Legal Human Rights And Tanzania Human Rights Defenders Coalition V Tanzania, Application No. 039/2020 (13 June 2023), Kafula M. Kasonde Nov 2023

Legal Human Rights And Tanzania Human Rights Defenders Coalition V Tanzania, Application No. 039/2020 (13 June 2023), Kafula M. Kasonde

SAIPAR Case Review

This judgement is a milestone in the Tanzanian jurisprudence as it subjects the Tanzanian legal system to scrutiny by an international court with regards to a provision in a domestic statute providing for non-bailable offenses. The legal system of Tanzania overlooked an opportunity in this case to examine the compatibility of national legislations with international human rights standards. This judgement highlights the critical role of human rights non-governmental organisations (NGOs) and their efforts to challenge domestic laws that may infringe upon fundamental rights through emphasizing the need for alignment and adherence to international human rights standards.

Recalibrating Bruen: The Merits Of Historical Burden-Shifting In Second Amendment Cases, Kevin G. Schascheck Ii Nov 2023

Recalibrating Bruen: The Merits Of Historical Burden-Shifting In Second Amendment Cases, Kevin G. Schascheck Ii

Belmont Law Review

After Bruen, the prevailing assumption was that the Second Amendment framework shifted radically for all gun laws. Courts throughout the country have already invalidated key gun safety statutes while applying the new test. However, such holdings fail to grapple with the full weight of Second Amendment doctrines. A proper application of the doctrine in toto will result in no significant changes to the constitutionality of the vast majority of gun laws after Bruen.

This Article explains the underdeveloped interaction between two principal Second Amendment doctrines - presumptions of legal validity and historical analyses. That interaction, framed in its simplest terms, …

Perceptions Of Childcare In Nonmetropolitan Nebraska, Rebecca J. Vogt, Heather Akin, Cheryl A. Burkhart-Kriesel, Bradley D. Lubben, L. J. Mcelravy, Timothy Meyer, Steven A. Schulz Nov 2023

Perceptions Of Childcare In Nonmetropolitan Nebraska, Rebecca J. Vogt, Heather Akin, Cheryl A. Burkhart-Kriesel, Bradley D. Lubben, L. J. Mcelravy, Timothy Meyer, Steven A. Schulz

Nebraska Rural Poll

Lack of childcare is an issue in many rural Nebraska communities. According to a report from Voices for Children, most counties in the state (91%) do not have enough available licensed childcare slots to meet the current demand there. Furthermore, 11 counties in the state have no licensed childcare facilities. Many communities are exploring options of how to address these shortages to maintain their current residents or to be able to attract new residents. Given these challenges, what types of childcare are rural Nebraskans currently using? How far do they drive to get to their childcare? And how do rural …

Police Officers, Policy, And Personnel Files: Prosecutorial Disclosure Obligations Above And Beyond Brady, Lauren Giles Nov 2023

Police Officers, Policy, And Personnel Files: Prosecutorial Disclosure Obligations Above And Beyond Brady, Lauren Giles

Fordham Law Review

Police officers play a significant role in the criminal trial process and are unlike any other witness who will take the stand. They are trained to testify, and jurors find them more credible than other witnesses, even though officers may have more incentive to lie than the ordinary witness. Despite the role of police officers in criminal proceedings, state statutes say virtually nothing about evidence used to impeach police officers, often contained in the officer’s personnel file. Worse still, the standard for disclosing information in an officer’s personnel file varies among and within states, resulting in inconsistent Brady disclosures. This …

Prevention Program Sustainability And Associated Determinants: A Literature Review, Version 1.0, Andrea Walker, Sarah Steele, Matt Allen, Nicholas J. Arreola

Reports, Projects, and Research

The Department of Homeland Security (DHS) has made millions of dollars available through the Targeted Violence and Terrorism Prevention (TVTP) Grant Program to help communities across the United States develop capabilities to combat terrorism and targeted violence. Given this investment, a key objective is ensuring the long-term impact of these programs, which depends on their sustainment beyond the initial grant. Thus, the purpose of this report is to review the relevant literature on program sustainability and discuss implications for the TVTP Grant Program. We began the review by exploring definitions of sustainability as well as similar social programming concepts, such …

Towards Critical Reflexivity In Gifted Education Teacher Preparation, Inna Kruvi Nov 2023

Towards Critical Reflexivity In Gifted Education Teacher Preparation, Inna Kruvi

Theses and Dissertations

Ever since the emergence of gifted education in the United States in the beginning of the twentieth century, the concept of giftedness has been used to marginalize, segregate, and exclude students of particular backgrounds from specialized academic programs. Among the factors that contribute to unequal access to gifted education for ethnically, culturally, linguistically, and economically diverse (ECLED) students, teacher bias, deficit thinking, and insufficient teacher preparation have been identified as especially significant (Coleman et al., 2015; DeWet & Gubbins, 2011; Mansfield, 2015). Among various approaches to mitigate underrepresentation of ECLED students, the concept of cultural humility (Tervalon and Murray-Garcia, 1998) …

Limited Clinical Utility Of Routine Mycobacterial Cultures For The Management Of Diabetic Foot Infections, Laila M. Castellino, Clare Mccormick-Baw, Tyler Coye, Peter A. Crisologo, John J. Hanna, Francesca Lee, Andrew Clark, Michael Fanning, Amanda L. Killeen

School of Podiatric Medicine Publications

Mycobacterial infections of the foot and ankle are uncommon. In a cohort of 2340 patients with diabetic foot infection (DFI) in a region with increased prevalence of mycobacterial disease, we identified no clinically significant positive cultures over a 3-year period. Routine mycobacterial culture of DFIs is of limited clinical utility.

