Energy is an essential household need to sustain health and wellbeing. Connecticut has one of the highest energy costs in the nation and leaves a majority of residents experiencing energy insecurity, where households are not able to meet their energy needs. Energy efficiency retrofits have been introduced as an effective solution to sustain thermal comfort indoors. Despite increased funding and resources for energy efficiency, federal and state programs continue to go widely unused by tenants for several reasons from health and safety barriers, tenant-landlord power imbalances, and administrative challenges to name a few. There are “haves” and “have-nots” in the federal appellate courts, and the “haves” get more attention. For decades, the courts have used a triage regime under which they distribute judicial attention selectively: some appeals receive a lot of judicial attention, and some appeals receive barely any. What this Article reveals is that this triage system produces demonstrably unequal results, depending on the circuit handling the appeal and whether the appellant has counsel or not. Together, these two factors produce significant disparities: in one circuit, for example, an unrepresented appellant receives, on average, a decision less than a tenth the length …

The U.S. immigration system is exceedingly complex, and access to legal representation is the primary determinant in obtaining a just immigration outcome. Immigrants must navigate a byzantine, burdensome, and high stakes legal process, conducted in a language they often do not speak. They often must do so without any legal representation. Unlike criminal defendants, immigrants are not entitled to government-funded lawyers. Legal services organizations, such as Legal Services Corporation, that receive any federal funding are prohibited from providing legal representation to most immigrants. Faith-based and charitable legal services organizations provide some legal representation to immigrants through attorneys, staff members, and …

Introduction: In 2021, leaders in Birmingham, Alabama established one of the first LGBTQ-affirming charter school in the United States to serve students who have dropped out, are not thriving in traditional schools, or are enrolled in home-school programs.
Methods: Using deductive analysis, our research team filtered data through the five pre-defined themes of the Youth Thrive Framework: (a) youth resilience, (b) social connections, (c) knowledge of adolescent development, (d) concrete support in times of need, and (e) cognitive and social-emotional competence.
Results: Study findings suggest that MCAA’s innovative and adaptive approaches to curriculum, discipline, and student engagement align with the …

The national conversation about criminal justice reform largely ignores the critical need for structural reforms in the provision of indigent defense. In most parts of the country, decisions about how to structure the provision of indigent defense are made at the local level, resulting in a fragmented patchwork of different indigent defense delivery systems. In most counties, if an indigent criminal defendant gets representation at all, it comes from assigned counsel or flat-fee contract lawyers rather than public defenders. In those assigned-counsel and flat-fee contract systems, the lawyers representing indigent defendants have financial incentives to get rid of assigned criminal …

In 2010, the United States Armed Forces ended the policy Don’t Ask, Don’t Tellthat excluded sexual minorities from being able to serve openly in the military. Full military benefits were extended to them and their family members in 2013. Despite these changes, victimization, stigma, and discrimination have continued to impact the lives of service members who identify as a sexual minority, as the result of microaggressions due to their sexual orientation. For the past decade there have been numerous and significant changes to the Uniform Code of Military Justice (UCMJ), the statutory basis for the military justice system. Although the Military Justice Act of 2016 made major changes to the UCMJ, the calls for change continued. One of the most-often heard calls for reform over the last decade has suggested removing commanders from the military justice system. In the 2022 National Defense Authorization Act, Congress amended the UCMJ to dramatically reduce the commander’s role in what Congress specified as “covered offenses" such as sexual assault and provided that those listed offenses …

Commercial actors long have argued that class actions are bad for business. But for even longer, business groups have supported other types of aggregate litigation that closely resemble class actions, such as expansive federal bankruptcy. While critics have successfully limited national aggregation via class actions, they have not even attempted to criticize aggregation via bankruptcy.
Why have business groups attacked aggregate litigation in some cases and supported it in others? This Article provides an answer by examining aggregation's origins and development, and what emerges, it turns out, is very much the opposite of what aggregation's pro-business critics would have us …

Despite the checkered history of contingency fees in the practice of law, attorneys often claim that such fee arrangements perfectly align the interests of lawyer and client. After all, contingency fee lawyers proclaim in TV ad after TV ad, "we don’t get paid unless you win." That superficial logic does not withstand economic scrutiny. Utilizing a behavioral economics lens, this Article demonstrates that contingency fee arrangements give attorneys excessive incentives to settle cases that their clients would be better off taking all the way through trial. Guardianship proceedings under New York Mental Hygiene Law Article 81 are intended to protect the personal needs and property management of an alleged incapacitated person. A guardian appointed for a person is responsible for making decisions in line with the best interests and wishes of his or her ward. While guardians serve a very important purpose, the current procedures of guardianship proceedings allow too much room for family members to bring a proceeding without the alleged incapacitated person’s best interests in mind. Adventists have been inconsistent in dealing with inequality and injustice in society, swaying between silence, accommodation, positional statements, and direct advocacy approaches. Although advocacy has become more prominent among Adventist thinkers since the end of the twentieth century, there is a lack of empirical data which answer questions related to contemporary Adventists' beliefs and practices in relation to advocacy in the context of mission. Concomitantly, there does not yet exist a documented or articulated Adventist missiological perspective on advocacy.

