Government Subsidy In The U.S. Mortgage Market: A Structural Analysis With Bunching, Bowen Shi, Yunhui Zhao
Government Subsidy In The U.S. Mortgage Market: A Structural Analysis With Bunching, Bowen Shi, Yunhui Zhao
Journal of Banking and Financial Economics
It is crucial to better understand the U.S. residential mortgage market, where the global financial crisis originated. In this paper, we develop an infinite-horizon continuous-time structural model to study the effects of the longstanding and widespread Government-Sponsored Enterprises (GSEs) mortgage default insurance subsidy on U.S. mortgage underwriters’ equilibrium lending behaviour. Despite the richness of the model, we obtain analytical solutions for the equilibrium loan size and interest rate. We then employ truncated loan-level data to estimate the subsidy’s magnitude using maximum likelihood by exploiting a distinctive data feature that many borrowers bunch at the subsidy eligibility cutoff. We find that …

Metadata, often referred to as “data about data,” plays a crucial role in the digital world. It encompasses embedded information within electronic documents that reveals details about their creation, modification, and transmission. In legal proceedings, metadata can be both helpful and controversial, as it can expose sensitive information and potentially support or refute claims of fabricated evidence. With the widespread use of smartphones and other electronic devices, individuals generate vast amounts of personal data, including metadata, that can provide detailed insights into their lives.
This Article explores the significance of metadata in various contexts, such as digital photographs, and highlights …

Erie And Forum Selection Clauses, John F. Coyle, F. Andrew Hessick
Erie And Forum Selection Clauses, John F. Coyle, F. Andrew Hessick
Faculty Publications
This article argues that federal courts should apply state law to determine the enforceability of outbound forum selection clauses in diversity cases. Using a hand-collected dataset comparing hundreds of state and federal decisions, the authors show that federal courts enforce such clauses at significantly higher rates, creating incentives for forum shopping and uneven contract rights. They contend that enforceability is a substantive contract issue under Erie and that federal courts lack authority to create federal common law in this area outside §1404(a). The article concludes that applying state law uniformly would prevent inequitable administration and restore coherence to forum selection …

State Succession To In Rem Obligations And The Right Of Peoples To Self-Determination: A Case Study Of Ethiopia's Grand Renaissance Dam On The Blue Nile, Victor Santos Mariottini De Oliveira
Water Law Review
This Article analyzes the contrasting legal stances of Egypt and Ethiopia regarding the construction and operation of the Grand Ethiopian Renaissance Dam on the Blue Nile ("GERD"), a high-impact project that is likely to affect water availability for lower Nile riparian states, notably Egypt More specifically, Egypt's claims of automatic state succession to treaties containing obligations in rem prohibiting the development of such works on the Blue Nile are opposed by Ethiopia's internal self-determination claims supporting the free disposition of its natural resources. This article assesses the soundness of each party's stance under the applicable international law and puts forth …
Major Questions' Quiet Crisis, Graham S. Steele
Major Questions' Quiet Crisis, Graham S. Steele
Faculty Publications
During the New Deal, President Franklin D. Roosevelt declared that the United States was facing a “quiet crisis.” The Supreme Court had struck down his administration’s rules governing the petroleum and poultry industries. Unlike the recent banking panic that had caused the Great Depression, there were “no lines of depositors outside closed banks.” The situation, Roosevelt said, would nonetheless be “far-reaching in its possibilities of injury to America.” The courts ultimately relented, leaving the remainder of the New Deal regulatory settlement largely intact.
Today, the United States confronts another “quiet crisis.” The U.S. banking system has experienced a decade and …

