European Soft Law Instruments For Sustainability Agreements – Presentation Of Procedural Issues, Critical Analysis And Recommendations For The President Of The Occp, Agata Zawłocka-Turno
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
The article focuses on the procedural aspects of soft law tools employed by competition authorities in Europe, in order to help businesses advance sustainable development. In response to global challenges, such as the climate crisis, some authorities have introduced guidelines and informal guidance to enable companies to undertake pro-environmental collaboration, without breaching competition laws. Examples include guidelines from the European Commission, as well as those from the UK, Dutch, and French competition authorities. The article examines how effective these tools are, their impact on legal certainty for businesses, and explores how a similar approach could be implemented by the Polish …

The Impact Of The Judgment In Case C-211/22 Super Bock On The Assessment Of Vertical Pricing Agreements, Krzysztof Kanton
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
The article discusses the impact of the judgment of the Court of Justice of the European Union (CJEU) in the Super Bock case (C-211/22) on the assessment of vertical pricing agreements under EU competition law. The judgment underscores the need to apply an economic approach when assessing whether an agreement, which provides for the setting of fixed or minimum resale prices, constitutes a restriction of competition ‘by object’. In this judgment, the CJEU rejects the previous formalistic approach – present in the practice of the EC and NCAs – which automatically qualified RPMs as anti-competitive, without analyzing its economic and …

Effective Revenue Growth Strategies For Nonprofit Organizations, Girum Assefa Gebretsadik
Walden Dissertations and Doctoral Studies
Nonprofit organizations serving under-resourced communities often face persistent challenges in securing sustainable revenue streams for fulfilling their mission and maintaining essential services, which can negatively impact vulnerable populations. Using the Baldrige excellence framework (BEF) as a conceptual lens, this qualitative single case study was conducted to explore effective revenue growth strategies to enhance financial stability, reduce financial uncertainty, strengthen resilience, and enhance community service delivery. Data collection included in-depth interviews with client leadership in the northeastern United States, an analysis of organizational documents, and financial data to support methodological triangulation. Thematic analysis using Yin’s 5-step process led to four core …

Metaplastic breast cancer (MpBC) is a highly chemoresistant subtype of breast cancer with no standardized therapy options. A clinical study in anthracycline-refractory MpBC patients suggested that nitric oxide synthase (NOS) inhibitor NG-monomethyl-l-arginine (L-NMMA) may augment anti-tumor efficacy of taxane. We report that NOS blockade potentiated response of human MpBC cell lines and tumors to phosphoinositide 3-kinase (PI3K) inhibitor alpelisib and taxane. Mechanistically, NOS blockade leads to a decrease in the S-nitrosylation of c-Jun NH

Cross-Generational Perception Analysis Of The Role Of Sharia Economics In Reducing Social Inequality In Jakarta (Case Study Of Gen Z, Gen Y, Gen X, And Early Gen X), Kuncoro Hadi, Nuraini Nuraini
Journal Of Middle East and Islamic Studies
This study aims to analyze cross-generational perceptions of the role of Islamic economics in reducing social inequality in Jakarta. Using a quantitative approach, this study collected data from 994 respondents divided into four age groups (18-25 years, 26-35 years, 36-45 years, and 46-55 years). Data were analyzed using the Kruskal-Wallis test to evaluate differences in perceptions between age groups on the basic principles of Islamic economics, the fairness of the system, and the effectiveness of its implementation. The results showed significant differences in understanding and perception between age groups, with 26-35 years old having the highest level of understanding. The …
How Halal Certification And Islamic Ethics Tackle Greenwashing: New Solutions For A Sustainable Economy, Muhammad Afif Ryan Pratama
How Halal Certification And Islamic Ethics Tackle Greenwashing: New Solutions For A Sustainable Economy, Muhammad Afif Ryan Pratama
Journal Of Middle East and Islamic Studies
This research explores the role of halal certification and Islamic ethics in addressing greenwashing within the financial sector. Greenwashing, the practice of exaggerating environmental responsibility, undermines genuine sustainability efforts and trust among consumers and investors. Islamic finance, based on principles of transparency, social justice, and ethical business practices, provides a robust framework to counter such deceptive practices. The study proposes expanding halal certification to incorporate environmental standards, ensuring that companies demonstrate both ethical and sustainable practices. This integrated approach offers a unique solution to combat greenwashing and aligns with broader sustainability goals. By including sustainability in halal certification, the credibility …

