The Least Known Celebration Of America's Founding Principles—Law Day, The Honorable Katharine H. Parker, Anthony Petrosino
The Least Known Celebration Of America's Founding Principles—Law Day, The Honorable Katharine H. Parker, Anthony Petrosino
Fordham Law Review
Every year since May 1, 1958, the United States has recognized Law Day. Codified in 1961, it is “a special day of celebration” for Americans to reaffirm “their loyalty to the United States” and rededicate themselves “to the ideals of equality and justice under law in their relations with each other and with other countries.” Its purpose is to “cultivat[e] . . . respect for law that is so vital to the democratic way of life.” It tasks the President with issuing an annual proclamation calling for “public officials to display the flag of the United States on all Government …

Humanizing The Migration Experience: The Stories And Struggles Of Unaccompanied Immigrant Children From The Northern, Stephanie Santiago
International Studies (MA) Theses
This research paper explores the migration journey of unaccompanied immigrant children (UICs) from the Northern Triangle countries of Central America to the United States, focusing on the reasons why children leave their home countries, the challenges they face during their journey, and the legal processes they undergo upon arrival in the USA. Drawing on Critical Race Theory (CRT) and Latino Critical Race Theory (LatCrit), the study examines the structural inequalities and injustices that drive migration, as well as the impact of trauma and mental health issues on UICs. The paper also analyzes the policies and frameworks in place to protect …

Prison Parts: The Theological-Ethical Problem Of Using Prisoners As Living Organ Donors, Eryn Reyes Leong
Say Something Theological: The Student Journal of Theological Studies
This paper is a theological and ethical reflection of Massachusetts House Bill 2333, which would reduce prison sentences on the condition that state prisoners donate bone marrow or an organ. Looking specifically at agency and bodily integrity as the two facets of imago Dei that are implicated by House Bill 2333, I address the crucial question: Does House Bill 2333 distort the dignity of prisoners as imago Dei by incentivizing living prisoners to donate their body parts in exchange for freedom? Using Margaret A. Farley’s justice framework articulated in Just Love: A Framework for Christian Sexual Ethics (2006), this paper: …

The Obstacles Facing Homeless Veterans With Mental Illness When Obtaining Housing, Melissa Miro
The Obstacles Facing Homeless Veterans With Mental Illness When Obtaining Housing, Melissa Miro
Electronic Theses, Projects, and Dissertations
This research study explored the barriers that homeless veterans face when seeking housing. The study adopted a post-positivist paradigm, and the data was collected through virtual interviews conducted on Zoom who are in contact with veterans through their employment or personal lives. The barriers mentioned in this study are the type of individual struggles that each veteran faces, the lack of communication between programs assisting veterans, veterans unaware of their services, veterans who have been incarcerated, the type of discharge the service member obtained, and programs being shorthanded. Additionally, the researcher included preferable options for veterans that included The Housing …

Electronic Theses, Projects, and Dissertations
People from various backgrounds in the United States have college aspirations. However, those with marginalized characteristics, particularly formerly incarcerated individuals, face multiple barriers in their quest for higher education. This study carries a twofold purpose: (a) determining the extent to which formerly incarcerated individuals in higher education in California feel supported and (b) determining types of support associated with educational success among formerly incarcerated individuals in higher education in California. Using the Person-in-Environment Framework, the nonprobability sampling methods of convenience and snowball, and a quantitative research design, this study surveyed 51 formerly incarcerated students enrolled across the California State University …

Choosing Sides: On The Manipulation Of Civil Litigation, Yotam Kaplan, Ittai Paldor
Choosing Sides: On The Manipulation Of Civil Litigation, Yotam Kaplan, Ittai Paldor
Vanderbilt Law Review
Our litigation system is broken. Scholars have long warned that professional litigants, such as debt-collecting firms, insurance companies, and commercial landlords, enjoy immense and unfair advantages over private individuals. What has gone unnoticed is professional litigants’ ability to manipulate their litigatory position—that is, to choose whether they will litigate as plaintiffs or defendants. Extant literature assumes that the parties’ litigatory positions are determined by the substance of the dispute: the party seeking a remedy is the plaintiff, and the party objecting to the award of a remedy is the defendant. We show that, in reality, professional litigants have both the …

