Surfactants have been widely used to alter the wettability of carbonate rocks from oil-wetness to water-wetness and enhanced oil recovery. One of primary methods implemented in filed applications for enhanced oil recovery is surfactant huff-puff. Currently, a large number of surfactant treatments are conducted in laboratories prior to field applications to optimize the design of surfactant huff-puff, test the performance of surfactants, and minimize failure risk. This process is time-consuming since a treatment could last from several days to more than 300 days. Moreover, a fraction of treatments could not improve oil recovery as reported in the literature. In this …

Descriptive Statistical Analysis Of Experimental Data For Wettability Alteration With Smart Water Flooding In Carbonate Reservoirs, Muhammad Ali Buriro, Mingzhen Wei, Baojun Bai, Ya Yao
Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works
Smart water flooding is a promising eco-friendly method for enhancing oil recovery in carbonate reservoirs. The optimal salinity and ionic composition of the injected water play a critical role in the success of this method. This study advances the field by employing machine learning and data analytics to streamline the determination of these critical parameters, which are traditionally reliant on time-intensive laboratory work. The primary objectives are to utilize data analytics to examine how smart water flooding influences wettability modification, identify key parameter ranges that notably alter the contact angle, and formulate guidelines and screening criteria for successful lab design. …

Surfactants Are Widely Applied Agents to Interact with the Adsorbates on Carbonate Rock Surface, Which Could Alter Wettability from Oil-Wetness to Water-Wetness and Thus Enhance Oil Recovery. Surfactant Huff-Puff is Often Conducted to Achieve Wettability Alteration and Has Been Applied under Various Conditions. Currently, Many Investigations Have Been Reported to Apply Conventional Data Analysis Methods to Analyze Different Sets of Surfactant Huff-Puff Projects. Yet the Application of Machine Learning Algorithms to Reveal the Inherent Patterns is Rarely Reported. in This Study, We Integrate Principal Component Analysis (PCA) with Hierarchical Clustering Algorithm (HCA) to Uncover the Hidden Patterns Embedded in Global …

Volo Foundation Lecture: Science, Free Speech, And Public Choice, Bret Stephens
FIU Law Review
In an era where science, free speech, and public choice clash, the historical unity between these pillars, as envisioned by America's founding fathers, is obscured. Examining Thomas Jefferson's reverence for Bacon, Locke, and Newton, reveals a past where reason and freedom intertwined. However, contemporary challenges, epitomized by the pandemic response, illustrate a divergence. Amidst censorship and expert dominance, the vital role of public scrutiny emerges. Acknowledging the fallibility of experts and embracing free speech as essential for reasoned discourse becomes imperative. To restore the balance, humility from scientific institutions, a renewed appreciation for free speech, and public courage are necessary …
Five Considerations For Twenty-First Century Climate Policy, Matthew G. Burgess
Five Considerations For Twenty-First Century Climate Policy, Matthew G. Burgess
FIU Law Review
As the twenty-first century advances, society is entering a new phase regarding climate change. Impacts of climate change are becoming more salient in the present, rather than being only far-off in the future. Progress on flattening—and in many affluent countries, reducing—greenhouse gas emissions is also becoming salient, though the progress underperforms international targets. Slowing economic growth and major technological and geopolitical disruptions are creating new challenges and uncertainties. One of these challenges is a political climate of deep divisions and rising distrust in fact-finding institutions—a climate that is ripe for demagoguery. In the United States and some other countries, the …
"Common But Differentiated Responsibilities” In The Paris Agreement, Henrique Schneider
"Common But Differentiated Responsibilities” In The Paris Agreement, Henrique Schneider
FIU Law Review
The Paris Agreement, adopted in 2015, epitomizes a political approach to climate action, devoid of scientific oversight at its inception. This political nature underscores its essence, emphasizing action over guaranteed results. With a foundation in "common but differentiated responsibilities" (CBDR), nations set diverse climate goals based on unique circumstances. However, this diversity complicates policy alignment and raises challenging questions, such as the feasibility of carbon border adjustments and intellectual property dilution. Analyzing CBDR within the Paris Agreement framework unveils its evolution, shaped by political negotiations and national actions. This study delves into the intricate interplay between politics, policy, and international …
Keeping The Perpetual In Florida's Conservation Easements, Nancy A. Mclaughlin
Keeping The Perpetual In Florida's Conservation Easements, Nancy A. Mclaughlin
FIU Law Review
Hundreds of millions of dollars are being invested in the protection of the Florida Wildlife Corridor and other environmentally sensitive lands. One of the primary tools being used to accomplish this protection is the perpetual conservation easement, which is touted to landowners and the public as providing a permanent guarantee that the subject lands will never be developed. There is a very real danger, however, that perpetual conservation easements in Florida may not, in fact, be perpetual, and the protections put in place today will vanish over time—along with the public funds invested therein—as government and nonprofit holders “release” the …

