Worker Debt And Worker Exit, Rachel Dempsey, David H. Seligman Jan 2024

Worker Debt And Worker Exit, Rachel Dempsey, David H. Seligman

University of Florida Journal of Law & Public Policy

One of the primary ways in which workers exercise power in the employment relationship is by leveraging competition among employers through the threat that they may go work for an employer that would pay them more or treat them better. Increasingly, employers have tried to undermine this core component of worker bargaining power through stay-or-pay contracts that charge workers penalties or threaten them with damages actions for leaving jobs before they have completed a prescribed term of employment. These contracts are intended and function to constrain worker mobility, suppress wages, and enable worker mistreatment. Through case studies of contemporary litigation …

Embracing Tax Avoidance, David Elkins Jan 2024

Embracing Tax Avoidance, David Elkins

University of Florida Journal of Law & Public Policy

Avoidance is a major theme in tax law jurisprudence. Congress, the Treasury, and the courts have developed numerous doctrines to deny beneficial treatment when the taxpayer’s principal purpose or presumed principal purpose was the avoidance of taxation. Each attempt to shut down tax avoidance then becomes the opening salvo in the next round of engagement as tax planners devise means of circumventing the restrictions and new rules are developed to counter the latest avoidance maneuvers. The thesis of this Article is that the incessant war on tax avoidance has prevented both academics and policymakers from appreciating the gifts that tax …

Making Beggars Out Of Victims: How Florida's Claim Bill System Leaves Claimants To Languish, Logan Grutchfield Jan 2024

Making Beggars Out Of Victims: How Florida's Claim Bill System Leaves Claimants To Languish, Logan Grutchfield

University of Florida Journal of Law & Public Policy

Within its waiver of state sovereign immunity, Florida requires plaintiffs who secure a judgment against the state, or one of its public entities, to seek legislative approval for payment of the judgment when it exceeds the statutory threshold. This Note explores the history of Florida’s waiver of sovereign immunity and the harm perpetuated by Florida’s claim bill system while also examining the unique features of Florida’s claim process. This Note then reviews other state approaches to sovereign immunity and recommends solutions for Florida’s claim system.

The Chinese Balloon Incident And Partisanism In International Law, Samuli Seppänen Jan 2024

The Chinese Balloon Incident And Partisanism In International Law, Samuli Seppänen

Cardozo International & Comparative Law Review

This Article discusses the implications of the February 2023 Chinese balloon incident for understanding Chinese foreign policy elites' approaches to international law. It argues that the Chinese balloon incident fits the perception of a globally ambitious and activist China. At the same time, the ethically ambiguous context offoreign surveillance flights problematizes the stark dichotomies between authoritarian and liberal approaches to international law. Chinese legal arguments in the Chinese balloon incident followed the Cold War-era playbook of diplomatic exchanges on unauthorized flights in foreign airspace. Moreover, the Chinese commentary on U.S. conduct in the Chinese balloon incident in some ways resembled …

Are Holocaust Denial Laws And Critical Race Theory Bans The Same?, Rob Kahn Jan 2024

Are Holocaust Denial Laws And Critical Race Theory Bans The Same?, Rob Kahn

Cardozo International & Comparative Law Review

Florida's education rules list Holocaust denial and critical race theory ("CRT") as "theories that distort the past." This is not a fair comparison. Holocaust denial laws and CRT bans are analytically distinguishable. Holocaust denial laws were originally intended to fight hate, and this is the only reason they might be legitimate today. By contrast, CRT bans, for all their well-meaning language aboutprotecting childrenfrom race-based accusations of guilt, intend to silence the past. Indeed, the CRT bans are uncannily similar to the laws used in Turkey to ban discussion of the Armenian Genocide in schools. While one might reject both sets …

Leading From The Middle: Arts Administrators' Beliefs About The Impact Of Arts Education On High-Needs Students, Sofia Fojas Jan 2024

Leading From The Middle: Arts Administrators' Beliefs About The Impact Of Arts Education On High-Needs Students, Sofia Fojas

Dissertations

Research on arts education notes the positive impact of arts education on educational outcomes for students, particularly students of color, students in poverty, and students needing additional academic support. Students living in low-income communities receive different educational opportunities than those in high-wealth districts. This disparity is especially true for highly mobile and high-needs students of color. Arts education has made positive differences in student outcomes. This qualitative study examined the beliefs of county arts leads, leaders in the middle, situated between the California Department of Education and their local school districts, and how they can be empowered to be change …