Coccolithophores comprise a major component of the oceanic carbon cycle. These unicellular algae produce ornate structures made of calcium carbonate, termed coccoliths, representing ~ 50% of calcite production in the open ocean. The exact molecular mechanisms which direct and control coccolith formation are unknown. In this study, we report on the presence and functional features of proteins within the coccoliths produced by a range of model coccolithophore species including: the globally abundant and well-studied Gephyrocapsa huxleyi (formerly Emiliania huxleyi) and related Gephyrocapsa oceanica, as well as the larger and more heavily calcified Coccolithus braarudii. Protein features were compared between species …

Afghan Allies In Limbo: Discrimination In The U.S. Immigration Response, Lindsay M. Harris, Yalda Royan
San Diego Law Review
After the fall of Kabul in August 2021, the U.S. government airlifted an estimated 120,000 people to safety from Afghanistan. An airlift of this scale was unprecedented, but also woefully inadequate as a solution to the Afghan humanitarian crisis. This Article, a contribution to participatory law scholarship, is written by a U.S. law professor and immigration expert and an Afghan woman evacuated from Afghanistan in 2021 and analyzes the United States’s immigration response to the Afghan humanitarian crisis following the Taliban takeover. While the United States granted humanitarian parole for two years to approximately 76,000 individuals, permitting them to enter …
Deadly Deterrence: Border Patrol Authority, Pursuits, And Deported Witnesses, Shaw Drake
Deadly Deterrence: Border Patrol Authority, Pursuits, And Deported Witnesses, Shaw Drake
San Diego Law Review
Since 1994, the United States has perpetrated a border policy based on the idea that tougher enforcement will mean fewer people will cross the border—termed “prevention through deterrence.” But this idea has never fulfilled its stated aim and has turned into something resembling a border ideology rather than a border policy based in fact and reality. The results have been deadly.
This Article examines a small slice of the results of this deadly border policy as it looks at Border Patrol vehicle pursuits and the deportation of those who witness Border Patrol misconduct. It also provides an overview of the …

Fentanyl, Narco-Terrorism, And National Security Politics, J. Richard Broughton
San Diego Law Review
This Article examines the use of a counterterrorism model to attack the fentanyl crisis. Rather than advocate for or against such a model, this Article envisions what employing a counterterrorism model against international drug traffickers would look like. Noting the dimensions of national security politics that intersect with counter-fentanyl policy, this Article will evaluate three distinct counterterrorism approaches: (1) using criminal counterterrorism statutes in federal indictments and prosecutions; (2) designating drug trafficking organizations as Foreign Terrorist Organizations (FTOs); and (3) authorizing the use of military force against Mexican cartels. While the current state of bellicose national security politics can inform …

Day in and day out, across administrations at all levels of government, a cadre of impassioned change agents, including advocates, service providers, community stakeholders, and grassroots organizations, are called to action to fight. Through exhaustion and fatigue, this group unequivocally continues to center humanity and uplift sustainable solutions.
As a “border attorney,” I have been proximate to this work and space for more than fourteen years, the entirety of which has been at Jewish Family Service of San Diego (JFS), a refugee resettlement organization, pro bono legal service provider, and operator of the San Diego Rapid Response Network Migrant Shelter …
The Uses Of The Border, Salvador G. Sarmiento
The Uses Of The Border, Salvador G. Sarmiento
San Diego Law Review
It is a good and necessary time to discuss “American Law at the Border” to better understand and engage with the politics and laws ostensibly addressing U.S. borders. Let’s hope it is also an exercise in understanding the borders of U.S. law itself—the limits, the periphery, and the jagged edges. A discussion on American law at the border should make clear that what is considered at the margins—starting with migrant labor—is central to U.S. economic, legal, and political life.
The first section of this Article will discuss the political uses of the border, beginning with the most recent example of …

