Nonconsensual Family Obligations, Emily Stolzenberg Jan 2023

Nonconsensual Family Obligations, Emily Stolzenberg

Faculty Publications

Even as the pandemic has both highlighted and compounded the challenges many U.S. families face in meeting their members’ basic needs, efforts to expand public subsidies for caretaking have gained little traction. Scholars have identified many historical and practical reasons for Americans’ entrenched skepticism toward the welfare state. Ideas matter, too, and this Article uncovers and critiques one that works to limit collective financial responsibility for families: the conviction that family support obligations must be legitimated through consent.

In family law, as in liberal political theory, consent works to reconcile state regulation with individual freedom. But because consent is a …

Friction-In-Design Regulation As 21st Century Time, Place, And Manner Restriction, Brett Frischmann, Susan Benesch Jan 2023

Friction-In-Design Regulation As 21st Century Time, Place, And Manner Restriction, Brett Frischmann, Susan Benesch

Faculty Publications

Digital networked society needs friction-in-design regulation that targets the digital architectures, supposedly smart (data-driven, algorithmic) systems, and interfaces that shape human interactions, behavior, and will (beliefs, preferences, values, intentions). The relentless push to eliminate friction for the sake of efficiency has hidden social costs that affect basic human capabilities and society. A general course correction is needed.

Friction in the digital networked environment can come in many forms. It can be as simple as a time delay prior to publishing a social media post, a notice that provides salient information coupled with a nudge toward actual deliberation, or a query …

Title Theft, Stewart E. Sterk Jan 2023

Title Theft, Stewart E. Sterk

Articles

Real property owners across the country have been targeted by scammers who prepare deeds purporting to convey title to property the scammers do not own. Sometimes, the true owners are entirely unaware of these bogus transfers. In other instances, the scammers use misrepresentation to induce unsophisticated owners to sign documents they do not understand. Property doctrine protects owners against forgery and fraud—the primary vehicles scammers use in their efforts to transfer title. Owners enjoy protection not only against the scammers themselves, but generally against unsuspecting purchasers to whom the scammers transfer purported title. Recovery of title, however, involves costs and …

Third-Party Releases Under The Bankruptcy Code After Purdue Pharma, Jeanne L. Schroeder, David G. Carlson Jan 2023

Third-Party Releases Under The Bankruptcy Code After Purdue Pharma, Jeanne L. Schroeder, David G. Carlson

Articles

The biggest bankruptcy case ever (as measured by unsecured claims against a debtor-in-possession) is In re Purdue Pharma, LLC. The bankruptcy court affirmed a plan discharging the Sackler family (equity owners and often officers of Purdue) of all “derivative” claims that belonged to the debtor-in-possession. The settlement was bought for a substantial sum payable over time by the Sacklers. A debtor-in-possession is the sole owner of a derivative claim and has the power to bind all the creditors to a settlement. Under the Bankruptcy Code, a plan discharging derivative claims is confirmable. In fact, as we will, show, a great …

Where The Action Is: Positioning Matters In Interaction, Danielle M. Pillet-Shore Jan 2023

Where The Action Is: Positioning Matters In Interaction, Danielle M. Pillet-Shore

Faculty Publications

Position matters. As a conversation analyst examining any form of recorded synchronous human interaction – be it casual or institutional – I constantly monitor for, and organize my collections of target phenomena around structural position: Where on a transcript and when in an unfolding real-time encounter does a participant enact some form of conduct? Because conversation analysis (CA) is primarily focused upon action sequences, I use CA methods to examine the ways in which participants’ audible utterances and visible body-behaviors accomplish particular social actions due at least in part to their positioning within a sequence of interaction – …

Status And Challenges Of Tribal Education In Jungle Mahal: A Statistical Analysis, Rajib Kumar Guin Jan 2023

Status And Challenges Of Tribal Education In Jungle Mahal: A Statistical Analysis, Rajib Kumar Guin

Library Philosophy and Practice (e-journal)

In this paper, a picture of tribal enrolment in schools and higher education in four tribal-dominated districts of West Bengal, namely Paschim Medinipur, Jhargram, Purulia, and Bankura, collectively known as "Jungle Mahal" is analysed through various statistical data. It is examined by the statistical data that the tribals here, especially the female tribals, are still lagging in literacy rate and average enrollment in every level of education in comparison to India and West Bengal. The dropout rate of tribal students in that region at every level of schooling is much higher than the national and state rates. Apart from this, …

