Kroc IPJ Research and Resources

I wanted to shed light on the situation of Indigenous women in Colombia and Venezuela, focusing specifically on the situation of Wayuu women living in the northern border of both countries. The identity of an Indigenous woman carries a dual burden—defined by both gender and ethnicity—that determines living conditions and access to rights within a worldview rooted in a collective sense of belonging to an Indigenous people. As a Wayuu Indigenous woman and a human rights researcher, my objective was to identify forms of discrimination by listening to Wayuu women in the territories of both countries. This approach allowed us …

Exploring The Pathway Of Far-Right Radicalization In The Age Of Neoliberalism, Biko Koenig Dec 2024

Exploring The Pathway Of Far-Right Radicalization In The Age Of Neoliberalism, Biko Koenig

Kroc IPJ Research and Resources

This paper examines the complex relationship between young white men and the rise of far-right extremism in contemporary American politics, particularly in the context of the MAGA movement and its implications for political violence. The January 6th riot serves as a stark example of how mainstream political affiliations can rapidly devolve into radicalization, as evidenced by the profiles of participants who often lacked formal ties to extremist groups yet shared a commitment to conspiracy-laden narratives and grievances. By framing these shifts within the broader socio-economic landscape marked by neoliberal decay, I explore how feelings of inequality, alienation, and powerlessness serve …

New Legal Realism At 20: Rethinking Law In An Era Of Populism And Social Movements, Jeffrey Omari, Pablo Rueda-Saiz, Richard Ashby Wilson

Connecticut Law Review

This Article critically examines the New Legal Realism (NLR) movement on its twentieth anniversary and illuminates its distinctive intellectual contributions. In evaluating NLR’s unique methodological and substantive contributions, we explore the movement's relationship to other interdisciplinary theories and empirical approaches to law. NLR approaches show a commitment to a comparative, crossnational exploration of legal phenomena while allowing for grounded generalizations about the relationship between law and society. NLR approaches embrace a diverse range of methods and emphasize the importance of “looking up, down, and sideways.” Notably, NLR embraces both “top-down” and “bottom-up” methods, providing comprehensive insights into the intricate interactions …

Impossibility Of Artificial Inventors, Matt Blaszczyk Dec 2024

Impossibility Of Artificial Inventors, Matt Blaszczyk

UC Law Science and Technology Journal

Recently, the United Kingdom Supreme Court decided that only natural persons can be considered inventors. A year before, the United States Court of Appeals for the Federal Circuit issued a similar decision. In fact, so have many of the courts all over the world. This Article analyzes these decisions, argues that the courts got it right, and finds that artificial inventorship is at odds with patent law doctrine, theory, and philosophy. This Article challenges the intellectual property (IP) post-humanists, exposing the analytical and normative perils of their argumentation, and recommends against getting rid of the nominally central place of humans …

Ties That Bind: The Long Emancipation And Status Ambiguity In Early 20th-Century Southwestern Tanzania, Lydia (Wilson) Marshall, Thomas John Biginagwa

Sociology & Anthropology Faculty publications

In the 1890s, the slave and ivory trader Rashid bin Masoud established the settlement Kikole deep in what is now southwestern Tanzania. Kikole was strategically located near Lake Nyasa, a major slaving region. Masoud's followers residing at Kikole were typically referred to as his slaves by German colonists and missionaries. Local oral histories today, however, define these followers as askari (soldiers or guards) or mafundi (technicians or specialists; in this case, in using weaponry). This article considers how recent expanded excavations at Kikole can help us better understand Masoud's followers. Differences in housing investment and material access suggest status differences …

Originalism's Selection Problem, Darrell A.H. Miller Dec 2024

Originalism's Selection Problem, Darrell A.H. Miller

William & Mary Bill of Rights Journal

This Essay examines the problem of selection with any originalist theory and what it means for constitutional adjudication. Part I surveys the major branches of originalism, explains how each share a commitment to the pursuit of objective, knowable, falsifiable fact, and then use that fact as a fixed point to constrain discretion. Part II discusses how each of these theories are vulnerable to methodological challenges familiar to all empirical projects. Part III explores the implications of these methodological challenges for originalism in particular and for constitutional doctrine and theory more generally.

This abstract has been taken from the author's introduction.

Citation Bias, Diversity, And Ethics, Keisha S Ray, Perry Zurn, Jordan D Dworkin, Dani S Bassett, David B Resnik

Faculty and Staff Publications

How often a researcher is cited usually plays a decisive role in that person's career advancement, because academic institutions often use citation metrics, either explicitly or implicitly, to estimate research impact and productivity. Research has shown, however, that citation patterns and practices are affected by various biases, including the prestige of the authors being cited and their gender, race, and nationality, whether self-attested or perceived. Some commentators have proposed that researchers can address biases related to social identity or position by including a Citation Diversity Statement in a manuscript submitted for publication. A Citation Diversity Statement is a paragraph placed …

Physical Activity And Sport Participation: Relationships With General Life Satisfaction And Social Life Satisfaction, Clay Barker

