Dartmouth Scholarship
At the intersection of drug policy, the opioid crisis, and fragmented care systems, persons with opioid use disorder (OUD) in the United States are significantly vulnerable to contact with the criminal legal system (CLS). In CLS settings, provision of evidence-based treatment for OUD is variable and often secondary to punitive approaches. Linkage facilitation at every touch point along the CLS Sequential Intercept Model has potential to redirect persons with OUD into recovery-oriented systems of care, increase evidence-based OUD treatment connections, and therefore reduce CLS re-exposure risk. Research in this area is still nascent. Thus, this narrative review explores the state …
Is The Second Amendment Outdated Or Misinterpreted?, William J. Carney
Is The Second Amendment Outdated Or Misinterpreted?, William J. Carney
Southern Illinois University Law Journal
This Article examines the evidence of original intent behind the Second Amendment, which Justice Antonin Scalia ignored in District of Columbia v. Heller. It suggests that the adoption of the Second Amendment was motivated by states' concerns about federal control over state and local militias. Thus, it was intended as a state’s rights amendment before Justice Scalia disregarded the opening clause. The Article then examines the results of Justice Scalia’s opinion in terms of a widespread increasing homicide rate in a nation with more firearms in circulation than the total population. Finally, it compares current homicide rates in the United …

High Functioning Females And Dating, Myla M. Streander
High Functioning Females And Dating, Myla M. Streander
Walden Dissertations and Doctoral Studies
The autism population in Southwest Florida does not have resources in the community to assist them with general living skills, social skills, job skills, and relationship skills. The research shows that autistic females have been ignored for years as they do not present autism the same as males. This means that instead of being independent and functional, they depend on the government for complete assistance. The study completed involved nine women with autism ages 18-35 to record their experiences and what gaps in the practice need to be addressed. This study was completed via Zoom and phone interviews, depending on …
Elimination Of Cash Bail In Illinois: Accessing Risk Of Defendants Using Risk Assessment Tools, Zachary Vancil
Elimination Of Cash Bail In Illinois: Accessing Risk Of Defendants Using Risk Assessment Tools, Zachary Vancil
Southern Illinois University Law Journal
In recent years, Illinois through the SAFE-T Act moved to eliminate cash bail in its entirety, moving to a new form of pretrial detention. Under the SAFE-T Act, persons are either released (sometimes with conditions), or detained pending trial. This Note argues that Illinois should amend its current statutory framework to mandate the use of a risk assessment tool to help aid decisions about pretrial detention. In support of mandating a risk assessment tool, this Note analyzes pretrial detention schemes in New Jersey, New York, and Illinois. While New Jersey has achieved high appearance rates and has seen success in …

Feeding The Cats: The Corruption Conundrum In The Failed Arab Spring-Egypt, Mohamed 'Arafa
Southern Illinois University Law Journal
The Egyptian civil society, across generational, religious, gender, and economic lines and without a charismatic leader, has organized itself at the grassroots level, evidencing the people's power in the face of a strong regime. Public order, security, and stability have deteriorated during the past two decades, with increased crime rates and other forms of abuses of power by individuals (e.g., thugs and small criminal bands), which the police have left somewhat unchecked. The people hold the military in high esteem because, in the last forty years, it has never acted against the general public. To prevent manipulation during the investigations …

Aged-Out Foster Youths’ Exposure To Spiritual Foster Homes And Transition Into Adulthood, Dr. Valerie Elaine Sims
Walden Dissertations and Doctoral Studies
There are 438,000 children and youth in foster care in the United States; almost 46,000 are aged 16 or older, and over 20,000 “age out” of many child welfare services between ages 18 and 20 every year. This qualitative phenomenological study aimed to explore the lived experience of foster youth growing up in a spiritual foster home (incorporating religious belief, practice, higher power, Bible study, or youth groups) and aging out of the system through the lens of faith-based theory. This study had a sample size of eight participants, ages 18 to 25, who transitioned out of the foster care …
Religious Liberty Vs. Discrimination: Striking A Balance When Business Owners Refuse Service To Same-Sex Couples Due To Religious Beliefs, Alex Riley
Southern Illinois University Law Journal
Same-sex marriage is now legal in all fifty states, which has created a same-sex wedding industry. Some business owners, who do not believe in discrimination based on sexual orientation, nevertheless have religious beliefs that forbid them from participating in same-sex marriage ceremonies and celebrations by providing goods and services for those ceremonies and celebrations. This comment argues for passage of a statute which adequately protects business owners who have religious objections to same-sex marriage, but does not provide for blanket discrimination against the LGBT community. The comment argues this goal is feasible if the statute is narrowly tailored to encompass …
The Role Of Apologies In Labor Arbitration Outcomes, Michele Hoyman, Lamont Stallworth, David Kershaw
The Role Of Apologies In Labor Arbitration Outcomes, Michele Hoyman, Lamont Stallworth, David Kershaw
Southern Illinois University Law Journal
This article considers the extent to which apologies provided by grievants affect the rulings of labor arbitrators in discipline and discharge cases. We used an experimental survey design which asked respondents to render awards on hypothetical arbitration cases. Hypothetical cases varied across four variables of importance: (1) the (perceived) sincerity of an apology, (2) the timing of the apology, (3) the issue in the case—sexual harassment, insubordination due to refusal to work, and insubordination due to profanity, and (4) the seniority of the grievant. All members of the National Academy of Arbitrators were surveyed, which provided a total of 177 …

An Analysis Of Relationships Between Demographics In Vermont’S Court Diversion Participants, Jennifer Hill
Student Theses
As solutions to mass incarceration continue to emerge, court diversion programs and specialty courts across the United States have grown as alternative options to the traditional criminal legal system. The State of Vermont has been utilizing court diversion programs for over 50 years to address harm in their communities. Court diversion has proven to be effective in reducing recidivism, improving cost efficiency and connecting individuals to their communities. However, what has gone unexamined are the potential disparities in opportunities for diversion participation along demographic lines. This study utilized a chi-square test of independence to explore the relationships between age, gender, …

Finding The Silver Lining: The Role Of Supportive Social Environments, Keturah Platt
College of Science and Health Theses and Dissertations
Experiencing a significant loss can be one of the most challenging life experiences. The adverse effects of bereavement can disrupt a person’s overall health and well-being. While it is essential to fully acknowledge the negative outcomes of bereavement, it is equally important to recognize the potential for posttraumatic growth (PTG) following such experiences. PTG has been consistently observed in adults who have experienced various traumas, yet there is still much to learn about PTG among adolescents. Given that death is one of the most stressful life events for youth, bereaved adolescents are a crucial population for examining PTG. Those living …

Conversing with the men challenged old assumptions and invited students to solidify goals and infuse their career paths with civic values and social justice concerns.
Voices Of Partnerships Within The Critical Service-Learning Framework, Kiesha Warren-Gordon, Ken Hudson, Frank Scott
Voices Of Partnerships Within The Critical Service-Learning Framework, Kiesha Warren-Gordon, Ken Hudson, Frank Scott
Journal of Community Engagement and Higher Education
Over the course of the past three decades, service learning has become a major component in higher education. Heretofore, however, there has been limited published research that focuses on the community partner or that assesses the role of the community partner within the community-servicelearning (CSL) model. This paper fills that gap by focusing on the community partner relationship as delineated by Mitchell (2008), the community partner’s position in CSL, and the authentic relationships between the community partner, class, and instructor. Specifically, we address the following question: How do community partners articulate their voices within the CSL framework? This paper argues …
