The Impact Of Race And Skin Color On Police Contact And Arrest: Results From A Nationally Representative Longitudinal Study, Michael F. Teneyck, Sarah A. El Sayed, Clay M. Driscoll, Krysta N. Knox

SAGE Open Access Agreement Publications-Archive

Racial inequality in arrest is a social problem that has challenged the United States for as long as police records have been kept. Prior work documents the extent of the disparity and observational studies have attempted to sort out the mechanisms that explain why the disparity exists. Building on the “constructivist” perspective of race, the current study draws on data from the National Longitudinal Study of Adolescent to Adult Health (Add Health) to assess the degree to which race and skin color explain the observed racial disparity in criminal justice contact and arrest. Results revealed that controlling for criminal behavior …

Decentralizing The Nigerian Police Force: A Plausible Approach To Hinterland Securities, Amobi P. Chiamogu, Uchechukwu P. Chiamogu

Journal of African Conflicts and Peace Studies

The structure of the Nigerian police has overtime depicted a centralized composition that negate principles of power sharing in a federal system of government. The complexities and diverse nature of policing in Nigeria remains the bane to effective and virile administration and management of the organization. The office of the Commissioner of Police vis-à-vis those of State Governors spell contradictions in power configuration from both the Constitution and the Police Act. The enactment of vigilante services and neighbourhood watches by state governments are indicative of a failing security system especially at the component units of the Nigerian federation. The hinterlands …

Amended Expert Disclosure Report: Navahine V. Dept. Of Transportation, State Of Hawai’I, Catherine Smith

Scholarly Articles

From a historical and sociological legal perspective, children in America, including in Hawai'i, require extraordinary legal protection from the harm of climate change and the government actions causing them harm. Hawai'i has a long history and tradition of leading the way on broadening rights and protections under state law, particularly for children. The principles of intergenerational justice and equity at the heart of the public trust doctrine in Hawai'i similarly require that courts accord special attention and protection for children.

On June 20, 2024, the youth-powered Navahine case settled, resulting in the first constitutional climate settlement of its kind in …

The Automated Fourth Amendment, Maneka Sinha Jan 2024

The Automated Fourth Amendment, Maneka Sinha

Faculty Scholarship

Courts routinely defer to police officer judgments in reasonable suspicion and probable cause determinations. Increasingly, though, police officers outsource these threshold judgments to new forms of technology that purport to predict and detect crime and identify those responsible. These policing technologies automate core police determinations about whether crime is occurring and who is responsible. Criminal procedure doctrine has failed to insist on some level of scrutiny of—or skepticism about—the reliability of this technology. Through an original study analyzing numerous state and federal court opinions, this Article exposes the implications of law enforcement’s reliance on these practices given the weighty interests …

Ameliorating School Experience With Restorative Practices, Faith Thompson-Lee Jan 2024

Ameliorating School Experience With Restorative Practices, Faith Thompson-Lee

Theses and Dissertations

The purpose of this quantitative, non-experimental study was to explore the association between school success after the tier-one introduction of a three-tiered restorative practices program. To understand school success, student factors were examined using middle school data from a suburban school district located outside of a large metropolitan city in the northeastern part of the United States. These factors included achievement (Final GPA), attendance (Absences), and suspensions (In-school and Out-of-school) across racial groups. Separate multiple regressions were conducted for each school success factor on racial group for the 2021-2022 and the 2022-2023 school years. By this time, all district staff …

The Transitional Journey From Incarceration To A College Degree Through The Lived Experiences Of Women, Marsha Milan-Bethel Jan 2024

The Transitional Journey From Incarceration To A College Degree Through The Lived Experiences Of Women, Marsha Milan-Bethel

Theses and Dissertations

This qualitative narrative study shares the lived experiences of formerly incarcerated women, their reintegration into the community, and their journey to and through college. The eight participants span between 25 and 64 years of age, have spent varying lengths of time incarcerated, and are now either in college or recent graduates of both public and private universities. Research indicates that a large majority of incarcerated women come from economically disadvantaged communities, are vocationally unskilled, and have limited access to in-prison postsecondary programs (Mallory, 2011; Western et al., 2015). However, by earning a college credential, women rebuild their sense of self, …

Optimizing Reunification Capabilities At Outdoor Music Festivals: Empowering Social Groups To Maintain Situational Awareness Through Geofencing And Geolocation, Justin Andrew Puchalsky Jan 2024

Optimizing Reunification Capabilities At Outdoor Music Festivals: Empowering Social Groups To Maintain Situational Awareness Through Geofencing And Geolocation, Justin Andrew Puchalsky

