Optional Price Discrimination, Lee Anne Fennell
Optional Price Discrimination, Lee Anne Fennell
Texas A&M Law Review
Price discrimination generates considerable angst. As merchants develop ever-more-powerful mechanisms for gathering and compiling information about consumers, the specter of fully personalized pricing seems to loom as an ominous threat. Yet a parallel phenomenon quietly coexists with all this distress over tailored prices: models that encourage people to voluntarily contribute, typically in varying amounts, the sums necessary to cover the fixed costs of producing particular goods and services. This Article proposes enabling customers to opt into price discrimination in a more structured way across a broader range of markets. Optional price differentiation can make markets fairer and more inclusive by …

Anchoring Lifeline Criminal Jurisprudence: Making The Leap From Theory To Critical Race-Inspired Jurisprudence, Danardo S. Jones
Anchoring Lifeline Criminal Jurisprudence: Making The Leap From Theory To Critical Race-Inspired Jurisprudence, Danardo S. Jones
Dalhousie Law Journal
This article takes as a starting point the claim that anti-Black racism permeates Canadian society and finds expression in our institutions, most notably the criminal justice system. Indeed, anti-Black racism in criminal justice and its impact on Black lives are not credibly in dispute. Thus, what should concern legal scholars is the staying power or permanence of racism. In other words, should Canadian legal scholars ‘get real’ about the intractability of race? Or can anti-Black racism be effectively confronted by developing legal and evidentiary tools designed to fix, rather than dismantle, the current system? Put another way, this article aims …

Simple Summary
Effective and scalable diet, exercise, and weight management interventions are needed for primary cancer prevention in the general public, as well as for cancer control and tertiary prevention among the growing population of cancer survivors. A 6-month online intervention, entitled “Daughters, dUdes, mothErs, and others Together” (DUET), was designed to promote weight loss, a healthful diet, and increased physical activity among cancer survivors and their chosen partners. Fifty-six cancer survivor-partner dyads (n = 112 participants in total) were recruited into a randomized controlled trial that compared DUET to a waitlist control. The trial surpassed all feasibility endpoints …

Sociological Aspects Of Music Education In Higher Education In Brazil, Canada, Israel, Norway, And The United States During The Covid-19 Pandemic, Edward Richard Mcclellan, Stian Vestby, Jennifer Lang, Amira Ehrlich
Visions of Research in Music Education
The purpose of this study was to examine the sociological aspects of music education and perspectives of university music education professors in five continents in relation to remote learning during the COVID-19 pandemic. The concepts of community of practice and agency were used to investigate the social interaction, socialization, and collective impact of people and experiences observed in university-level music education in different parts of the world. As the global pandemic completely changed the conditions on university campuses and music education programs, each participant provided 1) an overview of the parameters of virtual and in-person instruction implemented by select institutions, …

Developing A Community Chaplaincy Ministry: Through A Need Satisfaction Care Model For A Native Language Church, Shanti Samuel
Developing A Community Chaplaincy Ministry: Through A Need Satisfaction Care Model For A Native Language Church, Shanti Samuel
Doctoral Dissertations and Projects
Believers in Jesus Christ are mandated to "go" into the world, and caring for people is part of the seeking. God has provided models and processes of His care in the scriptures. A chaplain holds spiritual care functions outside the church's four walls on the field. Unfortunately, many Asian Indian Americans in the booming immigrant population have not received care. Therefore, this action research thesis assumes need-based church training to build a culture-sensitive model of care to provide care. This research project explored the causes and impediments to care through participative sessions with the spiritual care provider volunteers of the …
American Military Cemeteries: Temples Of Nationalism And Civic Religion, Kyler James Webb
American Military Cemeteries: Temples Of Nationalism And Civic Religion, Kyler James Webb
Doctoral Dissertations and Projects
Beginning with the dedication of the cemetery at Gettysburg and the address given by Abraham Lincoln, American military cemeteries would have a dual objective to honor nationalism and expand civic religion. Military cemeteries have been on the leading edge of accomplishing ideals such as equality during their construction, implementation, and development. As military cemeteries were created both domestically and on foreign soil between 1860-1960 they became temples to honor nationalism and civic religion.

Choice Of Law And Time, Part Ii: Choice Of Law Clauses And Changing Law, Jeffrey L. Rensberger
Choice Of Law And Time, Part Ii: Choice Of Law Clauses And Changing Law, Jeffrey L. Rensberger
Georgia State University Law Review
Modern choice of law analysis usually honors the parties’ contractual choice of governing law. But what happens when the law selected by the parties changes between the time of their contracting and the time of litigation? Or what if the law of the state whose law would otherwise apply changes so that its policy is now offended by the choice of law clause although its policy was not violated when the parties contracted? These questions raise the often-overlooked temporal aspect of choice of law analysis. Should courts regard the law to be applied as fixed to the time of the …

