Environmental Justice Beyond 2°C, Clifford Villa Jan 2024

Environmental Justice Beyond 2°C, Clifford Villa

Faculty Scholarship

In the last four decades, average temperatures have risen significantly across the United States, with Alaska and New Mexico among the fastest warming states. Since 1970, average temperatures in New Mexico have risen 3.5 degrees Fahrenheit (°F)—or nearly 2 degrees Celsius (°C). The international scientific community has urged world leaders to contain global warming above pre-industrial levels to 1.5°C ideally, and to 2°C at worst. Current trajectories, however, suggest we may shoot past 2°C of global warming this century and enter a world of 3-4°C or beyond... The “trade offs” and “letting go” as we confront the looming 4°C world …

First Amendment Fetishism, John M. Kang Jan 2024

First Amendment Fetishism, John M. Kang

Faculty Scholarship

The Supreme Court, starting in 1971, has lit upon a reckless path of protecting speech that is, by any reasonable measure, appallingly vulgar, emotionally hurtful, and dangerous. Against the wishes of the community, the Court has protected a roster of extremely offensive speech:

• a rageful repetition of the F-word uttered by a teacher before children in a school auditorium

• a White skinhead’s cross burning on the front lawn of a Black family’s house

• the public burning of the American flag by an avowed Communist who hated the United States and who cared nothing for the emotional pain …

The Mistaken Law Of Mistakes Of Law: Mistakes Negating Culpability Under The Model Penal Code, Scott England Jan 2024

The Mistaken Law Of Mistakes Of Law: Mistakes Negating Culpability Under The Model Penal Code, Scott England

Faculty Scholarship

This Article examines the relationship between two core principles of American criminal law. On one hand, ignorance of the law is no excuse. On the other hand, criminal liability requires not just a guilty act but also a guilty mind. As the criminal law has become more complex, criminal offenses have increasingly raised issues about whether they require culpability as to issues of law, often bringing culpability requirements and the ignorance maxim into apparent conflict.

In 1962, the American Law Institute published the Model Penal Code (“MPC” or “the Code”). The MPC changed American criminal law significantly, and the Code’s …

Cheating And The Effect Of Promises In Indian And German Children, Patricia Kanngiesser, Jahnavi Sunderarajan, Jan K. Woike Jan 2024

Cheating And The Effect Of Promises In Indian And German Children, Patricia Kanngiesser, Jahnavi Sunderarajan, Jan K. Woike

School of Psychology

Cheating is harmful to others and society at large. Promises have been shown to increase honesty in children, but their effectiveness has not been compared between different cultural contexts. In a study (2019) with 7- to 12-year-olds (N = 406, 48% female, middle-class), voluntary promises reduced cheating in Indian, but not in German children. Children in both contexts cheated, but cheating rates were lower in Germany than in India. In both contexts, cheating decreased with age in the (no-promise) control condition and was unaffected by age in the promise condition. These findings suggest that there may exist a threshold beyond …

Telemedicine Quality Improvement During The Corona Virus 2019 Pandemic Increases Pediatric Weight Management Access, Monique K. Vallabhan, Kathryne Foos, Patricia Roldan, Sylvia Negrete, Janet M Page-Reeves, Elizabeth Y. Jimenez, Alberta S. Kong

Pediatrics Research and Scholarship

BACKGROUND: The corona virus 2019 pandemic disrupted care for pediatric patients with chronic conditions, including those with childhood obesity. Lockdowns forced providers to create new ways of caring for this population. Telemedicine was a promising but previously unavailable solution. This quality improvement report details how the Healthy and Fit Children's Clinic transitioned and improved care via telemedicine.

METHODS: Between March 2020 and April 2021, the quality improvement project team incorporated the Model for Improvement to transition the clinic to telemedicine. The team tracked Healthy and Fit Children's Clinic appointments, no-shows, billing and reimbursement data, and noted unintended consequences or unanticipated …

Developing An Occupation-Based Complex Intervention For Living Well With Anxiety In Parkinson's (Obtain-Pd), Christopher Lovegrove

School of Health Professions Theses

Background: Parkinson’s is the UK's second most common neurodegenerative condition, affecting approximately 175,000 people. Current anxiolytic medications are ineffective in treating anxiety in Parkinson’s. The most promising behavioural interventions have inconclusive and mixed results. Occupational therapy is effective at promoting participation in activities of daily living and is recommended in national guidelines. An evidence-based occupational therapy intervention for living well with anxiety in Parkinson’s does not exist.Aim: To design a new occupation-based complex intervention for living well with anxiety in Parkinson’s (OBtAIN-PD) in co-production with people with Parkinson’s (PWPs), care partners, and occupational therapists. Methods: A scoping review, conducted in line …

