Due Process Protections For Charter School Students In Long-Term Exclusionary Discipline Proceedings, Leah E. Soloff
Due Process Protections For Charter School Students In Long-Term Exclusionary Discipline Proceedings, Leah E. Soloff
Fordham Law Review
Charter schools—public schools that are subject to minimal state regulation—often employ high levels of exclusionary discipline. Because charter schools in many states are exempt from state laws regulating school discipline, the U.S. Constitution provides charter school students their only source of protections during such disciplinary proceedings. However, the constitutional due process protections afforded to public school students in disciplinary proceedings remain a source of significant disagreement among courts. Although the U.S. Supreme Court has established that public school students must be afforded due process protections in exclusionary discipline proceedings, the Court has yet to determine what process is actually due …

A Comparison Of Defensiveness In Mmpi-2-Rf Profiles Of Male Sex Offenders And Child Custody Litigants, Kyla M. Jones
Theses and Dissertations
Clinical evaluations have had a long-standing role in criminal and civil legal proceedings due to the intersection between various legal criteria and aspects of psychological functioning. The Minnesota Multiphasic Personality Inventory (MMPI; Hathaway & McKinley, 1943) and its subsequent versions have been among the most commonly utilized and empirically supported measures of personality and psychopathology in assessing forensic populations. One application for which MMPI instruments have been particularly useful is in the evaluation of sex offenders. This is in part due to the tests’ built-in validity scales, as MMPI underreporting scales are found to be effective in assessing sex offenders’ …

The Knowledge And Utilization Of Trauma-Informed Care By Educational And Mental Health Professionals Who Serve Children In A Texas City, Mashelle D. Ancell
The Knowledge And Utilization Of Trauma-Informed Care By Educational And Mental Health Professionals Who Serve Children In A Texas City, Mashelle D. Ancell
Electronic Theses and Dissertations
The purpose of this qualitative descriptive study was to understand the knowledge and utilization of trauma-informed care by professionals serving children within schools, social service agencies, or child therapy in a middle-sized Texas city. Previous studies acknowledged the prevalence of trauma and the need for systemic trauma-informed care in communities. The theoretical framework used to guide this study was attachment theory due to the emphasis on securely attached relationships, which is consistent with trauma-informed care. Data collection methods included an online open-ended questionnaire and semistructured personal interviews. Data analysis was completed using reflexive thematic analysis to develop themes from participant …

Designing Safety: Community Safety Initiatives Managed By The New York City Department Of Youth And Community Development, Kwan-Lamar Blount-Hill, Patricia A. Cobar, Fidel L. Osorio, Sheyla A. Delgado, Jeffrey A. Butts
Publications and Research
New York City supplements traditional policing with community-based strategies to prevent crime and violence. At the request of the Department of Youth and Community Development, the Research and Evaluation Center at John Jay College reviewed three such programs: the Crisis Management System (CMS), the Mayor’s Action Plan for Neighborhood Safety (MAP), and the Precision Employment Initiative (PEI). While grounded in promising practices, these initiatives have not yet undergone rigorous evaluation. Additional research is needed to assess their effectiveness and guide potential expansion efforts.

The Public Prosecutions Role in Closing Criminal Cases without Litigation “A Study of the Federal Criminal Procedures Law and Special Criminal Laws”
The dissertation highlights the role of the public prosecution in solving criminal lawsuits without a judicial ruling, by the procedures it takes either by dismissal of action at the evidence collection stage or by issuing a criminal case dismissal order at the initial investigation stage. This can also be done through a penal order in some crimes. Though this latter option gives the public prosecution the jurisdiction to adjudicate on some criminal cases, though this …