Honors College Theses

This study investigated the impact of college student physical activity and sport participation on life satisfaction and social life satisfaction. This study used a survey with scales to assess students’ frequency of physical activity, frequency of traditional sport participation, frequency of esport participation, life satisfaction, and social life satisfaction. This study’s hypotheses attempted to assess if each involvement variable will individually and positively correlate to both life satisfaction and social life satisfaction. This study used in-person surveys given to Murray State University college students. The findings of this study could provide information on the importance of physical activity and sport …

Challenging Myths & Addressing Intimate Partner Sexual Violence In Lgbtq+ Relationships, Nora K. Whitten Dec 2024

Challenging Myths & Addressing Intimate Partner Sexual Violence In Lgbtq+ Relationships, Nora K. Whitten

SPARK Symposium Presentations

Intimate partner violence (IPV), including intimate partner sexual violence (IPSV), is a public health crisis that disproportionately affects members of the LGBTQ+ community. This paper draws upon related, though limited, research to identify the five prevalent myths surrounding IPSV in LGBTQ+ relationships, addressing the following misconceptions: 1) IPSV can only occur in heterosexual relationships, 2) IPSV in LGBTQ+ relationships is not as severe, 3) Women cannot commit acts of sexual violence, 4) The more “masculine” partner is always the perpetrator, and 5) IPSV is a “mutual fight” among partners of the same sex. These myths perpetuate victim-blaming, minimize the severity …

Burnout, Stress And Its Effect On The Use Of Deadly Force, Charles Gutshall Dec 2024

Burnout, Stress And Its Effect On The Use Of Deadly Force, Charles Gutshall

School of Criminal Justice Theses and Dissertations

Police officers encounter significant occupational stressors that contribute to heightened levels of burnout and stress, potentially influencing their critical decision-making during deadly force encounters. This dissertation investigates the relationship between selfreported perceived stress, burnout, and the frequency of deadly force application among officers in southeastern Florida. Drawing on the Professional Quality of Life Scale, the Perceived Stress Scale, and the Restraint in the Use of Deadly Force Scale, survey responses from 202 officers were statistically analyzed using regression and descriptive techniques.

Contrary to initial hypotheses, findings revealed no significant predictive relationship between perceived stress, burnout, and the likelihood of using …

The Attachment Repair Hexagon: A Model For Recovery From Infidelity In Evangelical Marriages, Theresa C. Allen, John C. Thomas Dec 2024

The Attachment Repair Hexagon: A Model For Recovery From Infidelity In Evangelical Marriages, Theresa C. Allen, John C. Thomas

Journal of Faith Integration Counseling (JFIC)

Many studies have examined risk factors for infidelity; however, few have investigated how couples recovered from the attachment injury of infidelity. Thus, a grounded theory pilot study was conducted by the lead author to explore the question, “What helps evangelical marriages recover after sexual infidelity by the husband?” Three evangelical couples who were a minimum of two years post-disclosure of infidelity shared their personal accounts of marital recovery. Six major findings emerged from the analysis of the data collected from their semi-structured interviews: 1) developing healthy communication; 2) obtaining support and accountability; 3) maintaining physical separation from the other woman; …

The Algorithm Of Fear: Unpacking Prejudice Against Ai And The Mistrust Of Technology, James Hutson, Daniel Plate Dec 2024

The Algorithm Of Fear: Unpacking Prejudice Against Ai And The Mistrust Of Technology, James Hutson, Daniel Plate

Faculty Scholarship

The mistrust of AI seen in the media, industry and education reflects deep-seated cultural anxieties, often comparable to societal prejudices like racism and sexism. Throughout history, literature and media have portrayed machines as antagonists, amplifying fears of technological obsolescence and identity loss. Despite the recent remarkable advancements in AI—particularly in creative and decision-making capacities—human resistance to its adoption persists, rooted in a combination of technophobia, algorithm aversion, and cultural narratives of dystopia. This review investigates the origins of this prejudice, focusing on the parallels between current attitudes toward AI and historical resistance to new technologies. Drawing on examples from popular …

Exposing The Disaster Disparities And Experiences On College Campuses, Deleanor Kirkpatrick Murray

All-Inclusive List of Electronic Theses and Dissertations

Challenges in higher education continue to arise, providing administrators with insights into how prepared—or unprepared—their institutions may be for future crises. The purpose of the study is to examine how mid-level leadership, staff, and students perceived the disaster response to Hurricane Ida during the 2021–2022 academic year. Using the theoretical frameworks of the Four-Frame Model (Bolman & Deal, 2021), Critical Race Theory (Delgado & Stefancic, 2017), and Institutional Theory (Manning, 2018), this case study employed interviews with 8 participants. Data analysis resulted in the emergence of 7 major themes and 11 sub-themes. The findings from the study suggest that participants …

The Interplay Of Covid 19, Organized Religion, And Social Media: “How Can I Be The Person I Feel I Need To Be?”, White Dove Bryant Beethoven Keith Short

