The study sample consisted of 61 parents of autistic children aged 5-10 years old. The Quality of Life for Children with Autism Spectrum Disorder Scale was used to measure children's quality of life based on parent report, and the Technology Use …

Relationship Between Spiritual Struggles And Health Outcomes In Adult Chronic Pain Patient Populations, Brianna Marie Todd Jan 2024

Relationship Between Spiritual Struggles And Health Outcomes In Adult Chronic Pain Patient Populations, Brianna Marie Todd

All-Inclusive List of Electronic Theses and Dissertations

Chronic pain affects about one-fifth of the worlds population. Although a biopsychosocial model is often applied, religious and spiritual factors are frequently neglected in the conceptualization of pain and its impact. Prior research has identified how religious and spiritual (R/S) struggles are associated with depression, pain catastrophizing, and pain disability in pain patients. However, few investigations have assessed how struggles affect the relationship between pain and well-being. The present study explored how R/S struggles affect the relationship between pain and well-being when tested as mediators and moderators, while accounting for the effects of age, gender, race, income, education, and religious …

Understanding The Overall Health Of Midwestern Bats, Nicole Castaneda

All-Inclusive List of Electronic Theses and Dissertations

The overall health of an individual or population can be measured in various ways. This research investigates bat health and reports baseline values of 1) hematological measures, 2) ectoparasite and endoparasite indices, and 3) prevalence of a zoonotic bacterium Bartonella , in four bat species, including big brown bat ( Eptesicus fuscus ), eastern red bat ( Lasiurus borealis ), Indiana bat ( Myotis sodalis ), and the evening bat ( Nycticeius humeralis ) that I captured at six state-protected sites in northeastern Missouri, USA over three summers. Such baseline values are needed, for example, when comparing diseased and stressed …

Gender Difference On Internal Equity: Evidence From The Hospitality Industry In Ghana, Patricia Peprah Jan 2024

Gender Difference On Internal Equity: Evidence From The Hospitality Industry In Ghana, Patricia Peprah

Faculty Publications

It is a hypothetical position that employees in the hospitality industry in Ghana experience salary disparities based on the gender of the employee. Pay disparities exist because of unconscious biases in areas such as hiring, promotions, performance reviews, and salary decisions. In ensuring equal pay for equal work to fulfill the International Labor Organization (ILO) convention, this study investigated the internal equity pay of the employees in Ghana's hospitality industry based on equal work. This quantitative association study adopted a self-constructed research instrument to measure internal equity pay and randomly selected 350 respondents in the hospitality industry in Ghana to …

A Simple, Inexpensive Alkaline Method For Bacterial Dna Extraction From Environmental Samples For Pcr Surveillance And Microbiome Analyses, Abdulkarim Shwani, Bin Zuo, Adnan Alrubaye, Jiangchao Zhao, Douglas D. Rhoads

Poultry Science Faculty Publications and Presentations

DNA extraction for downstream molecular diagnostic applications can be an expensive, time-consuming process. We devised a method to quickly extract total bacterial DNA from environmental samples based on the sodium hydroxide lysis of cells with or without capture by magnetic beads for subsequent PCR or quantitative PCR. The final DNA extraction method using NaOH is extremely low-cost and can be completed in as little as 10 min at room temperature with dilution, or the DNA can be further purified using silica-coated paramagnetic beads. NaOH extraction was effective for Gram-negative and Gram-positive bacteria in samples from air, soil, sewage, food, laboratory …

The Subsistence And Enforcement Of Copyright And Trademark Rights In The Metaverse, Cheng Lim Saw, Zheng Wen Samuel Chan Jan 2024

The Subsistence And Enforcement Of Copyright And Trademark Rights In The Metaverse, Cheng Lim Saw, Zheng Wen Samuel Chan

Research Collection Yong Pung How School Of Law

The metaverse has been widely hailed as a symbol of technological progress, presenting an immersive virtual realm that has the potential to transform how individuals engage in social and commercial activities. However, this conception of a borderless virtual world - which purportedly transcends the capabilities and reach of Web 2.0 - sits uncomfortably with the territorial nature of intellectual property rights. This chapter examines the complexities surrounding the subsistence and enforcement of intellectual property rights within the metaverse, with a specific focus on copyright and trademarks. Especial attention is paid to issues concerning choice of law and jurisdiction. Finally, the …

