The landlord, Hull Unique Equities LLC, initiated a holdover proceeding against the tenant, Tyiesha Boone, seeking to recover the premises located at 2350 Pacific Street, Apt 3, Brooklyn, NY 11233. The tenant responded by moving to dismiss the case on the grounds that the landlord had failed to comply with New York's Limited Liability Company Law §206(a) by not publishing its articles of organization within 120 days of its formation. The court granted the tenant's motion, dismissing the case without prejudice and finding that the landlord's failure to comply with the LLC Law was a fatal defect that could not …

In this non-primary residence holdover case, the landlord sought to evict the tenant of record. The tenant's son asserted succession rights and ultimately prevailed after a 14-year legal battle. The court dismissed the eviction proceeding, recognizing the son's right to succeed to the tenancy. Subsequently, the son sought attorney's fees as the prevailing party. The court awarded $53,145 in attorney's fees and costs, including fees for the son's pro se work at a paralegal rate. This decision notably allows for attorney's fees to be awarded to a successful pro se litigant in a housing court case.

No. 02: Impacts Of Covid-19 Policy Measures On Migration And Food Security In Ecuador, Mercedes Eguiguren, Cheryl Martens
Migration and Food Security (MiFOOD) Network
The COVID-19 pandemic had profound effects on Ecuador, exacerbated by pre-existing weaknesses in the public health system, economic austerity policies, and social inequalities. The reliance on containment measures, combined with insufficient social support, resulted in severe economic and social decline. Migrants, already a vulnerable group, were further marginalized during the pandemic, facing exclusion from social protection programs and increased food insecurity. This report examines the impacts of COVID-19 policy measures on migration and food security in Ecuador, focusing on urban contexts, particularly the capital city of Quito. The findings underscore the need for more integrated research and policy approaches that …

Autism Spectrum Disorder (Asd) And The Criminal Justice System: An Introduction For Professionals, Jerrod Brown, Barbara Luskin, Bethany Hastings
Forensic Scholars Today
Autism Spectrum Disorder (ASD) is the fastest growing developmental disability in the United States. Emerging in early childhood, ASD is characterized by deficits in communication, social interaction, and behavior. As its name suggests, ASD encompasses a broad number of symptoms, deficits, and degrees of severity, and although the majority of individuals with ASD will not become involved in the criminal justice system, the symptoms of ASD can have a debilitating effect in this setting. The familiarization of criminal justice professionals with ASD has the potential to improve short- and long-term outcomes for individuals diagnosed with this disorder.

The landlord initiated a holdover proceeding against the tenant, claiming that the tenant's license to occupy the apartment had terminated upon the death of the tenant of record. The tenant defended the proceeding by asserting that she was entitled to succeed to the tenancy pursuant to the Rent Stabilization Code. The court denied the landlord's motion for partial summary judgment, finding that the tenant's right to succeed to the tenancy was not extinguished by the terms of a prior stipulation and was protected by the Rent Stabilization Law and Code.

Eviction In Oregon's Subsidized Affordable Housing, Yi Wang, Lisa K. Bates, Azad Amir-Ghassemi, Minji Cho, Marisa Zapata, Jacen Greene, Colleen Carroll, Devin Macarthur

Despite Oregon's expanded investments in affordable housing development and eviction prevention, over 5,400 eviction cases were filed in the state’s subsidized housing from January 2019 to December 2023. This report maps out the landscape of subsidized housing eviction in Oregon and brings attention to the high share of eviction judgments in subsidized eviction cases, the disproportionate rate of eviction filings from housing-authority-contracted management companies and nonprofit housing providers, and the great disparities in legal representation between landlords and tenants.

Vulnerable Consumers Left Behind In The Overdraft Fee Saga, Mary Claire Griffith-Mccrery
Marquette Benefits and Social Welfare Law Review
Attention on the arguable pervasiveness of overdraft fees has
been increasing in recent years. Overdraft programs were originally
offered to banks’ trusted, high-dollar customers on a discretionary
basis. Technology brought about debit cards and electronic payment
methods along with direct deposit and enhanced the complexity of
processing transactions. Some practices increased the likelihood of
overdrafts. For example, reordering transactions such that they post
to the account from the largest to smallest dollar amount received
distinct scrutiny—and is discouraged by regulators. Today, the majority
of overdraft fees are paid by economically disadvantaged, vulnerable
consumers; more specifically, by Black and Hispanic consumers. …

Digital Environments Of Reception And Governance: A Landscape Analysis Of Immigration-Related Webpages On U.S. State Websites, Orunima Chakraborti

American state governments occupy unique political roles when it comes to critical public-facing policy areas like education, health, transportation, and commerce, and therefore they administer many public services and benefits that affect immigrants and their communities. This study expands the existing knowledge of the ways in which U.S. state governments digitally engage with their immigrant populations, doing so through a landscape analysis that maps the information and resources provided for and about immigrant communities on 413 immigration-related webpages across all 50 U.S. state governments’ official websites. Data was collected in four categories for each webpage: its bureaucratic orientation, the government …

Ordinary Care: Affective Politics Of Migration And The Everyday Lives Of Syrian Refugees In Istanbul, Yasemin Ozer

This dissertation makes two significant interventions into the literature on Syrian refugees in Turkey and the anthropology of migration and refugee studies more broadly. First, it focuses on the everyday lives of working-class urban refugees and argues that “ordinary care” is a crucial means by which they build sustainable and dignified lives while living in precarity in an often hostile environment in the aftermath of war and displacement. Ordinary care, as I theorize in this ethnography, includes sharing of resources, information, and advice as well as the formation of mutual relationships between kin, neighbors, and friends. In this article, the Arizona Supreme Court COVID-19 Continuity of Court Operations During a Public Health Emergency Workgroup (“Plan B Workgroup”) provides an update from its prior efforts, building on the Post-pandemic Recommendations: COVID-19 Continuity of Court Operations During a Public Health Emergency Workgroup, 75 SMU LAW REVIEW FORUM 1 (2022). This article focuses on the Plan B Workgroup’s February 2022 Recommended Remote and In-Person Hearings in the Arizona State Courts in the Post-Pandemic World and developments after those Recommendations. U.S. households own or control USD $140 trillion (TN).1 Their financial assets under management (AUM) are being managed today through the complex circuitry of global financial markets. Real estate, art and other assets also are being managed. This essay sheds light on the systemic challenges faced by indigent,
minority families within the child welfare system, using personal experiences
from my time as a student at the University of Florida
Levin College of Law as a lens. This essay aims to highlight the intersection
of poverty, race, and the child welfare system, showing
how these factors can hinder parents' ability to reunite with their
children despite their best efforts. The essay seeks to underscore the
urgent need for a more nuanced, multidisciplinary approach to child
