The Nagging In Our Ears And Original Public Meaning, Perry Dane Jun 2023

The Nagging In Our Ears And Original Public Meaning, Perry Dane

Marquette Law Review

The debate over how to understand the meaning of legal texts once pitted intentionalism against a variety of other views united by the conviction that a legal enactment takes on a meaning not reducible to anybody’s mental state. Both these approaches are supported by powerful intuitions. This Article does not try to referee between them. Instead, it takes aim at a third set of views— theories of “original public meaning”—that in recent decades has upended the traditional debate and has now become gospel for the new majority on the United States Supreme Court.

Identity And Public History, William Holderfield Jun 2023

Identity And Public History, William Holderfield

Dissertations

This paper considers the creation of identity and self through interaction with museums. By understanding whether there is a correlation between how someone views themselves and their placement within society and the national narrative, consideration of alternative actions in combating social issues is possible. Likewise, through this knowledge, there is the potential for museums and public spaces to become of greater interest as places where topics relating to social concerns are presented and discussed. A qualitative research method was used to gather evidence of the correlation between identity and museums and revealed a relationship between identity and self-understanding and museum …

“And God Blessed The Seventh Day And Sanctified It”: The Sabbath At Creation, Dedications, And Christ’S Theophany In 3 Nephi, Dan L. Belnap Jun 2023

“And God Blessed The Seventh Day And Sanctified It”: The Sabbath At Creation, Dedications, And Christ’S Theophany In 3 Nephi, Dan L. Belnap

Faculty Publications

The Creation narrative, found in various places within the canon of scripture of The Church of Jesus Christ of Latter-day Saints, describes the institution of two different types of time. The first type of time is established in the “fourth day” with the placement of the astronomical bodies, which act as markers “for signs, and for seasons, and for days, and for years”—that is, common time (Genesis 1:14; Moses 2:14). The second type of time is established in the “seventh day,” when the Lord rests from his labors. Situated as it was at the conclusion of the physical creation and …

Endogenous Political Legitimacy: The Tudor Roots Of England’S Constitutional Governance, Avner Greif, Jared Rubin Jun 2023

Endogenous Political Legitimacy: The Tudor Roots Of England’S Constitutional Governance, Avner Greif, Jared Rubin

ESI Working Papers

This paper highlights the importance of endogenous changes in the foundations of legitimacy for political regimes. It focuses on the central role of legitimacy changes in the rise of constitutional monarchy in England. It first defines legitimacy and briefly elaborates a theoretical framework enabling a historical study of this unobservable variable. It proceeds to substantiate that the low-legitimacy, post-Reformation Tudor monarchs of the 16th century promoted Parliament to enhance their legitimacy, thereby changing the legislative process from the “Crown and Parliament” to the “Crown in Parliament” that still prevails in England.

Housing Hipsters: Adapting The Spirit Of Hipster Antitrust To Address Wealth Asymmetries Between Corporate Residential Properties And Cost-Burdened Residents, Beth Brodsky

University of the District of Columbia Law Review

Sean Gotcher, a real estate agent for 11 years, went viral on TikTok with a real estate hypothetical.1 Gotcher asked how weird society would be if a billion-dollar company collected data on what people would be willing to pay for housing by zip code and then use that information to buy under the market-rate in order to sell above the market rate.2 He wondered how weird it would be if this company bought 31 homes in a two-mile radius to sell for a profit of $1.2 million within a year.3 Zillow inspired this scenario. 4 After Gotcher’s TikTok video received …

Reinvest In Us: Reimagine The Role Of Police In The U.S., Jamil Davis May 2023

Reinvest In Us: Reimagine The Role Of Police In The U.S., Jamil Davis

College Honors Program

In America, we must question and understand what is “law and order.” Over centuries, America developed a racialized slave-class politically and socially through power and force. Police are the foot soldiers of maintaining law and order as Slave Patrols evolved into the State Police. In my thesis, I discuss how their efforts in traffic enforcement enable a dominant class to target and enslave the oppressed class. Traffic control leads to 18 million interactions a year which is 34 people a minute. The numbers of interactions along with persistent practices regarding discrimination cause police to be a social liability. When bad …

Natural Property Rights: A Reply, Eric R. Claeys May 2023

Natural Property Rights: A Reply, Eric R. Claeys

Texas A&M Journal of Property Law

This Reply concludes the symposium hosted by the Texas A&M University Journal of Property Law on the author’s forthcoming book Natural Property Rights. The Reply shows how natural law and rights apply to a wide range of doctrinal examples raised in this symposium—including business associations, correlative oil rights, timber extraction, sinking coastlands, water law, nuisance law, property rights in subsurface minerals, and the issues about sovereignty and property disposition associated with Johnson v. M’Intosh (1823). The Reply also addresses a wide range of skeptical objections to natural law—especially the arguments that it relies too much on intuitions and …

