The Gay Science: Power On The Body, Population, And Psyche, Nicola Augustyn
The Gay Science: Power On The Body, Population, And Psyche, Nicola Augustyn
CMC Senior Theses
Michel Foucault is a philosopher of power who left behind a legacy of ideas that continue to inspire scholars today. His conceptualization of power is not limited to the figures of kings, monarchs, or the sovereign state. Rather, he regards power as a productive force that shapes subjectivity, manufactures knowledge, and engenders the truth in a particular historical context. In this thesis, I aim to provide a comprehensive account of Foucault’s analysis of power, starting with his refutation of the “repressive hypothesis” that challenges the predominant view of centralized top-down power. Then, I present Foucault’s proposal for redefining power as …
Mysteries Of The Gothic, Addison Duvall
Mysteries Of The Gothic, Addison Duvall
CMC Senior Theses
By examining the histories of the Notre-Dame and Chartres cathedrals, I will consider three academic schools of thought regarding the high Gothic Cathedrals: the balanced and rational feat of engineering, the communal and social rituals that bond humans to this space, and the iconographic manifestation of the supernatural. Functionalist engineering paradoxically lays at the heart of these cathedrals' capacity to open the human consciousness to the sacred by using recurrent symbolic patterns from nature, music and mathematics to create divine ratios that transport us. Integrated into these larger architectural designs the repeating visual patterns exalting both biblical and supernatural icons …
Stressors And Hormone Levels: Predictors Of Covid-19 Health Outcomes In Latine Adults, Wendy Rodriguez
Stressors And Hormone Levels: Predictors Of Covid-19 Health Outcomes In Latine Adults, Wendy Rodriguez
CMC Senior Theses
The Coronavirus 2019 Disease (COVID-19) has been shown by multiple studies to have disproportionate impacts on some individuals, especially minority populations. These may be attributed to differences in biological (sex), gender, social or cultural factors. In this study, we aim to identify and investigate the gender and social predictors that may be involved in the pathogenesis of the virus and its health outcomes. To achieve this, a literature review expands on relevant topics that better contextualize COVID-19’s complex nature. The potential role of hormones, estrogen, and testosterone is considered across different sexes and genders as protective agents against COVID-19. This …

