Intimate Partner Violence: The Silent Enemy Among African Immigrant Women, Omoniyi Anne Bello Jan 2023

Intimate Partner Violence: The Silent Enemy Among African Immigrant Women, Omoniyi Anne Bello

Walden Dissertations and Doctoral Studies

Intimate partner violence among immigrant and minority groups remains a social and health problem that has garnered little attention. African immigrant women particularly face intersectional challenges (e.g., language barriers, unemployment, and lack of access to health care, resources, and services) that heighten their vulnerability to partner violence. Yet, knowledge about their experiences remains elusive in empirical research. Examining the nature and extent of their experience can provide valuable insights that could enhance research and practice on partner violence. The purpose of this generic qualitative study was to explore the experiences of African immigrant women survivors of partner violence in Edmonton, …

Attorney Perspectives Regarding Use Of Federal Confidential Informants In White-Collar Crimes, Richard Dwayne Britt Jan 2023

Attorney Perspectives Regarding Use Of Federal Confidential Informants In White-Collar Crimes, Richard Dwayne Britt

Walden Dissertations and Doctoral Studies

Most federal white-collar cases involve the use of confidential informants (CIs) to obtain convictions. However, there was a gap in research regarding the examination of CI efficacy safeguards and whether combinations of safeguards produce desired effects from the perspectives of private practice attorneys with defense and prosecutor experience. The purpose of this historical research qualitative study was to explore the literature related to whether federal CI policies of safeguards influenced the national use of CIs to obtain convictions in federal white-collar cases based on the perspectives of private practice attorneys with defense and prosecutorial experience as gathered through participant interviews. …

Probationer Officer Experiences: Dual Role Decision-Making For Probationers With Mental Illness, Myra A. Fields Jan 2023

Probationer Officer Experiences: Dual Role Decision-Making For Probationers With Mental Illness, Myra A. Fields

Walden Dissertations and Doctoral Studies

Probation officers play a major role in maintaining public safety by balancing their dual roles of care and control. The number of individuals within the United States community corrections system is significantly growing. This has increased the need for probation officers to make decisions for probationers with mental illness. However, there is a gap in understanding how active-duty probation officers make decisions for probationers. This study examined how probation officers balance their dual roles while decision-making for probationers with mental illness. An interpretative phenomenological analysis design was used. Semi-structured interviews were conducted with six participants who met inclusion criteria to …

The Experiences Of Successful Formerly Incarcerated African American Males, Bernice Gordon-Young Jan 2023

The Experiences Of Successful Formerly Incarcerated African American Males, Bernice Gordon-Young

Walden Dissertations and Doctoral Studies

African American men are incarcerated at alarming rates and often recidivate at high rates within 3 years. Researchers have demonstrated that recidivism rates last through years 4 and beyond. There is limited qualitative data to provide strategies from formerly incarcerated African American males who have been successful at not recidivating for 10 or more years after their release. The purpose of this Afrocentric-hermeneutic phenomenological study was to bridge the gap in the literature and explore the lived experiences of African American males who were formerly incarcerated and have positively changed their lives to avoid further criminality. A purposeful and snowball …

Participant Perceptions Of Investigative Interviewing Utilizing Archival Pre And Post-Implementation Data, Shaun Michael Sylvester

Walden Dissertations and Doctoral Studies

Scholars and practitioners have provided substantial literature and research into the efficacy of investigative interviewing as a method of police interrogation that mitigates false confession and coercion. This quantitative study examined archival data on participant perceptions of investigative interviewing before and immediately following an investigative course. Three areas representing principles of investigative interviewing and police investigator perceptions were examined: Confession and evidentiary testimony, confirmation bias, and deception detection through body language observation. Participants included sworn law enforcement officers, either newly employed or on the path to becoming an investigator. There were 206 responses for both the pre-test and post-test surveys. …

Exploring Dual Roles In Law Enforcement Officers Who Administer Naloxone, Regina Sullivan Wachenheim Jan 2023

Exploring Dual Roles In Law Enforcement Officers Who Administer Naloxone, Regina Sullivan Wachenheim

Walden Dissertations and Doctoral Studies

With the introduction of law enforcement-administered naloxone, officers are assuming the dual role of law enforcer and caregiver with opioid users. This study used cognitive role theory and Thorne’s interpretive approach to explore the dual roles experienced by officers. The purpose of this study was to understand (1) how officers who administer naloxone describe their experience of the dual role, and (2) how the officers describe the role expectations of law enforcer and caregiver. Seven officers completed semi-structured, one-on-one, telephone interviews. The eight themes that emerged were related to the officers’ views of (1) saving and changing opioid users’ lives; …

Assessing African American Perceptions Of Racial Discrimination By Law Enforcement In Rural South Georgia, Joseph Bacot Jan 2023

Assessing African American Perceptions Of Racial Discrimination By Law Enforcement In Rural South Georgia, Joseph Bacot

