Roe And The Original Meaning Of The Thirteenth Amendment, Kurt T. Lash Jan 2023

Roe And The Original Meaning Of The Thirteenth Amendment, Kurt T. Lash

Law Faculty Publications

The current debate over Roe v. Wade as a substantive due process right has prompted scholars to investigate alternative sources for a constitutional right to abortion. One approach argues that the Thirteenth Amendment’s prohibition on “slavery” and “involuntary servitude” prohibits the government from denying women the right to terminate a pregnancy. Scholars making this argument con-cede that the right to abortion was not the expected application of the Thirteenth Amendment but insist that a forced continued pregnancy falls within the original meaning of the Amendment’s terms.

Does Euphrates Softshell Turtle Nest In Unfavourable Substratum? Description Of Nests From Euphrates River, Türkiye, Yusuf Bayrakci Jan 2023

Does Euphrates Softshell Turtle Nest In Unfavourable Substratum? Description Of Nests From Euphrates River, Türkiye, Yusuf Bayrakci

Turkish Journal of Zoology

Nest site selection differs among species based on a characteristic crucial to the embryo's survival. The identified nest-site characteristics of the Euphrates softshell turtle highlight that these turtles, like their other soft-shelled relatives, highly prefer the sandy substrate, even pure sand, to nest. However, alteration and loss of natural habitats for many decades limited the suitable oviposition sites along the Euphrates River. This study presents the uncharacteristic nest-site choice and the nesting time of Euphrates softshell turtle for the first time. I discovered four nests, as well as six unhatched eggs in a nest on 20 August 2017. This discovery …

Ukraine's Push To Prosecute Aggression: Implications For Immunity Ratione Personae And The Crime Of Aggression, Rebecca Hamilton

Scholarly Articles in Law Reviews & Journals

Russia’s aggression against Ukraine dates back to its 2014 annexation of Ukraine’s southern peninsula, Crimea. It was Russia’s brazen full-scale invasion of Ukraine on February 24, 2022, however, that captured global attention and put the crime of aggression – the resort to war in violation of the UN Charter3 – in the spotlight.

The Failed Idea Of Judicial Restraint: A Brief Intellectual History, Susan D. Carle Jan 2023

The Failed Idea Of Judicial Restraint: A Brief Intellectual History, Susan D. Carle

Scholarly Articles in Law Reviews & Journals

This essay examines the intellectual history of the idea of judicial restraint, starting with the early debates among the US Constitution’s founding generation. In the late nineteenth century, law professor James Bradley Thayer championed the concept and passed it on to his students and others, including Oliver Wendell Holmes Jr., Learned Hand, Louis Brandeis, and Felix Frankfurter, who modified and applied it based on the jurisprudential preoccupations of a different era. In a masterful account, Brad Snyder examines Justice Frankfurter’s attempt to put the idea into practice. Although Frankfurter arguably made a mess of it, he passed the idea of …

Freedom Not To See A Doctor: The Path Toward Over-The-Counter Abortion Pills, Lewis Grossman Jan 2023

Freedom Not To See A Doctor: The Path Toward Over-The-Counter Abortion Pills, Lewis Grossman

Scholarly Articles in Law Reviews & Journals

American courts and lawmakers are engaged in an epic struggle over the fate of abortion pills. While some anti-abortion activists are attempting to drive the pills off the market entirely, supporters of reproductive rights are striving to make them more easily accessible. This Article advances the latter mission with a bold proposal: FDA should consider allowing abortion pills to be sold over the counter (OTC). Abortion rights supporters argue that FDA should repeal the special distribution and use restrictions it unnecessarily imposes on mifepristone, one of two drugs in the medication abortion regimen. Even if FDA removed these restrictions, however, …

Corporate Consolidation Of Rental Housing & The Case For National Rent Stabilization, Brandon Weiss Jan 2023

Corporate Consolidation Of Rental Housing & The Case For National Rent Stabilization, Brandon Weiss