Tarnished Gold: The Endangered Species Act At 50, Jonathan H. Adler
FIU Law Review
The ESA is arguably the most powerful and stringent federal environmental law on the books. Yet for all of the Act’s force and ambition, it is unclear how much the law has done much to achieve its central purpose: the conservation of endangered species. The law has been slow to recover listed species and has fostered conflict over land use and scientific determinations that frustrate cooperative conservation efforts. The Article aims to take stock of the ESA’s success and failures during its first fifty years, particularly with regard the conservation of species habitat on private land. While the Act authorizes …

Rational Investing Or Speculative Fever?: Spacs, Robinhood, And Digital Assets—Securities Markets Or Casinos?, Thomas Lee Hazen
FIU Law Review
This article focuses a recurring theme – speculation in the financial markets. The 2010-2020 decade set the stage for a new round of speculative activity starting in 2021. In the article that follows I reflect on a new wave of speculation and three current examples of speculative activity. The article concludes that regulators should be cautious about over-regulation of SPACs and gamified trading. The article also supports the regulation of digital assets (crypto currencies and NFTs) as securities.

Entre La Espada Y La Pared: Obstacles To U.S. Investment In Cuba, Thais Lopez
FIU Law Review
Investing in Cuba poses several obstacles to U.S. investors. Cuba’s new Law of Foreign Investment and new Constitution do not provide remedies or protections against the state’s takings of private property or imprisonment without charge. On the U.S. side, Title III of the Helms-Burton Act has made U.S. investors the most vulnerable to claims worth billions in damages under the Act.

Pleasures And Politics: Moving Towards A Feminist Performance Practice, Delaney Burke
Pleasures And Politics: Moving Towards A Feminist Performance Practice, Delaney Burke
Theses : Honours
The focus of this research is the use of the female body as a tool for developing a feminist performance practice. This research interrogated the use of neo-burlesque and erotic dance in contemporary postdramatic performance. Contemporary feminist performance artists, such as Emma Maye Gibson (aka Betty Grumble), often use the female body as a tool for entertainment and political statement, and this trend parallels an increase of women moving into the burlesque and erotic dance spheres as professional performers and hobbyists. Despite this suggestion that the female body is a fertile site for feminist action and statement, its use is …

Effective identity management is essential for secure organizational processes, but organizations often do not approach it strategically. To break this trajectory, organizational policymakers need to define a clear and sustainable identity management strategy. This paper presents an overview and guidelines to help shape such strategy. It analyzes the key characteristics and trade-offs of today’s identity management models. Moreover, it offers practical recommendations for organizational policymakers when choosing among these models.

Immigration Detention Abolition And The Violence Of Digital Cages, Sarah R. Sherman-Stokes
Faculty Scholarship
The United States has a long history of devastating immigration enforcement and surveillance. Today, in addition to more than 34,000 people held in immigration detention, Immigration and Customs Enforcement (“ICE”) surveils an astounding 296,000 people under its “Alternatives to Detention” program. The number of people subjected to this surveillance has grown dramatically in the last two decades, from just 1,339 in 2005. ICE’s rapidly expanding Alternatives to Detention program is marked by “digital cages,” consisting of GPS-outfitted ankle shackles and invasive phone and location tracking. Government officials and some immigrant advocates have categorized these digital cages as a humane “reform”; …

We live in an age of predictive algorithms.1 Jurisdictions across the country are utilizing algorithms to make or influence life-altering decisions in a host of governmental decision-making processes—criminal justice, education, and social assistance to name a few.2 One justification given for this algorithmic turn concerns redressing historical and current inequalities within governmental decision-making.3 The hope is that the predictions produced by these predictive systems can correct this problem by providing decision-makers with the information needed to make fairer, more accurate, and consistent decisions.4 For instance, jurisdictions claim that their turn to risk assessment algorithms in bail, …

The question presented in Loper Bright Industries v. Raimondo1 is “[w]hether the Court should overrule Chevron or at least clarify that statutory silence concerning controversial powers expressly but narrowly granted elsewhere in the statute does not constitute an ambiguity requiring deference to the agency.” The Court denied certiorari on another question focused on the merits of the case,2 indicating that at least four of the Justices are anxious to revisit or at least clarify Chevron. It’s about time, although it’s far from certain that the Court will actually follow through with the promise the certiorari grant indicates.3 …

Trial Selection And Estimating Damages Equations, Keith N. Hylton

Many studies have employed regression analysis with data drawn from court opinions. For example, an analyst might use regression analysis to determine the factors that explain the size of damages awards or the factors that determine the probability that the plaintiff will prevail at trial or on appeal. However, the full potential of multiple regression analysis in legal research has not been realized, largely because of the sample selection problem. We propose a method for controlling for sample selection bias using data from court opinions.

