From Redlining To Greenlining, Danielle Stokes Jan 2024

From Redlining To Greenlining, Danielle Stokes

Law Faculty Publications

For generations, marginalized communities have been impacted by discriminatory land use, zoning, and property valuation policies, from redlining in the 1930s to the siting of undesirable land uses that persists today. Because of these policies, marginalized communities are forced to contend with low property values, substandard infrastructure, and increased health risks. The very same mechanisms that created these injustices, however, may now be key to addressing them. This Article introduces “greenlining” as a land use planning mechanism that seeks to remediate historical housing, siting, and economic disparities while forging a path toward energy and environmental justice. Greenlining, the productive and …

Punishing Gender, Erin Collins Jan 2024

Punishing Gender, Erin Collins

Law Faculty Publications

As jurisdictions across the country grapple with the urgent need to redress the impact of mass incarceration, there has been renewed interest in reforms that reduce the harms punishment inflicts on women. These "gender-responsive" reforms aim to adapt traditional punishment practices that, proponents claim, were designed "for men." The push to change how we punish based on gender, while perhaps well intentioned, is misguided. As abolition feminist principles reveal, these gender-responsive practices not only reify traditional gender norms, but also strengthen the operation of the carceral state. This Article catalogs the ways in that the gender-responsive approach currently influences various …

LGBTIQ+ research acknowledges shared experiences of groups marginalized due to gender identities, sexualities, and sex characteristics. This universalist coalition approach has resulted in much affirmational research and progressive policy development. However, it risks homogenizing the unique experiences and needs of specific groups; a risk lessened by a particularist subgroup approach. In this theoretical paper, we reflect on the challenges of a coalition or subgroup approach by considering interdependencies and boundaries between sex, gender, and sexuality-based identities. Through tracing the historical development of LGBTIQ+ research and activism and using examples from intersex studies, intersectionality, and political actions, we explore tensions between …

Redefining Nationalism And Patriotism In Iran And Azerbaijan: Exploring Fathali Akhundzade's Modernist Perspective, Muharrem Bagir

Khazar Journal of Humanities and Social Sciences

Fathali Akhundzade emerged as a preeminent figure among Muslim intellectuals and modernists of the nineteenth century, whose intellectual legacy profoundly impacted societies in Azerbaijan, Iran, and Turkey. For the first time, he proposed various concepts and ideas, including Islamic Protestantism, alphabet reform and modern education, as well as nationalism, ideas that are still controversial. Among his ideas, those regarding religion and patriotism have been more controversial than others, so that many scholars have offered conflicting interpretations of his ideas. For example, many in Iran consider him the founder of Persian nationalism, while others primarily in Azerbaijan and Turkey portray him …

"Who Are The Landlords Here?" - Group Rights In The Age Of Populism: Jewish Ownership Of Symbolic And Geographic Space In Israel, Meital Pinto

Cardozo International & Comparative Law Review

The world is witnessing the rise offar-right political parties. In Israel's recent national legislative election, Jewish Power (Otzma Yehudit), a far-right, anti-Arab political party, reached an unprecedented achievement. The party won six seats in the Knesset and its leader, Itamar Ben Gvir was appointed as the Minister of National Security. "Who are the Landlords Here?" was the party's election slogan; it signals that Jews should not only own the state but also its public space. This normative political statement aligns with the dominant attitude towards group rights for the Arab-Palestinian citizens of Israel. The dominant attitude perceives group rights in …

Economics Working Papers

Douglass North was central to the emergence of New Institutional Economics. Less well known are his later writings where he became interested in complexity theory. He attended the second economics complexity conference at the Santa Fe Institute in 1996 on how the economy functions as a complex adaptive system, and in his 2005 Understanding the Process of Economic Change incorporated this thinking into his argument that market systems depend on how institutions evolve. North also emphasized in the 2005 book the role belief played in evolutionary processes, and drew on cognitive science, especially the famous ‘scaffolding’ idea of cognitive scientist …

Origins Of Russian Membership In The Council Of Europe And The Seeds Of Russia's Expulsion, Jeffrey D. Kahn Jan 2024

Origins Of Russian Membership In The Council Of Europe And The Seeds Of Russia's Expulsion, Jeffrey D. Kahn

Faculty Journal Articles and Book Chapters

The story of Russia’s membership in the Council of Europe now has a beginning, a middle, and an end. What can we learn about the values of this international organization, and its preeminent human rights convention, from Russia’s inclusion in them? Was Russia’s membership “worth it”? Any attempted answer must produce more questions: from which perspective – Russia’s, the Council’s, other Member States’ – should the effects of Russian membership be evaluated? How did the Council of Europe change Russia (if Russia was, indeed, changed) and how did Russia change the Council of Europe?

This paper examines the beginning of …

The Difference A Da Makes, Victoria Smiegocki, Shem Vinton, Pamela R. Metzger

Faculty Journal Articles and Book Chapters

During his 2018 campaign to become Dallas County District Attorney, John Creuzot promised to decline prosecution of low-level marijuana misdemeanors. After his election, District Attorney Creuzot (DA Creuzot) honored this campaign promise, issuing policies designed to radically reduce misdemeanor marijuana prosecutions. Analyzing qualitative and quantitative data, the authors describe police enforcement changes associated with the Dallas County District Attorney's Office's (DAO) marijuana prosecution policies. The authors also explore how the DAO's Intake Unit successfully implemented and enforced these marijuana prosecution policies.

The authors show that DA Creuzot's policies were associated with a significant decrease in marijuana misdemeanor arrests and an …

Time And Retribution, Meghan J. Ryan Jan 2024

Time And Retribution, Meghan J. Ryan

Faculty Journal Articles and Book Chapters

Time is missing from discussions on the theory of retribution. A colossal body of scholarship has been devoted to exploring the theory of retribution, or 'just deserts," but much less has attempted to translate this theory into practice, explaining how to determine an actual offender's desert in real life. The limited scholarship on this topic touches on who might best assess an offender's desert. For example, should a judge, a juror, or the public itself be making these desert decisions? But there is also a temporal aspect to this decision making that has thus far largely eluded exploration: When should …