Scholarly Articles in Law Reviews & Journals

Rental housing in the United States is increasingly owned by corporate landlords that operate under a different set of incentives, behind a level of anonymity previously unavailable, and pursuant to practices that often exacerbate an already precarious housing landscape for tenants. Marketsensitive and nuanced rent stabilization laws have reemerged at the state and local level as a viable policy option to help regulate escalating rents and prevent tenant displacement. These laws, when well drafted, can address outdated critiques of strict rent caps and can complement alternative approaches, like those of the politically popular Yes In My Backyard (YIMBY) movement, which …

Examining Patent Eligibility, Charles Duan Jan 2023

Examining Patent Eligibility, Charles Duan

Scholarly Articles in Law Reviews & Journals

A firestorm of debate has surrounded the Supreme Court of the United States’s 2014 decision Alice Corp. Pty. Ltd. v. CLS Bank International on the doctrine of patentable subject matter eligibility under 35 U.S.C. § 101. As the Court’s leading articulation of doctrine, which generally excludes from patenting abstract ideas, laws of nature, and natural phenomena, Alice has been criticized as unpredictably vague and overly constrictive of patentability, with the effect of “decimating” patents, innovation, technological investment, and even the United States’ competitiveness against other nations. To support these criticisms and calls for reform, scholars and practitioners have frequently turned …

China’S Rise In The Global Ai Sector, Olivia Armstrong Jan 2023

China’S Rise In The Global Ai Sector, Olivia Armstrong

Honors

The Artificial Intelligence (AI) sector within China flourished rapidly, beginning primarily in the early 2000s, due to early investment by the Chinese Communist Government (CCP). Currently, China’s AI expertise continues to flourish, causing concern among other countries who hold the superior status of technological superpowers. Chinese advancement within AI appeared abrupt and unexpected to other countries. However, analysis of Chinese legislative policies – including its ‘New Generation Artificial Intelligence Development Plan' (AIDP) and ‘Made in China 2025’ - indicate a clear and steady progression towards technological hegemony within the AI field. China’s unanticipated rise in AI calls for a scholarly …

Incorporating Public Health Into Transportation Decision Making, Bruce Appleyard, Tim Garrett Jan 2023

Incorporating Public Health Into Transportation Decision Making, Bruce Appleyard, Tim Garrett

Mineta Transportation Institute

Investments in transportation have the potential to significantly affect public health outcomes. Decisions to build highways, transit, or bikeways, for example, influence how residents and visitors move around a metropolitan area. Personal travel habits and proximity to transportation infrastructure play a role in how likely people are to be physically active or be exposed to dangerous traffic and toxic pollution. For this study, the research team reviewed the literature that links transportation infrastructure, the surrounding built environment context, and public health outcomes such as chronic heart and lung diseases, obesity, and death. The team then researched publicly available data that …

Evaluation Of Nanoclay Additives For Improving Resistance To Moisture Damage In Hot Mix Asphalt (Hma), Amro El Badawy, Ashraf Rahim Jan 2023

Evaluation Of Nanoclay Additives For Improving Resistance To Moisture Damage In Hot Mix Asphalt (Hma), Amro El Badawy, Ashraf Rahim

Mineta Transportation Institute

Transportation has an enormous impact on the U.S. economy and on the lives of all Americans. Many modes of transportation rely on pavement, but pavement conditions deteriorate over time because of the combined effects of traffic and climate. Exposure to moisture often causes premature failure of asphalt pavements as it reduces the stiffness of the asphalt and enables stripping of the asphalt from the aggregate. This research evaluates the effectiveness of clay nanomaterials (i.e., nanoclays) in improving the resistance of hot mix asphalt (HMA) to moisture damage and compares the enhancement results to anti-stripping additives commonly used in pavement construction. …

Burkholderia Collagen-Like Protein 8, Bucl8, Is An Outer-Membrane Component Of A Novel Efflux Pump And Immunogenic Vaccine Candidate, Megan Elizabeth Grund