Family law is for young people. To facilitate child rearing and help spouses pool resources over a lifetime, the law obligates parents to minor children and spouses to each other. Family law’s presumption of young, financially interdependent, conjugal couples raising children privileges one family form — marriage — and centers the dependency needs of children.
This age myopia fundamentally fails older adults. Families are essential to flourishing in the last third of life, but the legal system offers neither the family forms many older adults want nor the support of family care older adults need. Racial and economic inequities, accumulated …

By the terms of its own statute and the limits of its constitutional authority, multidistrict litigation (“MDL”) is designed to transfer and coordinate individual lawsuits then return plaintiffs back to their chosen fora for case-specific discovery and trial. Because each plaintiff is present and has her own lawyer, there is no need for the judge to police conflicts of interest or attorney loyalty as in the MDL’s kin, the class action.
But these assumptions do not match the empirical reality. Remand is rare. MDL judges resolve ninety-nine percent of the cases before them. And to some attorneys, the people of …

Promoting Cognitive Complexity Among Yezidi Youth Impacted By Isis In Kurdistan, Iraq, Sara Savage, Jessica Francar, Kristin Perry

This article reports on the results of an intervention to promote the reintegration of Yezidi children and youth in the Kurdistan Region of Iraq, who had been in ISIS captivity or were displaced by ISIS, by increasing their cognitive complexity through experiential learning. The article explores the challenges faced by this demographic, including trauma and exclusion. It looks at the impact of a group-based curriculum designed to increase cognitive complexity (measured by integrative complexity), and discusses how the intervention addressed socio-cognitive needs in order to support reintegration. การติดตั้งโซลาร์เซลล์บนหลังคาบ้านได้รับความนิยมเพิ่มขึ้นเป็นอย่างมากในปัจจุบัน และมีแนวโน้มจะมากขึ้นอีกในอนาคต อย่างไรก็ดี ด้วยลักษณะเฉพาะแผงโซลาร์เซลล์ ซึ่งเป็นสินค้าที่ผู้บริโภคต้องมีความรู้ ความเข้าใจในตัวสินค้า และเป็นการลงทุนระยะยาวที่ใช้เวลาการคืนทุนค่อนข้างนาน จึงมีความจำเป็นที่ผู้บริโภคจะต้องได้รับสัญญาที่มีข้อกำหนดระบุถึงสาระสำคัญของสินค้า ตลอดจนสิทธิหน้าที่ของผู้บริโภคและผู้ประกอบธุรกิจ ประกอบกับปัจจุบันประเทศไทยยังไม่ได้มีกฎหมายว่าด้วยการคุ้มครองผู้บริโภคกรณีของการติดตั้งโซลาร์เซลล์บนหลังคาบ้านพักอาศัยเป็นการเฉพาะจากการศึกษาแนวทางการคุ้มครองผู้บริโภคด้านสัญญากรณีติดตั้งโซลาร์เซลล์บนหลังคาบ้านพักอาศัยของต่างประเทศ ได้แก่ รัฐแคลิฟอร์เนีย สหรัฐอเมริกา เครือรัฐออสเตรเลีย ประเทศญี่ปุ่น และประเทศมาเลเซีย พบว่ามีแนวทางการคุ้มครองผู้บริโภคด้านสัญญาที่แตกต่างกัน โดยแบ่งรูปแบบการบังคับใช้กับผู้ประกอบธุรกิจได้เป็น 2 รูปแบบ คือ บังคับใช้โดยกฎหมาย และ อาศัยความสมัครใจของผู้ประกอบธุรกิจ เมื่อผู้วิจัยวิเคราะห์และเปรียบเทียบกับบริบทของประเทศไทยแล้ว พบว่าแต่ละรูปแบบการบังคับใช้มีความเหมาะสมกับประเทศไทยในสถานการณ์ที่แตกต่างกัน กล่าวคือ ในช่วงระยะเริ่มต้นที่ผู้บริโภคเริ่มสนใจการติดตั้งโซลาร์เซลล์ และยังไม่ได้ปรากฏข้อร้องเรียนเกี่ยวกับการเอารัดเอาเปรียบผู้บริโภคจากผู้ประกอบธุรกิจ การบังคับใช้เป็นกฎหมายจึงยังไม่อาจกระทำได้ เพราะตามแนวปฏิบัติในการออกประกาศของคณะกรรมการว่าด้วยสัญญาให้เป็นธุรกิจควบคุมสัญญาจะต้องปรากฏสถิติข้อร้องเรียนก่อน ผู้วิจัยจึงเสนอให้มีการเผยแพร่แบบสัญญามาตรฐานสำหรับการติดตั้งโซลาร์เซลล์ภาคครัวเรือนบนเว็บไซต์ของกรมพัฒนาพลังงานทดแทนและอนุรักษ์พลังงาน อันเป็นแนวทางการคุ้มครองผู้บริโภครูปแบบสมัครใจในระยะเริ่มต้นก่อน แต่หากในอนาคตปรากฏข้อร้องเรียนเช่นว่านั้น ผู้วิจัยเสนอให้นำรูปแบบการบังคับใช้เป็นกฎหมาย หรือ รูปแบบที่อาศัยความสมัครใจของผู้ประกอบธุรกิจมาปรับใช้ตามความเหมาะสมต่อไปในประเด็นเรื่องหน่วยงานกำกับดูแล ผู้วิจัยเสนอให้สำนักงานคณะกรรมการคุ้มครองผู้บริโภค (สคบ.) เป็นหน่วยงานผู้มีหน้าที่มีอำนาจกำกับดูแลธุรกิจติดตั้งโซลาร์เซลล์บนหลังคาบ้านพักอาศัย ด้วย สคบ. มีบุคลากรที่มีความเชี่ยวชาญในด้านการคุ้มครองผู้บริโภคมากกว่าสำนักงานคณะกรรมการกำกับกิจการพลังงาน (สำนักงาน กกพ.)