The First Byte Rule: A Proposal For Liability Of Artificial Intelligences, Hilyard Nichols Nov 2023

The First Byte Rule: A Proposal For Liability Of Artificial Intelligences, Hilyard Nichols

William & Mary Business Law Review

Artificial Intelligences (AIs) are a relatively new addition to human civilization. From delivery robots to board game champions, researchers and businesses have found a variety of ways to apply this new technology. As it continues to grow and become more prevalent, though, so do its interactions with society at large. This will create benefits for people, through cheaper or better products and services. It also has the possibility to create harm. AIs are not perfect, and as the range of AI uses grows, so will the range of potential harms. A mistake from an AI customer service bot could fraudulently …

Special Challenges In Execution Of Arbitral Awards In Public Private Partnerships, Srividhya Ragavan, Niraj Kumar Seth Nov 2023

Special Challenges In Execution Of Arbitral Awards In Public Private Partnerships, Srividhya Ragavan, Niraj Kumar Seth

Faculty Scholarship

With around 47 million pending cases at various stages of Indian judiciary and one of the lowest levels of judges per million of population in the world, India’s arbitration regime presents a ray of hope for millions of Indians who face the prospect of justice being denied to them due to inordinate delays caused by a clogged judicial pipeline. The enactment of the Arbitration and Conciliation Act, 1996 was presented as a viable alternative to resolve commercial disputes in a timely manner. This paper uses a case study to discuss how arbitration in India has not fulfilled the timeliness promise …

Creative Placemaking And Empowered Participatory Governance, Amber Wichowsky, Jennifer Gaul-Stout, Jill Mcnew-Birren Nov 2023

Creative Placemaking And Empowered Participatory Governance, Amber Wichowsky, Jennifer Gaul-Stout, Jill Mcnew-Birren

College of Education Faculty Research and Publications

Creative placemaking has become a popular strategy to revitalize distressed neighborhoods. Who is empowered to participate in these projects and in what capacity? Do such efforts reduce or reinforce existing race-class inequities in community development? Drawing on three years of participant observations, interviews with stakeholders, and analyses of project reports, we use Archon Fung's “Democracy Cube” framework to evaluate a creative placemaking initiative in one of the most segregated cities in the United States. We find that over the course of the project, participation patterns shifted from highly diffuse across many individuals with varied roles to highly concentrated, such that …

The Constitutional Court Of Colombia Imposes Limits On The Use Of Internet Jammers During Social Protests, Carolina Botero, Lina Paola Velásquez

Joint PIJIP/TLS Research Paper Series

The Constitutional Court of Colombia has issued an important ruling regarding the use of the Internet as the main tool to guarantee the fundamental rights to freedom of speech and access to information during social protests. This ruling marks an important precedent in the matter because it imposed new obligations on the State and the government to guarantee the "maximum level of information". Likewise, the Court ordered the regulation of the use of signal jammers during social protests. This article will analyze the ruling and its effects in Colombia.

Owning The Police: Crime Data, Copyright, And Public Information, A. Jay Wagner Nov 2023

Owning The Police: Crime Data, Copyright, And Public Information, A. Jay Wagner

College of Communication Faculty Research and Publications

Online crime maps, which plot law enforcement crime data, promise to promote civic engagement and increase government transparency. This study reviewed the websites of the 250 largest U.S. cities and found 65% host or link to a crime map, and that 116 police departments entered into agreements with crime mapping companies that provide the companies preferred or exclusive access to local crime data, curtailing public access and use. This study examines the legal tactics used by commercial mapping companies to maintain information control, explores recent examples of legal battles over the data, and proposes solutions, including targeted public record law …

A Right To Fly: Navigating The Air Carrier Access Act And The Americans With Disabilities Act Following Alexander V. Sandoval, William Belles Nov 2023

A Right To Fly: Navigating The Air Carrier Access Act And The Americans With Disabilities Act Following Alexander V. Sandoval, William Belles

Northern Illinois University Law Review

There are approximately 54 million disabled individuals in the United States. Those 54 million American citizens live their day to day lives differently than the average person, facing difficulties most others cannot comprehend. While legislation has come a long way in recent decades, one area that has remained stagnant is how we treat disabilities on airplanes. Despite legislation remaining relatively stagnant, judicial opinions have not. In fact, many United States Circuit Courts have determined that the Air Carrier Access Act, which provides limited protections on airplanes, does not confer a private cause of action for violations. As a result, the …