Daugherty Water for Food Global Institute: Faculty Publications
Long-term atmospheric CO2 concentration records have suggested a reduction in the positive effect of warming on high-latitude carbon uptake since the 1990s. A variety of mechanisms have been proposed to explain the reduced net carbon sink of northern ecosystems with increased air temperature, including water stress on vegetation and increased respiration over recent decades. However, the lack of consistent long-term carbon flux and in situ soil moisture data has severely limited our ability to identify the mechanisms responsible for the recent reduced carbon sink strength. In this study, we used a record of nearly 100 site-years of eddy covariance …

#Blackatuark: Digital Counterpublic Memories Of Anti-Black Racism On Campus, T. Jake Dionne, Joe Hatfield, Gabrielle Willingham
Communication Faculty Publications and Presentations
After #BlackLivesMatter protests in summer 2020, many leaders in the US South reevaluated monuments dedicated to the confederate and segregation eras. Black affiliates of the University of Arkansas used the Twitter hashtag #BlackatUARK to demand the removal of memorials commemorating a segregationist senator and share their experiences of anti-Black racism on campus. We argue that #BlackatUARK provides a counterpublic memorial of campus life that opposes and transforms dominant public memories, geographies, and subjectivities. Our analysis of the hashtag expands the conceptual boundaries of the kairos/metanoia partnership to show how digital counterpublic memories gain momentum and produce tangible rhetorical effects across …

Strengths And Opportunities For Sustainability, Ab Currie
Canadian Forum on Civil Justice
At the mid-point of this three-year pilot project, the evidence suggests that the Mobile Rural Law Van is accomplishing its primary objective of better meeting the needs of people in rural Wellington County and North Halton. Is the success after two summers and one winter of operation sustainable? Sustainability is about more than just money, more than cost and about cost per person served. Sustainability depends on how the project operates and how it is connected with the community being served. This paper identifies the non-monetary factors that make the Law Van project sustainable, suggesting adjustments that might be made …

Diagnostics, including laboratory tests, medical and nuclear imaging, and molecular testing, are essential in the diagnosis and management of cancer to optimize clinical outcomes. With the continuous rise in cancer mortality and morbidity in the Association of Southeast Asian Nations (ASEAN), there exists a critical need to evaluate the accessibility of cancer diagnostics in the region so as to direct multifaceted interventions that will address regional inequities and inadequacies in cancer care. This paper identifies existing gaps in service delivery, health workforce, health information systems, leadership and governance, and financing and how these contribute to disparities in access to cancer …
Flood Hydrology In Tropical Coastal Catchments: Linking Watershed Dynamics To Mangrove Sedimentation, Shannon L. Jones
Flood Hydrology In Tropical Coastal Catchments: Linking Watershed Dynamics To Mangrove Sedimentation, Shannon L. Jones
Electronic Theses and Dissertations
Coastal flooding is expected to be more frequent and severe from amplified flooding from sea level rise (SLR) and upstream anthropogenic activity, particularly in tropical regions. Improved hydrologic modeling and characterization are needed to better understand, predict, and manage flooding where these amplifications are expected. Yet tropical catchments are often ungauged or have limited hydrogeomorphic data. Thus, locally calibrated models that incorporate local knowledge and alternative data can be used to provide greater information. This doctoral dissertation quantifies relationships between land use, precipitation, discharge, and downstream sediment accretion in a representative ungauged catchment using a locally calibrated rainfallrunoff model validated …
The Impact Of Foreign Aid On Internal Stability: A Case Study Of Costa Rica And Venezuela, Sierra P. Tanner
The Impact Of Foreign Aid On Internal Stability: A Case Study Of Costa Rica And Venezuela, Sierra P. Tanner
Electronic Theses and Dissertations
This thesis examines the relationship between foreign aid and the internal stability of recipient countries. Foreign aid programs have been an important tool through which countries can receive support in development efforts. Through extensive case study and process tracing analysis of twelve foreign aid projects in Venezuela and Costa Rica, this thesis examines the question: Does foreign aid impact the internal stability of the recipient state? Although Costa Rica and Venezuela have different levels of internal stability, patterns emerge associating different types of aid projects with outcomes in both countries. The research finds that the impact of foreign aid on …

Financial Well-Being And Financial Capability Among Low-Income Entrepreneurs, Baorong Guo, Jin Huang
Social Work Faculty Works
Financial well-being is a key component of quality of life and overall well-being and is likely to affect other aspects of quality of life, such as health and health care. The COVID-19 pandemic presents an immense crisis of financial well-being among low-income entrepreneurs and has left many small-scale entrepreneurs financially fragile. We argue that promoting the financial capability of low-income entrepreneurs is effective in protecting their financial well-being from a crisis. To examine the association between financial capability and the financial well-being of low-income entrepreneurs, we use the 2016 National Financial Well-Being Survey, which provides the latest and comprehensive measurement …

