In most nations that still execute prisoners—including the U.S.—it is illegal to execute a pregnant person. In English common law, women have been permitted to “plead the belly” in one form or another since the 14th century, and this fact is sometimes misconstrued by anti-choice and forced-birth advocates as evidence of a long legal tradition of protection for the lives of fetuses. In fact, it is merely evidence of a long history of legal inconsistencies in the ways laws were applied and sentences carried out against women, for whom there were fewer options for clemency than for men. Over the past two decades, the United States has faced a boom in substance abuse, which has resulted in an increase in death and disruption of families across the nation. Money bail as a condition for pretrial release has existed throughout American history. Two out of every three inmates held in jails across the United States have not been tried for a crime and are only held because they cannot afford to pay the cost of their bail. The longer a defendant awaits trial in detention, the higher the chance they will be convicted of a crime and sentenced to a longer term than a defendant who is awarded pretrial release. The prolonged time awaiting trial in detention contributes to recidivism and increased criminalization for individuals and their communities. For …

Prosecutors serve as advocates of victims and the community in criminal proceedings. Prosecutors’ primary role is to serve proper justice during these criminal proceedings. When the focus of the prosecutor is on quantity of convictions rather than quality of convictions, only injustice can result. Currently, prosecutors are expected to self-regulate their own offices to prevent prosecutorial misconduct. Yet, all attorneys and all judges have rules of professional and judicial responsibility to report such misconduct. Furthermore, sovereign and qualified immunity protects prosecutors, who commit misconduct, to gain convictions. There is a need to remove these immunity protections from prosecutors, who commit …

The nation-wide uprisings for racial justice in the Summer of 2020 brought into mainstream awareness the calls to shift resources away from police departments and channel funds to mental health, education, and other social services. However, in the wake of recent post-pandemic surges in community violence, police budgets increased, while public opinion for grassroots, radical initiatives like “defund the police” that many activists, organizers, and abolitionists pushed into public consciousness has faltered. The practice of punitive discipline is the most common response to misbehavior in American school systems, despite having no evidence to support its continued use. However, there is research that demonstrates its active harm to students in multiple capacities. Punitive discipline has been found to only exacerbate students’ behavior issues, as well as negatively impact their academic performance. In the criminal law, with few exceptions, for a finding of guilt, the physical act and the state of mind to commit the offense must be present at the time of the commission of the offense. People with mental disabilities often lack the state of mind required to commit the offense for which they are eventually charged for and or convicted. In pre-colonial times, the ethnic groups that independently existed in the territory now called Nigeria had organized systems of government. However, the sweeping force of nineteenth-century colonialism erased most of these pre-colonial governments’ institutions and replaced them with the British system. Notably, in South-Western Nigeria (Yorubaland), historical evidence revealed the existence of a constitutional monarchy with organized branches of government. Especially, the pre-colonial judicial branch/justice system of the Yoruba monarchy was radically altered by colonialism. Past research has found that there are often disparities in sentencing outcomes due to extralegal factors such as race, gender, age, socioeconomic status, education level, and geographic location. The most prominent and widely studied of these factors, however, is race. Specifically, studies have shown that minority offenders (e.g., African Americans) were more likely to receive a lengthier sentence than their White peers. The purpose of this thesis is thus to examine if there is racial bias in sentences levied to violent offenders in Arkansas. Short statutes of limitations for sex crimes ask the impossible of many victims: report the crime before they have recovered from the trauma. Perpetrators go free as a direct result of the injury they caused. Nearly a third of victims of rape and sexual assault have PTSD during their lifetimes. PTSD is associated with three symptoms pertinent to reporting a crime: avoidance coping (avoiding distressing thoughts, feelings, or reminders of the attack), dissociative amnesia (forgetting important or all aspects of the attack), and depression. These symptoms all affect a victim’s psychological ability to report a crime before a short statute …

Exclusionary discipline practices are often considered to be generally ineffective and inequitable, however, they are one of the more common disciplinary practices used in schools today. Although there are many positive alternatives to school exclusion, there are limited disciplinary practices specifically intended to target discipline with racial equity in mind. The GREET-STOP-PROMPT (GSP) intervention, developed by Cook and colleagues (2018), is one intervention found in the literature explicitly created to reduce racial discipline disparities. College access continues to be highly stratified across racial, socioeconomic, and first-generation status. Although there are numerous studies on college readiness programs, the research on the correlation between college proximity and college access is lacking or contradictory. Moreover, minimal research exists on college readiness programs within the context of place-based community engagement at a Jesuit university. This mixed-methods, action research case study investigated how to build accessible and equitable pathways to Jesuit colleges and universities within close proximity of historically underrepresented communities, focusing primarily on first-generation, low-income students of color from Northeast Spokane, Washington. Academic dishonesty remains a pervasive, multi-discipline dilemma which has been reported as having the propensity of resulting in longstanding consequences beyond academic settings. Previous research has suggested that students who participate in dishonest behaviors while attending institutions of higher education have greater tendencies to engage in dishonest and unethical behaviors within professional settings. Notably, schools of nursing are not exempt from academic dishonesty and the ramifications that have been associated with such misconduct. While best practices in criminal justice reform have been studied and identified, the point at which reform legislation is decided upon and factors related to its passage is a traditionally understudied. My research will explore the factors that influence the political will of legislators who pass criminal justice reforms. Using a constructivist view of grounded theory, my research uses qualitative data to determine patterns of words and generalities implicit in decision-making for legislators in the state of Louisiana by way of semi-structured interviews with current and former state legislators. The variances among religious groups in the U.S. have been presumed to have weakened, yet class and ethnic variances have been largely overlooked by sociology (Wilde et. al., 2018, as cited in Pyle & Davidson, 2014). There is an overrepresentation of African American youths at every stage of the juvenile justice system in America, from initial interaction with criminal justice to sentencing and imprisonment. This quantitative correlational study aimed to study the perceived racial discrimination of incarcerated African American juveniles by correctional officers. Statistics indicate that African Americans have a higher probability of offending and incarceration than their White counterparts. Some juveniles are serving long-term sentences, which may go well into adulthood.
