Black Mothers’ Mothering Experiences: Race, Gender And Imprisonment, Ada Gamez

Theses & ETDs

In this study I examine the unique challenges faced by incarcerated Black mothers within the criminal justice system and how their race and gender contribute to the difficulties they face when returning to freedom. I pay particular attention to the way motherhood impacts Black mothers during and post incarceration. This study employs a combination of statistical data and content analysis. Statistical data provides a generalized view of the conditions of incarceration for Black women. Through content analysis of first-hand accounts of 4 incarcerated Black mothers I share in depth insight into how their lived experiences have impacted them in different …

Effects Of Visitor Disturbance On The Flushing Behaviors Of American Alligators (Alligator Mississippiensis) In Myakka River State Park, Zane Cullinane Walsh

Theses & ETDs

Anthropogenic presences and influence spread into wildlife spaces and can negatively affect species living in areas that were previously less disturbed. In this thesis, a study was conducted in which the flight initiation distances and flushing behaviors of American alligators in a wild-living congregation within the Myakka River State Park Wilderness Preserve, an area within a state park in Southern Florida, were measured and analyzed. Flight initiation distances in reptiles are an important component of population risk assessment, which influences wildlife management decisions, that often goes understudied in these species. Potential negative effects of an increased human presence in wild …

Heterogeneous Effects Of Deferred Action For Childhood Arrivals (Daca) On Undoheterogeneous Effects Of Deferred Action For Childhood Arrivals (Daca) On Undocumented College Students’ Educational Outcomescumented College Students’ Educational Outcomes, Keitaro Okura, Amy Hsin, Sofya Aptekar

Publications and Research

We investigate why prior studies examining the effects of the Deferred Action for Childhood Arrivals (DACA) on undocumented youth’s college outcomes in the United States have yielded mixed findings. We draw on unique administrative data from the City University of New York (CUNY) at the time of DACA’s implementation and utilize difference-in-difference estimation to examine DACA’s effects on undocumented students’ college GPA and interruptions to their college progress. We find that DACA’s effects on the educational outcomes of undocumented students enrolled in college were heterogeneous: It had as negative effect on those who, prior to the policy, were academically high …

Saying No To Say Yes: Mediating Student Technology Needs In Times Of Crisis, Catherine Fonseca, Rita Premo, Hilary Smith

Faculty & Staff Scholarship

This chapter details the mediating role embraced by the SSU Library in managing university-wide technology and learning challenges during an unanticipated pivot to remote instruction and is organized according to lessons learned. Responding to COVID disruptions in real time, we identified key areas where our expertise and relationships allowed us to advocate for and support students, while also saying no or limiting our participation in others. Limiting the services provided during a crisis to only those that fit within the core scope of our mission was a powerful tactic that libraries should exercise often and widely communicate. Rather than answering …

Legalize Recreational Marijuana In West Virginia To Increase Tax Revenue, Create Jobs, And Make Communities Safer, Crosby Hipes Jan 2023

Legalize Recreational Marijuana In West Virginia To Increase Tax Revenue, Create Jobs, And Make Communities Safer, Crosby Hipes

Bridge Initiative for Science and Technology Policy, Leadership, and Communications

Although West Virginia legalized the medical use of marijuana, it has one of the harshest penalties in the nation for recreational use - a possible 90 days in prison for the first offense for possessing any amount. In contrast, more than 50% of states have legalized the recreational use of marijuana. And, 70% of West Virginians support marijuana legalization at the federal level. Benefits to legalizing marijuana include increased tax revenue, decreased costs of enforcing drug laws, job creation in the marijuana industry, and safer communities due to less criminal activity.

How Nonmarket Externalities Affect The U.S. Business Dynamism: An Economic Approach To Drug Epidemic, Chukwudi Ikwueze Jan 2023

How Nonmarket Externalities Affect The U.S. Business Dynamism: An Economic Approach To Drug Epidemic, Chukwudi Ikwueze

Pennsylvania Economic Review

Businesses thrive best in an environment devoid of constraints, including those resulting from third-party activities with longstanding economic underpinnings. While existing research has extensively explored how costs and benefits emanating from businesses affect third parties, in the form of market externality, little attention has been given to understanding how costs and benefits arising from third-party activities influence businesses. To fill this gap, this paper aims to introduce the concept of nonmarket externality, which represents the influence of third-party activities on businesses, and use it to examine whether third-party activities associated with the drug epidemic influence the U.S. business dynamism. The …

Nonparty Interests In Contract Law, Omri Ben-Shahar, David Hoffman, Cathy Hwang Jan 2023

Nonparty Interests In Contract Law, Omri Ben-Shahar, David Hoffman, Cathy Hwang

Articles

Contract law has one overarching goal: to advance the legitimate interests of the contracting parties. For the most part, scholars, judges, and parties embrace this party primacy norm, recognizing only a few exceptions, such as mandatory rules that bar enforcement of agreements that harm others. This Article describes a distinct species of previously unnoticed contract law rules that advance nonparty interests, which it calls “nonparty defaults.”

