One Treaty To Apply Them All? Defining Maritime Terrorism By Cross-References And Reservations: The Asean Region Example, Arron N. Honniball
One Treaty To Apply Them All? Defining Maritime Terrorism By Cross-References And Reservations: The Asean Region Example, Arron N. Honniball
International Law Studies
Defining terms will shape a State’s treaty obligations, the domestic legislation necessary, the availability of cooperative mechanisms, and norm diffusion. Maritime terrorism is an umbrella term referring to the piecemeal approach of treaties creating offenses for identified acts at sea. Further treaties cross-reference the offenses in a selection of global instruments to create related offenses. This includes financing of terrorism (Convention for the Suppression of the Financing of Terrorism (ICSFT)) and regional maritime terrorism (ASEAN Convention on Counter Terrorism (ACCT)). All cross-referenced instruments shall apply to define ICFST or ACCT offenses unless a State excludes, by reservation, a cross-referenced instrument …
From Dropout To Doctorate: A Phenomenology Of The Self-Determination Of Individuals Who Persisted To Completion, Nancy Catherine Hamilton
From Dropout To Doctorate: A Phenomenology Of The Self-Determination Of Individuals Who Persisted To Completion, Nancy Catherine Hamilton
Doctoral Dissertations and Projects
The purpose of this transcendental phenomenological study was to describe the lived experiences of former high school dropouts in the Continental United States who self-determined to persist to doctoral degree attainment. The theory that guided this study was the self-determination theory with support from the self-efficacy theory and adult learning theory. These three theories framed this study, which sought to discover the motivating factors, life influences, and perseverance required of former high school dropouts who determined to re-enter academia and pursue an education to the doctoral level. The problem this study sought to address was the need to discover the …
The Impact Of Pre-Hire Fitness Scores On Resilience And Burnout Among New Castle County Patrol-Level Police Officers, Eugene Joseph Reid
The Impact Of Pre-Hire Fitness Scores On Resilience And Burnout Among New Castle County Patrol-Level Police Officers, Eugene Joseph Reid
Doctoral Dissertations and Projects
This study seeks participation from patrol-level officers with at least two years’ experience in the New Castle County Police Department in Delaware (n=134) and requests that they respond to two questionnaires measuring resilience and job burnout: the 25-item Resilience Scale and the Maslach Burnout Inventory. Additionally, participants are asked to self-report their pre-hire fitness scores. Police officers are repeatedly exposed to trauma, which has negative mental and physical consequences, often leading to extreme stress, fatigue, and emotional imbalance. Repeated trauma also impacts physical fitness, which is critical for not only physical and mental health but also work performance, especially for …

Community Justice Services: Models From Around The World, Lisa Moore
Community Justice Services: Models From Around The World, Lisa Moore
Canadian Forum on Civil Justice
This document examines community justice services. It highlights approaches and models for local justice outreach and legal assistance effectuated by organizations around the world. The organizations profiled in this document all provide legal assistance in some form to underserved, underprivileged, vulnerable, and/or marginalized populations. In many cases, geographic location is an important factor determining who can access legal help, but it is not the only factor or necessarily a prerequisite. Across the diverse community justice services included in this document, legal assistance is provided virtually, in-person, by phone, or in hybrid formats to individuals living within or beyond a given …

The Society For Community Research And Action On A Path Toward Conocimiento: From Silences And Statements To Solidarities In Action In U.S Community Psychology, Jesica S. Fernández
Ethnic Studies
A first-person narrative essay is presented through a critically reflexive auto-ethnography of a community psychologist's experiences as a member of the Society for Community Research and Action (SCRA) and (as of this writing) co-chair of the Cultural, Ethnic and Racial Affairs council. Through this methodological orientation, an analysis of some of the discourses that circulated within the SCRA listserv in relation to the murder of Mr. George Floyd, and amidst an ensuing pandemic are analyzed and discussed in relation to Anzaldúa's seven stages of conocimiento. The intentions that guide and ground this first-person account are to animate deeper reflection, accountability, …

College Administrator Experiences: A Phenomenological Study Of Higher Education Leadership In American Prisons, Donavan Bailey
College Administrator Experiences: A Phenomenological Study Of Higher Education Leadership In American Prisons, Donavan Bailey
Education Doctorate Dissertations
Higher education for the incarcerated (HEP) is a re-energized phenomenon in the age of criminal justice reform and social change. Following the 2015 Second Chance Pell Grant Experimental Initiative (SCP), which granted select colleges tuition funding for prisoners, HEP grew exponentially. The successes of the SCP laid the groundwork for the 2020 FASFA Simplification Act. In July 2023 the 2020 FSA begins, and all those imprisoned within America may access Pell Grant Funds for higher education. Despite momentous efforts to bring higher education to the incarcerated, HEP grapples with continued challenges and lacks unified, evidence-based competency equal to normative higher …
The Grass Is Always Greener: Analyzing Crime Concentration And Specialization In Urban Greenspace Environs, Cheyenne Pamela Hodgen, Kathryn Wuschke
The Grass Is Always Greener: Analyzing Crime Concentration And Specialization In Urban Greenspace Environs, Cheyenne Pamela Hodgen, Kathryn Wuschke
Criminology and Criminal Justice Faculty Publications and Presentations
Greenspaces play an important role in the urban landscape, with prior research suggesting that they are associated with numerous health and social benefits for residents. Despite this, research conflicts regarding the relationship between greenspaces and crime, with some studies finding these locations to be criminogenic and others finding them to be protective against local crime. This study examines this relationship in Portland, Oregon, considering different greenspace types as well as different crime types. Further, this study presents a novel methodological adaption to measure crime concentration and specialization around discrete location types by integrating a street network buffer into the standard …

