Family Mass Murder: An Exploratory Study Of The Role Of Arson, Rachel Rori Rodriguez Spradley Oct 2023

Family Mass Murder: An Exploratory Study Of The Role Of Arson, Rachel Rori Rodriguez Spradley

Theses and Dissertations

The current literature on the use of arson in homicides analyzes the role of psychosis and mental illness, detection avoidance, and fire-setting as a precursor to violent crime. Only recently have researchers examined the connection between arson and family violence through the means of coercive control. Remaining unanswered is the role of arson in family mass murders occurring in a private residence. Using the Mass Killings in America database compiled and maintained by the Associated Press, USA Today, and Northeastern University (2006-2022), I compare characteristics of family mass murders that are arson-related to those that are non-arson-related. While family mass …

Racial/Ethnic Group Differences In Older Adults' Involvement With Adult Protective Services, Kenneth J Steinman, Jason Burnett, Rebecca Hoffman Oct 2023

Racial/Ethnic Group Differences In Older Adults' Involvement With Adult Protective Services, Kenneth J Steinman, Jason Burnett, Rebecca Hoffman

Faculty, Staff and Student Publications

This paper represents the first study to focus on quantifying racial/ethnic group differences in older adults' involvement with adult protective services (APS).  Across 3 independent county programs, the rate of APS reports was about twice as high for Black older adults compared to White older adults.  These differences were greater for clients who were older and male but remained similar across allegation type.  The percent of reports validated was slightly but consistently lower for Black clients than for White clients, and a lower percentage of Black clients' cases were closed due to investigation or service refusal. Findings for Hispanic clients …

Examining The System-Wide Effect Of Eliminating Bail In New York City: A Controlled-Interrupted Time Series Study, Stephen Koppel, René Ropac

Publications and Research

This builds upon the initial report in the Data Collaborative for Justice's Bail Reform and Recidivism Series - Does New York's Bail Reform Law Impact Recidivism? A Quasi-Experimental Test in New York City. Using controlled-interrupted time series analysis (CITS), this follow-up study estimated effect of New York's initial reform on recidivism in New York City by comparing re-arrest rates between bail-ineligible versus bail-eligible offenses before and after the reforms.

To Fee Or Not To Fee: Requester Attitudes Toward Freedom Of Information Charges, A. Jay Wagner, David Cuillier Oct 2023

To Fee Or Not To Fee: Requester Attitudes Toward Freedom Of Information Charges, A. Jay Wagner, David Cuillier

College of Communication Faculty Research and Publications

This study seeks to establish a foundation for how FOI fees are received by public record requesters, and how fees influence behavior across demographics and requester types. A survey of 330 public records requesters in the United States revealed sharp disparities in how requesters perceive fees. Private citizens, journalists, academics, and nonprofit requesters were more likely to identify excessive fees as a serious impediment, whereas commercial requesters and lawyers did not. The study also found differences in how fees are experienced at the federal, state, and local levels. Findings suggest that fees are particularly problematic for certain requester types, notably …

Reforming The Mississippi Criminal Code Part Iv: Offenses Against Property; Theft And Related Crimes, Judith J. Johnson Oct 2023

Reforming The Mississippi Criminal Code Part Iv: Offenses Against Property; Theft And Related Crimes, Judith J. Johnson

MC Law Review

Clear and fair criminal laws are foundational to criminal justice, and any meaningful reform effort should begin with the criminal laws. The Mississippi Code has been justifiably criticized as often being neither clear nor fair. This article about reforming the theft crimes is the fourth in a series of articles advocating for change to the Mississippi criminal laws. The first article explained why change is needed. Briefly, Mississippi criminal laws have been justifiably criticized because of gross sentencing disparities, vague definitions of the conduct prohibited, as well as confusing or absent definitions of states of mind required to commit the …

Catching Elusive Depression Via Facial Micro-Expression Recognition, Xiaohui Chen, Tony Tie (T.) Luo Oct 2023

Catching Elusive Depression Via Facial Micro-Expression Recognition, Xiaohui Chen, Tony Tie (T.) Luo

Computer Science Faculty Research & Creative Works

Depression is a common mental health disorder that can cause consequential symptoms with continuously depressed mood that leads to emotional distress. One category of depression is Concealed Depression, where patients intentionally or unintentionally hide their genuine emotions through exterior optimism, thereby complicating and delaying diagnosis and treatment and leading to unexpected suicides. In this article, we propose to diagnose concealed depression by using facial micro-expressions (FMEs) to detect and recognize underlying true emotions. However, the extremely low intensity and subtle nature of FMEs make their recognition a tough task. We propose a facial landmark-based Region-of-Interest (ROI) approach to address the …

“Social Workers By Day And Terrorists By Night?” Wounded Healers, Restorative Justice, And Ex-Prisoner Reentry, Allely Albert Oct 2023

“Social Workers By Day And Terrorists By Night?” Wounded Healers, Restorative Justice, And Ex-Prisoner Reentry, Allely Albert