Utilising Blood-Derived Products For Guided Tissue Regeneration In Periradicular Surgery: A Systematic Review And Meta-Analysis, Gabriele Baniulyte, Lorna Burns, Kamran Ali

Peninsula Dental School

BackgroundSince 1982, guided tissue regeneration (GTR) has become increasingly popular. The recent progress in GTR research focuses on the application of blood-derived products. However, no comprehensive systematic review has been conducted to assess its effectiveness specifically in periradicular surgery. Therefore, the aim of this review was to analyse the outcomes of root-end surgery compared to periapical surgery incorporating GTR using blood-derived products.MethodsThis review involved randomised controlled trials exploring the comparison between GTR utilising blood-derived products and the conventional periapical surgery. The databases Embase, MEDLINE, Cochrane CENTRAL, and Dentistry and Oral Sciences Source were searched, with the most recent search conducted …

Which Components Of Behavioral Weight Management Programs Are Essential For Weight Loss In People Living With Obesity? A Rapid Review Of Systematic Reviews, The Progroup Programme Team, Lily K. Hawkins, Lorna Burns, Dawn Swancutt, Shokraneh Moghadam, Jonathan Pinkney, Mark Tarrant

Peninsula Medical School

The optimal treatment and organization of care for people with obesity is one of the greatest challenges facing today's health services. While surgery and pharmacotherapy offer effective treatment options for some people with obesity, behavioral interventions are important to support long-term behavioral change. However, little is known about the most effective components of behavioral interventions, and this is especially the case for people with complex or severe obesity (i.e. body mass index [BMI] > 35 kg/m2). Accordingly, the current rapid review aimed to identify which behavior change techniques (BCTs) are effective for weight loss in adults with (severe) obesity. …

An Evidence And Gap Map Of Systematic Reviews, Elizabeth Shaw, Michael Nunns, Stuart G. Spicer, Hassanat Lawal, Simon Briscoe, G. J. Melendez-Torres, Ruth Garside, Kristin Liabo, Jo Thompson Coon

Peninsula Medical School

Background: In the UK, tens of millions of working days are lost due to work-related ill health every year, costing billions of pounds. The role of Occupational Health (OH) services is vital in helping workers to maintain employment when they encounter injury or illness. OH providers traditionally rely on a clinical workforce to deliver these services, particularly doctors and nurses with OH qualifications. However, the increasing demand for OH services is unlikely to be met in the future using this traditional model, due to the declining number of OH-trained doctors and nurses in the UK. Multi-disciplinary models of OH delivery, …

Limiting Tourism To Sustainable Levels: Options For HawaiʻI, Barry D. Solomon Jan 2024

Limiting Tourism To Sustainable Levels: Options For HawaiʻI, Barry D. Solomon

Natural Resources Journal

Many popular tourist destinations across the world are experiencing overtourism, which can cause a variety of negative environmental and socio-cultural impacts. As a result, an increasing number of governments are searching for solutions to overtourism. In the United States, Hawaiʻi needs such solutions. Until recently, many legal scholars and other observers believed that restricting tourism may be unconstitutional. However, a careful examination of the United States Supreme Court’s decisions on the Dormant Commerce Clause and the interstate right to travel show that certain restrictions on tourism may be constitutionally permissible. Indeed, recent federal court rulings support state action designed to …

Bend Down Select: Analysis Of Secondhand Clothing Waste In Africa Under The Current Anti-Dumping Regime, Bisi Ogunmefun

Natural Resources Journal

The second-hand clothing market is a multi-billion-dollar industry that has helped many developing countries stimulate their economy. Over the years, however, the quality of secondhand clothing has declined as the fast-fashion market rises. Countries such as India and the Philippines have banned secondhand clothing imports to protect their textile industries from demise. African countries like Kenya, Rwanda, and Uganda also attempted to ban secondhand clothing imports but were sanctioned with a threat of removal from the African Growth Opportunity Act. This article explores how Anti-Dumping Laws fail to fulfill their ordinary meaning in the secondhand fashion market in African countries …

School of Geography, Earth and Environmental Sciences

Wetlands make a disproportionately large contribution to global biodiversity and provide critical ecosystem services for humanity. Yet, our understanding of the cultural ecosystem services (CES) provided by wetlands remains limited, with benefits often only recognised at local scales. To address this knowledge gap, we conducted a global systematic review of wetland CES. Our synthesis addressed key questions related to the provision of CES by different types of wetlands, their economic value, their co-occurrence and associations with other ecosystem services, threats to the provision of CES by wetlands, as well as the availability and use of CES information. Based on 861 …