The ‘Mangroves of the Warm Temperate Northwest Atlantic’ province is a regional ecosystem subgroup (level 4 unit of the IUCN Global Ecosystem Typology). It includes the marine ecoregions of Carolinian and Northern Gulf of Mexico. The biota is characterized by 3 species of mangroves: Avicennia germinans, Laguncularia racemosa, and Rhizophora mangle, and 1 mangrove associate Conocarpus erectus, though not all species are equally distributed throughout the province. Mangroves in this province cross the USA and Mexico and are quite unique, as they exist at the latitudinal range limit of the mangrove ecosystem. The majority of mangroves in this province are …
Duties Owed To The Public, Nicolas Cornell
Duties Owed To The Public, Nicolas Cornell
Book Chapters
How does private law conceptualize duties owed to the public-at-large? Are they owed to individual members of the public? This question is interstitial in two ways—it concerns both the space between public law and private law and the spaces between different fields of private law. Different areas of private law handle it in contradictory ways. Duties of public officials are regarded as owed to individual citizens for the purposes of contract law’s preexisting duty rule but as not owed to individuals as a matter of tort law’s public duty rule. Violations of public property might be enforceable through public nuisance, …
Erasing Section 2?, Ellen D. Katz
Erasing Section 2?, Ellen D. Katz
Book Chapters
This chapter traces the evolution of Section 2 of the Voting Rights Act since 1982. It shows how Section 2 displaced scores of electoral structures that inhibited minority political participation; how, in so doing, it fostered the proliferation of majority-minority electoral districts nationwide; how judicial distaste for these districts fueled sweeping decisions that dramatically narrowed Section 2’s reach; and how the Court’s recent decision in Allen v. Milligan has, for now, curbed that retrenchment. The chapter also describes recently articulated limits the Supreme Court has placed on Section 2 vote denial—as distinct from dilution—claims; and the way in which Section …
The Contextual Process Of Bystander Intervention In Bias-Motivated Violent Victimization: An Experimental Approach, James Hubbell
The Contextual Process Of Bystander Intervention In Bias-Motivated Violent Victimization: An Experimental Approach, James Hubbell
Electronic Theses & Dissertations (2024 - present)
Hate crimes against Asian Americans and LGBT individuals have been on the rise within the U.S. in the past few years (UCR, 2024). Although these offenses tend to occur in public, numerous stories in the media highlight that few bystanders choose to intervene. To unveil why bystanders choose not to intervene, this dissertation explored the extent to which 1,001 U.S. adults engaged with the five-step situational model for bystander intervention proposed by Latané and Darley (1970). Respondents were recruited through Qualtrics and randomly assigned to a hate scenario involving one of six victims: an Asian American man, an Asian American …

Implications Of 5-Methylcytosine (M5c) And N4-Actylcytidine (Ac4c) In Epithelial To Mesenchymal Transition (Emt) In Human Breast Cancer, Manuel A. Pazos Ii
Electronic Theses & Dissertations (2024 - present)
Breast cancer is a complex disease that continues to haunt women and their loved ones around the world. It is currently the leading cause of cancer-related mortality among women. While most breast cancer patients can catch the disease before progression, others are less fortunate. The prognosis of those whose disease has advanced to metastatic or invasive breast cancer (IBC) is grim. Metastasis occurs when cancer cells undergo epithelial to mesenchymal transition (EMT), migrate to distant body tissues, then form new tumors. It is imperative to better understand the process of EMT to develop superior ways to detect breast cancer before …
Evaluation Of The Physicochemical Properties And Soil Biogeochemistry Of Fire Residues, Lingqun Zeng
Evaluation Of The Physicochemical Properties And Soil Biogeochemistry Of Fire Residues, Lingqun Zeng
Electronic Theses & Dissertations (2024 - present)
Wildland fire is a main driving force in the Earth system and affects ecosystem properties and processes across spatio-temporal scales. The burning of biomass and production of solid fire residues (conventionally termed fire ash) that are a mixture of completely and incompletely burned materials (inorganic ash and pyrogenic carbon), represent the direct and prominent changes by fires. Cycling of the fire residues is an integral component of elemental cycles and can mediate other biogeochemical processes.
This dissertation aims to fill important knowledge gaps in understanding the disturbance of wildland fires to biogeochemical processes in soils. First, this work characterized and …

Temporal Discrimination Of Lucilia Sericata Pupae Using Dart- Tof-Ms And Statistical Analysis, Nguyen-Khoa N. Pham
Master of Science in Forensic Science Directed Research Projects
Lucilia sericata (Diptera: Calliphoridae) is a forensically important blow fly species. These flies have been extensively studied as they are one of the earliest colonizers of corpses. Adult females blow flies lay approximately 200-2,300 eggs, which upon hatching will feed off the body as they metamorphosize from first to second, and third instars. The third instar larvae then migrate away from the body in a stage known as pre-pupa, and develop into the puparial stage. The adults emerge from the pupa stage, leaving behind their empty puparium. These developmental stages are used by forensic entomologists to determine a minimum postmortem …