The Legacy Of Trayvon Martin—Neighborhood Watches, Vigilantes, Race, And Our Law Of Self-Defense, Mark S. Brodin
The Legacy Of Trayvon Martin—Neighborhood Watches, Vigilantes, Race, And Our Law Of Self-Defense, Mark S. Brodin
Marquette Law Review
Reflecting back a decade later, what is the enduring significance of the Trayvon Martin case—a Black teenager whose life is violently cut short, and a legal system that accepted his death without consequence? The poet Elizabeth Alexander speaks of “The Trayvon Generation” of Black youth who have grown up in the haunting shadow of his killing, and the anguished parents who cannot protect their children from such a fate. America’s first Black president spoke for them: “When I think about this boy, I think about my own kids. If I had a son, he’d look like Trayvon,” Barack Obama told …

Carceral Socialization As Voter Suppression, Danieli Evans
Carceral Socialization As Voter Suppression, Danieli Evans
Articles
In an era of mass incarceration, many people are socialized through interactions with the carceral state. These interactions are poweful learning experiences, and by design, they are contrary to democratic citizenship. Citizenship is about belonging to a community of equals, being entitled to mutual respect and concern. Criminal punishment deliberately harms, subordinates, and stigmatizes. Encounters with the carceral system are powerful experiences of anti-democratic socialization, and they impact peoples' sense of citizenship and trust in government. Accordingly, a large body of social science research shows that eligible voters who have carceral contact are significantly less likely to vote or to …

Ensuring Equity In Education: End Exclusionary Discipline To Protect All Students Access To Learning, Emma Daugherty, Dominika Dyminski, Lacey Erickson, Carly Manderfeld
Master of Social Work Student Policy Advocacy Briefs
A student's race, disability status and previous history of discipline are leading factors associated with being subjected to exclusionary discipline. This contributes to a negative cycle of discipline for our Black, Indigenous, and other students of color (BIPOC) and students with disabilities. This cycle prevents BIPOC and students with disabilities from learning, growing, and reaching their full potential. Minnesota must disrupt this negative disciplinary cycle by ending subjective disciplinary practices and investing in practices that promote an equity and a healthy school environment for all students.
Let My People Go, Part One: Black Rebellion And The Second Amendment Political Necessity Defense, Kindaka Sanders
Let My People Go, Part One: Black Rebellion And The Second Amendment Political Necessity Defense, Kindaka Sanders
William & Mary Bill of Rights Journal
This Article argues that when an individual or group acts to protect a government-assailed constitutional right by criminal means, the doctrine of political necessity may serve as a constitutionally protected defense. The doctrine of political necessity builds on the common law doctrine of necessity. The necessity doctrine, also referred to as the “choice of evils” defense, exonerates an individual who creates a social harm to allay a greater harm to herself or others. Both state and federal courts have been especially reluctant to allow the use of the necessity defense in cases with political implications, in which the defendant acts …
The Structure Of Criminal Federalism, Erin C. Blondel
The Structure Of Criminal Federalism, Erin C. Blondel
Notre Dame Law Review
Scholars and courts have long assumed that a limited federal government should stick to genuinely “federal” crimes and leave “local” crimes to the states. By that measure, criminal federalism has failed; federal criminal law largely overlaps with state crime, and federal prosecutors regularly do seemingly “local” cases. Despite nearly unlimited paper jurisdiction, however, the federal enforcement footprint has remained tiny and virtually static for a century. Something is strongly limiting the federal system, just not differences in substantive coverage.
The answer is different enforcement responsibilities. The police power means states alone provide basic public safety and criminal justice. Rather than …
“Hey, Google, What Are The Elements Of Homicide By Vehicle In The First Degree?”: The Supreme Court Of Georgia Reinforces The Prohibition On Extrajudicial Information Considered By A Jury In Criminal Trials, Savannah Hall
Mercer Law Review
In a criminal trial, the presentation of evidence and the instruction of law to the jury are of crucial importance to ensure that a person is only convicted based upon sound understandings of the factual and legal framework under which they were charged. The complexities surrounding the rules of evidence are in place so that jurors are only allowed to consider the facts and testimony permissible under the rules of evidence, meaning it is of utmost importance for the jury to consider solely those things which a judge deems admissible, relevant, and helpful to understanding the case. However, given the …