Theses and Dissertations

The purpose of this research was to apply Social Identity Theory concepts to a modified Technology Acceptance Model for existing application-based software technologies on android and iOS platforms in an effort to facilitate user expectations of reunification efforts for pre-planned or spontaneous evacuations of Outdoor Music Festivals (OMF). Geofencing technology combined with geolocation sharing software will enable users that “opt-in” the ability to interface, plan, and disseminate instructions when separated from their social groups. While the overarching goal will allow evacuees to maintain baseline situational/spatial awareness, the modified concept, when applied, functions as a pseudo-visual crowd analysis tool for evacuees …

Homeless Encampments On Railroad Property And Their Effect On Crime Rates: A Multiple Methods Analysis, Michael Everett Jones Jan 2024

Homeless Encampments On Railroad Property And Their Effect On Crime Rates: A Multiple Methods Analysis, Michael Everett Jones

Theses and Dissertations

The U.S. homeless population’s size, vulnerability, and crime victim and offender risk merit further investigation. Valuable studies relating to homelessness and crime have been completed. However, there are missing notes in which a sample populace of homeless encampment sites, and subject matter expert opinions are combined into one study. A relationship tradition exists in the criminology research arena between appearance and esthetics levels in areas as visual cues and criminality. Through the decades, variations in crime rates across different settings have resulted in research about setting appearance and changes in frequency of crimes committed there. The purpose of this study …

An Analysis Of Traditional Sports Stadium Security And Facial Recognition Biometrics Towards The Prevention Of Crime And Violence In Sports Arenas, Darnell R. Downes

Theses and Dissertations

This qualitative descriptive study sought to determine how stadium security managers perceive and describe their experiences with biometric security systems, especially facial recognition software, to mitigate crime and violent behaviors in sports stadiums on the east coast of the U.S. The problem that was addressed in the study is that despite the increase in violence and crime in sports stadiums and the use of biometric systems, it is not known how stadium security managers perceive and describe their experiences with biometric systems in mitigating crime and violence in and around sports stadiums on the east coast of the U.S. Interviews …

Student Barriers And Motivators To Bystander Intervention If Witnessing Potential Sexual Violence On College Campuses, Jaquenette G. Lochrie Jan 2024

Student Barriers And Motivators To Bystander Intervention If Witnessing Potential Sexual Violence On College Campuses, Jaquenette G. Lochrie

Theses and Dissertations

Bystander intervention has received increased attention as a potential sexual violence prevention strategy, primarily to address campus sexual assault (McMahon et al., 2017). Shifting the focus from potential victims and perpetrators, the bystander approach engages all members of a campus community to act by increasing positive attitudes and behaviors related to sexual violence and greater willingness to intervene in pro-social ways. This study examined associations between college students’ bystander intervention behavior and three key factors: (a) perceived self-efficacy, (b) a sense of responsibility to act, and (c) the relationship between the student bystander and the victim or perpetrator. The researcher …

Restorative Justice Practices Within A School, Channing J. Smith Jan 2024

Restorative Justice Practices Within A School, Channing J. Smith

All Electronic Theses and Dissertations

This literature review looks into restorative justice practices within schools, guided by the main research question: How is a restorative justice model best implemented, and what are the associated challenges? Restorative justice is presented as a non-exclusionary approach to school discipline, prioritizing communication, accountability, and community building over traditional punitive measures like suspension and expulsion. Research studies and literature indicate that restorative practices can solve some of the issues surrounding the inequality prevalent in traditional punitive discipline, especially among marginalized and disadvantaged students. Additionally, this literature review explores implementation tools such as professional development and pedagogy. It also discusses the …

Effects Of Police Hiring & Training On Civilian Complaints: A Case Study Of The Nassau County, Ny Police Department, Shevach Berkovits Jan 2024

Effects Of Police Hiring & Training On Civilian Complaints: A Case Study Of The Nassau County, Ny Police Department, Shevach Berkovits

Theses and Dissertations

Police agencies and administrations continue to face public scrutiny, consequential poor policing, and costly litigation from within their communities. Newly hired Police officers, trained in the latest police science, can lead to fewer received civilian complaints from the communities they serve. Without established literature and studies, agency leadership and policy-makers' decision-making are constrained to quantifying spreadsheet data, which rarely alter the totality of any micro-level police-related interactions. Therefore, this study asks, how does the amount of newly hired police officers affect the number of civilian complaints received? Theories applied include Risk Management, Societal Security, and Conflict Criminology. The Nassau County …

American Academy Of Criminal Justice Sciences 2024 Annual Meeting, Gary Kowaluk

Title III Professional Development Reports

With my Title III funds, I attended the Academy of Criminal Justice Sciences (ACJS) 2024 Annual Meeting in Chicago, Illinois which took place from Tuesday, March 19th through Saturday, March 23rd. While I did not present at the conference, I used my time attending sessions to help formulate ideas about future research and to learn more about experiential learning practices, a type of teaching Lincoln University is promoting. I began the conference by attending a special two-hour training course on “crimmigration” research on Tuesday. With a focus on researching illegal immigration, the training moved into how to use participatory …
