Climate Cap And Trade And Pollution Hot Spots: An Economics Perspective, Jeff Todd

Although cap and trade is overwhelmingly preferred by economists for reducing greenhouse gases and spurring the adoption of renewables and other zero-carbon alternatives, some scholars and advocates worry that it allows firms to concentrate operations in poor and minority neighborhoods, thus leading to hot spots of harmful co-pollutants. Commentators differ on the danger of hot spots and the necessity of adjusting cap-and-trade programs to avoid them, however. This Article therefore surveys ex post economic studies of cap-and-trade programs to show that they do not lead to hot spots but may actually cool them—perhaps even better than command-and-control regulation. Synthesizing Energy Transitions, Nadia Ahmad, Uma Outka, Danielle Stokes, Hannah Wiseman

This Article assesses the growing and cross-disciplinary literature on energy transitions to explore how it can guide law and policy reforms for the energy sector. The modern conception of energy transition centers primarily on clean energy—a shift away from fossil energy dependence. It also, however, incorporates equity as a core principle, as an increasing emphasis on energy justice and just transition seeks to create guiding norms for the energy sector’s current state of change. The concept of energy transition is critical for describing and giving meaning to a fundamental societal shift at the local, regional, national, and global scales, aligned …

The body of public health literature related to air pollution epidemiology is extensive. Similarly, the body of literature related to social epidemiology has also expanded greatly in recent years. While studies in these sub-disciplines of epidemiology sometimes seek to control for variables more commonly studied in one or the other, fewer studies report on their combined effects. Studies which do attempt to summarize how the combined air pollution burden and contextual sociodemographic burden differentially effect health outcomes beyond their individual effects could be beneficial in understanding links between the environment and certain health outcomes such as childhood asthma. “Ground Level” is a full-length poetry collection situated at the intersection of ecopoetics and psychology, where the theme of “grounding” one’s self continually emerges in the midst of personal geographical changes and experiences of collective social trauma during a period of prolonged immersion in the natural world. By exploring through an array of poetic forms, structures, and experimentations including golden shovels, contrapuntals, haikus, an abecedarian, a sestina, grounding exercises, poems featuring 20th century children’s television host Fred Rogers, and a sonnet crown which also explores queerness in the 21st century Southeast, the speaker engages with a number of different methods …

Better Policy Interventions Through Intersectionality, Elizabeth R. Cole, Lauren E. Duncan

Deployment of intersectionality frameworks in policy design and implementation is a way to ensure that the means and goals of interventions are congruent with target populations’ understanding of their circumstances, their desired outcomes, and their empowerment. In this paper, we examine the ways concepts from psychology have been used to inform interventions and policies, and we use an intersectional lens to suggest improvements to these interventions to be more inclusive in their impact. We review three social policy interventions that were developed based on social psychological research: (1) sexual assault prevention programs based on bystander interventions; (2) so-called “wise schooling” …

การเมืองของชนชั้นนำเวียดนามคือ การเมืองในพรรคคอมมิวนิสต์เวียดนามที่อาศัยความชอบธรรม 2 ชนิดที่ค้ำจุนให้อยู่ในอำนาจนับแต่ได้เอกราชในปี 1945 คือ ประการแรก ความชอบธรรมทางอุดมการณ์ที่อ้างอิงจากการต่อสู้เพื่อปลดปล่อยประเทศจากการเป็นอาณานิคมฝรั่งเศสและเปลี่ยนแบบแผนทางการเมืองให้เป็นแบบอำนาจนิยมรวมศูนย์อยู่ที่พรรคคอมมิวนิสต์เท่านั้น และมีแบบแผนทางเศรษฐกิจเป็นแบบสังคมนิยม ประการที่สอง ความชอบธรรมทางด้านผลงานจากความสำเร็จทางเศรษฐกิจหลังการปฏิรูปโด่ยเหมยในปี 1986 ซึ่งได้เปลี่ยนแปลงเศรษฐกิจจากแบบวางแผนเป็นเศรษฐกิจสังคมนิยมแบบตลาด เปิดโอกาสให้ประชาชนเวียดนามได้สะสมความมั่งคั่งขึ้นมาได้อย่างมาก บทความนี้ใช้แนวคิดของ Samuel Huntington ที่ว่าความสำเร็จในการพัฒนาเศรษฐกิจจะนำไปสู่ความเป็นประชาธิปไตยเพราะกลุ่มคนที่มั่งคั่งมักจะเป็นกลุ่มกดดันทางการเมืองเรียกร้องการเปลี่ยนแปลงเพื่อให้รัฐตอบสนองความต้องการและทำให้การสะสมความมั่งคั่งทำให้ราบรื่นมากขึ้น แต่ได้โต้แย้งว่า แม้ความสำเร็จทางเศรษฐกิจจะก่อให้เกิดชนชั้นใหม่ในเวียดนาม แต่กลุ่มพลังทางสังคมกลุ่มนี้ไม่ได้แสดงความเป็นปรปักษ์หรือท้าทายต่ออำนาจนำทางการเมืองของพรรคคอมมิวนิสต์แต่อย่างใด เพราะเหตุที่พวกเขาล้วนอาศัย โครงสร้างอำนาจ นโยบาย และเส้นสายในกลไกรัฐและพรรคคอมมิวนิสต์ในการสร้างฐานะขึ้นมา กล่าวในอีกแง่หนึ่งการรวมศูนย์อำนาจของพรรคคอมมิวนิสต์ไม่ได้เป็นอุปสรรคต่อการดำเนินธุรกิจและการสะสมความมั่งคั่งของชนชั้นใหม่นี้แต่อย่างใด ในอีกทางหนึ่งความสำเร็จทางธุรกิจของชนชั้นใหม่นี้มีส่วนอย่างมากในการเกื้อหนุนความชอบธรรมในเชิงผลงานแก่พรรคคอมมิวนิสต์ทำให้มีแรงสนับสนุนให้อยู่ในอำนาจได้ต่อไป สิ่งที่ท้าทายอำนาจของพรรคคอมมิวนิสต์เวียดนามยุคปัจจุบัน คือกลุ่มคนที่ถูกละเลยหรือพลาดโอกาสในการใช้โครงสร้างทางอำนาจของพรรคและรัฐเพื่อสนองความต้องการของตนเองหรือกล่าวอีกนัยหนึ่งคือ นอกจากจะไม่ได้รับผลประโยชน์ใด ๆ จากการพัฒนาหากแต่ยังอาจจะได้รับผลกระทบให้เกิดความเสียหายอีกด้วย กลุ่มคนเหล่านี้ได้อาศัยสื่อสังคมออนไลน์เป็นเครื่องมือในการแสดงออกและเรียกร้องสิทธิของตนเอง ซึ่งทำให้พรรคคอมมิวนิสต์ต้องหาทางตอบโต้ จำกัด และกำจัดในที่สุด บทความนี้พัฒนาจาก“โครงการชนชั้นนำและแรงงานในเอเชียตะวันออกเฉียงใต้:องค์ประกอบ โครงสร้างและพลวัตในยุคเปลี่ยนผ่าน” ซึ่งศึกษาและสำรวจการเมืองชนชั้นนำของเวียดนามจากเอกสารของภาครัฐ รายงานขององค์กรเอกชน หนังสือ วารสารและรายงานของสื่อมวลชนเป็นหลัก