Before Facebook And Twitter: The Online Computing Revolution Of The 1980s, David Scott Cooper May 2023

Before Facebook And Twitter: The Online Computing Revolution Of The 1980s, David Scott Cooper

Doctoral Dissertations and Projects

The 1980s was the intersection of technological, economic, and social influences. Computer technology became smaller and more affordable, yet this alone did not spark online connectivity. Businesses experienced the available computers and online capabilities dating to 1950. Academic usage increased from the early 1970s. What made the 1980s the first computer generation was a combination of technological improvements, consumerism, business advertising, video games, and two-income households. Consumers were introduced to home computing through video game consoles, and the game console market crash of 1983 allowed home computers to increase sales. Computer manufacturers changed marketing strategies to educate the population on …

How does their identity and use of their “voice” in business situations, position them as businesspersons? Can photography illustrate how they see themselves as businesspersons? There were eight participants in the study, who ranged in age from 18 to 69 years. They were three females and five males who belonged to diverse marginalized identities such as a single mother, …

Innovation, Flexibility, And Adaptation: Keys To Patton’S Information Dominance, Spencer L. French May 2023

Innovation, Flexibility, And Adaptation: Keys To Patton’S Information Dominance, Spencer L. French

The US Army War College Quarterly: Parameters

In 1944, Third US Army created a cohesive and flexible system for managing information and denying it to the enemy that aligned operational concepts with technological capabilities. The organization’s success in the European Theater highlights its effective combined arms integration. An examination of the historical record shows the creative design of the Signal Intelligence and Army Information Services enabled Third Army to deliver information effects consistently and provides a useful model for considering the dynamics at play in fielding new and experimental multidomain effects formations.

Change And Innovation In The Institutional Army From 1860–2020, John A. Bonin, James D. Scudieri

The US Army War College Quarterly: Parameters

This article showcases the understudied institutional Army, the generating force, as a critical prerequisite for overall strategic success. Competition, crisis, and conflict require more than the manned, trained, and equipped units that deploy. This article analyzes six case studies of institutional Army reforms over 160 years to examine adaptation in peace and war. The conclusions provide historical insights to inform current practices and fulfill the Army’s articulated 2022 Institutional Strategy.

Caring For Rural Hispanic/Latinx Foster Youth: Cultural Competency And Providers Of Foster Youth Mental Health Services, Vidal Salgado Gonzalez May 2023

Caring For Rural Hispanic/Latinx Foster Youth: Cultural Competency And Providers Of Foster Youth Mental Health Services, Vidal Salgado Gonzalez

Master's Projects and Capstones

Hispanic/Latinx cultural competency is desperately needed in our child welfare system. Hispanic/Latinx is the largest population in the California foster care system, 48.6% of California’s total foster care population (Population Reference Bureau 2021). There is a lack of cultural competency in the workforce available to address their specific mental health needs. A particular need and opportunity for improvement in the foster care system would be a commitment by public providers to make cultural competency a foundational workforce requirement. In this capstone thesis paper, I have investigated how public providers can recruit and retain a diverse and culturally competent workforce and …

Stories Untold: Riddim Of A Contemporary Creole Architecture, Rolando Joseph May 2023

Stories Untold: Riddim Of A Contemporary Creole Architecture, Rolando Joseph

Bachelor of Architecture Theses - 5th Year

This thesis is about my interest in the architectural identity within the tropical region, specifically in the Caribbean on the island of Grenada. In this region, colonial and modern architecture have proliferated, often without adequately considering the local environment and its unique contexts. The people of this region have a distinct rhythm of life and a genuine appreciation of their local environment. This cultural rhythm can be seen in the annual celebration of the traditional carnival, filled with colorful costumes, jab-jab mas, and parades that bring the streets to life.

The intent of this thesis is to question the current …

What God Has Joined Together: The One Threefold Purpose Of Marriage, David Frayne Shudy May 2023

What God Has Joined Together: The One Threefold Purpose Of Marriage, David Frayne Shudy

Master of Sacred Theology Thesis

Modern married couples and marriage-minded individuals are often left awash in a sea of confusion aimlessly groping about for a purpose for their marriage, with disastrous societal results. Whereas long-standing Christian tradition has taught a unified threefold marital purpose of three equal elements—procreation, mutual help, and remedy for sin—Enlightenment thinkers and their ideological descendants have introduced a hierarchical marriage teleology with a self-chosen purpose (usually companionship) at the top in order to correct for an alleged countervailing overemphasis on procreation in premodern marital teleology.