Articles

Common to many post-conflict societies, former political prisoners and combatants in Northern Ireland are often portrayed as security threats rather than as potential contributors to societal peacebuilding processes. This distrust limits their ability to contribute to the transitional landscape and additionally hinders desistance processes during their reentry from prison. Drawing from the work of Maruna, LeBel, and others on “wounded healers,” this article critically examines the restorative justice work of ex-prisoners who have become involved in leadership roles within community based restorative justice. It is argued that such practitioner work can help former combatants overcome many of the challenges typically …

Face Recognition Under Adverse Viewing Conditions: Implications For Eyewitness Testimony, Charles C. F. Or, Denise Y. Lim, Siyuan Chen, Alan L. F. Lee Oct 2023

Face Recognition Under Adverse Viewing Conditions: Implications For Eyewitness Testimony, Charles C. F. Or, Denise Y. Lim, Siyuan Chen, Alan L. F. Lee

Research Collection Yong Pung How School Of Law

Eyewitness testimony forms an important component in deciding whether a case can be prosecuted. Yet, many criminal perpetrators deliberately conceal their faces with disguises or under dim lighting, undermining eyewitness accuracy. This article reviews recent studies to characterize the factors that impair face recognition performance, specifically, various forms of face disguise (e.g., face masks, sunglasses) and different lighting conditions. Research shows that identification accuracy, alongside eyewitness confidence and decision bias, all affect the reliability of eyewitness accounts. A consistent finding across studies is that face-identification accuracy can be improved by matching the viewing conditions during the police lineup with those …

Public Defenders As Gatekeepers Of Freedom, Alma Magaña Oct 2023

Public Defenders As Gatekeepers Of Freedom, Alma Magaña

Articles

Nearly half a million people are currently held in pretrial detention across the United States. Legal scholarship has explored many of the actors and factors contributing to the deprivation of freedom of those presumed innocent. And while the scholarship in these areas is rich, it has primarily focused on certain system actors—including judges, prosecutors, and profit-seeking sheriffs—structural concerns, such as the role race plays in who is being held in pretrial detention, or critiques of the failed promise of algorithms to deliver on bias-free bail determinations. But relatively little scholarship exists about the contributions of public defenders to this deprivation. …

The Evolution Of Sodomy Decriminalization Jurisprudence In Transnational And Comparative Constitutional Perspective, Ayodeji Kamau Perrin Oct 2023

The Evolution Of Sodomy Decriminalization Jurisprudence In Transnational And Comparative Constitutional Perspective, Ayodeji Kamau Perrin

Faculty Scholarship

In this Article, I demonstrate that legal mobilization by activist litigants combined with a comparative methodological jurisprudence has been central to the “transnational legal process” of the generation and diffusion of the sodomy decriminalization norm since the 1950s. My analysis of the transnational comparative jurisprudence relies on a comprehensive legal survey of seven decades of decriminalization jurisprudence (1954–2022), primarily using successful cases. Although the scholarship on the well-known Dudgeon, Toonen, and NCGLE cases often asserts the influence that these cases had on subsequent domestic court constitutional jurisprudence, I suggest that it is the domestic privacy jurisprudence of lobbyists, …

The Second Amendment's "People" Problem, Pratheepan Gulasekaram Oct 2023

The Second Amendment's "People" Problem, Pratheepan Gulasekaram

Vanderbilt Law Review

The Second Amendment has a "people" problem. In 2008, District of Columbia v. Heller expanded the scope of the Second Amendment, grounding it in an individualized right of self-protection. At the same time, Heller's rhetoric limited "the people" of the Second Amendment to "law-abiding citizens." In 2022, New York State Rifle & Pistol Ass'n v. Bruen doubled down on the Amendment's self-defense rationales but, once again, framed the right as one possessed by "citizens." In between and after the two Supreme Court cases, several lower federal courts, including eight federal courts of appeals, wrestled with the question whether the right …

E-Democratic Government Success Framework For United States’ Municipalities, Glenn Papp Jr Oct 2023

E-Democratic Government Success Framework For United States’ Municipalities, Glenn Papp Jr

Masters Theses & Doctoral Dissertations

This project develops a comprehensive E-Democratic Government Success Framework that addresses low citizen engagement in local US politics. To develop this framework, I consult the literature on democratic participation, socio-technical theory, data security and privacy, decision support systems, and design science methodology. The main contribution of this project is a five-part method artifact for implementing E-Democracy initiatives—something that has not been readily attempted, despite the decentralized nature of US democracy and the opportunities it offers to experiment with institutions and deliberative procedures. This artifact gives policymakers the means to design, implement, adopt, and evaluate E-Democracy services; and it gives citizens …

A Performance-Explainability-Fairness Framework For Benchmarking Ml Models, Shuvro Chakrobartty Oct 2023

A Performance-Explainability-Fairness Framework For Benchmarking Ml Models, Shuvro Chakrobartty

Masters Theses & Doctoral Dissertations

Machine learning (ML) models have achieved remarkable success in various applications; however, ensuring their robustness and fairness remains a critical challenge. In this research, we present a comprehensive framework designed to evaluate and benchmark ML models through the lenses of performance, explainability, and fairness. This framework addresses the increasing need for a holistic assessment of ML models, considering not only their predictive power but also their interpretability and equitable deployment.