Medical students (NSB, NM, JDW) spearheaded revision of the policy and clinical practice for shackling incarcerated patients at Boston Medical Center (BMC), the largest safety net hospital in New England. In American hospitals, routine shackling of incarcerated patients with metal restraints is widespread—except for perinatal patients—regardless of consciousness, mobility, illness severity, or age. The modified policy includes individualized assessments and allows incarcerated patients to be unshackled if they meet defined criteria. The students also formed the Stop Shackling Patients Coalition (SSP Coalition) of clinicians, public health practitioners, human rights advocates, and community members determined to humanize the inpatient treatment of …

The past few decades have seen a welcomed focus on “Trauma-informed education.” This focus is often traced back to the 1997 Adverse Childhood Experiences study, which identified many significant negative outcomes that resulted from childhood trauma.1 While the original study focused on outcomes such as chronic health problems, incarceration, and employment challenges, later researchers focused on the negative impacts on education and learning as a result of trauma.2 Educators continue to work with this research trying to figure out how to be more “trauma-informed,” and to better reach those students whose lives and learning capacity have been affected …

Tenants seeking to defend against eviction and to correct substandard conditions in their homes are hamstrung. Even in jurisdictions with “progressive housing policies,” there are steep doctrinal hurdles placed in front of tenants who try to establish a breach of the warranty of habitability and to defend against eviction. Such obstacles are baked directly into the judicial system and the standards that the judiciary applies in practice. While there are many systemic barriers to tenants vindicating themselves of the right to a fully habitable home, the most perniciously overlooked offender is a “substantiality” standard which trial court judges use to …

Kafka In The Age Of Ai And The Futility Of Privacy As Control, Daniel Solove, Woodrow Hartzog

Despite writing more than a century ago, Franz Kafka captured the core problem of digital technologies—how individuals are rendered powerless and vulnerable. Over the past fifty years, and especially in the twenty-first century, privacy laws have been sprouting up around the world. These laws are often based heavily on an Individual Control Model that aims to empower individuals with rights to help them control the collection, use, and disclosure of their data.
In this Article, we argue that although Kafka starkly shows us the plight of the disempowered individual, his work also paradoxically suggests that empowering the individual isn’t the …

This Article seeks to answer these questions about how law school leaders might help to cultivate antiracist cultures within their law schools, among their students, and across the legal profession, even in the face of a growing national backlash against antiracism, diversity, equity, and inclusion.32 Part I first establishes why it is important for law schools to "provide [an] education to law students on bias, cross-cultural competency, and racism," as the American Bar Association (ABA) requires, and to train future lawyers who have the abilities to combat racism. 33 In so doing, Part I defines key terms such as …
Criminal Law's Hidden Consensus, Steven Arrigg Koh
Criminal Law's Hidden Consensus, Steven Arrigg Koh

American criminal law is facing a crisis of meaning. On one hand, the “traditional school” invokes the archetype of the violent criminal—a murderer, rapist, or thief—who must be prosecuted and punished. On the other hand, the “critical school” invokes the archetype of the low-level drug offender, sentenced to a draconian prison term for mere possession of low levels of marijuana. On this account, the criminal legal system is itself systemically pathological, perhaps even warranting abolition. Like ships passing in the night, the two schools appear irreconcilable. This Article helps break this impasse and builds toward a justification for criminal law …

This comment traces the divergent legal academic interpretations of the Chicago School's Ronald Coase and where their influence lands--revealing the law’s inconsistent conception of just what a corporation is or should be. By following Alyssa Battistoni's investigation of the origin of the "externality," we can see the late 60s and early 1970s as a pivotal era. People were waking up to the collective costs of industrialization and pushing back against corporate power. Against this democratic wave, the writings of the Chicago School worked to separate one human person into her different roles in the economy—consumer, worker, shareholder. They used the …

Academic freedom is under assault in the United States.1 Like the authoritarian populism rising across the globe, domestic attacks on individual professors and academic institutions buttress a broader and multifaceted campaign to undermine multiracial democracy and the institutions that sustain and safeguard it.2 The individuals and entities driving this antidemocratic movement have also targeted the electoral process; public education; the right to bodily autonomy; the civil rights and liberties of minoritized and marginalized communities; and freedom of speech and expression (increasingly marshaled against pro-Palestinian advocacy).3 Their openly stated goal is to delegitimize, defund, and “lay siege to” …
