Transportation Infrastructure Needs In The Central Appalachian Basin To Support Core-Cm, Bryan Gibson, Robin Baskette, Doug Kreis
Transportation Infrastructure Needs In The Central Appalachian Basin To Support Core-Cm, Bryan Gibson, Robin Baskette, Doug Kreis
Kentucky Transportation Center Research Report
With demand for coal from the Central Appalachian Basin waning, coalitions and organizations throughout the region have sought to diversify the region’s economy. However, the potential exists to use coal and coal-based resources to produce new and innovative products and kick start economic growth in the basin. This includes carbon ore, rare earth and critical minerals (CORE-CM), other minerals, and waste streams. If the region is to take advantage of these economic growth opportunities, transportation infrastructure must be developed and maintained in a sound condition. Reliable roads, highways, and bridges provide rural areas with access to capital, labor, and markets …

A Legal History Of The Regulation Of Assault-Style Rifles In Canada, R. Blake Brown
A Legal History Of The Regulation Of Assault-Style Rifles In Canada, R. Blake Brown
Dalhousie Law Journal
This article provides the first legal history of the regulation of “assault-style” weapons in Canada. A contentious part of Canada’s gun control regime is the firearms classification system that divides guns into non-restricted, restricted, and prohibited firearms. The sale of semi-automatic firearms, often based on military designs that could be quickly fired and reloaded, sparked concerns since the 1970s, particularly after mass shooting events. Canada adopted a classification regime relying on both statutory provisions that used technical details of firearms and Orders-in-Council to name models of firearms as restricted or prohibited weapons. Critics warned that this system allowed private citizens …
Black And Battered: The Impact Of The Violence Against Women Act On Women Of Color, Antonia D. Adams
Black And Battered: The Impact Of The Violence Against Women Act On Women Of Color, Antonia D. Adams
Senior Theses
Domestic violence is the intentional act of someone exerting control to harm another person. Domestic violence can impact individuals of all genders, ethnicities, and backgrounds. However, domestic violence has a disproportionate impact on Black women over their white counterparts. By analyzing raw SLED data, as well as peer-reviewed articles and personal interviews, this paper will explore whether the Violence Against Women Act (VAWA) helped Black women, or if it failed to protect them. The hypothesis is that VAWA did not address the unique needs that Black women faced in domestic violence. Due to the myriad of circumstances that Black women …
Let Us Talk About It: Using A Communication Tool To Improve The Timeliness Of Rapid Responses, Lajaynees Singleton
Let Us Talk About It: Using A Communication Tool To Improve The Timeliness Of Rapid Responses, Lajaynees Singleton
Doctor of Nursing Practice Projects
Background: In healthcare emergencies, minutes matter. Code blue, code stroke, and rapid responses are processes put in place by hospitals to save lives and improve the outcome of deteriorating patients. At a local medical facility in Alabama, the process for calling codes and rapid responses created miscommunication and delays in the code team’s arrival. An assessment revealed that a purchased clinical communication device (CCD) was underutilized.
Purpose: The purpose of the Doctor of Nursing Practice (DNP) project was to improve the communication of code blue, code stroke, and rapid responses by utilizing the CCD.
Methods: The quality improvement project consisted …

Doctor of Nursing Practice Projects
Background: Correctional nurses’ function in a high-stress environment due to the nature of their clients and the importance of environmental security. Acute stress can occur in correctional nurses when faced with unexpected or intense situations, such as a medical emergency, a violent incident, or a suicide attempt. Several factors can contribute to acute stress in correctional nurses, leading to overwhelming feelings and making it difficult for nurses to provide quality care.

Title Ix 50 Years Later. . . Reflections From A Title Ix Coordinator, Dr. Kristena Gaylor
MC Law Review
On June 23, 1972, Congress enacted the Title IX Education Amendment of 1972. Title IX prohibits discrimination based on sex in education programs and activities operated by recipients of federal financial assistance. Title IX’s core is the concept that students may not be denied educational opportunities based on their sex. Title IX’s protections extend to school activities, including admissions, financial aid, student services, counseling services, athletics, and physical education. The Title IX legislation eliminates sex-based discrimination to ensure all students—both male and female––have access to and equality in education.
The enactment of Title IX led to an upward trajectory for …

Adolescent Brain Development And Crime: Why New York State Should Increase The Age Of Criminal Culpability To Twenty-One Years Old, Julia Patz
Cardozo Journal of Equal Rights & Social Justice
The note argues that New York State should increase the age of criminal culpability from eighteen to twenty-one years old, aligning with scientific evidence on adolescent brain development. It contends that the current age threshold is arbitrary and unsupported by research, which shows that brain development, particularly in areas responsible for decision-making and impulse control, continues well into the mid-twenties. The note advocates for this policy change to improve outcomes for young offenders and reduce the harms caused by adult incarceration.

Speech on race and racism in our nation’s public schools is under attack for partisan gain. The Free Speech Clause of the First Amendment teaches a lot about the wisdom and legality of laws that chill such speech in the classroom. But more importantly, a First Amendment analysis of these laws reveals profound insights about the health and meaning of our free speech doctrine.
Through a First Amendment analysis of “anti-critical race theory” laws, this essay illuminates the first principles of free speech law. Specifically, it shows that the First Amendment offers little refuge to teachers or parents looking to …
Creating A People-First Court Data Framework, Lauren Sudeall, Charlotte S. Alexander
Creating A People-First Court Data Framework, Lauren Sudeall, Charlotte S. Alexander
Vanderbilt Law School Faculty Publications
Most court data are maintained--and most empirical court research is conducted--from the institutional vantage point of the courts. Using the case as the common unit of measurement, data-driven court research typically focuses on metrics such as the size of court dockets, the speed of case processing, judicial decision-making within cases, and the frequency of case events occurring within or resulting from the court system.
This Article sets forth a methodological framework for reconceptualizing and restructuring court data as "people-first"-centered not on the perspective of courts as institutions but on the people who interact with the court system. We reorganize case-level …
Administrative Regulation Of Programmatic Policing: Why "Leaders Of A Beautiful Struggle" Is Both Right And Wrong, Christopher Slobogin
Administrative Regulation Of Programmatic Policing: Why "Leaders Of A Beautiful Struggle" Is Both Right And Wrong, Christopher Slobogin
Vanderbilt Law School Faculty Publications
In Leaders of a Beautiful Struggle v. Baltimore Police Department, the Fourth Circuit Court of Appeals held that Aerial Investigation Research (AIR), Baltimore's aerial surveillance program, violated the Fourth Amendment because it was not authorized by a warrant. AIR was constitutionaly problematic, but not for the reason given by the Fourth Circuit. AIR, like many other technologically-enhanced policing programs that rely on closed-circuit television (CCTV), automated license plate readers and the like, involves the collection and retention of information about huge numbers ofpeople. Because individualized suspicion does not exist with respect to any of these people's information, an individual-specific warrant …
