Crisis Of Conscience In Post-Roe America, Elizabeth Sepper
The Journal of Contemporary Legal Issues
This essay proceeds in four parts. Summarizing my previous writing, Part II explains that since Roe, the law has systematically favored refusing individuals and institutions. This asymmetry was unjustified, because “[c]onscience equally may compel a doctor or nurse to deliver a controversial treatment to a patient in need.” After Dobbs v. Jackson Women’s Health Organization, the asymmetry may deepen. In restrictive states, Part III contends, the crisis of conscience for willing providers will increase, even as rights to refusal expand. Part IV identifies several possible complications for the legal framework governing conscience in medicine. It suggests that as …

In recent years the theological term “pronomianism” has emerged within lay scholarship and academia. While still evolving as a concept, it is the doctrine that affirms the ongoing and universal nature of all God’s commandments, to be practised literally and non-literally (by way of principlism and paradigm), as opposed to a theological framework that designates only the “moral” as operative and those that are “civil and ceremonial”, as redundant. Adolescence is a numinous stage of self-discovery fraught with challenges and obscurities that threaten a healthy trajectory. Religion and spirituality are proven coping resources and school counselors can provide identity and meaning-making resources to aid adolescent development. However, religion and spirituality are often avoided in the public-school setting. Divisions in the American Catholic Church have resulted in widespread dissent from Catholic moral teaching. In response to this dissent, the United States Conference of Catholic Bishops (USCCB) has used the language of communion to bar dissenting Catholics from the Eucharist, which is to push them to the margins of the Church. In contrast, Pope Francis has used the language of communion to welcome dissenting Catholics to the table through the Synod on Synodality. This thesis explores the theological implications of these different approaches to communion. It argues that the people of the Church must embrace an understanding of communion …

While exercising ministry in my home country, Cameroon, I have lived the negative effects of the internal confusion that can sometimes bedevil human life and the external chaos that can envelop society because of war. This dissertation examines 1983 pastoral on war and peace, The Challenge of Peace, from the National Conference of Catholic Bishops (NCCB). It analyzes in-depth the process of the ad hoc committee of the NCCB that wrote the pastoral alongside the simultaneous debates within the American Catholic community and the Reagan administration surrounding the pastoral. Special attention is given here to the interactions of the Reagan administration with the ad hoc committee, led by Archbishop Joseph Bernardin, and the role of American Catholic lay critics Michael Novak, Philip Lawler, and George Weigel. This dissertation provides a theological response to eating disorders, disordered eating, and body dissatisfaction, particularly in light of social media’s influence on women and girls. Theologically, eating disorders may be thought of as conditions produced by a debased version of beauty, a self-transcending rather than self-negating conception of kenosis, and a distorted pursuit of goodness or “misguided moralism” that results. Paying particular attention to the feminine thin ideal and its influence on Western beauty standards, this dissertation engages Hans Urs von Balthasar’s theological aesthetics and presentation of kenosis alongside virtue ethics to respond to society’s impoverished vision of beauty and …

The Fourth Chapter of Laudato Si’ (LS) of Pope Francis deals with the theme of ‘Integral Ecology’ from a religious tradition. This chapter can be interpreted as the fulcrum of the encyclical because of the density of its anthropological and ethical considerations. The theme of this chapter has informed a more emphatic presentation in the apostolic exhortation Laudate Deum (LD) on the climatic challenges confronting humanity. The Church is actively working to promote and build up a culture of safeguarding. Those most vulnerable to abuse need care and protection. Sexual orientation is an important element to consider in safeguarding, as there are specific risks for homosexual persons, and persons with same-sex attraction (SSA) frequently experience abuse. In a sensitive and respectful way, this article examines the background elements regarding homosexuality and abuse and gives specific details that can help in formulating a vision of safeguarding that takes into account the specific reality of persons with SSA.

The viability standard plays an important role in abortion access around much of the United States. In fact, before the Dobbs decision, the viability standard was the constitutional gatekeeper to abortion access and was uniform across the entire nation. Unfortunately, the Supreme Court has removed the constitutional right to abortion altogether. Nevertheless, I will provide an argument as to why Dobbs does not signal the end of viability-based abortion around the U.S. I will prove the importance of the viability standard even in a post-Dobbs society, highlighting its operation within various state laws, such as Michigan’s Prop. 3, as well …

This dissertation develops an account of the nature of education from a Thomistic point of view. The thesis is that education is best understood as ‘human growth’—growth, because it is the natural development of potentialities inherent within the human person toward full actualization, and human, because it pertains in particular to those faculties of reason that are unique to human beings among all natural creatures, the intellect and will. The first three chapters provide an overview of Thomistic anthropology and virtue theory, from which I conclude that the final goal toward which all genuinely educational activity aims is the speculative …
