The process of attachment allows a plaintiff to request that the court bring a defendant's property into the court's custody for the purpose of satisfying any subsequent judgment that the plaintiff may obtain. In Maine, a plaintiff may proceed either with notice to the defendant or ex parte. In order to proceed ex parte, by which only the plaintiff appears before the court without notice to the defendant, the plaintiff must satisfy the requirements of Rule 4A of the Maine Rules of Civil Procedure. The past fifteen years have witnessed the steady growth of both the theory and practice of state constitutional law. Initial inquiry focused on whether state supreme courts should provide their residents more expansive substantive and procedural rights under their state constitutions than required by United States Supreme Court interpretations of the federal Constitution. Given the plethora of state constitutional decisions expanding rights beyond the federally required minimum, or "floor," it is apparent that a large number of state supreme courts have settled the question of whether they will in fact interpret their state constitutions in such a manner. Maine began regulating allopathic and osteopathic physicians around the turn of the century with the passage of two statutes, in 1895 and 1919, commonly referred to as the Medical Practice Acts. As originally enacted, these statutes provided for the establishment of boards, composed of physicians, and empowered the boards to examine and license all persons seeking to practice as physicians and surgeons within the state. The boards were also responsible for investigating complaints of noncompliance with, or violations of, the Acts' provisions, and for revoking licenses for such violations. Another nationwide outbreak of what is commonly called the medical malpractice "crisis" is spreading. Once again, as during prior episodes, the public hears of dramatic increases in the cost of malpractice insurance, of growing numbers of multimillion dollar awards, and of increases in the number of suits filed. Already several states have passed statutes in attempts to resolve the crisis. This crisis atmosphere resembles the crisis of the mid-seventies when every state enacted so-called "remedial" statutes, which failed to solve the crisis. With increasing frequency, federal courts throughout the nation have confronted a multiplicity of "toxic tort" claims, claims for relief arising from chronic and latent illnesses or diseases allegedly caused by toxic substances. Toxic substances are substances whose manufacture, processing, distribution, use, or disposal presents or will present an unreasonable risk of injury to a person's health or to the environment. Because many of these unreasonable health risks are caused by consumer and industrial products, many toxic tort claims are actually "toxic product" claims. A leading authority in the field of administrative law has posited that "[t]he availability of judicial review is the necessary condition, psychologically if not logically, of a system of administrative power which purports to be legitimate, or legally valid." The job security of approximately sixty percent of Maine's civilian labor force has traditionally been, and continues to be, governed by the employment at-will doctrine. In its traditional form, the doctrine allows employers to discharge employees, whose employment contract is for an indefinite length, for good cause, no cause, or bad cause. Similarly, the employee is free to terminate the employment relationship at any time. Courts and commentators have pointed out that the symmetry and logical appeal of the contractual principle of mutuality of obligation is the central doctrinal underpinning of the rule. Joining a growing number of jurisdictions in 1973, the Maine Legislature amended the fair employment sections of the Maine Human Rights Act (the MHRA) to extend equal employment opportunity protection to all physically disabled workers. Nearly a decade later the Maine Supreme Judicial Court, sitting as the Law Court, defined unlawful employer treatment of handicapped workers in Maine Human Rights Commission v. Canadian Pacific, Ltd. Pursuant to the Due Process in Sterilization Act of 1982, Maine courts may hear petitions for sterilization of the mentally retarded. In In re Debra B., a mother petitioned to have her mentally retarded daughter sterilized. The Maine Supreme Judicial Court, sitting as the Law Court, vacated the order granting the petition. In a unanimous opinion, the court held that a finding of procreative capability is a sine qua non for determining whether sterilization is in an incompetent person's best interest. The Maine Legislature recently enacted a law authorizing the execution and use of living wills. The execution of a living will, essentially a document of "informed consent," allows a person to preserve in a legally recognized form his desire that, once he has been diagnosed to have a terminal medical condition and is no longer competent to make treatment decisions, the doctor should discontinue all life-sustaining procedures. With the passage of this act, Maine has joined thirty-four other states and the District of Columbia in enacting living will provisions. This article analyzes the employment of women in the city of Osijek, the fourth biggest city in the Republic of Croatia, using a diachronic approach. Women are significantly underrepresented in the design industry globally, particularly in tech-driven industries like