Walden Dissertations and Doctoral Studies

African Americans make up a very small percentage of our nation’s population. However, studies have shown that they are treated unfairly by law enforcement at higher rates than their white counterparts. The purpose of this qualitative study was to utilize a phenomenological approach to assess the perceptions of the lived experience of African Americans who claim to have been the recipients of racial discrimination by police. The study specifically focused on targeted rural areas in South Georgia to determine if “rural” life would alter how recipients perceived the overall legitimacy of policing after encountering a racially discriminatory interaction with police. …

Law Enforcement Leaders’ Perceptions Of The Attributes Of Emotional Intelligence, Gordon A. Broussard

Walden Dissertations and Doctoral Studies

AbstractAlthough there have been numerous studies conducted on emotional intelligence and effective leadership, there is a need for increased emotional intelligence among law enforcement leaders. This study aimed at determining how law enforcement leaders perceive the importance of emotional intelligence attributes when leading their organization. A phenomenological qualitative study was used with purposive and snowball sampling of 12 participants who held senior leadership positions for over five years as chiefs and sheriffs throughout the United States. Semistructured interviews were conducted to determine participants’ perceptions of the importance of the four attributes of emotional intelligence: self-awareness, self-management, social awareness, and relationship …

Correctional Officers’ Perceptions Of Punitive Force In Solitary Confinement, Megan Crista Oberholtzer Jan 2023

Correctional Officers’ Perceptions Of Punitive Force In Solitary Confinement, Megan Crista Oberholtzer

Walden Dissertations and Doctoral Studies

Solitary confinement in United States prisons is a common practice influenced by legal and human rights discussions. Physical conditions of the prison environment can cause somatic and psychological distress among correctional officers. The research problem is how lived experiences of solitary confinement correctional officers may influence punitive force perceptions. A positive outcome for inmates may be influenced by correctional officers who are unbiased in confinement, interventions, and treatment management. Positive inmate outcomes also rely on institutional functions. The purpose was to explore correctional officers’ lived experiences and perspectives. The supporting theoretical framework is Weiner’s attribution theory. The research question involved …

Controlling Images: Black Male And Female Representations, Peyton Gindrow

Capstone Showcase

American culture has a very rich history that has shaped our society in the present day. One thing in history that has stayed with us throughout the years is racism. This phenomenon has had a big impact on our society throughout the years. And if it never came into existence, our world would be a much different place. Racism affects any and everything imaginable. It affects the way we see each other, communicate, and interact with each other. Slavery was a turning point for racism and it allowed for racism to flourish by dehumanizing people just because of the color …

Expanding The Samat In Kentucky Correction Institutions: Benefits And Funding, Blair Lozier Jan 2023

Expanding The Samat In Kentucky Correction Institutions: Benefits And Funding, Blair Lozier

MPA/MPP/MPFM Capstone Projects

The United States has seen an increasing rate of substance use disorder among individuals. Those convicted and incarcerated are more likely to have substance use disorder. With correctional institutions becoming overcrowded, policymakers struggle to find an answer to the number of individuals incarcerated with substance use disorder. The Cabinet of Health and Family Services and the Department of Corrections created Supportive Assistance with Medication for Addiction Treatment (SAMAT) in Kentucky. SAMAT is an addictive services program focused on preventing overdose and relapse and aiding recidivism for individuals with opioid and alcohol use disorder. The SAMAT has been deemed successful through …

The Prison Industrial Complex: A Microcosm Of Environmental Justice As A Human Rights Issue, Isabella Brusco Jan 2023

The Prison Industrial Complex: A Microcosm Of Environmental Justice As A Human Rights Issue, Isabella Brusco

Scripps Senior Theses

Many scholars have established a connection between Environmental Justice (EJ) and the Prison Industrial Complex (PIC), EJ and human rights, and the PIC and human rights.. The aim of this thesis is to encourage a conversation that connects these three concepts: EJ, the PIC, and human rights. This will be accomplished by scrutinizing a legal case called Rutherford v. Luna, in which American Civil Liberties Union (ACLU) lawyers contend that individuals incarcerated in the inmate reception center of Los Angeles County are enduring inhumane conditions. I employ this case as an example of the PIC, illustrating that the PIC represents …

Renewing Freedom Of Expression, Part Two: From The Contextual Approach To Proportionality Balancing, Jamie Cameron Jan 2023

Renewing Freedom Of Expression, Part Two: From The Contextual Approach To Proportionality Balancing, Jamie Cameron

All Papers

This article continues the project to renew the Charter’s methodology of expressive freedom in two parts. Part One explained that the Court’s approach to s.2(b) decision making is skewed against expressive freedom and must be addressed holistically, under ss.2(b) and s.1. (see J. Cameron, “Resetting the Foundations: Renewing Freedom of Expression under Section 2(b) of the Charter”, in B. Bird and D. Ross, eds., Forgotten Foundations of the Canadian Constitution. (LexisNexis Canada, 2022). Part One provided a critique of the current methodology, addressed the meaning of freedom under s.2(b), proposed a revised standard of breach, and sketched a …

