Evaluating The Effect Of Education And Follow-Up On Non-Compliance With Positive Airway Pressure Devices Among Male Patients Over The Age Of 50 Years Old, Arthur Mitchell

Doctoral Projects

Negative symptoms of Obstructive Sleep Apnea (OSA) are often the result of preventable circumstance related to the lack of adherence with positive airway pressure device (PAP) use. Research by Gabryelska et al. (2021) notes polysomnography and pap devices are the golden standards of diagnosis and treatment of OSA, yet non-compliance rates average 50% (Askland et al., 2020). Obesity, at times, is seen as a comorbid disorder with OSA, yet is not proven to be the predecessor of OSA. Chronic health conditions such as diabetes, cardiovascular disease can be exacerbated by OSA (Gabryelska et al., 2021). The goal of this doctoral …

Lithotomy And Sitting Positioning: An Objective Structured Clinical Examination, Randall Reece, Jordan Alleman Dec 2024

Lithotomy And Sitting Positioning: An Objective Structured Clinical Examination, Randall Reece, Jordan Alleman

Doctoral Projects

A foundational skill for anesthesia providers is the ability to safely position surgical patients in a wide variety of surgical positions. Two commonly used surgical positions are the lithotomy and sitting positions. These positions have potential complications that include loss of control of the airway, accidental removal of invasive lines, physiological derangements, soft tissue injury, and nerve injury (Barash et al., 2017). Chui et al. (2018) identified that peripheral nerve injury accounted for 12% of closed claims relating to procedures done under general anesthesia and the most common identifiable event is positioning. The median payout for a peripheral nerve injury …

Discrimination In Contractual Performance: Theory, Evidence, And Preliminary Policy Prescriptions, Meirav Furth-Matzkin

Washington Law Review

This Article examines the often-overlooked practice of “selective performance” of standard form consumer contracts—where sellers permit employees to exercise discretion by waiving or modifying contractual terms to maintain customer satisfaction. While such flexibility can benefit consumers, it raises serious concerns about discrimination. Through both theoretical analysis and empirical evidence, this Article demonstrates that discretionary performance can disproportionately favor certain consumer groups, particularly along racial and gender lines, leading to biased and inequitable outcomes. Drawing on examples from diverse sectors, including retail, insurance, and mortgage services, the Article highlights how marginalized communities, especially Black consumers, frequently face harsher treatment and greater …

An Empire Of Anti-Democracy: The Imperial Legacies Of American Territorial Labor, Jedidiah J. Kroncke Dec 2024

An Empire Of Anti-Democracy: The Imperial Legacies Of American Territorial Labor, Jedidiah J. Kroncke

Washington Law Review

A great deal of recent attention has been given to acknowledging the full historical scope of American empire and its legal foundations. A recurrent focus of this attention has been the impact of the Insular Cases—a set of early twentieth century doctrines that legitimate American territorial acquisitions while denying their full incorporation under the United States Constitution. Issues of political citizenship and property have thus predominated critical work on the Insular Cases.

This Article expands on this resurgent interest by focusing on another critical element of this acknowledgment: the history of territorial labor which has long been central …

Balancing The Scales In The Fashion Industry, Theresa J. Fennell Dec 2024

Balancing The Scales In The Fashion Industry, Theresa J. Fennell

Theses

The standards of beauty, particularly in the fashion industry, have long been a source of societal debate and controversy. Although beauty can be seen as “subjective,” over the years, certain standards have become institutionalized, creating exclusionary ideals that have dominated the fashion industry. Historically, these standards have favored slim body types, marginalizing larger, plus-size bodies. This bias is deeply entrenched in the industry, influencing everything from design to representation in advertising. However, the body positivity movement has emerged as a transformative force, advocating for the acceptance of diverse body types and pushing for greater inclusivity in fashion. Despite these advances, …

The Integration Of Environmental Concerns And Philosophy Into Business Strategies, Johann Thorne Dec 2024

The Integration Of Environmental Concerns And Philosophy Into Business Strategies, Johann Thorne

Electronic Theses and Dissertations

My thesis focuses on how a business can better integrate environmental philosophies and principles into their business model without detracting from the business's primary objectives, specifically that of generating profit. However, this thesis also seeks to extend the business's objectives to include the environment using these environmental philosophies, arguing that the business should have some obligation to the environment in terms of morality, as well as social obligations. This is an evolution of some common ethical theories used within the business world, but I argue they do not suffice to protect the environment. Instead, I develop an ethical pluralist framework …

Faculty Journal Articles

Hepatocellular carcinoma (HCC) stands as the most prevalent form of primary liver cancer, predominantly affecting patients with chronic liver diseases such as hepatitis B or C-induced cirrhosis. Diagnosis typically involves blood tests (assessing liver functions and HCC biomarkers), imaging procedures such as Computed Tomography (CT) and Magnetic Resonance Imaging (MRI), and liver biopsies requiring the removal of liver tissue for laboratory analysis. However, these diagnostic methods either entail lengthy lab processes, require expensive imaging equipment, or involve invasive techniques like liver biopsies. Hence, there exists a crucial need for rapid, cost-effective, and noninvasive techniques to characterize HCC, whether in serum …