Codis: Community Detection Via Distributed Seed Set Expansion On Graph Streams, Austin Anderson, Petros Potikas, Katerina Potika
Faculty Research, Scholarly, and Creative Activity
Community detection has been (and remains) a very important topic in several fields. From marketing and social networking to biological studies, community detection plays a key role in advancing research in many different fields. Research on this topic originally looked at classifying nodes into discrete communities (non-overlapping communities) but eventually moved forward to placing nodes in multiple communities (overlapping communities). Unfortunately, community detection has always been a time-inefficient process, and datasets are too large to realistically process them using traditional methods. Because of this, recent methods have turned to parallelism and graph stream models, where the edge list is accessed …
Ignorance Of The Rules Of Omission: An Essay On Privilege Law, Rebecca Wexler
Ignorance Of The Rules Of Omission: An Essay On Privilege Law, Rebecca Wexler
Vanderbilt Law Review
Evidentiary privileges--that is, rules that empower people to withhold evidence from legal proceedings-are one thread in a mesh of secrecy powers that control the flow of information in society. They are part and parcel of the laws, rules, norms, and practicalities that determine who can conceal and who can compel, that allocate power based on access to knowledge and its opposite. Despite the significance of privileges and of the harms that they produce, our understanding of this body of law has profound gaps.5 The questions posed above turn out to be more challenging than they might at first appear. Notwithstanding …
Models And Limits Of Federal Rule Of Evidence 609 Reform, Anna Roberts
Models And Limits Of Federal Rule Of Evidence 609 Reform, Anna Roberts
Vanderbilt Law Review
A Symposium focusing on Reimagining the Rules of Evidence at 50 makes one turn to the federal rule that governs one's designated topic--prior conviction impeachment--and think about how that rule could be altered. Part I of this Article does just that, drawing inspiration from state models to propose ways in which the multiple criticisms of the existing federal rule might be addressed. But recent scholarship by Alice Ristroph, focusing on ways in which criminal law scholars talk to their students about "the rules," gives one pause. Ristroph identifies a pedagogical tendency to erase the many humans who turn rules into …
Race, Gatekeeping, Magical Words, And The Rules Of Evidence, Bennet Capers --
Race, Gatekeeping, Magical Words, And The Rules Of Evidence, Bennet Capers --
Vanderbilt Law Review
Although it might not be apparent from the Federal Rules of Evidence themselves, or the common law that preceded them, there is a long history in this country of tying evidence-what is deemed relevant, what is deemed trustworthy-to race. And increasingly, evidence scholars are excavating that history. Indeed, not just excavating, but showing how that history has racial effects that continue into the present.
One area that has escaped racialized scrutiny-at least of the type I am interested in-is that of expert testimony. Even in my own work on race and evidence, I have avoided discussion of expert testimony. In …
How Machines Reveal The Gaps In Evidence Law, Andrea Roth --
How Machines Reveal The Gaps In Evidence Law, Andrea Roth --
Vanderbilt Law Review
This Symposium asks participants to reimagine the Federal Rules of Evidence on the fiftieth anniversary of their effective date. As part of that conversation, this short Essay argues that the Rules of Evidence contain critical gaps in terms of empowering litigants to meaningfully challenge the credibility of evidence. Specifically, the increasing use of machine-generated proof has made clear that evidence law does not offer sufficiently meaningful opportunities to scrutinize conveyances of information whose flaws cannot be exposed through cross-examination. These underscrutinized conveyances include machine-generated output, information conveyed by animals, and statements made by absent hearsay declarants. Even for some witnesses …
Infusing Anarchist Pedagogy Into Counselor Education, Andrew Wood
Infusing Anarchist Pedagogy Into Counselor Education, Andrew Wood
Teaching and Supervision in Counseling
Anarchist pedagogy has existed for well over 100 years, but little has been written on the subject within the counseling profession and the counselor education literature specifically. Anarchist pedagogy offers a direct relationship between education and social justice praxis that many counseling programs espouse, and thus the consideration of an explicitly political pedagogy may benefit the counselor education profession. This manuscript aims to provide a brief overview of anarchist pedagogy, how it fits into the work of counselor education, and how counselor educators can utilize anarchist pedagogy. Limitations for the infusion of anarchist pedagogy into counselor education and future areas …

Transportation Planning, Policy, and Processes (TP3) Final Reports
In an effort to make roadways safer and to relieve the cost burden that unsafe roadways place on Hillsborough County residents, the Hillsborough County Community & Infrastructure Planning Department asked researchers from the Center for Urban Transportation Research (CUTR) at the University of South Florida (USF) to identify and summarize noteworthy and reproducible practices currently being used in other large Florida Counties regarding data-driven safety coordination between counties and first responder agencies. This research project explored methods County planners might employ to assist law enforcement and other first responders within their county in identifying the most dangerous areas for road …