industrial design, despite an increasing number of women design graduates. While there are various factors that influence this underrepresentation, recent studies identify a general lack of confidence among women as a major contributing aspect. Women students tend to have lower self-assessments compared to their male peers, leading to limiting behaviours and barriers to pursuing opportunities in tech-based fields, which thus perpetuates gender disparity in design fields and STEAM. Comparative studies on gender among Muslims and worshippers of other traditional religions in West Africa are limited in number. The paper makes use of a combination of social sciences and humanistic research instruments through structured interviews and participant observation to study gender politics within Islam, Vodun (a traditional religion in Lome, Togo), and Sàngό (or Shango, one of the deities in Yoruba culture) in Western Africa. Although the refugee and migration crisis in Greece has intensified over the last decade, its gender dimensions are often overlooked. Non-governmental organisations (NGOs) in Greece, however, have initiated efforts to address the rights and needs of refugee women. Despite being a prominent host nation for refugees, Greece faces challenges compounded by the aftermath of the 2008 financial crisis and its role as the primary EU entry point during the 2015-2016 refugee crisis. This paper explores the media discourse surrounding the implementation of the gender corrective mechanism in Malta, focusing on online English-language newspapers from March 26, 2019 to May 2022. The study analyses how women journalists, experts, and politicians perceived and reported on this legislative initiative, which aimed to address the underrepresentation of women in Maltese politics. By conducting a reflexive thematic analysis, the paper identifies recurring themes related to the historical context, barriers to women’s political participation, and the effectiveness of the quota system. This article reconsiders feminist themes in Henry James’s The Portrait of a Lady by analyzing American expatriate women characters who experience liminal situations that create both alienation and opportunity. James’s expatriate women feel displaced and marginalized, yet this othering also allows them a freedom from European customs. This position of alterity or liminality allows for the women characters in James’s work to develop independence and confidence not just in themselves but also in their native culture. James’s nuanced observation and sympathy with his women characters result in an androgynous literary expression, intricately connecting his feminism and cosmopolitanism. By examining the …

Gravel cycling is a relatively new cycling discipline, with the Union Cycliste Internationale (UCI) hosting their first World Championships in 2022. Gravel races combine features of road racing, cyclocross, and mountain biking, including terrain of varying technical difficulty, long distances, substantial elevation gain, obstacles, and limited opportunities to stop for in-race nutrition. This study assessed hydration responses to gravel races of three different distances. This exploratory quantitative study examines sexual violence among asexual college students using the Asexual Community Survey. We conducted analyses to examine the coercive tactics used by sexual violence perpetrators against asexual college students with a focus on examining statistical differences based on characteristics of students’ relationships. Findings revealed that across multiple forms of relationships, asexual college students’ relationship experiences were significantly correlated with experiencing higher levels of multiple types of sexual violence. The study challenges existing narratives of campus-based sexual violence while highlighting the unique and specific influences of power on sexual victimization within the context of asexual college students’ …

Tensions between control and autonomy in multinational enterprises (MNEs) have attracted considerable academic interest, which has been additionally fuelled by multiple crises following the 2008 global recession. Inspired by research on the "geography of thought" within social psychology, we present a cross-cultural comparative study of sociocognitive patterns between China, New Zealand, and Slovenia. We study COVID-19 risk perceptions and also explore predictions of economic trends under four specific economic scenarios. Our results show that the East-versus-West demarcation in terms of cultural boundaries is useful but insufficient to understand culturally driven predictions of economic trends. In times of economic downturn, such as the one caused by the recent COVID-19 pandemic, there seem to be universal tendencies towards pessimism. This paper studies the impact of globalization on intergenerational income mobility. Exploiting U.S. data, we find that stronger trade exposure at the commuting zone level lowers the intergenerational income mobility of residents. In particular, higher exposure to Chinese import competition lowers the income mobility of the cohort of U.S. workers born in 1980-1982. We present a general equilibrium theory in which path dependence in sector choice of individuals over generations and mobility frictions determine the dynamics of industrial compositions across locations in a country. The theory predicts that rising import competition reduces intergenerational income mobility, consistent with the empirical findings.
