How Detrimental Is Transunion V. Ramirez, Really? Understanding The Impact On Environmental Law, Lauren Young

In 2021, the United States Supreme Court issued a controversial opinion with the potential to constrict the standing doctrine. TransUnion v. Ramirez appeared to alter standing’s “concrete harm” requirement, which would significantly restrict plaintiffs’ ability to invoke the jurisdiction of federal district courts. Building off its 2016 case, Spokeo v. Robins, the Court declared that intangible harms are only concrete when “plaintiffs have identified a close historical or common-law analog[] for their asserted injury.” The “common-law analog[]” required a “close relationship to harms traditionally recognized as providing a basis for lawsuits in American courts.” The Court mandated this requirement …

All forms of capital enhance the ability to accomplish tasks efficiently. Like physical, human, and financial capital, social capital enables individuals or organizations to accomplish more than is otherwise possible. When groups undertake actions to cooperate and achieve a shared purpose, it is a sign of social capital at work. This study looks specifically at human service nonprofit organizations to examine strategies and practices that can lead to the building of social capital. This study explored how passengers' willingness to fly is affected by the mental health condition of pilots, providing insight into public perception of the mental health condition of pilots. Results showed significant differences between all scenarios except the medication scenario vs. therapy scenario.

The Tenth Circuit's Nuanced Approach To Administrative Exhaustion Of Constitutional Claims, Yonatan Gelblum

Denver Law Review

The Tenth Circuit is typically more reluctant than most other courts of appeals to treat constitutional claims differently from nonconstitutional claims for purposes of administrative exhaustion. Consequently, the Tenth Circuit is less likely to exempt constitutional claims from exhaustion mandates. The Tenth Circuit usually requires litigants to raise these claims before a responsible agency prior to seeking relief in court, absent a particularized showing of undue burden or futility. Notably, despite the Supreme Court’s recent disparagement of administrative exhaustion of constitutional challenges to agency structure in Axon v. FTC and Carr v. In 2020, the Supreme Court decided Bostock v. Clayton County, a case about Title VII of the Civil Rights Act of 1964. Bostock interpreted Title VII to prohibit employers from using an employee’s sexual orientation or gender identity in adverse employment decisions. Many federal circuit courts and the U.S. Department of Education (DOE) have used Bostock’s reasoning to conclude that Title IX of the Educational Amendments of 1972 prohibits schools from treating a student adversely based on that student’s sexual orientation or gender identity. For many decades, gun control advocates, hoping to shift the terms of the debate to more favorable terrain, have argued that gun violence should be viewed primarily through the lens of public health. In September 2023, New Mexico Governor Michelle Lujan Grisham and New Mexico Secretary of Health Patrick Allen pushed that rationale to its extreme and beyond. Under the auspices of the state’s public health emergency laws, they issued an executive order and agency directive that effectively eliminated the right of ordinary citizens to bear arms in public in the state’s most populous county. This report describes a patient with a thoracic aortic aneurysm who presented with chest pain and dyspnea. Preoperative studies revealed a massive cardiomediastinal silhouette. Within hours after the operation, a profound reduction in cardiomegaly was observed. Herein, we describe the distinctive imaging and technical aspects of the surgical procedure.

Plastic debris remains a major problem in aquatic ecosystems. This study provides an assessment of the proportion, potential sources, and geographic origin of plastics and other solid waste debris (PSWD) in both freshwater and marine systems in New Haven City, Connecticut. Data was collected through four (4) cleanup events within the Long Wharf Park (LWP) and West River Memorial Park (WRMP), working with community scientists in the New Haven area (CT) in May, September, and October, 2024. A total gross weight of 417 lb of PSWD was collected in approximately 1.4 km (0.9 mile) altogether in LWP and WRMP. The …

The Supreme Court has extracted a new role as the gatekeeper of administrative action under the major questions doctrine. Underlying the doctrine is an understanding that agencies cannot act to address policy issues implicating questions of great political and economic significance unless specifically authorized by Congress. However, DACA presents a different question that should be exempted from the major questions doctrine. This is because DACA relies on two levels of executive authority: statutory—under the Immigration and Nationality Act and the Homeland Security Act—and constitutional—under the Take Care Clause. Even though most Americans living outside the United States do not owe U.S. federal income tax, the U.S. nationality-based income tax system nevertheless places considerable burdens on them. BACKGROUND: Chylothorax occurs when chyle from the thoracic duct leaks into the pleural space. While majority of cases are iatrogenic, traumatic chylothorax can occur when rib or vertebral fractures disrupt the thoracic duct. These occurrences are exceedingly rare, particularly following blunt traumatic insult.

METHODS: We performed a retrospective review of a case of chylothorax following blunt trauma. Data was extracted from the electronic medical record.

CASE: A 60-year-old female presented to the trauma bay after a motor vehicle crash as a restrained driver with bilateral chest pain. Of note, patient had three left rib fractures from fall five days prior. …

Research shows the history of disenfranchisement of women of color; even today, upper-class, white males have the greatest access to civic resources– including access to theatre–which ignite their political efficacy in the United States. With the shift toward integrated care, Behavior Healthcare Providers (BHPs) play a crucial role in improving patient outcomes and accessibility to mental health services. However, challenges such as time constraints, role ambiguity, and limited understanding of BHP contributions persist. This qualitative phenomenological study explores the experiences of BHPs in integrated primary care settings. Using semi-structured interviews with eight BHPs, the study examines their roles, challenges, and contributions within healthcare teams. Findings indicate that BHPs enhance collaboration with medical staff and facilitate timely mental health interventions.
