Parental Involvement In Children's Writing, Bronte Peta Kelso-Marsh Jan 2024

Parental Involvement In Children's Writing, Bronte Peta Kelso-Marsh

Theses: Doctorates and Masters

Research suggests that parental involvement is important for supporting children’s early literacy development. However, much of the existing research has focused on reading outcomes, and studies have seldom examined the influence of parental involvement on children’s writing outcomes. Learning to write is a complex process. Furthermore, although writing is a necessary skill required throughout schooling and the workforce, evidence from international studies suggests children’s writing performance is in decline. Theoretical models of writing have proposed the importance of contextual factors in shaping children’s writing acquisition and development, which may include parents. However, whilst previous research suggests parental involvement in supporting …

The Experiences Of Older Immigrants Living With Dementia In Australia: A Multi-Method Secondary Analysis, Pelden Chejor Jan 2024

The Experiences Of Older Immigrants Living With Dementia In Australia: A Multi-Method Secondary Analysis, Pelden Chejor

Theses: Doctorates and Masters

The ageing immigrant population and rising dementia cases underscores the need for culturally appropriate dementia care services. However, accessing dementia care services can be challenging for immigrants due to cultural and linguistical differences including their health beliefs. Understanding the experiences and concerns of older immigrants living with dementia is imperative for the planning and delivery of culturally and linguistically appropriate care. The aim of this thesis was to explore and describe the experiences of older immigrants living with dementia, as well as to describe and compare (against non-immigrants living with dementia) the characteristics (neuropsychiatric symptoms and pain characteristics) of older …

The Catholic Modernity Of Pope Benedict Xvi: Healthy Secularity And Christian Jurisprudence, Zachary R. Calo Jan 2024

The Catholic Modernity Of Pope Benedict Xvi: Healthy Secularity And Christian Jurisprudence, Zachary R. Calo

Scholarly Works

This article examines the concept of healthy secularity in the thought of Pope Benedict XVI. In developing the idea of healthy secularity, Benedict builds upon longstanding themes in Catholic social thought while also provoking a deeper engagement with western modernity. Rather than placing Christianity and the secular in an oppositional framework, Benedict positions Christianity as the foundation of an authentic secular order. In so doing, he opens up new modes of critical engagement with western legal and political thought. Yet, while the concept offers a creative theological method for addressing contemporary issues, it depends for its realisation on vanishing cultural …

Tribes,States, And Sovereigns' Interest In Children, Emily Stolzenberg Jan 2024

Tribes,States, And Sovereigns' Interest In Children, Emily Stolzenberg

Faculty Publications

Haaland v. Brackeen, the unsuccessful SCOTUS challenge to the Indian Child Welfare Act (ICWA), trumpeted a critique made consistently over the statute’s 45-year history: that ICWA harms Indian children by subordinating their interests to their tribes’ interests, unlike State family law, which pursues the “best interests of the child.” This critique is likely to underpin future challenges to ICWA—and it is wrong in both fact and theory. Not only does ICWA generally benefit Indian children. More fundamentally, a tribe’s interest in Indian children corresponds directly to an interest States regularly pursue vis-à-vis all children: the political community’s interest in self-perpetuation. …

The Thrusts And Parries Of Policy Arguments, Scott Hirst Jan 2024

The Thrusts And Parries Of Policy Arguments, Scott Hirst

Faculty Scholarship

Anyone who has ever put forward a policy proposal has heard the response, “if it ain’t broke, don’t fix it.” But despite the ubiquity of this attack on policy proposals, there has been little sustained inquiry into how the attack works and how it can be defended. The goal of this Article is to identify policy attacks like this, and to show their underlying logical structure, and how they function to attack policy proposals. The Article demonstrates this approach by considering three generic attacks on policy proposals, which I refer to as ain’t broke attacks, partial framing attacks, and dollar …