Medieval Art, Modern Politics, Brigitte Buettner, William J. Diebold Jan 2024

Medieval Art, Modern Politics, Brigitte Buettner, William J. Diebold

Art: Faculty Books

Medieval Art, Modern Politics is an innovative volume of twelve essays by international scholars, prefaced by a comprehensive introduction. It examines the political uses and misuses of medieval images, objects, and the built environment from the 16th to the 20th century. In case studies ranging from Russia to the US and from catacombs, mosques, cathedrals, and feudal castles to museums and textbooks, it demonstrates how the artistic and built legacy has been appropriated in post-medieval times to legitimize varied political agendas, whether royalist, imperial, fascist, or colonial. Entities as diverse as the Roman papacy, the Catholic Church, local arts organizations, …

How And Why Teachers Taught About The 2020 U.S. Election: An Analysis Of Survey Responses From Twelve States, Paul G. Fitchett, Brett L.M. Levy, Jeremy D. Stoddard Jan 2024

How And Why Teachers Taught About The 2020 U.S. Election: An Analysis Of Survey Responses From Twelve States, Paul G. Fitchett, Brett L.M. Levy, Jeremy D. Stoddard

Educational Theory and Practice Faculty Scholarship

This study explores social studies teachers’ self-reported instruction about teaching the 2020 election in U.S. secondary schools. We analyzed survey responses from 1,723 secondary social studies teachers from 12 states (3 left-leaning, 3 rightleaning, 6 battleground) collected in the weeks after the election, examining self-reported pedagogies, topics taught, and overall frequency of teaching about the election. Respondents reported teaching about the election more frequently if they taught courses in civics or government and/or if they had greater control over their curricula. Analyses indicated that teachers’ demographic characteristics, teaching contexts, and ideologies about civic education were related to the election-related topics …

How Can Educators Motivate Young People To Participate In Civic Life?, Brett L.M. Levy Jan 2024

How Can Educators Motivate Young People To Participate In Civic Life?, Brett L.M. Levy

Educational Theory and Practice Faculty Scholarship

Introduction:

In a democratic society, why do some people engage in civic and political action while others sit on the sidelines? What — if anything — can educators do to support informed civic participation among a wider segment of the population, even at a time of political cynicism?

These are challenging and vital issues, as we see during each election cycle and the periods in between, and I’ve tried to address them from various angles.

As a middle school social studies teacher in the early 2000s, I aimed to motivate young people to be civically engaged — sometimes succeeding, sometimes …

Battling The Form: A Front-End Approach To Default-Use Noncompetes, Rachel Arnow-Richman Jan 2024

Battling The Form: A Front-End Approach To Default-Use Noncompetes, Rachel Arnow-Richman

University of Florida Journal of Law & Public Policy

A growing consensus holds that employer overuse of noncompete agreements adversely affects workers and the economy. But there is little agreement on how best to regulate these instruments. States have experimented with an array of idiosyncratic reforms that capture the most egregious misuses, while the Federal Trade Commission (FTC), has issued an outright ban that would prohibit all employee noncompetes and comparable instruments nationwide.

This Article argues that any effective reform strategy must target what it terms “default-use” noncompetes—boilerplate restraints imposed by employers as a matter of course without close consideration of their underlying justification. Some unlawful noncompetes are clearly …

Stop Worrying About What To Wear To Court: It Probably Doesn't Matter, Catherine Cameron Jan 2024

Stop Worrying About What To Wear To Court: It Probably Doesn't Matter, Catherine Cameron

University of Florida Journal of Law & Public Policy

New lawyers are often told to wear conservative clothes to court, so their clothing does not distract from their message. And many new lawyers have responded to this advice by questioning whether the advice is more myth than science. To assess the validity of this oft-repeated advice, the author of this Article conducted a study using eye-tracking technology and traditional survey questions to test whether potential jurors who watched an opening statement given by a conservatively dressed attorney would learn and remember information differently than a potential juror who watched an opening statement given by a non-conservatively dressed attorney. This …

Real Estate Recycling: Supporting Office-To-Residential Conversions, Kate Hamman, Kiara Sims Jan 2024

Real Estate Recycling: Supporting Office-To-Residential Conversions, Kate Hamman, Kiara Sims