In doing so, this Article makes three contributions to the contract law literature. First, it identifies nonparty defaults as a judicial technique. It shows how courts deviate from the party primacy norm with surprising …

Over 11.5 million people in the United States who are deaf and/or hard of hearing are unable to seek emergency help via a conventional 911 voice call. accesSOS provides a text-to-911 platform for members of this community. They have developed a progressive web application (PWA) and native iOS and Android mobile apps, that collect emergency information from users via an icon-based user interface (UI). However, their platform lacked a mechanism for including altitude information in the geolocation data regarding the user’s location in a multi-story building that is relayed to emergency responders when the user tries to contact 911 via …

Restoring Balance To The Federal Tax-Exemption Regime’S Treatment Of Hospitals: Let Their Actions Speak Louder Than Their Charters, Nicholas Archibald Jan 2023

Restoring Balance To The Federal Tax-Exemption Regime’S Treatment Of Hospitals: Let Their Actions Speak Louder Than Their Charters, Nicholas Archibald

Campbell Law Review

The tax-exemption system for American hospitals was created both to optimize care for those who cannot afford it and to encourage good deeds by hospitals. But despite well-intentioned attempts by the IRS to implement these lofty policy goals, for-profit hospitals today pay taxes despite at times providing more public benefit than their nonprofit brethren while nonprofit hospitals are incentivized to seek profit rather than provide free care. This rise of this state of affairs coincides with changes by the IRS to the standards required to obtain the exemption. Originally, the nonprofit system operated on a quid pro quo model, where …

The Impact Of Supreme Court Make Up On Rulings Towards Administrative Agencies, Hannah N. Cothern Jan 2023

The Impact Of Supreme Court Make Up On Rulings Towards Administrative Agencies, Hannah N. Cothern

Honors Undergraduate Theses

This study investigated whether or not the membership of the United States Supreme Court affects the way the institution rules in cases regarding federal administrative agencies by collecting and comparing votes from 2018-2019 and 2020-2022. It found in the first section that justices showed an anti-deferential attitude towards agencies and in the second section a deferential attitude towards agencies, despite the conservative majority being larger in the second section. The result is likely due to the types of agencies and content of cases involved.

Protection Or Control? – The History & Impact Of The Major Crimes Act On Native Americans And Its Future In Criminal Law, Cameron A. Garrow

Honors Undergraduate Theses

In this thesis, I traced the history of the Major Crimes Act of 1885, focusing on United States Supreme Court cases regarding the Act's enforcement and its constitutionality. In particular, analysis focused on how the USSC's decisions affected Native Americans within the field of criminal law, both as defendants and victims, and how these decisions prove to be contradictory or unjustly detrimental in nature. There is also focus on the ongoing issues in the state of Oklahoma resulting from the Major Crimes Act's enforcement that have begun to spread from a state-level crisis into a nationwide problem. The thesis concludes …

Soft Skills In Stem, Mariana Sorroza Aguilar

Honors Undergraduate Theses

Those working in science, technology, engineering, and math (STEM) fields are delivering world-changing solutions to the problems we face and are saving lives every day. Some of them do surgeries, some design airplanes and cars, others study the wildlife around us, and others create processes to facilitate the manufacturing of devices we use often. In order to do this, the engineers, scientists, doctors, and other professionals in STEM disciplines need to possess hard skills. Hard skills are often called technical skills and are measurable abilities and skills that are needed to perform tasks effectively. The tasks done share something in …

Undergraduates’ Preparedness For College-Level Work In Stem: The Importance Of Reading And Understanding Scientific Theories, Arguments, And Data, Ewa M. Burchard Jan 2023

Undergraduates’ Preparedness For College-Level Work In Stem: The Importance Of Reading And Understanding Scientific Theories, Arguments, And Data, Ewa M. Burchard

CGU Theses & Dissertations

This study focuses on undergraduates’ preparation for college level courses. In recent international PISA results United States students fall behind seventeen countries on the computer-based reading proficiency test. They have scored low for over a decade, in spite of spending more than one hundred-thousand dollars per student on education. This US score is similar to, or lower than, the scores of other countries where spending is lower. Considering reading performance statistics from the international PISA assessment and the inconclusive results from reading comprehension studies across media, the concern arose whether today’s high school students are well prepared for college level …

Strengthening Urban Resilience: Understanding The Interdependencies Of Outer Space And Strategic Planning For Sustainable Smart Environments, Ulpia-Elena Botezatu, Olga Bucovetchi, Adrian V. Gheorghe, Radu D. Stanciu

Engineering Management & Systems Engineering Faculty Publications

The conventional approach to urban planning has predominantly focused on horizontal dimensions, disregarding the potential risks originating from outer space. This paper aims to initiate a discourse on the vertical dimension of cities, which is influenced by outer space, as an essential element of strategic urban planning. Through an examination of a highly disruptive incident in outer space involving a collision between the Iridium 33 and Cosmos 2251 satellites, this article elucidates the intricate interdependencies between urban areas and outer space infrastructure and services. Leveraging the principles of critical infrastructure protection, which bridge the urban and outer space domains, and …

Psychology Faculty Research and Scholarship

This paper identifies what we see as opportunities to improve data collection, analysis, and interpretation of findings in American and British terrorism research. We suggest seven directions that we see as promising. These include: 1) interview methods and reporting, 2) source reporting in database studies, prioritizing available court records, 3) more comparison groups, including non-offender activists for the same cause and non-political offenders, 4) comparison of cases with and without confidential informants, 5) extremist ideas and extremist violence studied as separate problems, 6) more attention to grievances, avoiding controversies over defining ideology and narrative, and 7) more attention to emotions …

Originalism-By-Analogy And Second Amendment Adjudication, Joseph Blocher, Eric Ruben Jan 2023

Originalism-By-Analogy And Second Amendment Adjudication, Joseph Blocher, Eric Ruben

Faculty Scholarship

In New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court held that the constitutionality of modern gun laws must be evaluated by direct analogy to history, unmediated by familiar doctrinal tests. Bruen’s novel approach to historical decision-making purported to constrain judicial discretion but instead enabled judicial subjectivity, obfuscation, and unpredictability. Those problems are painfully evident in courts’ faltering efforts to apply Bruen to laws regulating 3D-printed guns, assault weapons, large-capacity magazines, obliterated serial numbers, and the possession of guns on subways or by people subject to domestic-violence restraining orders. The Court’s recent grant of certiorari in United …