This thesis will challenge the claim of a relative deficiency in the companionate aspect of premodern …

Educating A Denomination: Albert C. Outler And American Theological Education, 1925 - 1974, Lane Davis May 2023

Educating A Denomination: Albert C. Outler And American Theological Education, 1925 - 1974, Lane Davis

Religious Studies Theses and Dissertations

This dissertation provides a critical biography of Albert C. Outler, a prominent historian and theologian in modern Methodism and analyzes three significant emphases in his work: ecumenism, theology and psychology, and Methodist doctrine. The study begins with Outler's formative education and his ministry as a Methodist pastor in Georgia. Outler's doctoral education at Yale focused his work on discovering the connections of the "common history" of all Christians. The study then considers Outler’s extensive work in three interconnected disciplines: ecumenical studies, the study of religion and psychology, and Methodist theology and doctrine. The connection between these diverse subjects lies in …

Reframing Culture: The Decolonization And Repatriation Process In The Italian Museum System, Leila De Gruy May 2023

Reframing Culture: The Decolonization And Repatriation Process In The Italian Museum System, Leila De Gruy

Honors Theses

In 2022, the collections of the former Museo Coloniale, Colonial Museum, were reopened to the public as a part of the Museo delle Civiltà in Rome. This reopening, viewed by many as an exhumation of fascist dictator Mussolini’s former collection, in the neighborhood he built for the World Fair, reinvigorated the debate surrounding museum decolonization and brought Italy into the spotlight for this topic. This thesis seeks to explore the conversation surrounding the topic of Italian museum decolonization, using the Museo Coloniale’s collection as the primary example of a colonial museum in a post colonial world. Through this, it asks …

“Great Excitement”: Violent Incorporations Of The American Southwest, Joseph Hall-Patton May 2023

“Great Excitement”: Violent Incorporations Of The American Southwest, Joseph Hall-Patton

History ETDs

This dissertation studies various incidents of violence throughout the Southwest from 1848-1919, often called “great excitement,” revealing a “Western Civil War of Incorporation.” US incorporation designated whether people would be included or excluded from the American body politic. Violence in the Southwest between the mid-nineteenth and early-twentieth centuries exposes deep change fueled by a relentless US drive to swallow and digest its people and resources, profiting handsomely in the process. Each chapter is a case study, culminating in a conclusion that ties them together to gain a greater understanding of American violence. They are the 1858 San Luis Obispo vigilantes, …

How Do Faculty And Staff Perceive The Effectiveness Of Student Support Systems That Promote The Retention Of First-Generation College Students?, David Shawn Wolff Dr. May 2023

How Do Faculty And Staff Perceive The Effectiveness Of Student Support Systems That Promote The Retention Of First-Generation College Students?, David Shawn Wolff Dr.

Dissertations, Theses, and Projects

Research showed faculty-student interactions impact student engagement and was a primary factor to student retention (Kuh & Hu, 2001; Means & Pyne, 2017; Swecker et al., 2013; Tinto, 1987). The literature revealed while retention may be an issue for many institutions, there is a greater need to address retention specifically related to first-generation college students (FGCS). Students often seek advice from faculty and staff when faced with questions about their academic progress. Faculty and staff voices need to be collected regarding their perceptions of the effectiveness of the support systems used within an institution that promote retention for FGCS. This …

Cultivating Reproductive Small Group Leaders Within Southwest Church, Springboro, Ohio, Roger D. Hendricks May 2023

Cultivating Reproductive Small Group Leaders Within Southwest Church, Springboro, Ohio, Roger D. Hendricks

Doctor of Ministry Theses and Dissertations

ABSTRACT

This project was designed to address an ongoing challenge within the Southwest Church (SWC) in Springboro, Ohio. The specific challenge that SWC leaders have faced throughout the twenty-five-year history of the church is to continually increase the number of small group options within a growing congregation. Small groups have been identified as the primary vehicle for SWC members to grow as disciples of Jesus Christ. This congregational emphasis has led to the good dilemma of having more individuals willing to participate than lead weekly small groups. In the past few years, SWC leaders have identified the need for the …

Fifty Years Of Canadian Legal History, Jim Phillips, Philip Girard May 2023

Fifty Years Of Canadian Legal History, Jim Phillips, Philip Girard

Dalhousie Law Journal

Fifty years ago Canadian legal history was very much in its infancy. What little had been published was in equal measure antiquarian, descriptive, and hagiographic. The field has undergone a profound transformation in the last half-century. We now know a great deal more about all aspects of our legal past, about our institutions, our legal personnel, and the substantive law. The field has also become much more sophisticated, concerned not only with internal legal developments but increasingly with the relationships between law and other aspects of Canadian history. Social history, labour history, women’s history, economic, intellectual, cultural and political history, …

21st Century Political Agronomy: Between Collapse And Apocalypse In The Capitalist World System, Harrison Raskin May 2023

21st Century Political Agronomy: Between Collapse And Apocalypse In The Capitalist World System, Harrison Raskin

Honors Scholar Theses

Examinations of the causal chain between ecological impacts and food shortages reveal significant impending global disturbances. This paper draws a causal link between ecological impacts and low food productivity which will lead to food insecurity and economic crises in the near term. Further, this paper argues that food insecurity may lead to the collapse of the capitalist world system. This threat is contrasted with “business as usual” climate models which, rather than depicting the collapse of the capitalist world system, depict its persistence throughout the collapse of the world ecology.