University of Florida Journal of Law & Public Policy

Following decades of zoning constraints, over-dependence on commercial land uses, and the recent trend toward work-from-home policies, U.S. downtowns are struggling to maintain tax revenues sufficient to keep downtowns vibrant and safe. One potential means of partially addressing these challenges is through greater government support of converting empty office buildings into affordable residential housing. Such office-to-residential conversions can increase affordable housing stock, promote social justice, mitigate climate change, and revitalize city cores. Unfortunately, a variety of structural, legal, and financial constraints presently make these conversion projects unduly difficult and expensive. This Article first highlights how office-to-residential conversions could help mitigate …

I Am Still Afraid A Federal Judge Is Going To Be Killed: What More Can Be Done To Protect The Judiciary In A Polarized Society, Natalie Rickards Jan 2024

I Am Still Afraid A Federal Judge Is Going To Be Killed: What More Can Be Done To Protect The Judiciary In A Polarized Society, Natalie Rickards

University of Florida Journal of Law & Public Policy

The idea that politicians would intimidate judges, that judges or their families would be murdered for their rulings, or that deadly mob violence might erupt in response to particular decisions all seemed the province of other countries, places that lack democracy or the rule of law. But all of these things have happened in the United States, in just the past few years.

Familial Consequences Following Deconversion: Perceived Parental Openness, Intrinsic Religiosity, And Impact Of Familial Repair, Michaelia R. Conway Jan 2024

Familial Consequences Following Deconversion: Perceived Parental Openness, Intrinsic Religiosity, And Impact Of Familial Repair, Michaelia R. Conway

Master's Theses & Other Graduate Student Works

This January 2024 Master of Science in Psychology thesis at Lipscomb University looks at how previous research on deconversion from a Christian religious background to atheism indicates that individuals experience negative social consequences with family, friends, and community groups when they disclose that their beliefs have changed (Marriott, 2015); (Dollinger, 2018). Past research has shown that mothers are impacted by their emerging adult child’s deconversion (Marriott, 2015). Studies also indicate that parents who are extrinsically religious and less open to new experiences are more likely to dismiss their emerging adult child’s worldview (Marriott, 2015). These findings are all derived from …

Eliciting The Effect Free Roaming Cats Have On Native Hawaiian Wildlife Using Stable Isotope Analysis, Erin Salano Jan 2024

Eliciting The Effect Free Roaming Cats Have On Native Hawaiian Wildlife Using Stable Isotope Analysis, Erin Salano

Theses and Dissertations--Biology

This study measured the concentration of the stable isotopes Carbon and Nitrogen within the tissues of free-roaming and indoor cats on the Hawai’ian islands. This study aimed to determine whether cats are consuming more human provisioned or wild food sources and whether their diet is having a negative impact on endemic species; with a focus on assessing impacts on conserved bird populations. We hypothesized that human provisioned food sources have higher levels of carbon due to the amount of corn fillers within them, while wild food sources are more Nitrogen rich. We found that indoor and feral cats sampled from …

Navigating Asynchronous Online Learning: The Impacts Of Active Learning And Assigned Group Work On Student Motivation, Belonging, And Inclusion, Shea Elisabeth Carr Jan 2024

Navigating Asynchronous Online Learning: The Impacts Of Active Learning And Assigned Group Work On Student Motivation, Belonging, And Inclusion, Shea Elisabeth Carr

Theses and Dissertations--Biology

Motivation, belonging, and inclusion are all critical factors for student success but can be difficult to support in asynchronous online courses. Active learning and required group work have been shown to increase student motivation in in-person and synchronous online courses, but little is known about their impact in online asynchronous settings. This dissertation aimed to 1) evaluate the effect of active learning on student motivation in an online asynchronous setting and 2) evaluate the impact of assigned group work on student motivation and perceptions of belonging and inclusion within the context of an online, asynchronous physiology laboratory course. It was …

Educators’ Perspectives On University Technology Transfer Processes In The Philippines: A Case Study, Leni Garcia, Kenbert Alan Ting, Mark Van Hoorebeek Jan 2024

Educators’ Perspectives On University Technology Transfer Processes In The Philippines: A Case Study, Leni Garcia, Kenbert Alan Ting, Mark Van Hoorebeek

Asia-Pacific Intellectual Property Management and Innovation Book Series

As universities extend the scope of their tasks as educational institutions to include technology transfer and commercialization of their faculty’s and students’ research outputs, it becomes necessary to investigate internal systems that facilitate such processes. Existing literature on technology transfer in the Philippines is mostly focused on the transfer of a specific technology, industry–academe research and development (R&D) collaboration, the experience in a specific industry, or the experience in public Philippine higher education institutions (HEIs). The perspectives of educators and researchers who are the recipients of technology transfer services within Philippine HEIs have, so far, not yet been investigated. This …