Healing A Broken Spirit, David Sedlacek, Beverly Sedlacek Jan 2023

Healing A Broken Spirit, David Sedlacek, Beverly Sedlacek

Faculty Publications

Abuse of any kind as well as significant losses such as death of a loved one can result in a broken spirit (Proverbs 15:13, 17:22). However, we have a wonderful God who heals the brokenhearted and binds up their wounds (Isaiah 51:3). He often leads us into communities where we can experience being seen, soothed, safe, and secure. This chapter describes the experience of brokenness and the process of healing integrating both biblical and interpersonal neurobiological perspectives.

Analysis Of Methods For Assimilating Fire Perimeters Into A Coupled Fire-Atmosphere Model, Adam K. Kochanski, Kathleen Clough, Angel Farguell, Derek V. Mallia, Jan Mandel, Kyle Hilburn Jan 2023

Analysis Of Methods For Assimilating Fire Perimeters Into A Coupled Fire-Atmosphere Model, Adam K. Kochanski, Kathleen Clough, Angel Farguell, Derek V. Mallia, Jan Mandel, Kyle Hilburn

Faculty Research, Scholarly, and Creative Activity

Correctly initializing the fire within coupled fire-atmosphere models is critical for producing accurate forecasts of meteorology near the fire, as well as the fire growth, and plume evolution. Improperly initializing the fire in a coupled fire-atmosphere model can introduce forecast errors that can impact wind circulations surrounding the fire and updrafts along the fire front. A well-constructed fire initialization process must be integrated within coupled fire-atmosphere models to ensure that the atmospheric component of the model does not become numerically unstable due to excessive heat fluxes released during the ignition, and that realistic fire-induced atmospheric circulations are established at the …

Chastity And Celibacy: A Rhetorical History Of A Rhetoric Of Sex And The Priest In The Catholic Church, Teresa Morales Jan 2023

Chastity And Celibacy: A Rhetorical History Of A Rhetoric Of Sex And The Priest In The Catholic Church, Teresa Morales

Iowa Journal of Communication

The seemingly never-ending instances of reported sex abuse by Roman Catholic priests is commonly thought to be a matter of deviancy and crime. This is true; but there is more to the story. The RC Church has, for two thousand years, known of the sexual behaviors and deviancies of its priests, yet has accomplished little in controlling the situation. The rise of the lawsuit against the Church has led, finally, to the need to examine more deeply the reasons for this ongoing criminal behavior. This paper uses a method of rhetorical history to uncover and understand how and why this …

The Use Of Artificial Intelligence In Crisis Communication: A Study Of Public Perceptions And Trust Of Ai, Travis Loof, Rachel Ehlers, Julia Lobo Paes, Prah Haider, Rachel Spinks

Iowa Journal of Communication

Organizational crises can be detrimental if not offset with an appropriate communication strategy. The Situational Crisis Communication Theory (Coombs, 2007) has been studied as a framework for understanding how organizations can respond to crises. The current study explores the effectiveness of a nontraditional message source, artificial intelligence (AI), when delivering a rebuilding crisis response strategy. The current study empirically tests and discusses future research in AI trust building and crisis communication response strategies.

Computer Science Faculty Publications

This paper compares three finite element-based methods used in a physics-based non-rigid registration approach and reports on the progress made over the last 15 years. Large brain shifts caused by brain tumor removal affect registration accuracy by creating point and element outliers. A combination of approximation- and geometry-based point and element outlier rejection improves the rigid registration error by 2.5 mm and meets the real-time constraints (4 min). In addition, the paper raises several questions and presents two open problems for the robust estimation and improvement of registration error in the presence of outliers due to sparse, noisy, and incomplete …

Recent advances in computer vision (CV) and natural language processing have been driven by exploiting big data on practical applications. However, these research fields are still limited by the sheer volume, versatility, and diversity of the available datasets. CV tasks, such as image captioning, which has primarily been carried out on natural images, still struggle to produce accurate and meaningful captions on sketched images often included in scientific and technical documents. The advancement of other tasks such as 3D reconstruction from 2D images requires larger datasets with multiple viewpoints. We introduce DeepPatent2, a large-scale dataset, providing more than 2.7 million …