Afreeist Legal Theory And The Problem Of Innocence, Stephen G. Marks Jan 2024

Afreeist Legal Theory And The Problem Of Innocence, Stephen G. Marks

Faculty Scholarship

Afreeism refers to the lack of the assumption that human beings have free will. Rather, it assumes that humans are subject to the same laws of physics, chemistry, biology, etc., that govern all other phenomena. Afreeist Legal Theory in turn is a legal theory that forgoes the assumption of free will. By foregoing the notion of free will, we also forgo notions of desert, blame, and moral responsibility. Human beings are causally or stochastically deterministic beings. As such, they can never do other than what they do. And because they never possess the ability to do otherwise, they are at …

Sound Marks, Deborah R. Gerhardt, Jon J. Lee

Faculty Publications

A lion roars just before a film rolls. A doughboy giggles. A giant green man laughs a hearty, "Ho, Ho, Ho." These iconic sounds are all federally registered as trademarks. They identify specific brands and distinguish their products and services from the competition. Human brains treat sounds like these as categorization tools and cognitive shortcuts—ideal trademark symbols. But what about the sounds your favorite toys or electronic devices make? Or those made by a fictional character in the latest blockbuster?

This Article tackles these issues and others. We push back against the widely-held belief that all unconventional trademarks—product designs, colors, …

Shaping College Habitus: An Exploration Of The Effect Of The Social/Spatial Construction Of First-Year Classes On The Habitus Of Low-Income, Working-Class Rural Students, Joshua R. Mcconnell Parsons

Theses and Dissertations--Educational Policy Studies and Evaluation

Low-income, working-class (LI/WC) students entering spaces of higher education often face completely new social and cultural fields that do not match their prior experiences, requiring them to construct new conceptualizations of their habitus within those spaces—the way they internalize and interact with the world. However, a dearth of research exists on how these students’ conceptualizations of the social and physical spaces that make up their actual classroom and academic experiences play a role in how they come to form their new identities or habitus. This in-depth qualitative analysis of students’ habitus formation leverages Doreen Massey’s theoretical framework of critical spatiality …

The Role Of Intersectionality In Research On Teachers Of Color And Indigenous Teachers, Saili S. Kulkarni, Tanja Burkhard, David J. Johns

Faculty Research, Scholarly, and Creative Activity

This paper emphasizes the complexity and criticality of intersectionality in understanding the research on Teachers of Color and Indigenous Teachers (TOCIT). Cho and colleagues (2013) identified three dimensions of intersectional dialogues: how intersectionality has been used in research and teaching, how it has been used as a theory and methodology, and how it has been used in community organizations. As Cho and colleagues noted, what intersectionality does in theory is equally as important as what it does in practice. Therefore, we drew from the recently published Handbook of Research on Teachers of Color and Indigenous Teachers to highlight how intersectionality …

The Harms Of Heien: Pulling Back The Curtain On The Court's Search And Seizure Doctrine, Steven M. Goldstein --

Vanderbilt Law Review

In Heien v. North Carolina, the Supreme Court held that individuals can be seized on the basis of reasonable police mistakes of law. In an opinion authored by Chief Justice Roberts, the eight-Justice majority held that the Fourth Amendment’s prohibition of “unreasonable” seizures does not bar legally mistaken seizures because “[t]o be reasonable is not to be perfect.” Concurring, Justice Kagan, joined by Justice Ginsburg, emphasized that judicial condonation of police mistakes of law should be “exceedingly rare.” In a solo dissent, Justice Sotomayor fairly “wonder[ed] why an innocent citizen should be made to shoulder the burden of being seized …

Access To Justice For Black Inventors, Jordana R. Goodman, Khamal Patterson Jan 2024

Access To Justice For Black Inventors, Jordana R. Goodman, Khamal Patterson

Vanderbilt Law Review

To receive a patent, an inventor must meet certain inventive and procedural standards. Their invention must be novel, nonobvious, and written in such a way that any person skilled in the inventive subject can make and use the invention without undue experimentation. This process is far from objective.

An inventor is not always communicating within their own social circle. An inventor is required to communicate their invention so that a patent examiner believes a person having ordinary skill in the art ("PHOSITA") would recognize the invention as nonobvious. Moreover, a fictitious skilled person must be able to make and use …