The Role Of Symbolic Politics In Shaping Political Attitudes: A Study Of Trump And Biden's Campaign Speeches, Nimra Asif Jan 2023

The Role Of Symbolic Politics In Shaping Political Attitudes: A Study Of Trump And Biden's Campaign Speeches, Nimra Asif

Williams Honors College, Honors Research Projects

In this study, five speeches by Donald Trump and six by Joe Biden were comprehensively analyzed for their symbolic politics on immigration and social issues. The data revealed a consistent trend, with Trump featuring a greater number of mentions in comparison to Biden—66 and 26, respectively. Furthermore, Trump's symbolic politics exhibited a predominantly negative tone, while Biden's approach was predominantly positive. The results of this analysis confirm my hypotheses, highlighting notable disparities in the rhetoric employed by each candidate. Trump amplified a negative outlook on social issues and immigration, whereas Biden strategically mentioned and positively framed these issues. This research …

Documenting Classification Systems: A Case Study And Considerations, Christopher Straughn Jan 2023

Documenting Classification Systems: A Case Study And Considerations, Christopher Straughn

Library Faculty Publications

There is little literature on documenting the correct application of classification systems. This paper seeks to remedy this gap by describing how Northeastern Illinois University created documentation for their implementation of system that describes Illinois State publications. We recommend creating documentation that is flexible, accessible, and user-oriented. Flexible documentation not only facilitates changes to the documentation, it also allows librarians to take advantage of other uses of this documentation. In our case, the process of documentation produced a near complete listing of Illinois publications and provided the basis for a structural history of Illinois government. Documentation of classification systems not …

Judge Frankel’S Fifty-Year-Old Invitation To Reconstruct Sentencing, Jelani Jefferson Exum Jan 2023

Judge Frankel’S Fifty-Year-Old Invitation To Reconstruct Sentencing, Jelani Jefferson Exum

Faculty Publications

(Excerpt)

America was a different place at the time Judge Marvin Frankel penned his now-famous text Criminal Sentences: Law without Order in 1973. Richard Nixon was the U.S. president. The Vietnam War was ending. The Watergate scandal was unfolding. There was much to grab the public’s attention, and criminal sentencing was not a national or international headline. Just two years earlier, President Nixon had declared a war on drugs and targeted drug abuse as “public enemy number one,” but it would be over a decade before punitive mandatory minimum drug sentences would become our sentencing norm. At the time of …

Investing In Abolition, Sandeep Singh Dhaliwal Jan 2023

Investing In Abolition, Sandeep Singh Dhaliwal

Faculty Publications

This Article situates the prison within a broader macro-financial trend, what I call “community capture.” As private equity firms have consolidated the market for carceral services, they have also gained control over other essential social infrastructure, like housing and healthcare. By layering debt, fees, and aggressive profit expectations over companies or assets that provide for basic needs, their strategies intensify the economic pressures communities face. These strategies rely on various forms of coordination and legal protection from contestation. To demonstrate this process in the context of mass incarceration, this Article tells the story of Securus, a dominant carceral service company …

The Paradoxes Of A Unified Judicial Philosophy: An Empirical Study Of The New Supreme Court, 2020-2022, Victoria Frances Nourse

Georgetown Law Faculty Publications and Other Works

The 2021 Supreme Court Term ended with a bang, yielding blockbuster cases making headlines. But what of the rest of the cases? This is the first major paper to examine the “Trump effect,” meaning the influence of three Justices appointed by President Trump who all share a “unified” judicial philosophy. In a two-year project, starting from 2020, when Justice Barrett ascended to the Court, to the end of June 2022, this article reviews 124 cases and over 300 opinions. There is both good and bad news for the court’s new “unified” judicial philosophy. History and text are both upwardly mobile …

Association For The Promotion Of Political Economy And The Law (Appeal): Transforming Law And Economic Power, Martha T. Mccluskey Jan 2023

Association For The Promotion Of Political Economy And The Law (Appeal): Transforming Law And Economic Power, Martha T. Mccluskey

Journal Articles

This article reflects on the Association for the Promotion of Political Economy and Law (APPEAL), formed in 2012 as the first contemporary scholarly group named for the emerging field of Law and Political Economy (LPE). APPEAL organizes academics and allies to address urgent social problems by exploring possibilities for reorienting the economy toward justice, equality, and democracy. To mobilize ideas for change, APPEAL emphasizes collaborative intellectual communities. I situate APPEAL in the context of a neoliberal political movement to capture law’s power by investing in the Law and Economics message that economic power inevitably limits democracy and social justice. Though …
