The late Judge Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit formed a study group in 2008 called the Study Group on Immigrant Representation to assess the scope of the problem and find a solution. The study group determined that the representation crisis was an issue “of both quality and quantity” and that the two most important variables for a successful outcome in a case were having counsel and not being detained. Homelessness Research & Action Collaborative Publications and Presentations
This study on student housing insecurity and homelessness was funded as part of a HUD FY2023 Community Project Funding Opportunity awarded to Portland State University. Phase 1 of the study included a literature review; a summary of past PSU student survey results; a description of PSU programs based on interviews with staff and administrators; an analysis of programs at other institutions; and a set of recommendations for better addressing student housing needs. Phase 2 of the study incorporated the results of a comprehensive student survey on housing insecurity and homelessness conducted in fall 2023. Additional reports by outside consultants on …

Research documents that diversity on the bench improves judicial decision-making, improves access to justice, and strengthens the rule of law. However, until 2019, no formal programs to increase judicial diversity existed within the Colorado Judicial Branch. In 2019, Colorado enacted legislation establishing an innovative, full-time judicial diversity outreach program that utilizes data and research to develop pipeline programs and amplify its impact through increased community engagement. Now, five years later, Colorado’s state court bench is more diverse than ever before. In the past two decades, the issue of human trafficking has grown more prominent around the world (Mollema, 2015). According to the Polaris Project, a nonprofit organization dedicated to fighting human trafficking as well as educating the world on the dangers of human trafficking analyzed data from the Human Trafficking Hotline found that in the year 2021, there were roughly 10,359 cases of human trafficking in the United States with about 16,554 victims (Polaris Project,2022). The Americans with Disabilities Act (ADA) was enacted with the hope that it would solve issues regarding discrimination against the disabled. However, the outcome fell short of its aspirations. Many people with disabilities still suffer from ongoing discrimination. This Note argues that the ADA’s heavy reliance on private enforcement is the main reason for this shortcoming. This Note analyzes the effectiveness of public enforcement in South Korea under the Act on the Prohibition of Discrimination Against Persons with Disabilities, Remedy Against Infringement of Their Rights (Korean Disability Discrimination Act. Medical-legal partnership (MLP) embeds attorneys and paralegals into care delivery to help clinicians address root causes of health inequities. Notwithstanding decades of favorable outcomes, MLP is not as well-known as might be expected. In this essay, the authors explore ways in which strategic alignment of legal services with healthcare services in terms of professionalism, information collection and sharing, and financing might help the MLP movement become a more widespread, sustainable model for holistic care delivery.

On April 19 and 20, 2023, Professors Bernard Hibbitts and Richard Weisberg convened a conference at the University of Pittsburgh School of Law titled “Disarmed, Distracted, Disconnected, and Distressed: Modern Legal Education and the Unmaking of American Lawyers.” Four speakers concluded the event with a spirited conversation about themes expressed during the proceedings. Distilling a lively two days, they asked: what are the most critical challenges now facing United States legal education and, by extension, lawyers and the communities they serve? Today, the legal profession faces new challenges to its integrity and legitimacy due to technological change, rising political polarization, and a stratified bar. In this Article, I first explore how technological innovations are undermining lawyers’ claims to a unique monopoly based on expert professionalism. These technologies are designed to transform routinized law practice in ways that improve efficiency. With little focus on attorneys’ obligations to serve the greater good, technology entrepreneurs emphasize practical advantages over traditional forms of representation. These proponents promise reduced costs and superior results through a single-minded commitment to market dynamics. Those promises in turn depend on …

Across the United States, historically imposed structural, social, and environmental variables are intimately connected to poor obstetric outcomes and high maternal and infant mortality rates among Black pregnancy-capable people. Efforts to diminish the effect of these variables include integrating screening for social determinants of health during the perinatal period and treating them with social services, mental health support, and other referrals, including connections to community-based resources. Although helpful, some of these social determinants cannot be overcome without legal advocacy. Medical–legal partnerships, which integrate lawyers into health care, fill this gap. This paper examines the typical responses and approaches our child welfare agencies and juvenile courts take when handling dependency cases involving families experiencing domestic violence that fall under California Welfare and Institutions Code section 300(b). All too often, when a child is exposed to domestic violence, their mothers, survivors of the domestic abuse, are adjudged to have acted negligently for “failing to protect” their children adequately from domestic violence. Unfortunately, jumping rashly to this jurisdictional finding results in the removal of countless children from their battered yet otherwise fit mothers, and, in some instances, can ultimately lead to the termination …

Identifying Heirs’ Property: Extent And Value Across The South And Appalachia, Ryan Thomson, Conner Bailey

A database of property tax records was used to locate and quantify the extent of heirs’ property across 11 states (Alabama, Florida, Georgia, Kentucky, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia). Based on previously published work, an index of four variables was then developed to estimate the likelihood that a given parcel was heirs’ property. The authors conservatively estimate that there are at least 496,994 parcels of heirs’ properties with a combined total area of 5.3 million acres and a market value of $41.9 billion in these states.

