"Common But Differentiated Responsibilities” In The Paris Agreement, Henrique Schneider Jan 2024

"Common But Differentiated Responsibilities” In The Paris Agreement, Henrique Schneider

FIU Law Review

The Paris Agreement, adopted in 2015, epitomizes a political approach to climate action, devoid of scientific oversight at its inception. This political nature underscores its essence, emphasizing action over guaranteed results. With a foundation in "common but differentiated responsibilities" (CBDR), nations set diverse climate goals based on unique circumstances. However, this diversity complicates policy alignment and raises challenging questions, such as the feasibility of carbon border adjustments and intellectual property dilution. Analyzing CBDR within the Paris Agreement framework unveils its evolution, shaped by political negotiations and national actions. This study delves into the intricate interplay between politics, policy, and international …

Reforming The Federal Regulatory Review Process, Joanne Spalding, Andres Restrepo Jan 2024

Reforming The Federal Regulatory Review Process, Joanne Spalding, Andres Restrepo

FIU Law Review

For decades, the Office of Information and Regulatory Affairs (OIRA) has overseen the development of federal regulatory policies with a strong emphasis on benefit-cost analysis. Despite its conceptual appeal, this analytic tool consistently shortchanges environmental and public health protection, with especially negative consequences for environmental justice communities. In this article, we address some of those shortcomings, focusing in particular on the standard agency practice of arithmetically discounting regulatory costs and benefits that accrue in the future. We propose that the OIRA abandon this practice as it relates to non-market goods, such as human lives saved, and instead work toward a …

An Unauthorized Renaissance? An Analysis Of Artists’ Claims For Copyright Infringement Against Ai Generated Art And Possible Defenses, Victoria Young

FIU Law Review

AI currently presents a novel issue in terms of copyright infringement, specifically AI generated art. Recently, a group of artists filed a class action lawsuit against several AI generated art companies. This comment evaluates the potential avenues the court may take. The artists allege these AI generated art companies directly infringed on their copyrighted works by making unauthorized copies of copyrighted works which they used to train their machine learning programs. A determination on whether AI generated art constitutes copyright infringement has not been made by the courts before. To bring a successful copyright infringement claim, a party must show …

Information Systems Faculty Publications and Presentations

Effective identity management is essential for secure organizational processes, but organizations often do not approach it strategically. To break this trajectory, organizational policymakers need to define a clear and sustainable identity management strategy. This paper presents an overview and guidelines to help shape such strategy. It analyzes the key characteristics and trade-offs of today’s identity management models. Moreover, it offers practical recommendations for organizational policymakers when choosing among these models.

Trial Selection And Estimating Damages Equations, Keith N. Hylton Jan 2024

Trial Selection And Estimating Damages Equations, Keith N. Hylton

Faculty Scholarship

Many studies have employed regression analysis with data drawn from court opinions. For example, an analyst might use regression analysis to determine the factors that explain the size of damages awards or the factors that determine the probability that the plaintiff will prevail at trial or on appeal. However, the full potential of multiple regression analysis in legal research has not been realized, largely because of the sample selection problem. We propose a method for controlling for sample selection bias using data from court opinions.

DNA extraction for downstream molecular diagnostic applications can be an expensive, time-consuming process. We devised a method to quickly extract total bacterial DNA from environmental samples based on the sodium hydroxide lysis of cells with or without capture by magnetic beads for subsequent PCR or quantitative PCR. The final DNA extraction method using NaOH is extremely low-cost and can be completed in as little as 10 min at room temperature with dilution, or the DNA can be further purified using silica-coated paramagnetic beads. NaOH extraction was effective for Gram-negative and Gram-positive bacteria in samples from air, soil, sewage, food, laboratory …

Multibillion-Dollar Tax Questions, James Alm, Jay A. Soled, Kathleen Delaney Thomas Jan 2024

Multibillion-Dollar Tax Questions, James Alm, Jay A. Soled, Kathleen Delaney Thomas

Faculty Publications

Tax compliance in the United States historically hovers in the 80 percent range, costing the nation approximately half a trillion dollars annually in uncollected tax revenue. To foster greater tax compliance, the Internal Revenue Service (IRS) should employ whatever tools are at its disposal. Standard deterrence theory argues that increasing the audit rate and imposing stiffer penalties would foster greater tax compliance. There are political headwinds, however, that strongly suggest that these approaches are not currently viable. Instead, there is a low-cost method that could yield greater tax compliance. Drawing on recent and compelling social science research, the IRS should …

Faculty Articles, Papers, and Other Scholarship

Science is often portrayed as a meritocratic endeavor, but university biology programs exhibit high rates of student attrition, particularly among students of Color, despite similar interest and aptitude for science, technology, engineering, and mathematics (STEM) as White students. Culturally relevant pedagogy is associated with student persistence in STEM. One way to practice culturally relevant pedagogy in biology courses is to engage students in discussions of race, racism, or racial equity. Guidance exists to help instructors incorporate race-related topics into the biology curriculum, but the reasoning behind the decision of whether to adopt this practice is not well characterized. Understanding instructors’ …

Student Loan Debt: Exploring The Economic Influences On Federal Student Loan Default For Students That Attended Public, Two-Year Institutions, Brian Perry

Theses and Dissertations--Educational Policy Studies and Evaluation

Over the past 30 years, a shift occurred in higher education that saw more of the burden for paying for postsecondary education placed on students. Combined with rising tuition and fees, this has led students to take on increasing amounts of student debt. Despite the historic rise in student loans, surprisingly little attention has focused on those students who default on their student loans. Additionally, the academic literature on student loans has predominately focused on traditional students at four-year institutions, despite the fact that nearly half of all undergraduates attend public two-year institutions. Finally, those studies that include economic factors …

Topological Models Of Abstract Commensurators, Edgar A. Bering, Daniel Studenmund Jan 2024

Topological Models Of Abstract Commensurators, Edgar A. Bering, Daniel Studenmund

Faculty Research, Scholarly, and Creative Activity

The full solenoid over a topological space X is the inverse limit of all finite covers. When X is a compact Hausdorff space admitting a locally path-connected universal cover, we relate the pointed homotopy equivalences of the full solenoid to the abstract commensurator of the fundamental group π1(X). The relationship is an isomorphism when X is an aspherical CW complex. If X is additionally a geodesic metric space and π1(X) is residually finite, we show that this topological model is compatible with the realization of the abstract commensurator as a subgroup of the quasi-isometry group of π1(X). This is a …

Enhancing Diagnostic Accuracy: A Hybrid Approach To Mitigate Speckle And Rician Noise In Medical Images, Naveenkumar Jayakumar, Saurabh Saoji, Sagar V. Joshi, Hemlata Mane, Roshni Narkhede, Shrikant Jadhav

Faculty Research, Scholarly, and Creative Activity

This research explores the detrimental effects of Rician and speckle noise in medical imaging, particularly within MRI and radiographic modalities. Such noise can significantly obscure critical details, potentially leading to misdiagnoses and inaccurate measurements. Rician noise candidly dangles on the signal strength. Removing this noise affects the origial information in image that makes this noise removal perplexing. On other hand speckle noise is visualised like granular clog in ultrasound imageries. It creates ambiguous details and edges in the images. To address this challenge, the study introduces a novel hybrid method implemented in Java. The method employs a frequency-based decomposition approach …