Facilitating Uav Application For Cav Deployment, Shuya Zong, Yujie Li, Sikai Chen, Shaoshuai Mou, Samuel Labi

Center for Connected and Automated Transportation

Connectivity-equipped UAVs offer communication opportunities within CAV ecosystems. This study was motivated by challenges in UAV-based monitoring: (a) at intersections where road user trajectories could be irregular, leading to traffic conflicts or collisions, and (b) during inclement weather where video images are often corrupted by falling rain streaks thus impairing the integrity of the image. In response to these challenges, the study developed and demonstrated the efficacy of (a) an algorithm for UAVs to predict vehicle trajectories at intersections and (b) a 2-stage self-supervised algorithm for enhancing the quality of UAV-sourced images. Both parts of the study highlight the UAV …

Advocating For Inclusion Of Recreational Athletics In State-Level Youth Concussion Policy, Joseph T. Vaughn Nov 2023

Advocating For Inclusion Of Recreational Athletics In State-Level Youth Concussion Policy, Joseph T. Vaughn

Journal of the Louisiana Public Health Association

Introduction: Interest in pediatric sports concussions has received increased interest in the last decade, with all fifty states and the District of Columbia passing laws based on Washington State’s Lystedt Law. Although these policies have made strides in addressing pediatric concussions, they lack provisions for recreational sports. Methods: A literature review of relevant statutes for all 50 states and the District of Columbia was performed. States with existing protections and evidence-based guidelines were also examined to provide recommendations. Results: States with the policy gap either had no statutes that applied to recreational sports or statutes that lacked at least the …

A Decade Of Wireless Emergency Alerts: A Longitudinal Assessment Of Message Content And Completeness, Michele K. Olson, Jeannette Sutton, Lauren B. Cain, Nicholas Waugh Nov 2023

A Decade Of Wireless Emergency Alerts: A Longitudinal Assessment Of Message Content And Completeness, Michele K. Olson, Jeannette Sutton, Lauren B. Cain, Nicholas Waugh

Emergency Preparedness, Homeland Security, and Cybersecurity Faculty Scholarship

Wireless Emergency Alerts (WEAs) provide a direct way for public safety officials to reach at‐risk publics via text‐based messages on their mobile devices. Although WEAs were introduced over a decade ago and can be either 90 or 360 characters in length, we currently do not know what these messages have contained. To address this gap, we quantify the contents of the last decade of WEA messages using the principles of effective warning message design. Specifically, we use quantitative content analysis to conduct a longitudinal assessment of 6080 WEAs sent by Alerting Authorities from 2012 to 2022. We code these messages …

Human Trafficking Research: Developing Collaborative Partnerships With Local Agencies, Jaymelee Kim Nov 2023

Human Trafficking Research: Developing Collaborative Partnerships With Local Agencies, Jaymelee Kim

Southern Anthropologist

This article considers an effort to develop meaningful research collaborations with non-governmental organizations and local agencies working on human trafficking. Scholarship discussing challenges and insights for “finding the field” and developing partnerships in the rural US is sparse. This research report briefly discusses considerations that should be taken into account when developing applied research projects with non-academic collaborators. Using Ohio-based human trafficking research as a case study, this piece discusses how cultural factors, misconceptions, confidentiality, and goals can be navigated to ultimately benefit the partner agencies and the populations they serve.

Establishing Control Order Regimes: The International Human Rights Law Implications For Pre-Conviction And Post-Release Control Orders, Natalie Garcia Nov 2023

Establishing Control Order Regimes: The International Human Rights Law Implications For Pre-Conviction And Post-Release Control Orders, Natalie Garcia

Vanderbilt Journal of Transnational Law

Control orders are restrictive measures placed on individuals that pose an identified threat to public safety as a component of domestic counterterrorism policy. Control orders and their compliance with International Human Rights Law have been the subject of extensive litigation within the European Court of Human Rights and domestic states courts. Controlling provisions are applied in either the pre- conviction or the post-release stage of a state's criminal procedure. Pre- conviction control orders face significant criticism for the potential conflicts with due process protections of the right to a fair trial and the broader right of liberty. This Note describes …

Second Amendment Exceptionalism: Public Expression And Public Carry, Timothy Zick Nov 2023

Second Amendment Exceptionalism: Public Expression And Public Carry, Timothy Zick

Faculty Publications

In New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court recognized a right to carry firearms in public places. The scope of that right will depend on where, why, and how governments regulated public carry during the eighteenth and perhaps nineteenth centuries. The Court claimed that its turn to history for determining the scope of Second Amendment rights “accords with” and “comports with” how the Court has interpreted First Amendment rights. This Article examines and rejects that claim, both in general and specifically as it applies to the public exercise of Second Amendment rights. Although Bruen …