Charged Track Reconstruction With Artificial Intelligence For Clas12, Gagik Gavalian, Polykarpos Thomadakis, Angelos Angelopoulos, Nikos Chrisochoides

Computer Science Faculty Publications

In this paper, we present the results of charged particle track reconstruction in CLAS12 using artificial intelligence. In our approach, we use neural networks working together to identify tracks based on the raw signals in the Drift Chambers. A Convolutional Auto-Encoder is used to de-noise raw data by removing the hits that do not satisfy the patterns for tracks, and second Multi-Layer Perceptron is used to identify tracks from combinations of clusters in the drift chambers. Our method increases the tracking efficiency by 50% for multi-particle final states already conducted experiments. The de-noising results indicate that future experiments can run …

Unttangling Irregular Actin Cytoskeleton Architectures In Tomograms Of The Cell With Struwwel Tracer, Salim Sazzed, Peter Scheible, Jing He, Willy Wriggers Jan 2023

Unttangling Irregular Actin Cytoskeleton Architectures In Tomograms Of The Cell With Struwwel Tracer, Salim Sazzed, Peter Scheible, Jing He, Willy Wriggers

Computer Science Faculty Publications

In this work, we established, validated, and optimized a novel computational framework for tracing arbitrarily oriented actin filaments in cryo-electron tomography maps. Our approach was designed for highly complex intracellular architectures in which a long-range cytoskeleton network extends throughout the cell bodies and protrusions. The irregular organization of the actin network, as well as cryo-electron-tomography-specific noise, missing wedge artifacts, and map dimensions call for a specialized implementation that is both robust and efficient. Our proposed solution, Struwwel Tracer, accumulates densities along paths of a specific length in various directions, starting from locally determined seed points. The highest-density paths originating …

A Structure-Aware Generative Adversarial Network For Bilingual Lexicon Induction, Bocheng Han, Qian Tao, Lusi Li, Zhihao Xiong Jan 2023

A Structure-Aware Generative Adversarial Network For Bilingual Lexicon Induction, Bocheng Han, Qian Tao, Lusi Li, Zhihao Xiong

Computer Science Faculty Publications

Bilingual lexicon induction (BLI) is the task of inducing word translations with a learned mapping function that aligns monolingual word embedding spaces in two different languages. However, most previous methods treat word embeddings as isolated entities and fail to jointly consider both the intra-space and inter-space topological relations between words. This limitation makes it challenging to align words from embedding spaces with distinct topological structures, especially when the assumption of isomorphism may not hold. To this end, we propose a novel approach called the Structure-Aware Generative Adversarial Network (SA-GAN) model to explicitly capture multiple topological structure information to achieve accurate …

Ecolabeling In The Multinational Mining Industry: A Method Toward Environmental Sustainability, Regina Raze Jan 2023

Ecolabeling In The Multinational Mining Industry: A Method Toward Environmental Sustainability, Regina Raze

Vanderbilt Journal of Transnational Law

The international mining industry's environmental impact is not new. However, with the rise of international scrutiny on climate change and global warming, what the industry can do to lessen its impact is changing. Consumers are demanding stronger commitments to the environment from producers, and producers are therefore requiring stronger commitments from their suppliers. One such commitment the extractive industry can adhere to is implementing an ecolabeling regime for open pit mines mining critical minerals for consumer products. Ecolabels signal to customers that the environment is a priority for companies. However, with an ecolabel comes trade implications and concerns about accuracy. …

Notes On Continental Constitutional Identities, Benjamen F. Gussen Jan 2023

Notes On Continental Constitutional Identities, Benjamen F. Gussen

Vanderbilt Journal of Transnational Law

Geo-constitutional analysis examines the reciprocal effect of geography on constitutions. Within this analysis, a continental constitutional identity focuses on the intersection between institutional geographies and institutional identities, where constitutions are understood as meta-institutions. In some constitutions, belonging to a continent is part of the national identity, while other constitutions only signal a non-geographic, usually an ethnic, identity. The US Constitution is an example of the former. The quintessential example of a non-geographic constitution is the Constitution of the Russian Federation. A similar disregard of continental identities can be found in Israel and the Arab League countries east of the Sinai …

Promoting Female Sporting Opportunities Without Title Ix: The Spanish Experience, Stephen Ross, Maria Josefa Garcia Cirac Jan 2023

Promoting Female Sporting Opportunities Without Title Ix: The Spanish Experience, Stephen Ross, Maria Josefa Garcia Cirac

Faculty Scholarship

This article compares the American approach to improving sporting opportunities for females – Title IX – with approaches taken by Spain. Because of the singular American dedication to elite interscholastic and intercollegiate sports, Title IX’s requirement of equal treatment requires that elite female athletes have equivalent opportunities to elite male athletes. The Spanish approach looks instead on the social benefits of athletics participation for boys, men, girls, and women.