Performing Britishness: Identity And Popular Music Tribute Shows In Perth, Western Australia, Colin Outhwaite Jan 2024

Performing Britishness: Identity And Popular Music Tribute Shows In Perth, Western Australia, Colin Outhwaite

Theses: Doctorates and Masters

This research investigates how and why individuals use popular music tribute shows to construct individual and collective identities within the British expatriate community in Perth, Western Australia. Popular music tribute shows involve recontextualised performances of past musical works and rely on shared first-hand or vicarious experiences between musicians and audiences. By examining how individuals and groups use music as a means for strengthening and maintaining cultural identity, the research investigates how musical activity is both a result and influence on the construction and perpetuation of a symbolic and temporal identity group that revolves around shared tastes and experiences.

Journal of Dental Sciences

Abstract Background/Purpose Pulp polyp is often eliminated as dental waste. Pulp polyp cells were reported to have high proliferation activity which might be comprised of stem cells. However, little has been known on the presence of stem cells in the pulp polyp. Moreover, pulp polyp cells might contain chromosomal abnormality. The present study was conducted to investigate the presence of pulp polyp stem cells, which could later be propagated and confirmed as normal/non-pathogenic cells using karyotype analysis. Materials and methods Collected pulp polyps were minced, enzymatically digested, and cultured. Expression of mesenchymal stem cell (MSC) markers on pulp polyp cells …

Utilizing a correlational research design, data were collected from a sample of 336 professionals through a self-constructed Likert-scale questionnaire. The analysis was conducted using path analysis and mediation techniques. The findings reveal that financial literacy had a significant partial mediating effect between blockchain technology application and financial risk, accounting for 26.0% of the total effect. The direct negative effect of blockchain technology applications on financial risk also remained significant, highlighting the independent contribution of blockchain …

Interpreting Ethics Rules, Samuel J. Levine Jan 2024

Interpreting Ethics Rules, Samuel J. Levine

Scholarly Works

This Article explores the interpretation of ethics rules through the prism of two rules that have been the subject of ongoing controversy and contention: Rule 4.2, the “no-contact” rule, which prohibits a lawyer from communicating with a represented client absent the consent of that client’s lawyer, and Rule 8.4(g), which prohibits various forms of discrimination and harassment. Each of these rules provides a model for a wider examination of different interpretive approaches to ethics rules, grounded in different attitudes toward the features and functions of ethics codes. Specifically, the debate revolving around Rule 4.2 illustrates competing approaches to interpreting a …

West Virginia V. Epa: Maybe A Big Deal, But Maybe Not, Michael Lewyn Jan 2024

West Virginia V. Epa: Maybe A Big Deal, But Maybe Not, Michael Lewyn

Scholarly Works

In West Virginia v. EPA, the Supreme Court ruled that the Environmental Protection Agency (EPA) lacked the statutory authority to implement the Clean Power Plan, a regulation designed to reduce coal-fired power plant emissions by encouraging the use of non-coal energy sources. The Court’s decision was primarily grounded in the "major questions doctrine," which asserts that courts may reject agency actions that involve significant and consequential powers not reasonably inferred from Congressional intent, even if a statute is unclear. This decision raised concerns among commentators that it might severely restrict environmental regulations and the broader administrative state. However, the …

The Role Of Pornography In The “Rough Sex” Defence In Canada, Lisa Gotell, Isabel Grant, Elizabeth Sheehy Jan 2024

The Role Of Pornography In The “Rough Sex” Defence In Canada, Lisa Gotell, Isabel Grant, Elizabeth Sheehy

All Faculty Publications

Drawing upon the authors’ earlier research studying the consent defence when it is used to suggest that the complainant agreed to “rough sex” involving violence, this paper develops an extended analysis of the complex role of pornography in these decisions. This paper focuses on a subset of “rough sex” cases, where pornography played a role in “scripting” the accused’s behaviour. Thematically, these cases included: those where the accused had a substantial history of consumption of violent pornography; cases in which the accused forced the complainant to view pornography as part of the assault; cases where the accused recorded the attack, …

The Governance Of Public Space By Legally Unique Bodies: A Case Study Of Vancouver’S Granville Island, Alexandra Flynn, Claire Stevenson-Blythe Jan 2024

The Governance Of Public Space By Legally Unique Bodies: A Case Study Of Vancouver’S Granville Island, Alexandra Flynn, Claire Stevenson-Blythe

