Postgraduate Supervision In A Chatgpt World: What’S Next?, Angela Wright

Conference Materials

This study explores the considerable challenges for research supervisors of postgraduate students in Higher Education. For experienced academics, the responsibility of assessing theses and dissertations has never been more critical. With the advent of ample search engine opportunities, Generative Artificial Intelligence (GenAI) technology, and adhering to proper academic integrity processes, how can supervisors navigate these complexities, unsupported by solid procedures, due to the rapidly changing nature of AI? If a supervisor is concerned as to the integrity of the presented work during the supervisory process, what options are available to the supervisor to address concerns with the student in an …

Paddlesport Safety Culture In Ireland: An Exploratory Study, John Pierce, Kevin O'Callaghan

Publications

Anecdotally, paddlesports (canoeing, kayaking, stand-up paddleboarding, and rafting) are seen as safe sports, though prior to this report little evidence was available to support this view in an Irish context. This report provides a summary of a research project exploring safety practices in Irish paddlesports. It includes the aim, objectives, research methodology, findings, and recommendations. Discussions early in the research process about how to investigate safety practices in Irish paddlesports brought a number of objectives into focus. It was agreed to compile empirical evidence on current safety practices across Irish paddlesports and to determine what, if any, additional supports may …

The use of nature-based solutions (NbS) to address the risks posed by hydro-meteorological hazards have not yet become part of the mainstream policy response, and one of the main reasons cited for this, is the lack of evidence that they can effectively reduce disaster risk. This paper addresses this issue, by providing model-based evidence from five European case studies which demonstrate the effectiveness of five different NbS in reducing the magnitude of the hazard and thus risk, in present-day and possible future climates. In OAL-Austria, the hazard is a deep-seated landslide, and the NbS analysed is afforestation. Modelling results …

Graduate School of Oceanography Faculty Publications

Exposure to per- and polyfluoroalkyl substances (PFAS) has been associated with toxicity in wildlife and negative health effects in humans. Decades of fire training activity at Joint Base Cape Cod (MA, USA) incorporated the use of aqueous film-forming foam (AFFF), which resulted in long-term PFAS contamination of sediments, groundwater, and hydrologically connected surface waters. To explore the bioconcentration potential of PFAS in complex environmental mixtures, a mobile laboratory was established to evaluate the bioconcentration of PFAS from AFFF-impacted groundwater by flow-through design. Fathead minnows (n = 24) were exposed to PFAS in groundwater over a 21-day period and tissue-specific …

Noteblocklib: A Library For Physics- And Animation-Driven Virtual Midi Instruments For Use In Video Games, Kevin Rotunni

Master's Projects

To better capture the relationship between the performer of a piece of music and the music itself in a video game context, I have designed NoteBlockLib, a system by which MIDI instructions are generated and processed in real time based on the motion and collision data of in-game objects. Ultimately, the movement of instruments made using this system would be driven by the animations of a character in the game. This system would thus allow the player character to interact with the performer in the game without sacrificing the relationship between the performer’s actions and the resulting music or to …

The War[Hol] Between Artistic Creativity And Commercial Use Within The Fair Use Defense, Morgan Houghtlin Jan 2024

The War[Hol] Between Artistic Creativity And Commercial Use Within The Fair Use Defense, Morgan Houghtlin

SMU Law Review

In May 2023, the Supreme Court decided Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith, articulating the standard for the “fair use” defense under a copyright infringement claim. The Court’s decision significantly narrowed the first factor of the fair use analysis, characterizing “purpose and use” in terms of the commercial nature of a secondary work with little consideration of the art’s creative value. This opinion deviates from the broader conception of “fair use” articulated in Campbell v. Acuff-Rose Music, Inc. (1994) and introduces various implications for modern-day artists and content creators. Specifically, Justice Sotomayor’s majority opinion and …

Cases And Materials For A Survey Of Government Procurement Law, Joshua I. Schwartz

School of Law Open Educational Resources

Before beginning to immerse yourself in the materials presented in this resource, consider the following fundamental questions:

1) What should the overall objectives of government procurement law be?

2) How could we tell if the system is working well or if it, on the other hand, requires significant reform?