Currently there are no effective treatments for an array of neurodegenerative disorders to a large part because cell-based models fail to recapitulate disease. Here we develop a reproducible human iPSC-based model where laser axotomy causes retrograde axon degeneration leading to neuronal cell death. Time-lapse confocal imaging revealed that damage triggers an apoptotic wave of mitochondrial fission proceeding from the site of injury to the soma. We demonstrate that this apoptotic wave is locally initiated in the axon by dual leucine zipper kinase (DLK). We find that mitochondrial fission and resultant cell death are entirely dependent on phosphorylation of dynamin related …

Accurate predictions of herbicide dissipation endpoints are essential for making environmental management decisions, estimating the duration of weed control, and deciding crop replant and rotation options. The performance of the single first-order (SFO), first-order multiple-compartment (FOMC), bi-exponential (BEXP), first-order double-exponential decay (FODED), and first-order two-compartment (FOTC) was evaluated to describe S-metolachlor dissipation. Results showed that the BEXP and FOTC were not appropriate. The FODED was ranked as the top model with the lowest Akaike's information criterion (AICc) value among the other three candidate models and was followed by the FOMC model. The SFO displayed the largest root mean square …

Reading As Lesbian, Reading As Trans* And Thinking Intergenerationally, Katherine Binhammer
ABO: Interactive Journal for Women in the Arts, 1640–1830
Written from the perspective of a critic who came of age in the queer 1990s, this essay considers the generational difference in understandings of Charlotte Charke as a butch lesbian and a transman. It argues that the history of sexuality demands an intergenerational reading practice because our objects are always engaged in a history of the present.

Teaching Margaret Cavendish Through The Lens Of Scientific Anti-Realism, Kevin Lower
ABO: Interactive Journal for Women in the Arts, 1640–1830
Margaret Cavendish (1623-1673) only began receiving sustained attention by historians of philosophy in recent decades, but she is being rapidly integrated into the early modern philosophical canon. This essay explores one dimension of teaching Cavendish that presents difficulties for introductory philosophy students: her criticisms of experimental philosophy. Section one explains how I integrate Cavendish into the narrative of my course, identifying both historical and thematic strategies for including her in introductory philosophy courses. Section two describes methods for teaching Cavendish’s natural philosophy and identifies a pedagogical challenge to presenting her criticisms of experimental philosophy. In their first exposure to Cavendish, …
Playing Proverbs With Madame De Genlis, Rebecca Cypess
Playing Proverbs With Madame De Genlis, Rebecca Cypess
ABO: Interactive Journal for Women in the Arts, 1640–1830
The theatrical genre known as the proverbe dramatique, which flourished as a pastime of French high society during the late eighteenth century, has often been understood through the written exemplars left by the author and artist Louis Carrogis, known as Carmontelle. Yet Carmontelle’s literary contributions to the genre have obscured the vast range of activities known as jouer des proverbes (playing proverbs)—activities associated especially with women—which included conversational games, pantomime, poetry, dance, and music making. Attending to the many descriptions of jouer des proverbes left by Stéphanie Félicité Ducrest de Saint-Aubin, the Comtesse de Genlis, reveals that the literary …

Simulating An Eighteenth-Century Enlightenment Salon: Embodied Experience And Scholarly Investigation, Jennifer M. Jones
ABO: Interactive Journal for Women in the Arts, 1640–1830
This paper reflects on my experience simulating an 18th-century French salon for an academic conference and in an undergraduate classroom. I argue that simulating a salon is heuristically as well as pedagogically useful and allows historians to test hypotheses about the nature of the salon and the role of the salonnière proposed by scholars such as Dena Goodman and Antoine Lilti. The essay also engages with some of the important insights gained from feminist and performance theory regarding historical reenactment. Thus I caution against naive attempts to reenact the past and instead suggest practices that foster open-ended conversations about the …

Utilitarian And Self-Representational: Player-To-Player Character Relationships In Final Fantasy Xiv, Zu Er Guan
Theses
This thesis studies the relationships between video game players and their player characters, the characters that they control, through the lens of player purpose and intent by conducting research using an online survey developed and analyzed using an interdisciplinary methodology based on existing studies in the field regarding avatar identification, player psychology, and queer and feminist theory. This thesis posits that are two types of player relationships with their player characters based on player intent—player characters as the personal avatar and representation of the self, and player characters as a tool for the execution of player control and gameplay experience. …