Strength Under Pressure: Superwoman Schema (Sws) And Intimate Partner Violence (Ipv) Among Black Women, Jasmin Washington, Dr. Jill Christine Hoxmeier
Strength Under Pressure: Superwoman Schema (Sws) And Intimate Partner Violence (Ipv) Among Black Women, Jasmin Washington, Dr. Jill Christine Hoxmeier
International Journal of Undergraduate Research and Creative Activities
Intimate Partner Violence (IPV) is a prominent public health issue in the U.S., and evidence suggests that IPV disproportionately affects Black women. Additionally, Black women who are victimized may be reluctant to report and/or seek supportive services. Given these disparities, it is important to understand the context of IPV in the Black community. Although the Superwoman Schema (SWS) conceptual framework’s utility for explaining other health-related outcomes, such as mental health issues, among Black women is emerging, its use to understand the experiences of Black women and IPV in the Black community is limited. In this paper, we provide an overview …

Every 73 seconds another person in America is sexually assaulted. For my senior practicum, I worked at Sexual Assault Resource Center, which provides advocacy and support services, including crisis intervention and counseling, for survivors of sexual violence. My goals for my time with SARC included developing knowledge and skills related to being a trauma therapist, learning about how a nonprofit operates, and gaining an understanding of sex education and sexual violence prevention programs. As a Sexual Assault Advocate and Education and Prevention Intern at SARC, my primary responsibilities involved engaging in community outreach events, delivering educational workshops, and presenting prevention …

Perceptions Of Sex Educators: A Qualitative Analysis, Christina Richardson, Hena Mustafa, Shanell K. Sanchez
International Journal of Undergraduate Research and Creative Activities
The fear of children getting victimized by strangers is the basis for several current pieces of legislation, specifically Megan’s law, despite the lack of corresponding empirical data. This legislation causes significant negative consequences for those who are on the registry, especially for juvenile offenders as they have unique challenges they face regarding labeling and societal reintegration. As most juveniles receive most of their sex education in school, and a lack sex education is a contributing factor to the commission of sex offenses, this study aims to explore a proactive method of preventing sex offenses. This study includes exploratory interviews with …

Relevance Of The Remedial Secession Theory For Indonesia's Territorial Integrity, Heribertus Jaka Triyana
Relevance Of The Remedial Secession Theory For Indonesia's Territorial Integrity, Heribertus Jaka Triyana
Indonesian Journal of International Law
This article aims to analyse the remedial secession theory in international law relevant to the current international armed conflict between Russia and Ukraine waged by Russia’s recognition of Donbask and Luhansk independence. It might have legal as well as political impacts on the territorial integrity of a sovereign State such as Indonesia where human rights violations in Papua have become problematic. The analysis in this paper is mainly construed using the paradigm of customary international law as the primary source of international law to find out the relevance of the remedial secession theory in terms of its area, scope, and …

With the current criminal compliance pilot, how to apply it correctly in the field of food safety is a new research direction. Starting from the criminal behavior of substantive law, this paper probes into the rationality of applying compliance non-prosecution in food production and operation enterprises, and through the analysis of the application of criminal compliance non-prosecution, puts forward the measures for applying the system in the field of food safety.
Submission To Justice Canada On The Criminalization Of Coercive Control, Janet Mosher, Shushanna Harris, Jennifer Koshan, Wanda Wiegers
Submission To Justice Canada On The Criminalization Of Coercive Control, Janet Mosher, Shushanna Harris, Jennifer Koshan, Wanda Wiegers
Commissioned Reports, Studies and Public Policy Documents
Justice Canada has been holding an engagement process on the issue of whether an offence of coercive control should be added to the Criminal Code. This offence has been proposed in a series of private members bills, most recently, Bill C-332. This submission argues that it is imperative that actors in all legal domains acquire a nuanced and contextual understanding of coercive control derived from an intersectional analysis that attends to how multiple systems of oppression interact to shape the tactics of coercion and control. However, we do not support the criminalization of coercive control, either as a standalone offence …