From Art To Propaganda: The Shift In The Concept Of The “Most Dead” In True Crime Literature, Hannah Mcconkey Jan 2023

From Art To Propaganda: The Shift In The Concept Of The “Most Dead” In True Crime Literature, Hannah Mcconkey

Dissertations and Theses @ UNI

This thesis studies the shift of the true crime genre from art to inescapable propaganda. This change is due, in part, to the politization of the genre by modern society. This includes the concept of the “most dead” seen within the true crime genre over the past several decades. The idea of the most dead is the belief that some victims of crimes are more or less dead depending on how marketable their demographic is. For instance, a blonde, Caucasian child would be considered the most dead while a woman of color in the sex work industry would be the …

Preparing Students For Life After College: A Mixed-Methods Analysis, Nichole Zumbach Harken Jan 2023

Preparing Students For Life After College: A Mixed-Methods Analysis, Nichole Zumbach Harken

Dissertations and Theses @ UNI

Institutions of higher education work to engage students in high-impact practices throughout their educational journey. Although prior research highlights the increase of stress as students near graduation, little research has explored how students manage the transition out of higher education. The purpose of this study was to investigate graduating students’ concerns, the emotional impact of those concerns, the discovery of information related to adulting practices, and the potential impact of a curriculum-infused exit program. The data were collected at a Midwest, comprehensive, liberal arts institution that confers bachelor, master’s, and doctoral degrees. To develop better praxis, the authentic union of …

Anchored To A Community: Middle School Students’ Experience Of Belonging In The Classroom: A Qualitative Phenomenological Study, Angela Thera Butler Jan 2023

Anchored To A Community: Middle School Students’ Experience Of Belonging In The Classroom: A Qualitative Phenomenological Study, Angela Thera Butler

Dissertations and Theses @ UNI

A student’s sense of belonging in the classroom makes a difference. Students who experience a feeling of belonging within the learning environment are more engaged and prepared to learn and contribute. Students who do not feel this sense of belonging in the classroom often pull away from school norms, and may separate themselves from formal education entirely. This qualitative phenomenological study explored the lived experiences of belonging for a small group of 6th grade students from a suburban, midwestern school. Experiences and intentions of three educators who shared these students were also collected and compared to the experiences and perceptions …

Assessment Of Conservation Reserve Program Enhancements At Contract Renewal: Impact On Monarch Butterfly (Danaus Plexippus) Habitat, Tristan L. Murphy

Dissertations and Theses @ UNI

The monarch butterfly (Danaus plexippus) is a migratory species whose primary breeding range is the upper Midwestern United States. In 2022, the International Union for the Conservation of Nature listed the monarch as endangered due to milkweed and migratory habitat loss. One of the most promising opportunities for monarch recovery is to enhance habitat quality on private land currently enrolled in the USDA Conservation Reserve Program (CRP). In order to qualify for re-enrollment in the program and continuation of annual government payments, farmers must show adequate habitat quality or enhance their site by overseeding after burning, herbicide application, …

Intimate Partner Violence Stigma: The Intersection Of Race And Socioeconomic Status, Antoinette Fleming Jan 2023

Intimate Partner Violence Stigma: The Intersection Of Race And Socioeconomic Status, Antoinette Fleming

Dissertations and Theses @ UNI

Approximately 36% of all women in the United States will experience intimate partner violence (IPV) at some point in their lifetime (Smith et al., 2018). Intimate partner violence can cause physical injury, poor mental health, chronic health problems, hospitalization, disability, or death (Breiding et al., 2015). Stigma is another consequence associated with IPV. Many victims of IPV report feeling guilt, denial, shame, and embarrassment as a result of the intimate partner violence victimization (Lichtenstein, 2006). Additionally, African American (Black) victims may be more heavily stigmatized than European American (White) victims. Socioeconomic status (SES) may also affect a person’s perception of …