BACKGROUND: Obesity is a chronic, relapsing, progressive disease of excess adiposity that increases the risk of dying from at least 16 types of cancer. The prevalence of obesity has increased more rapidly in cancer survivors compared with the general population. Tailored weight management strategies are needed to improve prognosis and health outcomes in the growing population of cancer survivors. However, certain cancer survivor population subgroups require unique consideration when developing weight management strategies. METHODS: In a symposium convened by The Obesity Society during ObesityWeek 2023 titled "From Surviving to Thriving: Key Considerations for Weight Control Across Diverse Cancer Survivorship Populations," …

Interculture Marketing From A Multimodal Perspective: Taking Burberry As An Example, Huan Liu, Shaojun Bai
Visions in Leisure and Business
In today's era of globalization and international reach, firms and organizations are actively seeking fresh avenues to grow and broaden their operations, particularly beyond their domestic markets. Achieving success in new markets is not solely dependent on creating a high-quality product, but also effective marketing. This essay takes Burberry as an example, analyzing the influence of culture in intercultural marketing from a multi-modal perspective. The posters for a Chinese New Year marketing campaign lack symmetry and harmony, contrary to Chinese aesthetics. The prominent element does not align with the campaign's purpose. The use of black violates New Year taboos, and …

This article aims to explore the application of visual grammar in a cross-cultural context. Taking the visual grammar performance of electric car advertisements in different cultural backgrounds as an example, it analyzes how visual elements in these advertisements reflect visual grammar from a cross-cultural perspective, focusing on the principles of cross-cultural business communication. Based on the visual grammar theory of Kress and van Leeuwen, this study selected electric vehicle advertising samples from China and the United States and analyzed them using content analysis. The study found that although global electric vehicle advertisements have commonalities in conveying core values such as …

Fair Wage: An Analysis Of Executive Compensation Through The Lens Of Catholic Social Teaching, James Martin, Mariah Webinger, Brian M. Saxton
Journal of Management for Global Sustainability
The controversy surrounding executive compensation has received attention in the popular press and academic literature. We explore executive compensation through the lens of Catholic Social Teaching (CST), outline the basic principles of CST and compare and contrast them with corporate social responsibility (CSR), and identify human dignity, in contrast to profit maximization, to be the differentiator between the two. Next, we use CST to develop a model for measuring excessive executive compensation. We then conduct a cluster analysis of our measure of excessive compensation with another CST variable: investment in employees. Lastly, we examine differences in the clusters regarding environmental …

Exploring Predictors Of Purchase Intention Toward Plant-Based Meat, Kristiana Ginelle D. Monares, Ken Sean D. Roque, Melissa A. Santos, Sofia Marianne S. So, Catherine A. Valentin, Alvin Patrick M. Valentin
Journal of Management for Global Sustainability
Plant-based meat (PBM) presents itself as a sustainable alternative to meat production systems that have adversely impacted consumers’ health and the environment at large. In the Philippine context, however, there are only a few PBM manufacturers to date even though production has been emerging with expanded options for consumers to consider. Moreover, while PBM’s potential allows it to be a prospective working food system in the country through the promotion of healthier food chains, the literature on PBM in the Philippines is scant. This study thus contributes to this literature by exploring predictors of purchase intention toward PBM. The researchers …

Hauntings Of Publication Deaths, Possibilities For Our Academic Present, Kathleen (Kaye) A. Hare, Amber Moore
Hauntings Of Publication Deaths, Possibilities For Our Academic Present, Kathleen (Kaye) A. Hare, Amber Moore
Journal of Feminist Scholarship
In this paper, we use a feminist dialogue to query publication deaths that haunt us. We ruminate on respective past publications that remain unread and uncited, despite encapsulating defining events in our development as scholars. For Author Kaye Hare this was an affective narrative that troubled a seemingly ideal moment of public scholarship; for Author Amber Moore, this was a hard-fought analysis of precarious intersectional feminist resistance in popular culture. Inspired by the horror-film genre “spectral incognizance,” we methodologically deploy a multivocal dialogical structure based on multiple revisitings that attenuate anxieties of metaphorical publication death, before revealing that this death …
