verdicts, this Note compares the intricacies of criminal responsibility in France with those in …

Expanding Our Horizons: Reflections On A Compass Of Possibilities, Corinna Barrett Lain Jan 2024

Expanding Our Horizons: Reflections On A Compass Of Possibilities, Corinna Barrett Lain

Law Faculty Publications

Once in a great while, I read a piece of literature and know immediately that I am reading something special. I instinctively know that the author is renowned, and I know this without even knowing who wrote whatever it is that I am reading. The words are crisp and clear, and the ideas are so provocative that it is evident that something deeply meaningful has been created, something that people will be thinking about for a long time. Such is the case with Mireille Delmas-Marty’s last lecture at the Collège de France in 2011, recently translated to English, and accompanied …

Bias Notification Duty, Eldar Haber, Shai Stern Jan 2024

Bias Notification Duty, Eldar Haber, Shai Stern

Cardozo Arts & Entertainment Law Journal

Algorithms are often tainted with bias that could negatively affect subjects' lives in many aspects. But while policymakers and scholars tend to focus their attention on methods to fix the bias within the algorithm or its output, they neglect a crucial piece of the puzzle: when companies discover bias and fix it in the algorithmic output, they do so behind the scenes. While such a move might debias the output, society remains in the dark about its existence or how it might have affected the outcome. Society thus misses a unique opportunity to study social and cognitive biases that shape …

What Recent Scrutiny Surrounding New Jersey's Newborn Screening Program Is Missing: Comment On The Reproductive And Social Justice Issues The Program Illuminates, Dylan Blanchard Jan 2024

What Recent Scrutiny Surrounding New Jersey's Newborn Screening Program Is Missing: Comment On The Reproductive And Social Justice Issues The Program Illuminates, Dylan Blanchard

Cardozo Arts & Entertainment Law Journal

The note critiques New Jersey's Newborn Screening Program, highlighting its constitutional and social justice implications. While the program is a vital public health measure, its retention of newborn blood samples without informed consent and subsequent use by law enforcement raises significant Fourth Amendment concerns. The analysis argues that the program disproportionately impacts minorities and perpetuates systemic racism in the criminal legal system, as biometric data from these samples can be used to bypass probable cause requirements.

Language Barriers In The U.S. Legal System For Primarily Spanish Speakers: Attorney Perspectives And Potential Solutions For True Equal Access, Emma F. Kizer

Honors Program Theses

The U.S. legal system is difficult to navigate for anyone who is attempting to use it, but non-English-speaking individuals have a unique set of obstacles to overcome. Communicating and understanding legal jargon and processes can become increasingly strenuous when one does not speak English in a predominantly English system. This study is specifically focused on the barriers that Spanish-speaking clients face and potential ways to change the system in order to make the experiences of non-English speakers more accessible. By interviewing attorneys who work with both English and Spanish speaking clients, we gain insight into their perspective on issues they …

Gender Socialization And Social Media In College Students' Fear Of Crime, Ashlyn C. Miller Jan 2024

Gender Socialization And Social Media In College Students' Fear Of Crime, Ashlyn C. Miller

Honors Program Theses

The purpose of this study is to explore the relationship between gender (socialization), viewing crime related material on social media, and fear of crime experienced by college students. While violent crime rates have fallen, the majority of college students report levels of crime are increasing. Many individuals lack both knowledge and experience related to crime, leading media exposure to influence their levels of fear. Previous research has focused on television media related to fear of crime with little research on social media, the preferred media source of young adults. College students (n = 124) from a midwestern university completed a …

Information Provided By State Human Trafficking Websites: A Content Analysis, Brooklyn Dilley Jan 2024

Information Provided By State Human Trafficking Websites: A Content Analysis, Brooklyn Dilley

Honors Program Theses

Human trafficking evolved from the legal and regulated slavery of the past and has likely been in existence throughout human history. Slavery was abolished in the United States in 1865, and slavery and servitude were prohibited globally through the Universal Declaration of Human Rights in 1948 (United Nations General Assembly, 1948). Nevertheless, modern-day slavery has still thrived in the form of human trafficking. There have been many global and national efforts to combat human trafficking, including the UN Protocol to Prevent, Suppress, and Punish Trafficking in Persons and the Trafficking Victims Protection Act of 2000 (OMCTP). The Trafficking Victims Protection …

The Roads Less Traveled: A Metaresearch Analysis Of Local Histories In Racial Health Equity Research, Devin Trévion Brown Jan 2024

The Roads Less Traveled: A Metaresearch Analysis Of Local Histories In Racial Health Equity Research, Devin Trévion Brown

Public Health Theses

While it is important that racial health equity research receive growing attention in theUnited States, doing so must involve a thorough recognition and interrogation of the role that structural racism plays in creating different outcomes for Black communities. History aids in making clear the process through which race can become biology as structural racism is embodied by members of Black communities. Guided by Táíwò’s conceptualization of “resource distribution and accumulation” as well as Carter’s discussion of “racialized local biologies”, this cross-sectional meta-research analysis sought to investigate when and how racial health equity research after 2020 utilized local history to understand …

“I Don't Work For The Prison. I Don't Work For The Hospital Either. I’M Yours. Who Else Here Is Yours?” A Qualitative Analysis Of Facilitators And Barriers Of Launching Enhanced Perinatal Programs In Seven State Prisons, Karenna Thomas

Public Health Theses

The United States incarcerates women at the highest rate globally (Fair & Walmsley, 2022), while simultaneously failing to provide incarcerated individuals with adequate reproductive health care. Perinatal programs, including a combination of one-on-one and group prenatal and postpartum education, labor and birth support with a doula, separation support, and lactation care have been implemented as an alternative to standard care in around 21 states (Wilson et al., 2022). While the efficacy of these programs among incarcerated individuals has been established (Bard et al., 2016; Barkauskas et al., 2002; Schroeder & Bell, 2005; Shlafer et al., 2018; Shlafer, Saunders, Boraas, et …

Given the critical role of supportive resources and the prevalent use of technology and internet use, it is essential to understand how digital health interventions contribute to addressing trauma explicitly. This scoping review aims to explore the landscape of trauma-informed digital health interventions for adults, assess their outcomes, and identify their measurable impacts across various settings. Methods: A scoping …

Rap Rhyme, Prison Time: How Prosecutors Use Rap Evidence In Gang Cases, Charis Kubrin, Kyle Winnen, Rebecca Rogers Jan 2024

Rap Rhyme, Prison Time: How Prosecutors Use Rap Evidence In Gang Cases, Charis Kubrin, Kyle Winnen, Rebecca Rogers

Chapman Law Review

"In this Article, we call for greater nuance and careful treatment of rap-related evidence in the courtroom, which includes recognizing rap’s history, conventions, and practices generally, and acknowledging rap’s complicated and complex intersection with gangs specifically. Greater nuance and more careful treatment will enable courtroom members, including judges and jurors, to make better informed evaluations regarding whether rap evidence, despite being prejudicial, is sufficiently probative and if so, what relevance it may have to the case. We preface this argument with a review of punitive policies and practices associated with gangs in the criminal justice system, and with a discussion …