"If These Walls Could Speak": Judson College And The Formation Of The New Baptist Woman, 1838-1930, E.Gabrielle Walker May 2023

"If These Walls Could Speak": Judson College And The Formation Of The New Baptist Woman, 1838-1930, E.Gabrielle Walker

Dissertations

Southern Baptist women’s collegiate education and experiences led to their questioning traditional Baptist gender roles and interpreting religion to fit a modern, progressive worldview. Judson College established in 1838 in Marion, Alabama, created a space for its Baptist students to consider socially appropriate ways, outside of doctrinal boundaries, to serve God, themselves, their families, and humanity. Judson remained theologically and culturally conservative, perpetuating inherited religious and social notions of female subordination to men, while increasingly offering students more progressive curricula to meet changing economic and cultural realities. In compliance with white Southern and Baptist conservative values, Judson’s students generally accepted …

The Permanent Court Of International Justice In Global History, James D. Fry May 2023

The Permanent Court Of International Justice In Global History, James D. Fry

Duke Journal of Comparative & International Law

The Permanent Court of International Justice's contributions often are overshadowed by the fact that it was the predecessor of the overwhelmingly important International Court of Justice. This article is the first to look at the Permanent Court's possible contribution to global history in its own right. While the case-study method adopted in this article does not allow for the determination of causal linkages between acts of the Permanent Court and consequences in global history, it nevertheless provides compelling support for liberal institutionalism and the notion that global history has been influenced by actors other than states, even though states remain …

Challenging The "Unexceptional": Marguerite Of Provence, Thirteenth-Century Queenship, And Power, Katie Despeaux May 2023

Challenging The "Unexceptional": Marguerite Of Provence, Thirteenth-Century Queenship, And Power, Katie Despeaux

History ETDs

Marguerite of Provence, wife to Saint Louis IX of France, has long been overlooked or negatively characterized by historians. Due to the unique circumstances of her mother-in-law’s political reach and her sister’s role as queen of England, Marguerite was limited by her husband and his court in her access to power. Traditionally understood as a passive queen, Marguerite’s expression of power through motherhood, curated images, and emotional performance can be better understood through Theresa Earenfight’s paradigm of gender and power. In a series of comparisons between Marguerite and her mother-in-law, sister, and Egyptian counterpart during the Seventh Crusade, Marguerite’s role …

"The Second Side" A Historic Retelling Of African American Life In Iberia Parish, Louisiana, Breighlynn Polk

Master of Arts in American Studies Capstones

In 1834, new living quarters emerged in the Main Street District of New Iberia for the Weeks family, who were prominent white sugar cane planters that owned a fully operating plantation twenty-five miles away. With their sixteen-room home sited twenty feet above the banks of the bayou, the Weeks family earned the reputation of flamboyant community members whose wealth was accumulated through the exploitation of enslaved African Americans. However, the ability to savor riches generated through the institution of slavery was short lived as the Union Army’s strategy of “Total War” threatened the prosperity of slave-owning families in the South. …

Health Disparities Within Rural Communities In The Southern Region Of The United States, D’Angelo Stokes, Jordan Howard, Terrence Mchugh, Nicholas Bohannon, Emeka Ikeakanam, Evan Curry, Jason Walker

Research Day

Intro:

Historical studies have shown that health disparities exist between urban and rural communities, however additional disparities are also known to exist within rural communities as well. These include health disparities between races, ethnicities, and socioeconomic statuses, among others. While the disparities between urban and rural communities have been researched and described more extensively, there is a paucity of information available about the disparities that exist within rural communities. Our goal in this research initiative was to characterize the disparities that exist within rural communities by examining the findings of several publications that sought to describe this phenomenon in the …

Devil In The Details: Witchcraft In Reformation England, Angela A. Luna May 2023

Devil In The Details: Witchcraft In Reformation England, Angela A. Luna

Theses and Dissertations

An analysis of the English Reformation’s impact on perceptions of witches and the transformation of witchcraft as a crime prosecutable in courts of law. It demonstrates English diabolism characterized by the use of animal familiars, body markings, and pacts with the Devil, which helped to shape the English witch trials.