3) What groups in society ought to be protected by the body of government procurement law? What are their interests that ought to be protected? (There is room for some real debate on this issue: Consider what a “Tea Party” advocate might say? What a defense industry advocate might say? What …

It Comes With Baggage: The Heavy Weight Implications Of Weighing Airline Passengers, Brooke Sutter Jan 2024

It Comes With Baggage: The Heavy Weight Implications Of Weighing Airline Passengers, Brooke Sutter

Journal of Air Law and Commerce

The aviation industry is one of the most regulated industries that exists in modern society. Before an airplane can take a passenger from one destination to another, diligent and thorough checks are performed on the aircraft, the runway, the pilots, the crewmembers, the luggage, the route, and the numerous other points of potential risk. Due in part to this diligence, air travel is also one of the safest forms of travel. However, one point of potential risk that is underregulated and overlooked in the safety calculation is the weight of the passengers. The act of weighing passengers is not just …

A Hard Pill To Swallow: Privacy Implications Of Direct-To-Consumer Prescription Drug Services, Varsha Challapally Jan 2024

A Hard Pill To Swallow: Privacy Implications Of Direct-To-Consumer Prescription Drug Services, Varsha Challapally

SMU Science and Technology Law Review

This case note discusses the emergence and popularity of direct-to-consumer prescription drug services and evaluates their privacy implications on consumers. Minimal regulation exists regarding direct-to-consumer prescription drug services, and patient privacy and data protection laws are also limited. Proponents of these services claim that they allow certain prescription drugs to be available to consumers without the hassle and logistics of health insurance and making and attending medical appointments, effectively empowering individuals to take control of their own health. Alternatively, critics claim that direct-to-consumer prescription drug services are operated by private companies that are not always required to be compliant with …

Proposed Methodologies To Cure The No-Fly List’S Current Violations Of The Due Process Clause For Affected U.S. Citizens, Sierra Stone

Journal of Air Law and Commerce

Often, the No-Fly List is a helpful tool that increases the safety of commercial aviation for U.S. citizens flying domestically and internationally. The TSA and various intergovernmental agencies utilize a nomination process and those who meet the requisite criteria are added to a database and can be entered into the No-Fly List. Once being placed on the “List,” an individual is no longer allowed to board a flight flying anywhere within or over U.S. airspace. However, for a small number of people, this deprivation of the ability to fly came unjustifiably and without realistic opportunities to be removed from the …

If Held Holds: Held V. Montana And The Future Of Constitutional Environmental Litigation, Leonora Owsley Jan 2024

If Held Holds: Held V. Montana And The Future Of Constitutional Environmental Litigation, Leonora Owsley

SMU Science and Technology Law Review

The State of Montana is one of three states whose constitutions presently contain a “green amendment[.]” These amendments, enshrined in their respective Bills of Rights, protect a citizen’s fundamental right to a clean and healthy environment, ideally ensuring that the state’s government cannot infringe upon that right. However, following the green amendment’s adoption in 1972, Montana’s law still prioritized its extractive energy and hard rock mining industries over its citizens’ environmental rights. Now, that landscape is beginning to change. In 2011, Montana adopted an amended State Energy Policy Act, which expressly forbade its agencies from considering the effects of climate …

“A Real Man . . .”: Deconstructing Machismo Heteronormative Standards With K–12 Latino Male Educators Through Dialogic Spaces, Mario Echeverria

Dissertations

In a K–12 educational landscape where 75% of educators are white women, recruitment of Latino male educators is crucial for diversification, yet these educators represent just 2% of the teaching workforce in the United States (NCES, 2020). These educators grapple with a layered sense of identity as they navigate expectations of hegemonic masculinity and machismo norms that dictate their roles as disciplinarians and saviors, especially for young boys of color (Brockenbrough, 2018; Lara & Fránquiz, 2015; Martino & Kehler, 2006; Mills et al., 2004; Singh, 2021). Unfortunately, Latino male educators leave the profession at twice the rate of their Latina …

The Post-Racial Deception Of The Roberts Court, Cedric M. Powell Jan 2024

The Post-Racial Deception Of The Roberts Court, Cedric M. Powell

SMU Law Review

Students for Fair Admissions v. Harvard/UNC (SFFA) is a post-racial deception unmoored from precedent and societal reality. SFFA deceives the polity and signals an all out assault on anti-discrimination law. To preserve its institutional legitimacy, the Roberts Court promotes doctrinal and conceptual distortions—post-racial deceptions of cognizable injuries advanced through reverse discrimination claims of white plaintiffs; racial proxy claims of discrimination proffered by Asian-Americans; and the fairness rationale of the Court’s circular post-racial edict that “the way to stop discrimination on the basis of race is to stop discriminating on the basis of race.” Chief Justice Roberts’s majority opinion discards the …