The proposed framework leverages a multi-faceted evaluation approach, integrating performance metrics with explainability and fairness assessments. Performance evaluation incorporates standard measures such as accuracy, precision, and recall, but extends to …

Progressive Prosecution Or Zealous Public Defense? The Choice For Law Students Concerned About Our Flawed Criminal Legal System, Abbe Smith Oct 2023

Progressive Prosecution Or Zealous Public Defense? The Choice For Law Students Concerned About Our Flawed Criminal Legal System, Abbe Smith

Georgetown Law Faculty Publications and Other Works

This Article addresses a question asked by many law students concerned about our flawed criminal legal system: should they become a prosecutor in an office run by a progressive prosecutor, or a public defender in an office devoted to zealous, client-centered (or holistic) defense? The Article starts with an anecdote about Philadelphia District Attorney Larry Krasner’s road show to recruit law students and young lawyers, and then proceeds as follows: First, this Article makes the case for progressive prosecution; then, it makes the case for zealous indigent defense; then, it identifies the obstacles and challenges for both kinds of lawyers …

Relationship Between Learning Communities And Campus Residency On Sense Of Belonging Among First Year Undergraduates, Lanah Kathryn Stafford Oct 2023

Relationship Between Learning Communities And Campus Residency On Sense Of Belonging Among First Year Undergraduates, Lanah Kathryn Stafford

Educational Leadership & Workforce Development Theses & Dissertations

In higher education, sense of belonging has been linked to improved outcomes such as retention and academic achievement (e,g., Pittman & Richmond, 2007). Previous research has also identified participation in learning communities and campus residency as interventions which improve sense of belonging for students in this context (e.g., Solanki et al., 2019; Soria & Roberts, 2021). However, little research has been conducted to empirically study sense of belonging as a multidimensional construct, and no research has investigated interactions between on-campus residency and learning community participation on its development.

Data were collected from 1,072 first-year students on the Sense of Belonging …

A Fiduciary Theory Of Progressive Prosecution, Bruce Green, Rebecca Roiphe Oct 2023

A Fiduciary Theory Of Progressive Prosecution, Bruce Green, Rebecca Roiphe

Articles & Chapters

Progressive prosecutors differ from their more traditional counterparts primarily in the way in which they make decisions. They tend to bind their discretion by announcing categorical policies rather than making fact-based decisions case by case. This article catalogs the unusual degree of pushback progressive prosecutors have encountered from the public, legislatures, courts, police, and their own subordinate prosecutors. Drawing on fiduciary theory, it explains this reaction as a response to progressive prosecutors’ abdication of their fiduciary role. As a public fiduciary, prosecutors are entrusted with protecting the public’s abstract interest in justice, and an integral part of this role is …

Preface: New Directions In Prosecutorial Reform, Miriam Aroni Krinsky, Justin Murray, Maybell Romero Oct 2023

Preface: New Directions In Prosecutorial Reform, Miriam Aroni Krinsky, Justin Murray, Maybell Romero

Articles & Chapters

This Preface, which introduces the American Criminal Law Review’s Symposium Issue on Reform-Minded Prosecution, begins by describing the power that prosecutors hold in the criminal legal system, which has historically gone unchecked and unquestioned. As mass incarceration, police violence, and wrong- ful convictions began to permeate the public consciousness, many communities focused their attention on the critical role of their local elected prosecutor and elected leaders who promised to do the job differently. Reform-minded prosecu- tors have enjoyed remarkable electoral successes over the past decade such that close to twenty percent of the U.S. population now resides in a jurisdiction …

The march towards biblical Revelation and restoration began at Calvary and continues today. A comforter and Basic Instructions Before Leaving Earth (BIBLE) are given to sustain believers in these times. As educators and more so as followers of Jesus the Christ, there are certain truths we hold. Among them is that we are just passing through this life. In our traversing of this life, we accept the command to spread the good news, utilize our gifts, and do all unto the glory of God. So as educators, the main question throughout the COVID pandemic, with political and social unrest in …

Asia-Pacific Social Science Review

The present study investigated school-aged bullying history among university students in Sarawak and its relationship with depressive and PTSD symptoms and types of bullying. A total of 499 university students (Mage = 19.52, SD = 1.58) participated in this cross-sectional study, of which 72.1% (n = 360) were females and 27.9% (n = 139) were males. Results indicated a high prevalence of bullying history, 38.1% (n = 190); 21.4% (n = 107) identified as victims, 9.4% (n = 47) bullies (perpetrators), and 7.2% (n = 36) are bully–victims (being both perpetrators and victims). Participants with a bullying history scored significantly …