All Faculty Publications

This paper focuses on the governance of Granville Island, a former industrial stretch of land that operates as an arts destination abutting the city’s waterfront. While Granville Island might look like any other neighbourhood in Vancouver, it is in fact owned and managed by the Canada Mortgage and Housing Corporation, a federal agency, on behalf of the Government of Canada. This paper examines what it means, democratically speaking, for the federal government to operate public space in a city. Public entities are each legally unique, raising questions as to how public entities and their relationships with other entities can be …

The Moderating Role Of Job Insecurity On The Relationship Between Psychological Contract Breach And Employee Turnover Intention, Madeline R. Clark Jan 2024

The Moderating Role Of Job Insecurity On The Relationship Between Psychological Contract Breach And Employee Turnover Intention, Madeline R. Clark

Master's Theses

The intentions for an employee to voluntarily leave their position at an organization has been widely researched, given it is a strong determinant of actual employee turnover. Psychological contract breach (PCB), an employee’s perception that their organization has failed to fulfill its promises or obligations, has been identified as a known predictor of employee turnover intention. While various moderators of the relationship between PCB and turnover intention have been explored in previous research, current literature had yet to examine how the job insecurity employees experience might be associated with this relationship. Therefore, the present study examined job insecurity as a …

Public Perspectives On Investigative Genetic Genealogy: Findings From A National Focus Group Study, Jacklyn Dahlquist, Jill O Robinson, Amira Daoud, Whitney Bash-Brooks, Amy L Mcguire, Christi J Guerrini, Stephanie M Fullerton Jan 2024

Public Perspectives On Investigative Genetic Genealogy: Findings From A National Focus Group Study, Jacklyn Dahlquist, Jill O Robinson, Amira Daoud, Whitney Bash-Brooks, Amy L Mcguire, Christi J Guerrini, Stephanie M Fullerton

Center for Medical Ethics and Health Policy Staff Publications

Background: Investigative genetic genealogy (IGG) is a technique that involves uploading genotypes developed from perpetrator DNA left at a crime scene, or DNA from unidentified remains, to public genetic genealogy databases to identify genetic relatives and, through the creation of a family tree, the individual who was the source of the DNA. As policymakers demonstrate interest in regulating IGG, it is important to understand public perspectives on IGG to determine whether proposed policies are aligned with public attitudes.

Methods: We conducted eight focus groups with members of the public (N = 72), sampled from four geographically diverse US regions, …

Utility, Copyright, And Fair Use After Warhol, Keith N. Hylton Jan 2024

Utility, Copyright, And Fair Use After Warhol, Keith N. Hylton

Faculty Scholarship

This paper is a reaction to AWF v. Goldsmith (Warhol), which finds that Warhol’s adaptation of a photograph of Prince, taken by photographer Lynn Goldsmith, is not protected from copyright liability by the fair use defense. The Warhol dissent accuses the majority of being overly concerned with the commercial character of Warhol’s use, while the dissent emphasizes the artistically transformative quality of Warhol’s adaptation. These different approaches provide strong evidence that the theory of fair use remains unclear to the Court. There is a need for a simple positive theory of the fair use doctrine. That need was largely …

A Matter Of Facts: The Evolution Of Copyright’S Fact-Exclusion And Its Implications For Disinformation And Democracy, Jessica Silbey Jan 2024

A Matter Of Facts: The Evolution Of Copyright’S Fact-Exclusion And Its Implications For Disinformation And Democracy, Jessica Silbey

Faculty Scholarship

The Article begins with a puzzle: the curious absence of an express fact-exclusion from copyright protection in both the Copyright Act and its legislative history despite it being a well-founded legal principle. It traces arguments in the foundational Supreme Court case (Feist Publications v. Rural Telephone Service) and in the Copyright Act’s legislative history to discern a basis for the fact-exclusion. That research trail produces a legal genealogy of the fact-exclusion based in early copyright common law anchored by canonical cases, Baker v. Selden, Burrow-Giles v. Sarony, and Wheaton v. Peters. Surprisingly, none of them …

Two Ai Truths And A Lie, Woodrow Hartzog Jan 2024

Two Ai Truths And A Lie, Woodrow Hartzog

Faculty Scholarship

Industry will take everything it can in developing Artificial Intelligence (AI) systems. We will get used to it. This will be done for our benefit. Two of these things are true and one of them is a lie. It is critical that lawmakers identify them correctly. In this Essay, I argue that no matter how AI systems develop, if lawmakers do not address the dynamics of dangerous extraction, harmful normalization, and adversarial self-dealing, then AI systems will likely be used to do more harm than good.

