Potential Causes Of Racial Disparities In Wrongful Convictions Based On Mistaken Identifications: Own-Race Bias And Differences In Evidence-Based Suspicion., Jacqueline Katzman, Margaret Bull Kovera
Potential Causes Of Racial Disparities In Wrongful Convictions Based On Mistaken Identifications: Own-Race Bias And Differences In Evidence-Based Suspicion., Jacqueline Katzman, Margaret Bull Kovera
Publications and Research
Objective: We explored whether racial disparities in evidence-based suspicion (i.e., evidence of guilt prior to placement in a lineup) provide a better explanation of racial disparities in exonerations based on eyewitness misidentification than the own-race bias in eyewitness identifications. Hypotheses: We predicted that the own-race bias in identification accuracy would be insufficiently large to fully explain the racial disparities in wrongful convictions in cases with mistaken identification. We also predicted that possible racial disparities in the prior probability of suspect guilt before subjecting suspects to the risk of misidentification might better explain racial disparities in wrongful convictions. Method …

In the American system of government, courts are designed to operate within the legal sphere, with limited political interference. Is it possible, though, that a behavior that is at the heart of the political process can be influenced directly by a judicial decision? Focusing on voter registration big data for the universe of voters in North Carolina around the time of Dobbs v. Jackson Women’s Health Organization, the authors assess the roles of gender, political party affiliation, and age in voter registration. North Carolina is the only state whose voter registry has the necessary granularity over time and information needed. …
Differences In Religious Framing Of Muslims And Islam In American Media Coverage Before And After The Trump Campaign, Emily Greene-Colozzi, Amy Adamczyk, Senahan Kiyal Keles
Differences In Religious Framing Of Muslims And Islam In American Media Coverage Before And After The Trump Campaign, Emily Greene-Colozzi, Amy Adamczyk, Senahan Kiyal Keles
Publications and Research
Over the last 20 years Muslims have received a disproportionate amount of news media attention. In 2017 they were again thrust into the spotlight when the Trump administration issued a travel ban blocking entry from seven predominately-Muslim countries. With our hand coding of over 900 newspaper articles and mixed modeling techniques, we examine the newspaper rhetoric surrounding Muslims before and during the Trump administration and across US states. We find that after President Trump’s election, fewer newspapers mentioned religion or referenced Muslim claimsmakers. We also reveal that higher state-level religious salience was associated with more newspapers referencing religious claimsmakers in …

Public Attitudes Towards Non-Criminal Preventive Detention As A Function Of The Covid-19 Pandemic, Matt Zaitchik, Kyle Gamache, Judith Platania
Arts & Sciences Faculty Publications
Non-criminal preventive detention is justified by both the state’s parens patriae and police power roles. Individuals with mental illness and individuals with a highly communicable, potentially lethal disease can be involuntarily detained. Modern applications of quarantine have led to higher court decisions that address the balance between liberty and public health and safety. The inherent tensions that underlie quarantine law – individual liberty versus public safety – are apparent in our contemporary, COVID-19 America. Consequently, much of the current discussion appears to have political overtones. In order to empirically address this issue, in the current study we examine attitudes towards …
Taming Dangerousness, Shima Baradaran Baughman
Taming Dangerousness, Shima Baradaran Baughman
Faculty Scholarship
In every courtroom across the country each day, judges determine whether thousands of individuals are either released or held before trial. These speedy and seemingly minor decisions have profound impacts on an accused’s fate and on national incarceration rates. Indeed, over the last fifty years, these individual decisions have led to a four-hundred percent increase in pretrial detention in the United States. This increase in pretrial detention accounts for 99% of the jail growth in the last fifteen years, despite record decreases in arrest and crime rates. At the same time, the United States has witnessed three meaningful periods of …
Rightsizing Local Legislatures, Brenner M. Fissell
Rightsizing Local Legislatures, Brenner M. Fissell
Faculty Publications
Local councils, boards, and commissions have all the lawmaking powers of a legislature—including the power to criminalize conduct—but they are far too small to deserve them. With an average size of only four members, local legislatures depart from the norm observable at all other levels of government. Only in the past few years have legal scholars turned their attention to the institutional design of these bodies, but this developing literature has yet to address their most striking feature—their small size.
This Article takes up this project. It claims that local microlegislatures are comparatively unrepresentative and undemocratic, and that their size …

The Monroe Method: A Methodology On Navigating Race, Oppression, And Equity In Medical Education Through Physician Cultural Responsibility, Christen D. Johnson
Antioch University Dissertations & Theses
Many forms of oppression create barriers for health care, further health disparities, and impact the wellness of physicians. As health disparities, caused by the social determinants of health, complicate the practice of medicine, physicians’ risk of burnout increases. The practice of Physician Cultural Responsibility provides a means to overcome health disparities and support physicians while embracing the intersectionality of the populations they serve. Incorporation of Physician Cultural Responsibility into physician professional identity is essential for the practice to be life-long. As there is no standardized curriculum to address teaching the practice of Physician Cultural Responsibility, this study aims to evaluate …

When Amicus Curiae Briefs Are Inimicus Curiae Briefs: Amicus Curiae Briefs And The Bypassing Of Admissibility Standards, David Dematteo, Kellie Wiltsie
American University Law Review
Amicus curiae briefs are being submitted at historically high levels by a range of individuals and entities, and there is compelling evidence that these briefs are highly influential in judicial decision-making, including in the Supreme Court of the United States. Although amicus curiae briefs have been an ingrained aspect of the U.S. legal system for hundred-plus years, various legal scholars, researchers, commentators, and judges, including Supreme Court Justices, have raised concerns about their use, including that amicus curiae briefs contain redundant information and often function as advocacy tools. This Article addresses an aspect of amicus curiae briefs that has received …
Deathly Delegation: Analyzing Mississippi's Execution Statute Under The Nondelegation Doctrine, Megan Meissner
Deathly Delegation: Analyzing Mississippi's Execution Statute Under The Nondelegation Doctrine, Megan Meissner
American University Law Review
The nondelegation doctrine is a separation of powers principle that limits the legislative branch from delegating its legislative authority to another branch of government. Although this doctrine is more widely known for its federal use, preventing Congress from relinquishing too much of its law-making authority to administrative agencies, most states have adopted similar nondelegation principles. Mississippi’s nondelegation doctrine requires that the legislature enact laws that prescribe the basic policy decision, provide adequate boundaries for agency guidance, and do not vest an agency with arbitrary discretion.
On July 1, 2022, Mississippi enacted a new execution statute, permitting the Department of Corrections …

Educators’ And Administrators’ Perceptions, Challenges, And Changes Associated With School District Consolidation, Candace L. Gillespie
Educators’ And Administrators’ Perceptions, Challenges, And Changes Associated With School District Consolidation, Candace L. Gillespie
Theses and Dissertations
School district consolidation has been a trend throughout the United States as state departments of education are mandating that nearby school districts consolidate with other nearby districts. This trend is being mandated in an effort to decrease funds being spent by having many small districts. This includes funds being spent on salaries and schools, as schools consolidate due to districts consolidating. Schools, central offices, parent centers, and other buildings that are related to having multiple central offices close. Jobs are lost, policies change, and sometimes leadership changes. However, change is inevitable. With change comes different concepts, policies, and in some …