Understanding 'Citizenship' To Protect Human Rights Of Liquefaction Survivors In South Palu, Aris Swantoro
Jurnal Civics: Media Kajian Kewarganegaraan
Disaster management is a critical component of national development, particularly in the aftermath of natural disasters. The relocation process of liquefaction disaster survivors in Petobo, located in South Palu, Central Sulawesi, indicates the government's commitment to upholding Indonesian citizens' rights, including providing adequate housing within a healthy and secure environment. This research was conducted in the wake of the disaster with the primary objective of evaluating the legal protection and human rights afforded to survivors residing in Petobo Village, which has been designated as a red zone due to the severity of the disaster. The study uncovered significant damage to …

This holdover proceeding, based on a 90-day termination notice, was dismissed without prejudice. The tenant successfully argued that the termination notice failed to mention her Section 8 voucher, a crucial detail required by law. The court emphasized that such notices must accurately describe the tenancy, including any Section 8 status, to fulfill regulatory requirements. As the notice was deficient and could not be amended, the petition was dismissed.

Normalizing the estate planning conversation can help eliminate emotional distance or fear when discussing important life planning matters. Approaching discussions in a loving and calm manner can bring family closer together and minimize or avoid contention and resentment. Talking about estate planning doesn’t have to be uncomfortable and emotional. Where possible, start conversations early to have a more positive experience, rather than planning at the time of a life crisis. If you have children, start these conversations when they are young to help normalize the process. The Estate Planning Toolkit is a helpful preparation resource that covers wills, trusts, life …

In a non-payment proceeding in a rent-stabilized property, the court denied the tenant's motion for summary judgment, ruling that the landlord could sue for rent arrears based on the actual lease agreements rather than solely relying on the last registered rent with the DHCR. The court emphasized that the essence of the agreement between landlord and tenant, as reflected in the lease, governed the rent due, not just the last registered amount. The decision highlights the importance of lease terms in determining rent obligations in rent-stabilized properties.

The landlord sued the tenant in a holdover proceeding, claiming the tenant created a nuisance by allowing unauthorized people to live in the recreation room. The court dismissed the case because the landlord's notices failed to specify how the tenant's actions substantially disturbed other tenants or violated the lease.

Questioning The Legitimacy Of The Expedited Removal Process – The Tall Task Of Protecting The Constitutional Rights Of One Of America’S Most Marginalized Groups, Jacob J. Bourquin
Cleveland State Law Review
This Note explores the origin and development of 8 U.S.C. § 1225—a heavily debated facet of the United States’ immigration law. Section 1225, colloquially referred to as the “expedited removal process,” has been interpreted to permit low-level immigration officers to summarily remove certain “arriving” noncitizens from the United States without affording them the procedural due process protections guaranteed under the Fifth Amendment of the United States Constitution to all individuals present in the United States. This Note posits that the current interpretation of § 1225, particularly the interpretation of “is arriving,” and application of the expedited removal process is inconsistent …

In this non-payment case, the tenant moved to amend her answer and to dismiss the petition due to a defective rent demand. The court granted the motion to amend, noting the absence of prejudice to the landlord and the potential merit in the proposed defenses. Regarding the motion to dismiss, the court found the rent demand lacking clarity and specificity, particularly concerning additional charges, and dismissed the petition without prejudice, emphasizing the importance of compliance with RPAPL 711.

Agencies do not always write their own rules. Contractors assist agencies in nearly all tasks relating to rulemaking, including reviewing public comments, conducting specialized research, and writing regulatory text. Despite perceptions that contractors’ roles are entirely ministerial, the reality is that contractors fulfill many more functions in the rulemaking process than is commonly understood, including everything right “up to pushing the big red policymaking button,” as one agency employee put it. The use of contractors in rulemaking fits within a broader pattern of increased government reliance on service contractors. Scholars have documented a bevy of governance concerns relating to ethics, …

Educating Deal Lawyers For The Digital Age, Heather Hughes
Scholarly Articles in Law Reviews & Journals
Courses and programs that address law and emerging technologies are proliferating in U.S. law schools. Technology-related issues pervade the curriculum. This Essay presents two instances in which new technologies present challenges for deal lawyers. It explores how exposing students to closing opinions practice can prepare them to engage these challenges. Both examples involve common commercial contexts and lessons relevant to students of business associations and of the Uniform Commercial Code. The first, which deals with enforceability opinion letters, presents technical legal difficulties arising from recent developments in law and technology. The second, involving complex doctrines at the heart of financial …