The University of Michigan Law School’s Law and Mobility Program (LAMP), a resource for scholarship about the legal implications of emerging transportation technology with a particular focus on connected and automated vehicles (CAVs), hosts an annual conference. The topic of the LAMP Annual Conference 2023 considered how we might reimagine transportation technology in a way that combats the systemic vulnerabilities that leave certain populations more likely to experience forced labor. African constitutions and domestic water legislation provide for the human right to clean and safe drinking water. This right is also sourced from international human rights treaties and declarations to which African states are parties or signatories. Both municipal law and public international law impose the duties of protection and fulfilment of the right to safe drinking water on states. Domestic water laws and regulations require African states to regulate and manage the utilisation of water resources including by approving the grant of rights, concessions, or contracts in respect of the exploitation of water resources. The international market has recently faced significant disruptions owing to major geo-political events such as the Covid-19 Pandemic and the Russia-Ukraine War, resulting in unreliable and erratic global supply chains. In a bid to create and secure more sustainable supply networks, countries have adopted ‘friend-shoring’ policies, encouraging their enterprises to source supplies from friendly or allied nations. While the primary objective of these policies is to stabilize global supply chains, these initiatives also stem from a desire to reduce reliance on countries that pose a threat to the geopolitical order.

Over the 50 years since former EPA Administrator William D. Ruckelshaus wrote The Citizen and the Environmental Regulatory Process, much has changed. On the one hand, participation in environmental regulatory decisionmaking has flourished, but on the other, Ruckelshaus's prediction of growing consensus around the environmental movement has proven illusory. In this short essay reflecting on participation in environmental regulatory decisionmaking, I highlight what Ruckelshaus was right about and, just as importantly, where his vision of environmental participatory governance might need some updating. As the need to reduce carbon emissions becomes more urgent, electric vehicles are becoming an increasingly popular solution. Last year, California, a leader in climate policy, mandated that 100 percent of new vehicle sales must be zero emission vehicles (ZEVs) by 2035. ZEVs will rule the freeways of California eventually, but uncertainty remains in terms of when and how this shift will occur. The El Paso-Ciudad Juárez (EPJ) region has a history of nonattainment for ozone and particulate matter. Given transboundary air pollution in the EPJ region is not confined to the U.S.-Mexico border, it is important to implement a transnational response that accounts for the health and safety of everyone, including marginalized communities in EPJ. This thesis assesses the state of air quality and transboundary air pollution in the EPJ region through a multidisciplinary perspective that focuses on issues of data monitoring, environmental governance, and transnational environmental justice. Efforts are underway to craft responses to the climate crisis within the international investment order. This Article highlights international investment law (“IIL”) and international climate law (“ICL”) as two basic governance contexts within which investment- related responses to climate change are being designed. There is, however, a multilevel—normative and institutional—dissonance between both regimes that makes for an asymmetric integration of the regimes at best, or worse still, the escalation of the injustices which have characterized both. Sustainability and Social Justice
A key element of risk assessment is accounting for the full range of variability in response to environmental exposures. Default dose-response methods typically assume a 10-fold difference in response to chemical exposures between average (healthy) and susceptible humans, despite evidence of wider variability. Experts and authoritative bodies support using advanced techniques to better account for human variability due to factors such as in utero or early life exposure and exposure to multiple environmental, social, and economic stressors. Many chemicals and hazardous substances are kept in places that can withstand ordinary rain, but not severe storms or floods. If these events occur and the chemicals are released, people and the environment may be endangered. This Article discusses the hazards posed to chemical and waste disposal facilities by extreme weather events that would be worsened as a result of climate change, and how U.S. laws do (or do not) deal with these hazards; and considers how the law would need to change to cope with what would happen to these facilities in a potentially 4°C world.
