Expanding Medication-Assisted Treatment In Drug Courts: A Comprehensive Examination And Proposed Solution To Expand Maud And Moud Programs In The United States, Katelin Carter

Research Awards

This article examines the relationships between substance abuse, criminal justice, and public health in the United States, with a specific focus on Medication-Assisted Treatment (MAT) within drug treatment courts. The analysis uncovers the limitations of punitive measures, particularly within the framework of President Richard Nixon's "War on Drugs," revealing the need for evidence-based solutions like MAT in criminal justice. The pivotal role of MAT in addressing opioid addiction within drug courts is explored in detail, and data is presented supporting its effectiveness. Despite this efficacy, persistent barriers to its implementation are identified, including stigma, policy constraints, and healthcare disparities. Legal …

Understanding Student Experiences Of Renewable And Traditional Assignments, Virginia Clinton-Lisell, Lindsey Gwozdz Jan 2023

Understanding Student Experiences Of Renewable And Traditional Assignments, Virginia Clinton-Lisell, Lindsey Gwozdz

Education, Health & Behavior Studies Faculty Publications

Renewable assignments are student created artifacts that have value outside of courses. However, more empirical inquiry in renewable assignments grounded in theoretical frameworks is necessary. In this study, students (N = 69) engaged in renewable assignments and were asked to report on their perceptions based on the self-determination theory of motivation and social justice principles. Overall, students reported higher levels of motivation as well as more opportunity to represent their identities for renewable assignments than traditional assignments. Students who opted to publicly share reported higher levels of competence and relatedness than did students who did not opt to publicly share.

As Long As There Is Money Involved In Justice, There Will Be No Justice: The United States' Criminalization Of Poverty And The Need To Demonitize Our Criminal "Justice" System, Amanda Piccione

Hofstra Law Student Works

This paper will show how the United States will fail to achieve a criminal “justice” system if money is involved. The cyclical impacts of poverty and marginalization on communities of color throughout our nation’s history will continuously perpetuate an unequal and unfair criminal system. Section II begins by delving into the history of poverty in the United States. It then analyzes poverty and its impacts today while specifically discussing the effects on communities of color and the intersections with crime. Section III examines the legal issue, exploring our monetized legal system and discussing how we can change our criminal legal …

Grandma Got Arrested: Police, Excessive Force, And People With Dementia, Rashmi Goel Jan 2023

Grandma Got Arrested: Police, Excessive Force, And People With Dementia, Rashmi Goel

Sturm College of Law: Faculty Scholarship

Recent events have shone a light on the particular vulnerability of people with dementia to police violence. Police are arresting people with dementia and using excessive force to do it—drawing their firearms, deploying tasers, and breaking bones.

To date, little attention has been paid to the burgeoning number of people with dementia, one of society’s most vulnerable populations, and their experiences with the criminal justice system. This Article examines how dementia leads people to engage in activity that appears criminal (shoplifting (forgetting to pay), and trespass (wandering), for instance) and the disproportionate response of police. In several cases where people …

Suicide is one of the leading causes of death among youth age 10-19, and is an increasing concern in the wake of COVID-19. K-12 schools are crucial spaces for offering mental health support to students, and can implement policies to help prevent suicidal thoughts and behaviors. This MERC research and policy brief focuses on education policy related to suicide prevention and response. It is structured to answer five questions: 1) What are recent trends in youth suicide? 2) What does research show about school division policies that are effective in suicide prevention and response? 3) What policies in Virginia and …

Running A Red Light: How Pennsylvania Rushed To Its Destination And Failed To Define "Exigent Circumstances" In Commonwealth V. Alexander, Josephine L. Mlakar

Duquesne Law Review

The United States Supreme Court and the Pennsylvania Supreme Court both recognize an "automobile exception" to the warrant requirement pursuant to their respective constitutions. In 2014, the Pennsylvania Supreme Court adopted the federal automobile exception. Under the federal automobile exception, police can search a vehicle without a warrant where probable cause exists. In 2020, the Pennsylvania Supreme Court overruled its 2014 decision, and announced its official departure from federal standard. Now, police can search a vehicle without a warrant only upon a showing of both probable cause and exigent circumstances.

Adding an exigency component to the warrantless search requirement is …

Perception Of Social And Physical Environmental Risk Factors Affecting Women Experiencing Homelessness: A Mixed Method Study, Lucy Alimamy, Anastasia Murphy, Nicole Munoz Ordonez, Paulina Aguilar Delgado

Undergraduate Review

Homeless people in general confront many difficulties that make their lives very challenging. However, when it comes to women experiencing homelessness, those challenges can threaten their well-being by increasing the risk of victimization and decreasing the levels of personal safety. This research project has three aims: first, to better understand the link between victimization and social and physical environment as it relates to homeless women; second, to recognize which aspects of the social and physical environment homeless women find threatening and difficult to overcome; and third, to examine the areas of conflict within the coexistence of homeless women in a …

A Study Of Public Opinion: The Importance Of Mental Illness Diagnosis And Perceptions Of Recidivism On Parole Eligibility, Emily Pedigo Jan 2023

A Study Of Public Opinion: The Importance Of Mental Illness Diagnosis And Perceptions Of Recidivism On Parole Eligibility, Emily Pedigo

Mahurin Honors College Capstone Experience/Thesis Projects

The present study examined the impact a mental illness diagnosis has on parole eligibility mediated by the participants’ perceptions of whether the prospective parolee would commit future crimes if released. Participants watched a video vignette of an individual charged with second degree manslaughter and diagnosed with borderline personality disorder, antisocial personality disorder, or bipolar disorder while incarcerated. Results indicated that a diagnosis of antisocial personality disorder indirectly reduced parole success compared to bipolar disorder and borderline personality disorder when mediated by participants’ perceptions of whether the convict would recommit a crime following release.

Power Shift: The Return Of The Uniting For Peace Resolution, Michael P. Scharf Jan 2023

Power Shift: The Return Of The Uniting For Peace Resolution, Michael P. Scharf

Faculty Publications

In 2022, the United States dusted off the 1950 Uniting for Peace Resolution in order to obtain General Assembly condemnation of the Russian invasion of Ukraine. This was the first time in three decades that the Security Council and General Assembly had utilized the Uniting for Peace mechanism – a process designed to end-run a Security Council veto. Together with the General Assembly’s creation of the international investigative mechanism for Syria in 2016 over Russia’s objection, the use of the Uniting for Peace process to condemn Russia’s aggression represented a shift in power away from the Security Council and to …