Researchers, practitioners, and policymakers interested in alleviating heirs’ property ownership precarity have long sought to connect these owners to titling and land management resources, but there is limited scholarly evidence on successful interventions. Using administrative data from the Center for Heirs’ Property Preservation® (CHPP®), this article explores the demographic characteristics, types of direct legal services received, and referral pathways of landowners seeking legal assistance from CHPP® between 2017 and 2021. We find that applicants are primarily elderly, Black women, referred through four main pathways: (1) owners’ personal networks, (2) CHPP® Outreach efforts, (3) CHPP® partner organizations—including public, private, and nonprofit …

California State University, Monterey Bay (CSUMB) students are severely impacted by high priced housing costs. This paper will demonstrate how imperative it is that Basic Needs implements a separate housing infrastructure to help support students with their housing needs during and upon graduation. CSUMB currently houses over 55% of their students and still many students have housing insecurities. To assess the micro-level housing insecurity problem; CSUMB students work with case managers to evaluate their needs. This capstone project delves into the persistent issue of homework perpetuating inequalities among low-income families. Drawing on insights from North American public school teachers who have shared their perspectives and experiences, this research employs a combination of literature reviews, teacher interviews, and anonymous surveys. The collective evidence underscores the unsettling fact that homework drives educational disparities. Consequently, it calls for a broader acknowledgment among educators and schools that homework often hinders rather than enhances a student's academic achievements.

This research is motivated by the industry and academic needs to corroborate a holistic understanding of preferred service brand status and customer service brand engagement (CSBE). The study investigates the impact of achieving preferred university brand status and how different touchpoints in higher education influence the CSBE outcomes of host universities, as seen from the perspective of international students. Data was collected from 22 American Universities with at least 1,000 international student enrollments using an online survey. Fifty years ago, in San Antonio Independent School District v. Rodriguez, the Supreme Court failed to address one of the preeminent civil rights issues of our generation—substandard and inequitable public education—by holding that the federal Constitution does not protect a general right to education. The Court didn’t completely close the door on a narrower argument that the Constitution guarantees “an opportunity to acquire the basic minimal skills necessary for the enjoyment of the rights of speech and of full participation in the political process.” Both litigants and scholars have been trying ever since to push that door open, pressing …

This essay presents a brief introduction to the special issue of the Journal of Rural Social Sciences focused on heirs’ property. Real property transferred over generations without a proper will or other transfer device, heirs’ property and heirs’ property owners are vulnerable to a range of challenges, from limited productive land use to the actual loss of land. A situation that is national in scope, heirs’ property rates are particularly high in the southern region of the United States and among African Americans. Domestic violence is often something that occurs between an abuser and a victim. However, children are also deeply affected by any type of abuse that they witness or experience. More specifically, children in rural areas face more challenges and barriers preventing them from experiencing the freedom to simply be a child. This study examined theories and interventions to treat children experiencing domestic violence. The researchers developed a treatment curriculum based on solution-focused brief therapy to address this population. Overall, solution-focused brief therapy is an effective treatment for children who have either witnessed or experienced domestic violence in a rural setting.

Topics include licensing requirements, dental record maintenance, accommodations for hearing-impaired and non-English proficient patients, the enforceability of covenants not to compete, the necessity of written employment agreements, responding to bad dental work, reporting suspected abuse, prescribing drugs to friends and family, contract terms with dental plans, and handling suspected employee theft. Islamophobia and a lack of legitimacy heavily impact Muslim-led nonprofits and limit their relationships with philanthropy in the United States, resulting in an anemic, continually underfunded sector. This article explores that disconnect within a discussion of the Year of Learning, a unique series of virtual workshops that brought together foundations and nonprofits serving the Muslim American community.
Among the barriers to more effective relationships that emerged from the workshops were the presence of Islamophobia within society at large and philanthropy in particular, a hesitance among U.S. foundations to fund faith-based work, and a lack of capacity among Muslim-led nonprofits. Also …

This study extends the literature by exploring the role of pro bono tax clinics within the social impact ecosystem with a focus on the experiences of women in financial distress who are otherwise unable to access professional tax advice. Using clinic data derived from a pro bono tax advisory clinic, this article finds that 58 per cent of financially vulnerable women seeking pro bono tax services have experienced domestic and family violence (DFV), confirming again the link between financial stress and economic abuse. Yet only 3 per cent of these women were receiving domestic and family violence-related support, highlighting the …