All-Inclusive List of Electronic Theses and Dissertations

Young adults are disaffiliating themselves from organized religion (Hout & Fischer, 2014). This study investigates the impact of social media use on religious identity, teaching, and learning. Social media use is changing young adults as individuals in worldview and perspective, spirituality, religion, and personal lifestyle (Schaeffer, 2019). Messages devised for young adults by Christian ministers for discipleship in teaching and instruction are inharmonious with young adults and their personal views of the world, how to live, and religion (Pew Research Center, 2019). The continued existence of religious teaching, congregant replenishment, and practice of the organized institutional Christian church within society …

Balancing The Scales In The Fashion Industry, Theresa J. Fennell Dec 2024

Balancing The Scales In The Fashion Industry, Theresa J. Fennell

Theses

The standards of beauty, particularly in the fashion industry, have long been a source of societal debate and controversy. Although beauty can be seen as “subjective,” over the years, certain standards have become institutionalized, creating exclusionary ideals that have dominated the fashion industry. Historically, these standards have favored slim body types, marginalizing larger, plus-size bodies. This bias is deeply entrenched in the industry, influencing everything from design to representation in advertising. However, the body positivity movement has emerged as a transformative force, advocating for the acceptance of diverse body types and pushing for greater inclusivity in fashion. Despite these advances, …

The Integration Of Environmental Concerns And Philosophy Into Business Strategies, Johann Thorne Dec 2024

The Integration Of Environmental Concerns And Philosophy Into Business Strategies, Johann Thorne

Electronic Theses and Dissertations

My thesis focuses on how a business can better integrate environmental philosophies and principles into their business model without detracting from the business's primary objectives, specifically that of generating profit. However, this thesis also seeks to extend the business's objectives to include the environment using these environmental philosophies, arguing that the business should have some obligation to the environment in terms of morality, as well as social obligations. This is an evolution of some common ethical theories used within the business world, but I argue they do not suffice to protect the environment. Instead, I develop an ethical pluralist framework …

A Brief History Of The Scheduling Discourse In Late-Colonial India (1918–1950), Saagar Tewari Dec 2024

A Brief History Of The Scheduling Discourse In Late-Colonial India (1918–1950), Saagar Tewari

National Law School Journal

Over a tenth of India’s land mass in 14 states are notified under the Fifth and Sixth Schedules of the Indian Constitution. Tracing the genealogy of the idea of scheduling in the late colonial period (1918–1950), this essay presents a brief survey of the deliberations on the ‘tribal question’ in British India. Focusing mainly on the debates in the administrative realm, it offers a top-down analysis of major developments vis-à-vis the discourse on aboriginal and hill tribes as the category itself transitioned into what is now called ‘Scheduled Tribes’.

Constitutionalism, Social Justice, And Social Contract: Unpacking The Debate On Scheduled Caste Reservation For Christian And Muslim Dalits, Arvind Kumar Dec 2024

Constitutionalism, Social Justice, And Social Contract: Unpacking The Debate On Scheduled Caste Reservation For Christian And Muslim Dalits, Arvind Kumar

National Law School Journal

This article examines the constitutional, historical, and political debates surrounding the demand for extending Scheduled Caste (SC) status to Christian and Muslim Dalits in India. Drawing on Constituent Assembly Debates, archival materials, judicial decisions, government affidavits, petitions, and my previous scholarship, it challenges the claim that SC reservation was originally conceived as religion-neutral. The article argues that SC reservation emerged as a specific pre-constitutional agreement rooted in the Poona Pact and designed to address the historical injustice of untouchability within Hindu society. Its provisions were subsequently extended to Sikh and Buddhist converts under particular historical and political circumstances but did …

An Analysis Of Policies, Practices, And Barriers To Create A Multi-Dimensional Approach To Renewable Energy Transition For Us Communities, Hanan Wehbi

Graduate Theses and Dissertations

The transition from fossil fuel-derived energy resources to clean, renewable, affordable, and reliable energy necessitates a comprehensive approach. This approach must incorporate an interdisciplinary contribution to ensure the sustainability, efficiency, and resilience of the energy system. In the United States, many communities and local governments are developing ambitious plans, regulations, and targets to support the renewable energy transition and enhance energy efficiency. This research builds on the principles of sustainable development planning and transition theory to develop a framework that assists communities in planning their renewable energy (RE) transition and integrate these plans in their long- and short-term development approaches. …

Utahns’ Generally Agree On Top Environmental Concerns, But Climate Change And Related Issues Reveal Political Polarization, Sarah E. Wilson, Jessica Ulrich-Schad

Utah People and Environment Poll (UPEP)

Utah is renowned for its unique landscapes and abundant opportunities to connect with the natural environment. However, the state is currently grappling with serious environmental challenges, including poor air quality, dwindling water supplies, and the alarming desiccation of the Great Salt Lake. These and other issues have major ecological and economic implications, and combating them will likely require large scale efforts. However, rising levels of political polarization are a common problem in the United States that many feel stifles our ability to combat societal problems, including those related to the environment and human health.
