This paper reports on research conducted to evaluate the effectiveness of the Certification Modular Model 2.0 (CMM 2.0) offered by the Teacher Quality Institute of the Australian Capital Territory. The research evaluated the extent to which the CMM 2.0 was attractive, sustainable and developmental. The data was collected via two surveys conducted with, teachers who were prospective applicants to the CMM 2.0 and current and former certification participants. The aim of this study was to investigate the relationship between prospective social studies teachers' global citizenship levels and their COVID-19 awareness levels. To do that, Relational survey model, one of the quantitative research methods, was used. The sample consisted of 409 prospective social studies teachers selected by simple random sampling method from six universities in Turkey. The 2022 Annual Texas Survey on Franchise Law presents an assortment of novel and familiar legal issues in Texas state and federal courts. This year’s Survey period contains decisions favorable to franchisors, franchisees, and third parties associated with franchised businesses on disputes involving intellectual property rights, enforceability of forum selection clauses, the essential elements of common law and statutory claims, and remedies available to franchise parties involved in litigation, among other issues. Litigants and judges alike have struggled to understand and resolve the parameters of personal jurisdiction, particularly in product liability cases. This results in significant costs and time which is likely to be of little benefit to anyone.
Much of this confusion arises from two problems: (1) most of the early Supreme Court decisions on personal jurisdiction arose from contractual disputes; and (2) when the economy expanded after World War II, and new automobiles, commercial aircraft, appliances, and other complex products appeared, the Court’s attempts to resolve personal jurisdiction issues were unsuccessful. Data privacy is a growing concern in our fast-paced society, as it has become increasingly necessary to relay and retain information digitally. However, the United States trails behind its counterparts in terms of the strength of existing data protection legislation. Unlike the European Union and its General Data Protection Regulation (“GDPR”) law, the United States has no similar comprehensive data protection act. Sandin and Wilkinson were decided during Chief Justice William Rehnquist's tenure, and the Chief Justice played the lead role in reshaping the Court's solitary confinement caselaw over the past thirty years. It was Chief Justice Rehnquist who fashioned the “atypical, significant hardship” test in Sandin v. Conner and it would have to be exhibit 1 demonstrating the Chief Justice's “indifference to prison terrors,” to borrow Professor Judith Resnik's eloquent phrase. Many have proclaimed that the Bipartisan Safer Communities Act is the most sweeping gun control legislation to be passed in decades. However, the bill is not primarily a gun control bill—instead, much of the Act seeks to improve mental health services in hopes of preventing gun violence. Such a move is not rooted in established evidence, which finds little predictive value in knowing an individual’s mental health history. In fact, people with mental health disabilities are more likely to be victims of violent crimes than perpetrators. The Act therefore shifts the debate about gun reform from one about easy access …

Waiver contracts are agreements in which one party promises not to sue the other for injuries that occur during their contractual relationship. Waivers are controversial in the consumer context, especially when presented in standard form, take-it-or-leave-it contracts. The law on waivers is inconsistent, with no doctrine or policy among the courts on enforceability. The aim of this paper is to offer a consistent set of policies that can form the foundation of a consistent set of doctrines, leading ultimately to a more consistent treatment of waivers in the courts. The Case Against Officer Fiduciary Duties, Paul D. Weitzel
Nebraska Law Review
This article argues that fiduciary duties owed by officer to shareholders are counterproductive, theoretically unsound and unnecessary in practice. Using experimental data from behavioral ethics research, the article shows that fiduciary duties expand the range of morally justifiable behavior, which increases self-serving transactions. This harm is not offset by the constraints created by fiduciary duties because officer fiduciary duties are rarely enforced and almost never result in actual damages paid by the officers themselves.
The article further shows that fiduciary duties owed by officers to shareholders are theoretically unsound. Fiduciary theory is premised on opportunism, vulnerability, entrusted assets and costly …

The COVID-19 pandemic laid bare the shared vulnerability inherent in the human condition, prompting a collective recognition of our physical susceptibility to infectious diseases. While great strides have been made in combating COVID-19 through vaccinations and treatments, a portion of the population remains profoundly vulnerable due to health conditions that make the disease more dangerous, that limit vaccine efficacy, or that prevent vaccination altogether.

Agricultural runoff is a major source of nonpoint pollution in the U.S., where portions of fertilizer are carried away as runoff before polluting navigable waters. Commercial fertilizers containing heavy concentrations of nitrate and phosphate are the dominant source of nonpoint pollution. In 1972, the Clean Water Act (CWA) was implemented to protect navigable waters from discharges of point source pollutants. However, currently there are only limited provisions regarding nonpoint source pollution. Instead, regulation is left to the states through a variety of voluntary management programs. After the Supreme Court of the United States returned authority to regulate abortion to the state level in Dobbs v. Jackson Women’s Health Organization, many states began to redraft their statutes, either protecting or eliminating abortion access. In doing this, the Supreme Court intensified demands for gender-inclusive language in reproductive healthcare legislation and court opinions. The ongoing shift in discourse acknowledges the reproductive healthcare needs of transgender and nonbinary (“TGNB”) people, given the already limited access to general healthcare. The firsthand pandemic experiences of rural health-care providers—who were already burdened when COVID-19 hit—raise questions about the future of public health and health-care delivery.
This volume comprises the COVID-19 pandemic experiences of Appalachian health-care workers, including frontline providers, administrators, and educators. The combined narrative reveals how governmental and corporate policies exacerbated the region’s injustices, stymied response efforts, and increased the death toll.

This paper used web scraping and data mining to analyze 831 health informatics job advertisements on indeed.com. Results showed that 87% of jobs explicitly required a college degree in a related field, 41% of jobs preferred a graduate degree, while 29% preferred or required professional certification. The analysis showed that preferred skills were analytics problem solving, communication skills, oral communication, interpersonal skills, project management, statistics, and critical thinking. The analysis also showed that college degrees, certifications, and the above-mentioned skill set are in high demand for working in the field of health informatics, especially in states with large populations and …

Conversational agents are increasingly being used by the general population due to shortages in healthcare providers and specialists, and limited access to treatments. They are also used by people to deal with loneliness and lack of companionship. As these apps are increasingly replacing real humans, there is a need to explore their design features and limitations for better design of conversational apps. School counselors are mental health experts in schools uniquely positioned to provide social and emotional support to students. However, not all students have access to a school counselor or another mental health professional. In this study, we aim to analyze the public perception of Twitter users with respect to the use of ChatGPT and the potential bias in its responses. Sentiment and emotion analysis were also analyzed. Analysis of 5,962 English tweets showed that Twitter users expressed concerns regarding six predominant types of biases, namely: political, ideological, data and algorithmic, gender, racial, cultural, and confirmation biases. Sentiment analysis showed that most of the users reflected a neutral sentiment, followed by negative and positive sentiment. Emotion analysis mainly reflected anger, disgust, and sadness with respect to bias concerns with ChatGPT use.

The digital transformation of agriculture can support economic growth and food and nutrition security in Africa. The objectives of this study were to provide an overview of the status of digital agriculture in five West African countries, analyze their efforts in developing the enabling environment and innovations, and formulate recommendations based on the identified gaps for the effective transformation of the sector.