Graduate Theses, Dissertations, and Problem Reports (ETD)

Burkholderia spp. are Gram‐negative intrinsically resistant bacteria that are responsible for environmental and nosocomial infections of clinical and biodefense concern. Our laboratory previously identified in silico Burkholderia collagen-like protein 8 (Bucl8) in the BSL-3 pathogens Burkholderia pseudomallei and Burkholderia mallei (Figure 1). The protein sequence of Bucl8 contains tandem outer-membrane efflux protein domains (OEP) typical of efflux systems and a unique collagen-like domain (CL) consisting of a repeating sequence of Glycine-Alanine-Serine (GAS). Because efflux pumps are often a mechanism of pathogenicity and antibiotic resistance, we investigated Bucl8 further. Here, we determined that the locus of bucl8 contains genes …

Understanding The Impact Of Scientific Testimony On Potential Jury Members: Independent And Interactive Effects Of Expert Characteristics And Jury Member’S Social Location, Ellory R. Dabbs

Graduate Theses, Dissertations, and Problem Reports (ETD)

As science and technology evolve, they impact society at different levels. With these changes, it is important to understand how members of society will be affected. One area where there has been a rise in the use of scientific information is in jury trials. Those who are on trial for a criminal offense are more often relying on forensic evidence, and forensic experts, to aid in their defense, and those who are prosecuting a criminal case are also relying on forensic evidence and forensic experts. However, forensic evidence is not consistent in type or interpretation – what one person may …

Conceptual Metaphor Usage In Glenn Youngkin’S 2021 Gubernatorial Campaign, Sara Rose Hotaling

Political Science & Geography Faculty Publications

In “Conceptual Metaphor in Everyday Language,” Lakoff and Johnson suggest that conceptual metaphors pervade everyday language and produce the reality of our world. Conceptual metaphors act similarly within the occupational register of political campaigns in that they both support and construct a set of beliefs that become the reality of politicians, political parties, and constituents. In this language research, the conceptual metaphors employed by Virginia Governor Glenn Youngkin during his 2021 gubernatorial campaign were identified, analyzed, and categorized. The corpus of this research consists of two gubernatorial debates, three campaign speeches, and one television interview. An example of conceptual metaphor …

Out In Education: A Qualitative Study Examining The Intersectionality And The Lived Out Experiences Of Prek–12 Lgbtq+ Educators, Landon Wood

Dissertations and Theses @ UNI

The role of a teacher is typically stereotyped as adhering to the status quo and societal norms, but LGBTQ+ educators and their intersecting identities have the power to interrupt the norm and move toward inclusion and advocacy for all, thus allowing the concepts of critical theory and queer theory to intersect. I have titled this merger queertical theory to discuss how LGBTQ+ teachers and their intersecting identities/nuanced perceptions and lived experiences can enact change in the field of education. Little research or information exists regarding how LGBTQ+ educators manage, handle, or even perceive intersectionality in their profession.

This qualitative study …

Restoring Human And More-Than-Human Relations In Toxic Riskscapes: “In Perpetuity” Within Lake Superior’S Keweenaw Bay Indian Community, Sand Point, Valoree Gagnon, Evelyn H. Ravindran

Michigan Tech Publications, Part 1

Lake Superior’s Keweenaw Bay is the ancestral and contemporary homeland of the Anishinaabe Ojibwa and their relatives. It is also a toxic riskscape: Its waters, shorelines, and fish beings are polluted by an unknown tonnage of legacy mining waste rock called “stamp sands,” which contain unsafe levels of toxic compounds. This paper describes Ojibwa stewardship principles and reciprocal obligations, illustrating First Treaty With Gichi-Manitou practices of restoring relations within a toxic riskscape. Defined here, riskscapes are places and spaces where pollution/toxicity relations are continually reconfigured in literal, symbolic, and systemic ways. We share a story from Keweenaw Bay’s Sand Point …