Abortion Localism And Preemption In A Post-Roe Era, Kaitlin Ainsworth Caruso
Abortion Localism And Preemption In A Post-Roe Era, Kaitlin Ainsworth Caruso
Lewis & Clark Law Review
In Dobbs v. Jackson Women’s Health Organization, the U.S. Supreme Court eliminated federal constitutional protections for abortion. Practically, a person’s access to abortion has long depended on where they live and where they can travel; that disparity is far worse now. In light of Dobbs, some states decisively changed their laws, often decimating abortion access. In other states, however, the law remains unclear; advocates are furiously lobbying and litigating to redefine their states’ standards. Amid this upheaval, one element of the new abortion landscape is underappreciated: how localities impact abortion access.
For decades, local governments have influenced access to abortion …
Abortion Rights As (Inter)National Human Rights: Dobbs And The Noncompliance Of U.S. Abortion Policies Under International Human Rights Law, Sydney Chong Ju Padgett
Abortion Rights As (Inter)National Human Rights: Dobbs And The Noncompliance Of U.S. Abortion Policies Under International Human Rights Law, Sydney Chong Ju Padgett
Lewis & Clark Law Review
The current state of reproductive rights in the United States following Dobbs v. Jackson Women’s Health Organization constitutes yet another chapter in the saga of the United States’ hypocrisy in failing to uphold international human rights at the domestic level. International human rights law unequivocally provides that safe and legal abortion access is a fundamental human right. Yet, applying treaty body guidance to the cruel and irrational legislation enacted in Dobbs’ wake, it is clear: the United States has wholly and dangerously failed to comply with its international commitments to protect and uphold the fundamental rights at stake in regulating …
Toward Principled Background Principles In Takings Law, Rebecca Hansen, Lior Jacob Strahilevitz
Toward Principled Background Principles In Takings Law, Rebecca Hansen, Lior Jacob Strahilevitz
Coase-Sandor Institute for Law & Economics Research Paper Series
Blunders made by lawyers, judges, and scholars have caused the Supreme Court’s recent opinion in Cedar Point Nursery v. Hassid to be deeply misunderstood. In Cedar Point, the Court re-wrote takings law by treating temporary and part-time entries onto private property as per se takings. Prior to Cedar Point these sorts of government-authorized physical entries would have been evaluated under a balancing framework that almost invariably enabled the government to prevail. As it happens, there were two well-established rules of black letter law that California’s lawyers and amici mistakenly failed to invoke in defending the Cedar Point union organizer access …
Expecting Corporate Prosociality, Hajin Kim
Expecting Corporate Prosociality, Hajin Kim
Coase-Sandor Institute for Law & Economics Research Paper Series
Teaching people that corporations must exclusively maximize profits can reduce “win-wins”—what is both profitable and good for society. If everyone believes that corporations must maximize profits only, nobody will protest when corporate pursuits of profits harm society—the firms were fulfilling their duty and meeting investor and consumer expectations. But what if people instead believed that corporations should consider their social impacts, even sometimes at the expense of profits? Consumers, employees, and investors might be more willing to object to corporate harms by changing their purchasing, job choice, and investing behaviors or by petitioning corporate leaders for redress. Those objections would …
Distributing Deterrence Fairly: A New Rationale For Decoupling Tort Liability, H. Javier Kordi
Distributing Deterrence Fairly: A New Rationale For Decoupling Tort Liability, H. Javier Kordi
Coase-Sandor Institute for Law & Economics Research Paper Series
Tort law faces a dilemma: how to adhere to a principle of make-whole compensation without entrenching social inequities. High-earning people receive greater compensation awards, resulting in an unequal distribution of deterrence. The deterrence disparity arises because injurers would rationally direct risky activity towards poorer victims to reduce liability costs; it persists even if race and gender classifications are barred from compensation. This Article offers a novel solution to the dilemma. It develops a decoupled liability regime under which injurers pay damages and are subject to standards of care that are invariant across individual victims, thus equalizing the distribution of deterrence. …
Labor Mobility And The Problems Of Modern Policing, Jonathan S. Masur, Aurélie Ouss, John Rappaport
Labor Mobility And The Problems Of Modern Policing, Jonathan S. Masur, Aurélie Ouss, John Rappaport
Coase-Sandor Institute for Law & Economics Research Paper Series
We document and discuss the implications of a striking feature of modern American policing: the stasis of police labor forces. Using an original employment dataset assembled through public records requests, we show that, after the first few years on a job, officers rarely change employers, and intermediate officer ranks are filled almost exclusively through promotion rather than lateral hiring. Policing is like a sports league, if you removed trades and free agency and left only the draft in place.
We identify both nonlegal and legal causes of this phenomenon—ranging from geographic monopolies to statutory and collectively bargained rules about pensions, …
Simplicity And Complexity In Law And In Markets, Saul Levmore
Simplicity And Complexity In Law And In Markets, Saul Levmore
Coase-Sandor Institute for Law & Economics Research Paper Series
Richard Epstein’s Simple Rules for a Complex World1 is true to its title and to the author’s demonstrated genius over a long career. It is a libertarian-oriented enterprise in that it requires the reader to share in the belief that government programs are often wasteful and subject to unattractive interest group pressures and corrupt bureaucracies. More generally, Simple Rules is framed against a background in which the reader must share the libertarian view that individuals can and should be trusted to look after themselves and to make their own choices. Epstein likes “simple” rules; these include strict liability, a flat …
Strategic Subdelegation, Brian D. Feinstein, Jennifer Nou
Strategic Subdelegation, Brian D. Feinstein, Jennifer Nou
Coase-Sandor Institute for Law & Economics Research Paper Series
Appointed leaders of administrative agencies routinely record subdelegations of governmental authority to civil servants. That appointees willingly cede authority in this way presents a puzzle, at least at first glance: Why do these appointees assign their power to civil servants insulated by merit protection laws, that is, to employees over whom they have limited control? This article develops and tests a theory to explain this behavior. Using original data on appointee-to-civil servant delegations and a measure of the ideological distance between these two groups of actors, we show that appointees are more willing to vest power in civil servants when …
Cross-Border Influencers: Democracy And Externalities, Saul Levmore
Cross-Border Influencers: Democracy And Externalities, Saul Levmore
Coase-Sandor Institute for Law & Economics Research Paper Series
The United States does not allow foreigners to influence U.S. elections by giving money to political parties or candidates, but many other countries do allow cross-border influencing. Indeed, the variety of policies among countries is remarkable. Some countries, like the United States, that forbid financial contributions from outside the country, do permit cross-border contributions across domestic borders, such as those of states and cities. Meanwhile, Canadians cannot contribute to the campaigns of U.S. political candidates, and cannot even (lawfully) influence the American political process by purchasing campaign t-shirts or bumper stickers. This prohibition is in place even though, like constituents …

During the COVID-19 pandemic, excessive drinking increased by 21% and alcohol-related deaths increased approximately 25%.6 At the same time, gun sales increased by 40%, gun homicides by 35%, and gun suicides had the largest one-year increase ever recorded.
These alarming trends urge us to think about alcohol misuse as a risk factor for gun violence. To better understand this connection, the Consortium, in partnership with the Center for Gun Violence Solutions, developed this report to highlight the available research to inform policy. As detailed in this report, alcohol misuse is associated with a risk of dangerous firearm behaviors, interpersonal firearm …

Globally, pests (invertebrates, vertebrates, pathogens, weeds) can cause estimated annual losses of between 20% and 40%, but higher losses are disproportionately experienced by many low-income countries, as agriculture is the mainstay of the majority of the people and of national economies. Pests pose a major barrier to these countries’ ability to meet the aims of the UN Sustainable Development Goals (SDGs), particularly SDG2, “End hunger, achieve food security and improved nutrition and promote sustainable agriculture.” However, solutions, in the form of pest risk alert systems, coupled with major advances in technology, are now providing opportunities to overcome this barrier in …

Tsetse flies are exclusively hematophagous and vectors of trypanosomes, which cause human and animal African trypanosomiasis. They are widely distributed in Africa, with 33 extant taxa and 22 species in three sub-genera. Despite a low reproductive rate, tsetse can maintain populations large enough to cause the restriction of the economic use of large areas of tropical Africa through the transmission of trypanosomiases. This success is largely due to their ability to navigate in their environments, using olfactory signals, which elicit critical behavioural phenotypes, such as attraction to hosts for blood meals, larviposition and resting sites, as well as avoidance of …