Given these inevitabilities, lawmakers will need to change their usual approach to regulating technology. …

Structural Sex Discrimination: Why Gynecology Patients Suffer Avoidable Injuries And What The Law Can Do About It, Christopher Robertson, Annabel Kupke, Louise P. King Jan 2024

Structural Sex Discrimination: Why Gynecology Patients Suffer Avoidable Injuries And What The Law Can Do About It, Christopher Robertson, Annabel Kupke, Louise P. King

Faculty Scholarship

The nearly four million Americans who undergo gynecological surgeries each year suffer avoidable lifelong, painful, and disabling injuries. This Article diagnoses the root cause in our legal framework for healthcare finance and identifies legal solutions.

America’s public-private system for reimbursing healthcare pays for procedures rather than outcomes, and it pays substantially more for work on male rather than female anatomies. This disparity is due to the federal government’s reliance on a secretive industry committee to set those rates, and the committee’s reliance on junk science surveys, allowing self-interested and gender-biased responses, contrary to objective measures.

As payors disvalue the bodies …

Children At Work, Parental Rights–And Rhetoric, Naomi Cahn, Maxine Eichner, Mary Ziegler Jan 2024

Children At Work, Parental Rights–And Rhetoric, Naomi Cahn, Maxine Eichner, Mary Ziegler

Faculty Publications

This Article examines the resurgence of child labor law rollbacks across the United States and argues that legislators and business‑aligned advocates increasingly deploy the rhetoric of “parental rights” to mask deregulatory efforts that primarily advance industry interests rather than children’s wellbeing or family autonomy. Tracing the historical tension among parental authority, state parens patriae power, and children’s welfare, the Article shows how contemporary invocations of parental rights—echoing arguments used a century ago to resist child labor reforms—operate as political cover for expanding hazardous work, extending hours, and reducing oversight in ways that endanger children and undermine their educational and economic …

New Tech, Old Problem: The Rise Of Virtual Rent-To-Own Agreements, Carrie Floyd Jan 2024

New Tech, Old Problem: The Rise Of Virtual Rent-To-Own Agreements, Carrie Floyd

Faculty Publications

This Article examines how fintech has transformed the traditional rent-to-own (RTO) industry by enabling the rise of virtual rent-to-own agreements (“VirTOs”), which now extend high-cost RTO-style financing into services and unconventional products such as vehicle repairs, pet ownership, and medical devices. It explains how VirTOs differ from classic RTO arrangements by involving hidden online transactions between retailers and third‑party VirTO providers, making termination through return of the item—central to the legal status of RTOs—practically impossible. As a result, the Article argues that VirTOs function as disguised credit rather than true rentals, forming a legal fiction designed to evade consumer protection …

Masking Identity At Public Protests, Deborah R. Gerhardt Jan 2024

Masking Identity At Public Protests, Deborah R. Gerhardt

Faculty Publications

This Article will explore these issues to assist those seeking to enact constitutionally valid mask policies. To situate today’s mask regulation challenges in the context of American history, Part I reviews events that led to enactment of anti-mask laws many years ago. Part II explains when the First Amendment protects the right to wear a mask in public and when such permission may be lawfully abridged. The section explains the importance of analyzing whether wearing a mask in public is sufficiently expressive to merit First Amendment protection. When it is, the next challenge is to identify the constitutional standard for …

Labor Law’S Impact On The Post-Dobbs Workplace, Jeffrey M. Hirsch Jan 2024

Labor Law’S Impact On The Post-Dobbs Workplace, Jeffrey M. Hirsch

Faculty Publications

The Supreme Court’s Dobbs decision has left many workers, especially in states with restrictive abortion-related laws, in a precarious position. Labor laws and unions, however, provide one avenue for providing these workers with more protections. Unions can demand bargaining to protect or expand health care, leave, and other terms of employment that give workers with means to obtain abortion-related care. Unions can also provide members legal defense and other support if they face prosecutions. Additionally, both union and non-union workers who make up the vast majority of workers in states with restrictive laws may have labor law protection for discussing …