The Role Of State Courts In Constraining Partisan Gerrymandering In Congressional Elections
The Role Of State Courts In Constraining Partisan Gerrymandering In Congressional Elections
The University of New Hampshire Law Review
Federal courts were once seen as the place for partisan gerrymandering challenges to be lodged, but after thirty-plus years of failing to find any redistricting plan to be a partisan gerrymander, even while holding partisan gerrymandering to be justiciable, the Supreme Court announced in Rucho v. Common Cause, 139 S.Ct. 2484, that partisan gerrymandering is not justiciable in federal courts. State courts are now seen as the only place where a remedy for egregious partisan gerrymandering might be sought (except, of course, for taking redistricting out of the hands of the state legislature and moving responsibility into a bipartisan …
Once Bitten, Twice Shy -- Multiple Voting Shares In Continental Europe, Jorge Brito Pereira
Once Bitten, Twice Shy -- Multiple Voting Shares In Continental Europe, Jorge Brito Pereira
Journal of International Business and Law
Over the last decade, several jurisdictions in continental Europe have lifted regulatory restrictions on multiple voting shares (hereinafter “MVS”) in the form of dual-class share structures and/or loyalty shares. Though more heterogenous than coherent, all such reforms have been overly conservative and fall short of allowing the legal freedom of jurisdictions such as the United States and the United Kingdom. This approach may be difficult to understand in a globalized environment of regulatory and stock-exchange competition. This paper explores the reasons for the common conservative approach, which appear to lie mostly in early 20th-century experiences of multiple voting rights in …

A Quantitative Evaluation From The Sand-Limited, Peat-Dominated Environment Of The Florida Coastal Everglades, Qiang Yao, Kam Biu Liu, Zhenqing Zhang, Erika Rodrigues, Marcelo Cohen, Kanchan Maiti, Yang Yang
Faculty Publications
Although many studies have attempted to reconstruct millennial-scale hurricane patterns using various proxy-based methods, it is still unclear what the most effective proxies are to identify storm surge deposits in different environmental settings. This study quantitatively compares the application of grain-size, loss-on-ignition, stable isotopes, X-ray fluorescence, and palynological proxies in paleotempestology from an organic-rich environment in the Florida Everglades. The nonparametric tests indicate that only 9 among the 27 parameters (mean diameter, %water, %organic, %carbonate, Ca, Sr, Ca/Ti, Cl/Br, and marine microfossils) exhibited significant differences between storm-surge and in situ deposits. The principal component analysis shows that five marine indicators …

Critical Workforce Skills For Bachelor-Level Geoscientists: An Analysis Of Geoscience Job Advertisements, Gregory W. Shafer, K. Viskupic, Anne E. Egger
Geological Sciences Faculty Scholarship
Understanding the skills bachelor-level geoscientists need to enter the workforce is critical to their success. The goal of this study was to identify the workforce skills that are most requested from a broad range of geoscience employers. We collected 3668 job advertisements for bachelor-level geoscientists and used a case-insensitive, code-matching function in Matlab to determine the skills geoscience employers seek. Written communication (67%), field skills (63%), planning (53%), and driving (51%) were most frequently requested. Field skills and data collection were frequently found together in the ads. Written communication skills were common regardless of occupation. Quantitative skills were requested less …

Spectator Awareness And Support Of Safety And Security Practices And Technologies During Covid-19, Stacey A. Hall, Joslyn Zale, Ryan Kavanaugh
Journal of Applied Sport Management
Since 2020, a global pandemic has challenged the sports industry in unprecedented ways; the industry came to a standstill at one point, eventually returning with limited capacities and public health safety and security precautions. This exploratory study examined spectators' awareness and level of support for general safety and security measures and their willingness to embrace COVID-19-specific policies as they returned to live events in the U.S. in 2021. A total of 609 participants who attended a professional or collegiate sporting event within the previous three years completed the survey. Results indicated that spectators considered security measures when deciding to attend …
Classification From The Margins : Three Alternative Classification Systems, 1930-1975, Sasha Frizzell
Classification From The Margins : Three Alternative Classification Systems, 1930-1975, Sasha Frizzell
Library Scholarship
Library classification systems frequently fail librarians and patrons because they do not provide space for the depth and breadth of topics both about and created by people within marginalized communities. This presentation explores three classification systems, created in North America between 1930-1975, that were produced by people in and for the communities that they represent. In 1930, Dorothy Burnett Porter Wesley, a librarian who helped to build the collection at Howard University, also created a classification system to better represent the works by, about, and for Black people. During the same time period, Alfred Kaiming Chiu was creating the Harvard-Yenching …
Rural Gentrification And The Spillover Effect: Integrated Transportation, Housing, And Land Use Challenges And Strategies In Gateway Communities, Danya Rumore, Philip Stoker
Rural Gentrification And The Spillover Effect: Integrated Transportation, Housing, And Land Use Challenges And Strategies In Gateway Communities, Danya Rumore, Philip Stoker
TREC Final Reports
Small towns and cities near national parks, public lands, and other natural amenities throughout the West are experiencing rapid growth and increased visitation. These “gateway communities” comprise a significant portion of the rural West, constituting about 31% of all communities and more than 60% of those under 25,000 people. Our prior NITC-funded research shows that growth and increased tourism create a range of “big city challenges” for gateway communities, particularly a significant increase in housing prices, which pushes the local workforce to outlying areas and other rural communities. As a result, despite being small towns, many developed gateway communities have …
